Foreword

UNHCR is pleased to publish a collection of citizenship laws of twelve States from Eastern Europe and Central Asia. This collection of instruments in Russian should enable States, relevant organisations and lawyers to clarify the application of citizenship laws, including in cases where laws conflict, as well as to determine the citizenship of individuals or the lack of it in cases of statelessness. The collection also includes various bilateral treaties that should help individuals wishing to acquire citizenship of another country do so without facing the risk of becoming stateless. Finally, the publication contains the main international instruments applicable to nationality issues and prevention of statelessness.

UNHCR has been designated by the United Nations General Assembly a mediating agency under Article 11 of the 1961 Convention on the Reduction of Statelessness, a role entailing the provision of assistance to individuals and States in resolving existing and potential cases of statelessness. The task entrusted to UNHCR was widened by the United Nations General Assembly in 1976 and various Conclusions of the Executive Committee of UNHCR to actively promote accessions to the 1954 Convention relating to the Status of Stateless Persons and 1961 Convention on the Reduction of Statelessness, as well as to provide relevant technical and advisory services pertaining to the preparation and implementation of nationality legislation to interested States.2

A recent survey on statelessness conducted by UNHCR pursuant to the Agenda for Protection has confirmed that no part of the world is free of the problems which lead to statelessness. Root causes of statelessness often result from state succession, disputes between States concerning the legal identity of individuals, protracted marginalization of specific groups within the society, or stripping individuals or groups of their nationality.

In Europe, specific efforts have been made to avoid situations of statelessness in particular through joint efforts led by the Council of Europe and UNHCR which resulted in the adoption of the 1997 European Convention on Nationality which provides a comprehensive legal framework in matters relating to nationality. The High Level Review Meeting serving the Followup to the 1996 CIS Conference held in Minsk in May 2004 also recognized that despite efforts made by the participating States to ensure

the realization of the right to a nationality to all persons living on their territory, there are still cases of statelessness, mainly resulting from State succession.

By providing this collection of instruments regulating citizenship, UNHCR hopes to contribute to the early identification of statelessness and enable States to give their residents the exercise of their right to an effective nationality as foreseen by Article 15 of the Universal Declaration of Human Rights and eliminate situations of statelessness. UNHCR will strive to regularly update this collection of laws in Russian language and also recommends consulting its database REFWORLD containing nationality laws and other instruments relating to nationality.
