Minister of the Ministry for Agriculture Forestry and Rural Development taking into account the UNMIK Regulation No.2001/9 of September 13th 2001 on the Executive Branch of Constitutional Framework for Provisional Institutions of Self – Government in Kosovo, article 1.3 point (d) and Regulation Nr. 2005/15 for the amendment of UNMIK Regulation No. 2001/19 on the Executive Branch of Provisional Institution of Self Government, article 12 paragraph 1 and 2 of Kosovo Livestock Law No. 33/2004 on 14 October 2004.

ADMISTRATIVE INSTRUCTION MA – No. 02/06

Raw materials of the animal’s compound feed

General provisions

Article 1

The present Administrative Instructions defines quality standards, package, labeling and preservation of raw materials of the animal’s compound feed.

Purpose

Article 2

Administrative Instruction has for the purpose the assurance that the raw material of the animal’s compound feed to be healthy, original with the acceptance quality for the market, which when it will be set in the circulation mustn’t present risk for animal’s health, human’s health or environmental.

Article 3

Definitions

For the understanding of the present Administrative Instruction expression and terms used have the following meaning:

(1) Raw materials: there are different products with plant and animal origin, in their natural situation, fresh or conservator, products that flow from their industrial processing as well as the organic and inorganic substances, that content or doesn’t content additive, and which are designated for the usage of feeding stuff animals in directly way such or after the process for feeding stuff animals composed or like carries s of mixtures;(2) Putting in the circulation or circulation: means circulation of feeding stuff with the purpose of selling or which wants another form for the transfer.

Quality Standards

Article 4

1. Compound of feeding stuff put in the circulation must be healthy, original and good quality.

2. Chemical compound of raw material compound feeding stuff must be within permitted tolerance, from stated content in accordance with Annex 1 of the present Administrative Instruction.

Packing and Saving

Article 5

1. Compound feeding stuff may come to the circulation only packed or in closed container in order that when it is opened the closure will be damaged and may not be reused.

2. For the packing of compound feeding stuff mustn’t use the covering that has been used before or used covering for the packing of damaged matters or toxics.

3. Compound of covering material ought not to affect in the quality of compound feeding stuff.

4. Compound of feeding stuff are preserved with the covering or without it:(1). In the spaces that must be clear, dry and comfortable; for the airing in order to interfere the contamination and spoiling.(2). In these spaces must not have defectors, poultries, acid, matters for the protection of plants as well as the other articles that may cause poising in raw materials or changes in their chemical compounds.

Article 6

Labeling

1.Compound feeding stuff may not be put in the circulation from the Producer, Importer, Seller or Spreader, of the label doesn’t keep the details for covered feed as below: (1). Name and address of Producer; (2). Number and date of license. Number of license is setting.Companies, Procurers, who show the raw material of compound feeding stuff in conformity with the

Administrative Instruction MA-No. 19/05, (3) Denomination of production;(4) Type or origin of product/sub product (vegetable, animal, mineral etc), (5) Part of the product from which is prepared the raw material (seeds, tubers, bones

etc),(6) Instructions for usage; (7) Declaration of analytic Composers (feed materials) expressed in: % gr, mg, MJ,

NjI, Nj.u. etc. - For the individual raw material must be done according to the Annex 4 of the present Administrative Instruction, - For grouping compound feeding stuff must be also done according to the Annex 5 of the present Administrative Instruction,(8) Declaration of preparation proves of compound feeding stuff must be done -

------ according to the chapter IV of Annex 3, if it is required,(9) Date of production as well as the expire date;(10) Net quantity;(11) Conditions of preservation(12) Information may be given as conditionally that those might be tested.

2. Minimal duration of preservation and net quantity may be indicated also out of country reserved in label.3.Labeling of compound feeding stuff that content proteins from tissue of mammals must be in conformity with Annex 2. 4.For the feed in container data ought to be indicated in the declaration, which accompanies the commodity.5.Data in the label and declaration must be visible, read and being without deleted.

Aditional information

Article 7

1.Responsible person for given details in the label, declaration and accompanied documents of compound feeding stuff may provide the determined addition with this administrative instructions; The following information:

(1) It may be not designed for showing the presence or content of analytical components expect those, declaration for whom is intended the Annex 4 and 5 of this Administrative Instruction;

(2) It may be not fraud the user and particularly using the attribute for effects of characteristics of compound feeding stuff that may not be possess suggesting that possess the special characteristics;

(3) It may be not pretended that compound feeding stuff will be prevented, treated and recover a disease;

2. It must be intercommunicated with the purpose of quantification factors that may be tested;3.This information must clearly share form all details specified in article 6 of this Administrative Instruction.

