In Yakutat Bay a subsistence salmon fishing permit holder shall attend the permit holders gillnet at all times when it is being used to take salmon from April 1 through May 31

Problem

A restriction in Yakutat Bay on subsistence users requiring them to attend gill nets at all imes April 1 through May 31 hi5 almost ciQmpletely elimil1i11td lhe spring chi nook harvest for ubsL once users Subsistence fishers catch on average less than 1 fish per day with most harvests occurri g overnight Fishers cant reasonably be expected to attend nets for 24 hour periods to catch 1 fish o in some

instances no fish Most fishers place their nets close to their homes where they can leav a skiff anchored close to the net and attend it regularly during the day

Repeil Proposal 135 adopted January 2018 and revert to pre-2018 restrictions

Reason to consider proposal

The Yakutr1t Tlineit Trihe believas the Board of liithorioc did not con9ider e ~~ped thi5 thtug- i11 regulations to almost eliminate subsistence harvest of spring Chinook The Chinook harvested in April and May is one of the most highly appreciated and important subsistence foods taken by local residents

This loss of spring Chinook to our Tribal members fails to provide the priority for subsistence the law requires While subsistence users suffer the loss on average of 200 Chinooks annually a newly established Troll fishery is harvesting the same fish on a 1000 fish quota and the commercial set gill nPt fi_hPry ii not required to ilttend notpound rt =ill timot Qvcn though ftlh are nuth 1n61 c1Lu11Jd11l Jurlng

the fishery They are only required to be at the set net site This is no way to provide a priority for subsistence

Due to the lack of support public comment and data the Yakutat Tlingit Tribe requests to repeal the decision with regards to Article 14 SAAC 01670 (e) Lawful Gear and Specifications

What will happen if this problem is not solved
