2.GeneralInstructionsfor Bidders

2.1. Parties:-ThepartiestotheContractarethecontractor(thebiddertowhomtheworkhas been awarded) and theDeputy Chief Electrical Inspector/Electrical Inspector,…Alappuzha………………… 2.2. Duration: -Thedurationofthecontractshallbeforaperiodofoneyearfromthedateof award of work order.

2.3.Earnest Money:

i)EarnestMoney ofRs4500…………/-(RupeesFour Thousand Five hundred ……………….Only)intheformofDemanddraft ofanynationalizedbankmustbedepositedbybiddersalongwiththeirdulyfilleduptenders documents.Thevalidity oftheDemanddraftmustbeupto3(Three)months.TheDemanddraft shall bein favourof―Deputy Chief Electrical Inspector/Electrical InspectorPayable at …Alappuzha………………….TheEMDinrespectoftheagencieswhichdonotqualify thequalifying Bid/FinancialBidshallbereturnedtothemwithoutanyinterest.HowevertheEMDinrespectof the successful tenderer shallnot be adjusted towardsthe performancesecuritydeposit.

a). Ifthebidderwithdrawsoramendsitstenderorincreaseinratesafteropening ofthetenderbut beforethevalidityof thequotation expires.

b). Onrefusal to enterintocontract afteraward ofcontract.

c). Iftheworkisnotcommencedonthedateof starting theworkafter workisawardedtothe contractor.

d). Unsatisfactoryperformanceand/or Non-performanceof the contract.

2.4. Preparationand SubmissionofTender: Thetenders havebeen invited under singlebid system i.e. Qualifying Bid andCommercial Bid. 2.4.1Theagencies are advised to submitthe bids as given below,

(i)Envelope 1superscribing―Qualifying BidforProvidinghiredVehicleforthe O/o The Deputy Chief Electrical Inspector/Electrical Inspector-2019-2020, should contain the followingdocuments. (a)Qualifying Bid form (As in AnnexureI);

(b)Copyof leased agreement (if thevehiclequoted is leased from athirdparty)

(c)Work experienceof similarwork forthe past oneyear

(d)Copyof PAN/ GIR Card; (e)Copyof theIT returnfiledforthe last (or recent) financialyear;

(f)Copyof ServiceTaxregistration certificate, ifapplicable;

(g)Copyof registration book ofthe vehicle;

(h)Certifieddocumentsinsupportofentriesincolumn8ofQualifyingBidform (Annexure–I) forworkexperience;

(i)CopyofthisTenderDocumentwitheachpagedulysignedandstampedbytheauthorized signatoryof theagencyin token oftheiracceptance.

(j)EMD as stipulated videitem 1.5 of Tender Notice.

(ii)Envelope2superscribing―Commercial BidforprovidinghiredVehicleforthe O/o The Deputy Chief Electrical Inspector/Electrical Inspectorfor2019-2020,should contain the CommercialBid (As in AnnexureII).

(iii)Envelope3superscribing―Tender forProvidinghiredVehicleforthe O/oThe Deputy Chief Electrical Inspector/Electrical Inspectorfor2019-2020should containthe above2 envelopes.

2.5. Qualifying Bid:

2.5.1 Thequalifyingbidshould besubmittedin form given in Annexure-Ialongwith the documents specifiedabove.

2.6. CommercialBid:

2.6.1TheCommercialBidshouldbesubmittedintheformgiveninAnnexureII inaseparate sealed cover keptinsidethe maincover. TheCommercialBidsof thosebidders. A dulyconstituted TenderEvaluation Committee (TEC) will evaluatethe Commercial Bids.

2.6.2Theratetobequotedforvehicleonmonthly basisminimum 1250Kmuseinamonth.Theprice quoted shallbe firm andfinal forthe entireperiodof contract.

2.6.3Taxes willbepaid as per the annexure –II

2.6.4Terms ofpaymentas stated in the TenderDocuments shall be final.

2.6.5Atthe time of paymentof bills,the taxesliable tobe deducted, if any,shallbe deducted at source as per Government rules andguidelines asmaybeprevailingat thetimeof payment.

2.6.6Allratesshallbewrittenbothinfiguresand inwords.Corrections,ifany aretobemadeby crossingout,initialingandrewriting.Incaseofdiscrepancybetweenthewordsandthefigures the rates indicatedinthe wordsshallprevail.Alloverwriting/cutting,insertionneedstobe authenticated.

