BACKGROUND INFORMATION: The applicant is requesting approval for a two-lot commercial tentative map for a 35.58+-acre site. According to the applicant’s letter of intent, the proposed development would benefit the neighborhood and general public. Specifically, it would allow the applicant to develop the site to provide beautification with landscaping and other improvements where none exist, and allow the site to be cleaned. On October 21, 2015, the City Council approved Ordinance 2731 which approved a new Development Agreement for the subject site. dwelling units, and common open space. That applicant has also filed a request to vacate Colton Avenue and Goldfield Street which are adjacent to the subject site. The associated Vacation (VAC-04-16) is also on this agenda for Planning Commission consideration. DEPARTMENT COMMENTS: Public Works: Please see the attached memorandum.

Fire Prevention: No comment. ANALYSIS: The proposed tentative map shows that two lots are proposed. The smaller lot, which fronts Cheyenne Avenue is approximately 6.47 acres in size. According to the preliminary development plan as part of the Development Agreement, this lot will be developed with a convenience store with gas pumps, restaurants, and office buildings. The proposed configuration of this lot appears to be consistent with the preliminary development plan. The larger lot, which is approximately 30.15 acres in size may contain 264 warehouse and showcase units with each unit having an accessory dwelling unit. In addition, one, 120 room hotel may also be developed, and approximately 79,200 square feet of open space is required for this portion of the development. The subject site is required to be developed in phases, with the first phase being the convenience store with gas pumps at the corner of Cheyenne Avenue and Commerce Street. (Note: The applicant is required to remediate all environmental issues by December 31, 2016.) Prior to recordation of the final map, the applicant is required to submit a Final Development Plan for the first phase of development. Within the first Final Development Plan, the applicant is also required to demonstrate the location of all open space areas, and such areas must be shown as common elements and recorded as appropriate with the final map. The subject site has a land use designation of Heavy Industrial and a zoning designation M-2, General Industrial District. The proposed commercial subdivision map is consistent with the Comprehensive Plan and zoning designation for the site, and appears to be consistent with the approved Development Agreement. The Public Works Department has recommended that this item be continued. As part of the Development Agreement, the applicant is required to show the limits of the flood zone. As a result, the tentative map needs to be amended to reflect this requirement.

RECOMMENDATION: The Community Development and Compliance Department recommends that T-1382 be continued indefinitely to allow the applicant additional time to amend the tentative map to reflect the flood zone. However, should the Planning Commission determine that approval is warranted, then staff recommends the following conditions: Planning and Zoning: 1. Unless expressly authorized through a variance, waiver or another approved

method, this development shall comply with all applicable codes and ordinances.

2. That all lands, areas, and open spaces are to be developed and maintained per the Development Agreement between the City of North Las Vegas and James Liu and Meng-Chun Tsai and Meng-Wei Tsai for the Huanghai Project dated October 21, 2015, (Ordinance 2731), or as amended.
