ADVERTISEMENT FOR SELECTION OF CHAIRPERSON OF APSERC

In accordance with Section 84, 85 & 89 of the Indian Electricity Act, 2003, the Government of Arunachal Pradesh invites applications from Indian citizens for the post of Chairperson of the

single member Arunachal Pradesh State Electricity Regulatory Commission from persons who meet the following criteria :

1. The person shall b~ 'of ability, integrity and standing who has adequate discerning knowl edge and experience of and has shown capacity in dealing with problems relating to engineering, finance, commerce, economics, law or management.

/. The person should not have any financial or other interest with any corporate entity dealing with generation, transmission, trading and distribution of electricity in Arunachal Pradesh which is likely to affect prejudicially his or her function as Chairperson of the Commission. The

person must give a certificate to this effect while applying for this post .

The Chairperson shall hold office for a term of five years from the date he enters upon his office or till he attains the age of Sixty Five (65) years, whichever is earlier, but shall not be eligible for re-appointment in the same capacity in APSERC.

It. The Chairman shall receive a pay in the Pay Band HAG+ Scale (Rs . 75,000 - 80,000/-) pm with

other allowances as admissible to the post in the State belonging to All India Services Cadre and other terms and conditions shall be as prescribed in the Arunachal Pradesh State Electri city Regulatory Commission (Salary, Allowance s and other conditions of Service of Chairman) Rules,

PWI<'SfW-1075/2004.- In exercise of Ihe powers conferred under Section 180 read wilh secllon 89 of Ihe I:leclricity Act, 2003 (Act No. 36 of 2003), the Governor of Arunachal Pradesh do hereby make Ihe following rules prescribing the conditions of service of the Chalrmah of lhe Arunachal Pradesh Slate Eleclricity Regulatory Commission (APSERC) eslablished vide nollncalioil No. PWRSIW-1075/2004 daled 7th May, 2010.

1. Short title and commencement: (1) These rules may be called Ihe Arunachal Pradesh State l:irclricily Regulatory Commission (Salary, Allowances and olhet. Condllions ofServic:e of Chairman) Rules, :)010

(2) They shall come Inlo force on Ihe dale of their publlcaUon in the OHlcial Galelle.

2. Definitions; In tilese rules, unless the context otherwise requires,­, ,

(a) "Act" me'aris the Electricily Act 2003 and

(b) words and expression used herein and not defined bul defined in the Act, shall have the meanings respectively assigned to them in theAc!.

3. Oath of office and secrecy: The Chairman shall before enlering upon his of lice, subscribe to an

onth of of lice and secrecy before the Minister in charge of the Ministry of Power. The oath of office and secrecy <;l1elli be admiriistered in the form as prescribed in the Schedule (I & II) annexed to this rule:

4 . Pay: The Chairman shall receive a pay in the pay band HAG + Scale (Rs. 75,000-80,000 p.m.) wilh uther allowances as admissible to Ule posl in the slate belonging to All India Services Cadre:

Provided thai If the Chairman has been a Judge of the Supreme Court or Chief Justice of a High Courl, he 0110111 receive pay as admissible to a Judge of the Supreme Court or Ihe Chief Justice of High Court:

Provided further thai in case a person appOinted as the Chairman is in receipt of any pension, the pay of such person shall be reduced by the gross amounl of pension drawn by him:

Provided also that the Chairman shall be entitled to drawr allowances on the original basic pay before ~uc:h fixation of pay.

:i . Dearness allowance and city compensatory allowance: The Chairman shall receive dearness ;Itk)wance '3nd city compensatory allowance, and olher allowances al the rate admissible to a Group 'A' Officer pf Ihe Central/Slate Government drawing an equivalent pay:

Provided Ihat In case the Chairman is or has been a Judge 61 the Supreme Court of Chief Jusllce of a High Court, he shall recetve dearness allowance at Ihe rate admissible 10 a Judge of Ihe Supreme Court or Ihe Chief Justice of a High Court, as Ihe case may be.

G. Leave: Tile Chairman shall be entitled to thirty days earned leave for every year of service. The \ pilyment of leave, salary, during leave shall be governed under the provisions of Central Civil Services (Leave) l Rules, 1972 as amended uplo date.

7. Leave sanctioning authority: In the case of the Chairman, the Minister of Power in charge of the Ministry, shall be the leave sanctioning authority.

n. Provident fund: The Chairman shall be governed by Ihe provisions 01 the Conlributory Provident Fund Rules 1962 ..

9. Traveling allowilnces : ('I) The Chairman while on tour wilhin India or on Iransfer (including the

journey undertaken by self and family to Join Ihe Commission or on the expiry of term wilh the Commission to proceed 10 his home town with falnity) shall be enlilled to Ihe journey allowance, daily allowances and transportation of personal effecls at Ihe same scales and at the same rales as are applicable to a Group 'A' Officer of the Central Government drawing an equlvalenl pay.

(2) Foreign tours 10 be undertaken by the Chairman shall require prior approval of the Slate Government! <Jnd as per the relevant rules of Central Government:

Provided that the daily allowance and provision for hotel accommodation during lhe period of lour abroad, sh'1ll be in accOrdance wilh such orders of the Cenlral Government as are applicable to a Group- 'N officer of the Central Government, drawing an equivalent pay and as per the economy instructions or other instruclions

issued by the Minislry of Finance from lime to time.

10. Leave travel concession: The Chairman shall be entitled to leave travel concession al the same scale (lnd at the same rate as applicable to Group 'A' officers of the Central Governmenl drawing an equiv<Jlent p8y:

Provided Ihat if the Chairman Ilas heen a Judge of the Supreme Court or a Chief Juslice of a High Court, he sllali be entitled to leave Iravel concession at the same scale and at the same rale as applicable to a Judge of the Supreme Court or the Chief Justice of High Court, as the caSe may be same r(lle ao applicable tu a Judge l,f th~ Supreme Court or the Chief Juslice of High Courl. as the case may be.