2.7. Validity oftheBids:

Thebids shall be valid for aperiod of90 days from thedate ofopeningofthe tenders.

2.8. Opening ofTender:

Thebidderisatlibertyeitherhimselforauthorizes,notmorethanonerepresentativetobe presentattheopening ofthetender.Therepresentativeattendingtheopeningofthetenderon behalfofthebiddershouldbringwithhimaletterofauthority fromthebidder(Annexure–III) and proof of identification.

2.9. Criterion forEvaluationofTender:

The evaluation ofthetenderswillbe made first on the basis of qualification information furnished in form given in Annexure-I and then on the basis of commercial information furnished informgiven inAnnexure-II.The Commercialbid(Annexure-II)ofsuchfirmsfound validwillbeevaluated.Theawardofworkwillbefurther subjecttoanyspecifictermsandconditionsofthecontract.L1isbasedonthevaluequotedin the total value in the Sl.No. 1in theAnnexure-II.On awardingthe contractthe Registeredownerhaveto executean agreement in the prescribed form on KeralaStamp Paper worth Rs.200/-

2.10. Right ofAcceptance: 2.10.1TheCompetentauthority reservesallrightstorejectany tenderincludingofthosebidders whofailtocomply withtheinstructionswithoutassigning any reasonwhatsoeveranddoesnot binditselftoacceptthelowestoranyspecifictender.Thedecisionofcompetentauthorityinthis regard shallbe final andbinding.

2.10.2Any failureonthepartofthecontractortoobservetheprescribedprocedureandany attempttocanvass forthework willprejudicethecontractor ‘s quotation.

2.11. Communicationof Acceptance:

Successful Bidder will be informed oftheacceptanceof his tender.

2.12. Security Deposit:

2.12.1The estimated value of the Tender isRs.…….Lakhs.The successfulbidder willhave to depositaperformancesecurity(SecurityDeposit)within7daysfromthedateofacceptanceof thetenderof2 . 5%ofthevalueofthecontractinformofagainst100% Treasury FixeddepositReceipt or 50% from PerformanceBankGuarantee fromaCommercialbankfor theamountvalidfor theperiod extending atleastthreemonthsbeyondthedateofcompletionofthecontract and 50%Treasury FixeddepositReceipt .The Security Deposit will not be adjusted againstanypaymentdueto the firm from this office.

2.12.2TheFixedDepositReceipt/BankGuarantee/canbeforfeitedby orderofthe competentauthorityintheeventofany breachornegligenceornon-observanceofany terms/conditionofcontractorforunsatisfactory performanceorfornon-acceptanceofthework order.Onexpiry ofthecontract,suchportionofthesaidFixedDepositReceipt/Bank Guarantee/demanddraftasmay beconsideredbythisoffice,sufficienttocoverany incorrector excesspaymentsmade onthe billstothefirm,shallbe retaineduntilthe finalaudit report onthe account offirm ‘s bill has been receivedand examined.

2.12.3ThesecurityDepositwillberefundedonsuccessfulcompletionofthecontract.Nointerest is payableon the SecurityDeposit.

2.13. Penalty: 2.13.1Incaseofbreachofanyconditionsofthecontractandforalltypeoflossescaused including excesscostduetohiring of VehiclefromthemarketintheeventofContractorfailing toproviderequisitionedvehicleornotprovidingVehicle,competentauthority shallmake deductionsattherateof50%morethanHiring rateonpro-rata basisfromthebillspreferredby theContractor orthatmay becomeduetothecontractorunderthisorany othercontractorfrom thesecurity depositormay bedemandedfromhimtobepaidwithinsevendaystothecreditof the Department of Electrical Inspectorate. . 2.13.2In addition, penaltiesmentionedinthespecificconditionsofthecontractare alsoapplicable on caseto casebasis.

2.13.3Thepowersofthecompetentauthorityundertheseconditionsshallinnowayaffector prejudice thepowersincertaineventstoterminate thecontractvestedin himashereinprovided nor forfeitureof deposit.

