3. In These Rules. unless the context otherwise requires -

(a) "ACT'' for the purpose of these Scheme Rules means the Mad1wa Pradesti Yidyut Sudhar Adh1niyam, 2000 (No. 4 of 2001 );

(b) "Board" means Madhya Pradesh State Electricity Board constituted under

Section 5 of the Electncity (Supply) Act, 1948 (54 of 1948),

(c) ~central Act'' means the Electricity Aci, 2003 (~fJ of 2003);

(h) "Di&com 1 '' means Madhya Pradesh Poor, r<nestrc1 V1dyut Vitaran Company Limited, a oomp~1w mccrporated with the main object of undertal<ing electricity distribution and retail supply in the Cormnlssionertes of Jabalpur, Rewa, and Sagar of the State of Maonya f'ractesh;

{I) ''Oiscom 2" means Madhya Prodesh Madhya Khestra V1dyut Vitaran Company L1m;ted, a company incorporated with the main object of undertaking electricity distribution and retail supply In the CommiMioneries of Bhopal, Hoshangabad, Ch:amb:al and Gw:alior

On and from the date of transfer to be notified by the State Govemment the properties and all interests, rights and 11ab1lrties of the Board as specified in Schedules 'A' to 'E' shall stand transferred to and vested in the State

Transfer of Undertaking by the State.

6. (1) The Undertakings forming part of Generation Undertakings 1:1s set out in Schedule - 'A' shall stand transferred to and vested in GENCO on and from the date of the transfer to be notified by the State Government suejact to the terms and conditions specified In the Act and these Scheme Rules.

(2) Tne Jndertak1ngs forrmng part of Transmission Undertakings as set out in Schedule - 'B' shall stand transferred to and vested in TRANSCO on and from the date of the transfer to I.Je notified by the State Government sut>ject to me terms ano condltions specified in the Act and these Scheme Rules

(3) The Undertakirg:5 forming part of Distribution Undertc,kfngs as set out 11 Schedule - 'C' shall stand transferred to and vested 1n D!SCOM - 1 on and from the date ot the transfer to be not.tied by the State Government subject to the terms and conditions specified in the Act and these Scheme Rules,

(4) The lJmertakings forming part of Distribution Undertakings as

set <XJt in Schedule - 'D' shall stand transferred to and vested in UISCUM - 'l on and trorn the date ot the transfer to be norfied by the State Govt11rnment subJ9ct to the t9rms and r.onqitloni spedfit-Q fn lhi Act and these Schema Rul8s.

(5) The Undertakings forming part of Distribution Undertakings e3 eet out in Ociledule - '-c' 3h.atr ~tend lran~ferred 10 and vested in DISCOM - 3 on and from the date of the transfer to be notfled by the State Government subject to the terms and condmons specified in the Act and ln these Scheme Rules.

IV. GENERAL:

FUNCTIONS AND UNDERTAKINGS RETAINED IN MPSEB

(1} Th~ hulk purchase and bulk supply functions, namely. purchase of electricity m bulk. from the generating companies including GENCO and supply of electricity in bulk to the DISCOMS MPSEB will not, however, undertake the activity of supply of electricity to anv consumer in the State of Madhya Pradesh from such date as the State Government may dlrect 10 this behalf.

(2) The liabilities to the e.><tent to be retained as per the- direction the State Government may issue in thts behalf.
