SUBJECT: THE DEPARTMENT OF STATE HEALTH SERVICES CONTRACT #75600090562007,HANSEN'S DISEASE, ATTACHMENT #02

BACKGROUND

The Department of State Health Services (DSHS) Contract #7560009056 2007, Attachment #02(Hansen's Disease), provides for specialized public health nursing services to Hansen's Disease (HD)patients, assist local physicians in providing quality outpatient services, provide and coordinateoutreach services, patient follow-up, case-finding, perform eye, hand, foot, and contract screening.Coordinate the HD nursing care program within the assigned areas and other existing health care andsocial agencies program that do or can provide assistance with patient following-up and coordinatepatient education. This attachment is effective January 1, 2006 and will expire on December 31,2006.

OPERATIONAL IMPACT

Attachment #02 of the Department of State Health Services contract continues to partially fund one(1) full-time Public Health Nurse II.

LEGAL IMPACT

The County Judge is required to sign the contract after approval by the Commissioners Court.

FISCAL IMPACT

Attachment #02, Hansen's Disease, provides $41,906 for salaries and fringe benefits, $1,950 fortravel, $223 for supplies, $10,471 for contractual for lab testing with LabCorp and physician serviceswith the University of Texas Southwestern, and $8,741 for indirect. A discretionary County match inthe amount of $19,436 is needed to supplement the salaries and fringes provided by DSHS.

SECTION 1. SCOPE OF WORK:

PERFORMING AGENCY shall provide specialized diagnostic and treatment services forHansen's disease (HD) clients (clients are defined as every person with known or suspectedHansen's disease and their household contracts) who live or receive services in the followingapproved countylies/area: Collin, Cooke, Dallas, Denton, Ellis, Erath, Fannin, Grayson,Henderson, Hood, Hunt, Johnson, Kaufman, Mclennan, NavalTo, Palo Pinto, Parker, Rockwall,Smith, Somervell, Tarrant, Travis, Wichita, Wise.

PERFORMING AGENCY shall provide a licensed medical physician whose field of expertise isHansen's disease to perform the following:

1. Provide medical, physical and rehabilitative services to clients with suspected orconfirmed Hansen's disease;

2. Provide Hansen's disease medical consultation on recommended treatment practices andmanagement to contracted local health departments;

3. Provide referrals for other specialty services such as physical or occupational therapy;and

4. Provide patient education on signs and symptoms of Hansen's disease such asneuropathy, nerve and muscle functions, and side effects of medications.

The medical physician assigned shall qualify for and maintain membership in PERFORMINGAGENCY'S medical staff, subject to all of the responsibilities of medical staff membership withrespect to clinical standards and practices. PERFORMING AGENCY shall maintaindocumentation of credentials for appointment and reappointment to PERFORMINGAGENCY'S medical staff.

PERFORMING AGENCY shall comply with all applicable federal and state laws, rules,regulations, standards, and guidelines in effect on the beginning date of this contract Attachmentunless amended including, but not limited to the following:

1. Communicable Disease Prevention and Control Act, Health and Safety Code, Chapter 81,VTCA;

2. Communicable Disease, 25 TAC, Chapter 97; and

3. National Hansen's Disease Program Standards of Care for Hansen's Disease in Texasrevised April 2005.

Within thirty (30 days of receipt of an amended standard(s) or guideline(s), PERFORMINGAGENCY shall inform RECEIVING AGENCY'S Program, in writing, if it will not continueperformance under this contract Attachment in compliance with the amended standard(s) orguideline(s). RECEIVING AGENCY may terminate the contract Attachment immediately orwithin a reasonable period-of-time as determined by RECEIVING AGENCY.

SECTION II. SPECIAL PROVISIONS:

None.

SECTION III. BUDGET:

In consideration of services provided, RECEIVING AGENCY will pay PERFORMINGAGENCY according to the most current list of the Texas Hansen's Disease Program authorizedrates for services under this contract.

In no event shall the total amount exceed $2,000.00.

BACKGROUND

The Texas Department of State Health Services (DSHS) Contract #75600090562007, Attachment#01 (Tuberculosis), provides basic services for tuberculosis (TB) prevention and control and (2)expanded outreach services to individuals of identified sub-groups who have TB or who are at highrisk of developing TB throughout Dallas County. This attachment is effective January 1, 2006 andwill expire on December 31,2006.

IMPACT ON OPERATIONS

There is no impact on operations to Dallas County for this contract.

LEGAL CONSIDERATIONS

The County Judge is required to sign the contract after approval by the Commissioners Court.

FINANCIAL CONSIDERATIONS

Attachment #03, Tuberculosis, provides $494,727 for salaries and fringe benefits, $53,533 fortravel, $13,091 for supplies $9,000 for contractual, and $85,554 for indirect. A discretionaryCounty match in the amount of$306, 181 is needed to supplement the salaries and fringes providedby DSHS.

SECTION 1. SCOPE OF WORK:

PERFORMING AGENCY shall develop and provide: (1) basic services for tuberculosis (TB)prevention and control, and (2) expanded outreach services to individuals of identifiedpopulations who have TB or who are at high risk of developing TB throughout PERFORMINGAGENCY'S defined service area.