1. Raw material which are put in the circulation must be associated with the accompanied documentation contenting given details as follows;

(1) The identification sign or sign of the market of the Person in Charge for given details in label;

(2) Name or name of business and the address of Producer, whether this Person is not responsible for the label.

(3) Place of production;(4) Quantity and type of production. (If the party of goods is shared during

the circulation, referred details must be presented in the accompanied document).

(5) Price of production;(6) Data and loading place;(7) Name of Driver and the Signs of Vehicle Registration;(8) Denomination of Consignee and Consignor;(9) Description of production and its name of market;(10) Description of physical conditions of feed or processing specifics in which has passed;(11) If the production will not be packed from the Producer, then be given the additional information for the Packer and indicated date of

packing;(12 )Date of production;(13)In the accompanied documentation will be given the additional information, which might be on behalf of Purchaser.

2.For small quantities dedicated for the last User, these details may show to the Purchaser through an appropriate introduction in the selling point.

Market conditions of raw material without being packaged

Article 9

1. Raw material may be traded without being packaged in container without closed or in opened trailer in case of:

(1) Trading between licensed producers for animal feeding under Administrative Instruction MA –Nr. 19/05,

(2) Trading from compound feeding stuff producers of the packing companies.

(3) Trading of small quantities that do not pass the weight from 50 kilogram which are dedicated for final user as well as are directly taken from the package or container that preliminary is opened.

Article 10

During the circulation of compound feeding stuff for animals within Kosovo, notes in accompanied document in the packaging, in container or in attached labeling will be written in official language.

Article 11

1. Legal and Natural Persons who put the compound feeding stuff in circulation in the contrary with the present Administrative Instruction cause the following violations:

(1) Standards of quality are in contrary with Article 4 of the present Administrative Instruction;

(2) Coverage and labeling are in conformity with the article 5 and 6 of the present Administrative Instruction;

(3) Compound feeding stuff analyzes are not in accordance with content of labeling; (according to the assigned standards in Annex 1 of the present Administrative Instruction);

(4) Compound feeding stuff content damaged materials stopped for use;(5) Compound of feeding stuff also content additional materials or damaged materials

out of the border permitted for usage;(6) Trade of compound of feeding stuff to whom are allowed the usage deadline;(7) Trade of feed without labeling, declaration or with label, facilitated declaration.

Control and Inspection

Article 12

Natural and Legal Persons who are dealing with usage and trade of feeding stuff animals and additives are obliged at any time and at any place to show to the Authorized Inspector the required documentation and to enable the same free access of each quantity of production including here and given of one quantity for sampling analyzes of samples in case of any suspicions.

Article 13

For all other issues regarding work and the Authorizations of Inspectors including here the stoppage of production and trade or confiscation of production, will be applied under the provisions on Livestock Law and other bylaws issued by this law.

Exclusions

Article 14

1. The livestock Inspector may exclude the provisions of the present administrative instructions and to allow as follow;

(1) Recommendation of feeding stuff types that complete the assigned analytical characteristics,(2) For compound of feeding stuff for which some appropriate notes are proved that those are designated for Export,(3) For compound of feeding stuff for which with some appropriate notes is proved that are designated for scientific purposes or experimental.

Penalty provisions

Article 15

Violation of the present Administrative Instruction and extracted provisions the sanctions under article 25 paragraph 1 point (a), (d), (e), (j) for Kosovo Livestock Law.

Temporal and Final Provisions

Article 16

With the present Administrative Instruction will not be touched the provisions of the Administrative Instruction that have to do with animals feeding stuff extracted under Kosovo Livestock Law.

Entry into force

Article 17

This Administrative Instruction will be come effective by the day of its signature.

Annex 1Quality Standards of Compound Feeding Stuff for Animals put in Circulation

1. Botanic cleaning 1.1 Botanic cleaning of products and sub products given in Annex 4 and Annex 5 will not be lower than 95%, expect if it is given in another level in Annex 4 or Annex 5.

1.2 Dirty Botanic consider as following:(1) Natural dirties but without damaged (reeds and residues animals, seeds of other types or weeds).(2) Undamaged residues of other oil seeds or oil fruits that flow from a previous fabricate processing previous; whose level doesn’t pass 0.5%.

