DS-15-188 Development Services Committee Meeting – October 5, 2015 Application for Removal of “h-14” Holding Symbol – Phase 4B of Draft Plan of Subdivision S-O-2006-02, East of Simcoe Street North and north of Britannia Avenue East – Minto Metropia (Windfields) GP Inc. (File: Z-2006-04-H4B) Whereas on April 27, 2009 Council passed By-law 29-2009 which delegated the approval of applications to remove “h’ holding symbols to the Development Services Committee subject to the conditions for lifting the holding symbol being fulfilled to the satisfaction of the Commissioner of Development Services and the necessary by-law being presented to Council for approval; and, Whereas Minto Metropia (Windfields) GP Inc., the owner of the lands located east of Simcoe Street North and north of Britannia Avenue East, intends to develop 54 street townhouse units and provide for a public elementary school site in approved plan of subdivision (S-O-2006-02) on the site (see Attachment 1); and, Whereas the site is zoned R1-E(21)/R3-A(8) “h-14” (Residential), R3-A(8) “h-14” (Residential) and CIN/R1-E(21) “h-14” (Community Institutional/Residential) which permits single detached dwellings, street townhouses and an elementary school; and Whereas the “h-14” holding symbol is in place to ensure appropriate arrangements are made for the provision of adequate sanitary, water, storm, and transportation services and facilities to serve this development and a subdivision agreement is executed; and, Whereas Minto Metropia (Windfields) GP Inc. has submitted an application to remove the “h-14” holding symbol to advance the issuance of building permits immediately after the subdivision is registered; and, Whereas the subdivision agreement for Phase 4B of draft plan of subdivision S-O-2006-02 will be executed; and Whereas the Commissioner of Development Services is satisfied that the conditions for lifting the holding symbol will be satisfied; Therefore, the application submitted by Minto Metropia (Windfields) GP Inc. to remove the “h-14” holding symbol from certain lands located east of Simcoe Street North and north of Britannia Avenue East for Phase 4B of Draft Plan of Subdivision S-O-2006-02 to facilitate the development of street townhouses and community institutional uses be approved and the necessary by-law be passed. 100