2.14. Disclaimer:

Thenear relatives of employees of this officeareprohibited from participation in this tender. The near relatives forthis purpose aredefinedas:- a)Members of aHindu Undivided Family (b)Their husband and wife. (c)Theoneisrelatedtotheotherinthemannerasfather,mother,son(s),son‘swife (daughter-in- law),Daughter(s)&daughter‘shusband(son-in-law),brother(s)& brother‘swife,sister(s)and sister‘s husband (brother-in-law).

2.15. BreachofTerms andConditions:

Incaseofbreachofanyoftermsandconditionsmentionedinthis NIT,theCompetentAuthority willhavetherighttocancelthecontractwithoutassigninganyreasonthereof,andnothingwill bepayableby thisofficeinthateventandthesecurity depositintheformofBank Guarantee/DemandDraft shallbe encashed.

2.16. Subletting ofWork: Thefirm/partyshallnotassignorsublettheworkorany partofittoanyotherpersonorparty withouthavingfirstobtainedpermissioninwritingofthecompetentauthority whichhe/shewill be at libertyto refuseif she/he thinksfit.

2.17.Thetender is not transferable.Onlyonetender shallbesubmitted byonebidder.

2.18.Terms ofpayment:

2.18.1Nopaymentshallbemadeinadvancenorshallanyloanfromanybankorfinancial institution be recommended on the basisof theorder ofaward of work.

2.18.2Thecontractorshallsubmitthebillsateachstage/inthefirstweekoffollowingmonthin respect of previous month forsanction oftheamount of bill and passingthebill forpayment.

2.18.3 All payments shall be made byonline transfer only,in thenameof the contractor.

2.18.4Thecompetentauthorityshallbeatlibertytowithholdanyofthepaymentsinfullorin part subject to recoveryof penalties mentioned inprecedingPara.

2.18.5Theterm―payment‖mentionedinthis Para includesall typesofpaymentduetothe contractorarising onaccountofthiscontractexcluding EarnestMoney andSecurity Deposit governed bythe separateclauses of thecontract.

2.19. Arbitration:

Ifanydifferencearises concerningthis Agreement, its interpretation on thepayment to bemade thereunder, thesameshallbesettled bymutual consultations and negotiations.If attempts for conciliation do notyieldanyresults within a period of 30 days, theprovisions of Arbitration and Conciliation Act, 1996 and theRules framed thereunder and inforceshallbe applicable to settle the issues.

3. SPECIFIC TERMSAND CONDITIONS 3.1. Vehicle

3.1.1.Reporting placeforthevehicleshallbe……………………….or any placewithinthearea ofjurisdictionofElectrical Inspectorate.Theuserofvehicleshallspecifytheactualplaceofreporting.The dutytimingsshallbe12hoursbetween08.00Hrsto20.00Hrsinadaythroughout week,except Sundayandotherlocalholidays n o r m a l l y ,howeverthetimingsanddaysmayvarydepending ontheactualrequirements.Ifthevehicleisrequiredessentially onany Sundayandotherlocal holidaysthe contractor should providethe vehicleat thesamerates.

3.1.2.Totheextentpossible,thecontractorwillhavetomakeeffortstoprovidethevehicle whoseRegistrationno.isindicatedinthebid.However,incaseofnon-availability ofthe specified vehicle,thecontractor canprovideanalternative vehicleof equivalentvariantmodelor aboveversion/make/model, in lieu of theassignedvehiclewithin 1 hour.But thepayment willbe released accordingto theapproved rates to the contractor

3.1.3.Thevehicleprovidedby thecontractormustbeinexcellentcondition,notolderthan2014 modelandmusthaveproperandcompletedocuments,whichshouldbeshowntotheuserif askedfor.No payment shallbemadeon accountof cars sorejected.

3.1.4.Thevehiclebeingsent by thetendererwillberegularly inspectedbytheofficernominated forthepurposeandincaseofnon-complianceofany oftheconditions,apenalty uptoRs.500/- per caseshall be imposedon the contractor . 3.1.5.ThevehicleregisteredunderTaxiQuotaonly shouldbeprovided.Privatevehicleshallnot be acceptedand paymentforsuchvehicle will notbemade.

3.1.6.The vehicle will meet all the necessary compliance of requirements like pollution, emission, noise and otherstatutoryprovisions etc.

3.1.7.Theprovidedvehiclemustbefully andcomprehensively insuredcoveringtherisktothe driver.

3.1.8.The vehicleshould be in avery good runningcondition,new

seatcovers/towelsand appropriate"ON DUTY Department of Electrical

Inspectorate ,Govt. of Kerala" willhavetobeprovidedbythe vendor.

