APPLICANT'S RESPONSE STANDARDS GOVERNING THE EXERCISE OF THE ZONING POWER
(A) Yes, the proposed development will provide a use that is suitable in view of the use and development of adjacent and nearby property. Property across Legacy Park Drive and Lawrenceville-Suwanee Road is zoned C-2 .
(B) No, the proposed development will not adversely affect the existing use or usability of any of the nearby properties. Rather, the proposed development would complement existing residential , commercial, and employment centers.
(C) In light of the size, location, layout, topography, and natural features of the property and in conjunction with the nature of surrounding development, the Applicant submits that the subject Property does not have reasonable economic use as currently zoned.
(D) No, the proposed development will not result in an excessive or burdensome use of the infrastructure systems.
(E) Yes, the proposed Rezoning Application is in conformity with the policy and intent of the Gwinnett County 2030 Unified Plan. For a variety of reasons, the subject propetiy is not suitable for multi-fmnily residential or office uses.
(F) Applicant submits that the zoning classifications and character of surrounding properties as well as the fact that the subject properiy is adjacent to Interstate 316 provide additional supporting grounds for approval of the proposed development.

REZONING APPLICATION OF SHIV SAl HOSPITALITY, LLC
Mahaffey Pickens Tucker, LLP submits this Letter of Intent on behalf the Property
Owner, Shiv Sai Hospitality, LLC (the "Applicant"), for the purpose of requesting a rezoning of
an approximately 1.65-acre tract of land (the "RM Tract") adjacent to University Parkway (State
Route 316) with additional road frontage on Legacy Park Drive just south of Duluth Highway
(State Route 120). The RM Tract is adjacent to a larger +/-6.829-acre tract of land (the "C-2
Tract") zoned C-2 with additional road frontage on Lawrenceville Suwanee Road (the RM Tract
and C-2 Tract together are collectively referred to as the "Property"). The Applicant is proposing
to develop the Property for use as a hotel with the potential for additional retail or commercial
development.
The Property is currently vacant and bears its current zoning pursuant to an area-wide
rezoning from 1975. However, the 1975 area-wide rezoning arbitrarily selected the land lot line
comtnon to land lots 7 and 8 as the zoning boundary line. The land to the west of the Propetiy
was developed under the RM zoning classification, but the Property, under common ownership,
has not been developed. The Applicant is requesting to rezoning the RM Tract to C-2 in order to
unify the Property under a single zoning classification. In order to develop the Property as
depicted on the site plan submitted with the application, the Applicant is also requesting to
reduce the required 75-foot wide natural undisturbed buffer and 25-foot wide landscaped buffer
(1 00 feet total) to a 25-foot wide landscaped buffer only. The majority of development and land
disturbance would occur on the C-2 Tract which already allows the proposed uses. However, the
proposed rezoning is required in order to unify the zoning of the Property, and permit the
installation of facilities related to the proposed developtnent including parking spaces,
driveways, and stonnwater detention facilities.