1.3 Botanical cleaning level determined referred to the product weight and sub product as such.

2. Moisture

(1) Moisture that content compound feeding stuff must be declared if it is passing above 14%.

(2) In the case when the moisture content doesn’t pass determined borders above, the content must be declared with the purchaser request.

3. Ash

Un melted ash in chlorides acid of compound feeding stuff must declare, if it is passing above 2.2% of the dry material.

4. Where it is certified that the content of compound feeding-stuff results lower than that declared, the minimal tolerance permitted is:

4.1 Crude proteins (gross proteins):2 Units for declared contents of 20 % or more,10 % When the declared content is between 10% and 20%.1 Unit for declared contents is less than 10 %.

4.2 Total sugar:- 2 Units when a declared content is 20 % or more,- 10 % when a declared content is between 10% and 20%.- 0.5 Unit for declared content is less than 10 %.

4.3 Starch and total sugar plus starch:

- 3 Units when a declared contents is 20 % or more,- 10 % when a declared content is between 5% and 20%.- 1 Unit when a declared content is less than 5 %.

4.4 Crude oils and fats:- 1.8 Units when a declared content is 15 % or more,- 12 % when a declared content is between 5% and 15%.- 0.6 Unit when a declared content is less than 5 %.

4.5 Gross fiber (gross cellulose): - 2.1 Unit when a declared content is 14 % or more,- 15 % when a declared content is between 6% and 14%- 0.9 Unit when a declared content is less than 6%.

4.6 Moisture and crude ash (gross) - 1 Unit when a declared content is 10 % or more,- 10 % when a declared content is between 5% and 10%- 0.5% when a declared content is less than 5%.

4.7 Sodium, potassium and magnesium, phosphor, calcium, calcium carbonate: - 1.5 Units when a declared content is 15 % or more,- 10 % when a declared content is between 2% and 15%.- 0.2 Unit when a declared content is less than 2%,

4.8 Ash insoluble in hydrochloric acid and expressed chloride like in NaCl: - 10% when a declared content is less than 3 % or more,- 0.3 % when a declared content is less than 3%

4.9 Carotine and Vitamin A xanthophylls :- 30 % of the declared content

4.10 Methionine lysine and steam base of the nitrogen: - 20% of declared content.

Annex 2Labeling of compound feeding stuff that content protein flowing

from tissue of mammals

Labeling of compound feeding stuff that content proteins flowing from mammal’s tissue and dedicated for other animals expect pets must keep the following declaration:“This nutritive substance content proteins that derives from mammals tissue, whose usage for nutritive ruminants and other domestic animals dedicated for consumer from human is prohibited, expect of animals feeding stuff in zoo garden , circus animals or for coat, known flocks of greyhounds, and growth of worm for decoy fishing”. 1. This does not apply for: - Milk and milk products - Gelatin - Hydrolyzed proteins with molecule weight under 10.000 come as follow:(1) It has passed from pre– mortem inspection from one authorized veterinary and has

resulted as healthy,(2) It is produced through process of production that involve appropriate measures for

minimizing contamination of skins, preparation of skins salting them, liming and intensive washing for following with exhibition of material over to pH from >11 for >3 hour in temperature >80ºC and followed with one treatment with heating from 40ºC for 30 min in > 3.6 bar;

(3) To reach from Companies which itself has finished the program for self resources control (HACCP);

a) De – calcium – phosphate that derive from un fat bones, andb) Dry plasma and other blood products.

Explanation indications for categorizing, labeling and for the used process for compound feeding stuff processed

I Raw materials ranges in the list and designated in the Annex 4 in the accordance with these criteria:(1) Origin of product/sub product (planting, vegetable and mineral). (2) Part of product/sub product used (seeds, tubers, bones etc).(3) Processing to which is subject the product/sub product, e.g. excoriation, extraction, heating and/or that result the product/ sub products e.g. flakes, swine bread, pulp, fating.(4) Ripeness of the product / sub product and/or the quality of product/sub product (low level of glycosides, rich with fat, less with sugar).

III Predictions that are related with denomination

When the name of feed material in the Annex 4 include one word or one word group in parenthesis, so that ought to be understanding as possibility e.g. Soya (grain), oil, Soya grain, must to be declared as oil from grains or as oil Soya.

IV Predictions that related to the dictionary

Given dictionary below is referred to the main processes used for the preparation of compound feeding stuff described in the annex 4 and 5 of the present Administrative Instruction. When the names of these compound feeding stuffs include the general name or quality from this dictionary, process that is used must be under below given limitation.