3.1.9.The vehiclesenttoour office onourrequisitionmusthave allrelevantdocumentslike registration book/driving license/insurance road tax/receipt permit fee/ passenger tax/border

tax/tolltax/etc.ThevehicleshouldbelicensedandshallconformtoallGovernmentRulesand Regulations beingin force from time to time.

3.1.10.The details of vehicle along with photocopies of lease agreement and registration book/RC should be attached with of thetender (Qualification Bid).

3.1.11.Vehicletobeprovidedby theContractorshouldbeinperfectly soundworkingcondition andsuitableforuseby SeniorOfficers.Dirty, noisy,andnotwellmaintainedvehicleshallbe rejectedand no paymentsshall be made forthesame.

3.1.12.Vehicleshouldbeprovidedwithtwosetsofstainfreewhiteseatcoverandreplaced every weekand/orfounddirty.Incaseofnon-complianceofthecondition,apenalty upto Rs.100/-per caseshall be imposed on the contractor

3.2. Contractors:

3.2.1.Contractor shallin nocaselease/transfer/sublet/appoint caretaker forservices.

3.2.2.The contractorshouldhaveatleastexperiencecertificateofoneyearofsatisfactory performanceinsimilarserviceswithGovernment/Public SectorCompanies/having atleastone year experiencewith acontractor havesimilar experience.

3.2.3.The contractor shall be responsible for all communication with the officers. For this purposeheshould haveaproper officewith telephones andpersonnel to takethe calls.

3.2.4.Unsatisfactory orunprofessionalbehaviorshallresultinterminationofthecontract.Non- adherencetothequality ofserviceandtermsandconditionsmentionedhereinshallresultin termination ofthe contract immediately, with encashment of thesecuritydeposit.

3.2.5.Contractorshallbedirectlyresponsibleforany/alldisputesarisingbetweenhimandhis personnelandkeepthisoffice indemnified againstallactions,losses,damages,expensesand claims whatsoeverarisingthereof.

3.2.6.Contractorshallbesolely responsibleforpaymentofwages/salariesotherbenefitsand allowancestohispersonnelthatmightbecomeapplicableunderany ActorOrderoftheGovt. Thisofficeshallhavenoliability whatsoeverinthisregardandtheContractorshallindemnify thisofficeagainstany/allclaims,whichmay ariseundertheprovisionsofvariousActs, Governments Orders etc.

3.2.7.Contractor shall be fully responsible for theft, burglary, fire, accidents, traffic rule violations or anyother harmful deeds byhis staff.

3.2.8.Thecontractorshallbefullyresponsibleforanylossordamagetothevehicleandalso liable to payfull compensation for anyinjuryor anyotherlossto passengers.

3.2.9.Only such contractors may apply whose vehicle have been duly authorized by the concerned RTO for useas public transport.

3.2.10.The contractor must havetrained drivers ontheir employee roll.

3.2.11.Thecontractormustreimbursealltheexpenditureincurredontravelling bytheofficer,in caseoffailuretoprovidethevehicleonany day,forany reasonwhatsoever.Thereimbursement shallbemadedirectlytotheofficerinquestionandincash.Thecontractorshallalsogivein writingthereasonsformaking thereimbursementspecifying thedateandtimeandnameofthe officer. Failingto do sowillresultin termination ofthe contract, forfeiting of thesecuritydeposit and/or deduction ofthe Payment forthe wholemonth.

3.2.12.Incaseof violation of anyof theterms andconditions mentioned in this tender document, competentauthority reservestherighttoterminatethecontractimmediately andawardthesame tothenextlowestbidderorthirdlowestbidderdependingonthesituation.Insuchcases,no payments (pendingor future) shallbereleased againstthe original contract.

3.3. Drivers

3.3.1.Thecontractorwillprovidewell-behaved drivershaving knowledgeofdifferentroutes,as wellas repair ofcars andvalid drivinglicense andalso havingproper uniforms and name badge.

3.3.2.Thedriverwould also be equipped with Mobilephone.

3.3.3.Thedrivers shouldbe residents of Kerala.

3.3.4.No charges willbegiven for lunch/teaof thedriver.

3.3.5.Driverofthevehiclerequisitioned by thisofficewillreporttotheofficertowhichthe vehicleis allotted.

