a. Sharon Davis is the gas claimant in Tracts 11. As such Sharon Davis is entitled to 100% ofthe CBM royalties now in escrow and as may be hereafter payable. See Va. Code Ann. () 45.1-361.22:2.A.b, That CNX Gas Company LLC has previously given the notice(s) required by (r 45.1-361.22:2.Ato all conflicting coal claimants identified in the above referenced pooling Order and anysupplemental Orders pertaining thereto.c. That when the Board granted Petitioner's Miscellaneous Petition in VGOB 95-0416-0503-03, it

dismissed the coal claimant(s) Coal Mountain Mining Co LLP as a Respondent to theseproceedings. Accordingly, Coal Mountain Mining Co LLP was not provided further notice under g45.1-361.19and 22 of the hearing set on this Petition.d. That a detailed acrounting in accordance with the applicable provisions of g 45.1-361.22issubmitted herewith and identified as Exhibit J.e. That an Exhibit identified as Table 1 is annexed hereto, and it specifies how the disbursement