3.3.6.Withinofficepremises,thedrivershallnotleavetheofficewithoutpermissionandshall notdoany privateworkotherthanthenormalduties.Ifthedriverisfoundtobeabsentfromthe office, itwillbetakenasnon-availabilityof thevehicle and suitablepenalties shallbeimposed.

3.3.7.The driver willdothe maintenance work,re-fuelingetc., onweekendsinadvance.Doing suchjobsduringduty shallattractapenalty amountingtothedeductionofthewholeday‘s payment on casebycasebasis.

3.3.8.Thedrivermustbepunctualandarriveonspecifiedtimeonspecifiedlocation.Delayin reportingfordutyshall attract a penaltyoncasebycasebasisas perclause2.13.1.

3.3.9.Drivers must notuse their mobile phones orstop forpersonal workswhile driving.

3.3.10. Drivers must notgo on leavewithout informingtheofficerand contractor well in advanceanditwillbetheresponsibilityofthecontractortoprovideasubstituteimmediately.

Violationsshallattractapenalty amountingtothedeductionofthewholeday‘spaymentoncase bycasebasis. (In addition to the penalties mentioned in clause 2.13 above).

3.3.11.ThepersonnelengagedbytheContractoraresubjecttosecuritycheckbytheSecurity Staff at anytime.

3.3.12.Thedriversmay beaskedtodoovertimeandmaybecalledonholidays/weekendsandon odd times dependingon thenecessityand heshould beprepared for suchevents.

3.4. MeterReading

3.4.1.Meterreading willstart/terminatefrom pointofpickup/drop respectively.Noextra kilometersshallbeaddedasdistancefromthegaragetopointofpickup/drop.Monthly contract shallbe1250Kmpermonth.Ifthevehicleisnotcalledonanyday duetoany reasons,thetotal kms forthat daywillbetreatedas 0 (Zero).

3.4.2.ThedriversofthevehiclewillmaintainLogbook/Sheets,whichwillbesuppliedby this office.

3.4.3.Competentauthorityreservestherighttogetthemetercalibratedorcheckedatany timeat itssolediscretionandintheeventofanyerror/faultinthemeterbeing noticed,thebillforthe journey undertaken(includingthoseundertakenearlier)wouldbeadjusted,besidesany other penalactionasdecidedby thecompetentauthority,whichmay evenleadtoterminationofthe contract.

3.4.4.Thetempering ofmeter reading, vehicleusagetimings,overwriting oflogsheet, misconductsandothersuchactsshallbepenalizedheavily,including terminationofthecontract and forfeitingof thesecuritydeposit.

3.4.5.Thebillsshallbecheckedwiththelogbookandifanydiscrepanciesarefound,the payment ofthe billshallbecancelledandthecontract shallbeterminatedwith encasement ofthe securitydeposit.

3.5. Prices andPayments

3.5.1.Paymentofbillswouldtakeaboutthreetofourweeks‘timeonanaveragefromthe submission of thebill. No advancepayment shallbemadeunder anycircumstances.

2. PAYMENT TERMS :- 2.1 Payment of bills would take about three to four weeks‟t ime on an average from the submission ofthe bill. No advancepayment shallbemadeunder anycircumstances.

3 Security:-

TheContractorshallfurnisha security depositequivalentto2 . 5%ofthevalueofthecontractinformofagainst 100% Treasury FixeddepositReceipt or 50% from PerformanceBankGuarantee fromaCommercialbankfor theamountvalidfor theperiod extending atleastthreemonthsbeyondthedateofcompletionofthecontract and 50%Treasury FixeddepositReceipt .The Security Deposit will not be adjusted againstanypaymentdueto the firm from this office.Thesecuritydeposit will notcarryanyinterest

5 Penalty:

5.1 Incaseofbreachofanyconditionsofthecontractandforalltypeoflossescaused including excesscostduetohiring ofVehicle fromthemarketintheeventofContractor failing to providerequisitioned vehicleornot providingVehicle,competentauthorityshall make deductionsatthe rateof50%morethanHiringrateonpro-ratabasisfromthebills preferredbytheContractororthatmaybecomeduetothecontractorunderthisorany othercontractorfromthesecuritydepositormaybedemandedfromhimtobepaid within seven days to thecreditof the Department of Electrical Inspectorate.