PERFORMING AGENCY shall comply with all applicable federal and state laws, rules,regulations, standards, and guidelines in effect on the beginning date of this contract Attachmentunless amended. All documents referenced herein are incorporated by reference and made a partof this contract Attachment. PERFORMING AGENCY shall perform the following activities:

Provide basic services and expanded outreach services in compliance with RECEIVINGAGENCY'S Program's most current version of the Standards of Performance and the followingseries of American Thoracic Society (ATS) and Centers for Disease Control and Prevention(CDC) "Joint Statements" on diagnosis, treatment and control of TB.

1. Diagnostic Standards and Classification of Tuberculosis in Adults and Children,(American Review Respiratory Disease, Vol. 161, pp. 1376-1395,2000);

3. Targeted Tuberculin Testing and Treatment of Latent TB Infection, MMWR, Vol. 49,No. RR-6, 2000;

PERFORMING AGENCY shall perform all actiVIties in accordance with PERFORMINGAGENCY'S objectives, work plans, and detailed budget as approved by RECEIVINGAGENCY'S Program. All of the above named documents are incorporated herein by referenceand made a part of this contract Attachment. RECEIVING AGENCY'S Program must approve,in wliting, any revisions to these documents.

Within thirty (30) days of receipt of an amended standard(s) or guideline(s), PERFORMINGAGENCY shall inform RECEIVING AGENCY'S Program, in writing, if it will not continueperformance under this contract Attachment in compliance with the amended standard(s) orguideIine(s). RECEIVING AGENCY may terminate the contract Attachment immediately orwithin a reasonable period-of-time as determined by RECEIVING AGENCY.

RECEIVI NG AGENCY reserves the right, where allowed by legal authority, to redirect funds inthe event of financial shortfalls. RECEIVING AGENCY'S Program will monitorPERFORMING AGENCY'S expenditures on a quarterly basis. If expenditures are below thatprojected in PERFORMING AGENCY'S total contract amount, as shown in SECTION III.BUDGET, PERFORMING AGENCY'S budget may be subject to a decrease for the remainderof the Attachment term. Vacant positions existing after ninety (90) days may result in a decreasein funds.

PERFORMING AGENCY'S approved service delivery plan shall meet or exceed RECEIVINGAGENCY'S Program's Standard of Performance.

PERFORMING AGENCY shall provide a narrative report on their performance goals,objectives, and screening activities semi-annually in a format provided by RECEIVINGAGENCY'S Program. The narrative reports shall be sent electronically or mailed to theDepartment of State Health Services, Attention: Infectious Disease Control Unit, Mail Code1939, 1100 West 49th Street, Austin, Texas 787576-3199. Report periods and due dates are asfollows:

RECEIVING AGENCY'S Program shall provide administrative and technical assistance for theimplementation and operation of the service delivery plan.

PERFORMANCE MEASURES:

The following outcome performance measures will be used to assess, in part, PERFORMINGAGENCY'S effectiveness in providing the services described in this contract Attachment,without waiving the enforceability of any of the other terms of the contract.

1. 90% of cases and suspects under treatment are on directly observed therapy (DOT);2. 92% of eligible TB cases complete a course of curative TB treatment within twelve (12)

months of initiation of treatment;3. 92% of TB patients with initial positive cultures tested for and have drug susceptibility

results documented in their medical record;4. 91% of smear positive TB cases reported in 2006 have at least one (1) contact identified;5. 72% of identified contacts to smear positive TB cases reported in 2006 shall be evaluated

for TB infection or disease;6. 63% of infected contacts (to smear positive cases reported in 2006) who are started on

treatment for latent TB infection (LTBI) shall complete therapy;7. 52% of immigrants and refugees designated as Class A, B1 or B2 are appropriately

evaluated;8. 63% of immigrants and refugees designated as Class A, B1 or B2 that are started on

treatment for LTBI, complete treatment;9. The rate for U.S. born African Americans will not exceed fourteen and five tenths (14.5)

TB cases per 100,000 population in PERFORMING AGENCY'S defined service area;and

10. 82% of adults (age >14) with TB disease are tested for HIV.

PERFORMING AGENCY shall collect and maintain documentation of clinical andepidemiological information related to TB cases, suspects, contacts, and persons with latent TBinfection that is used by RECEIVING AGENCY to calculate outcome performance measures.PERFORMING AGENCY shall submit RECEIVING AGENCY Program's reporting forms forTB cases, suspects, contacts, and persons with LTBI on the timelines stated in SECTION II.SPECIAL PROVISIONS below and in RECEIVING AGENCY Program's most current versionof the Standards of Performance. PERFORMING AGENCY shall provide additionalinformation about TB cases, suspects, contacts, and persons with LTBI upon request ofRECEIVING AGENCY through limited scope audits or inspections and scheduled programreviews of PERFORMING AGENCY.

RECEIVING AGENCY'S Program shall calculate performance measures based on theinformation maintained in databases kept at RECEIVING AGENCY'S Program, through limitedscope audits, or inspections and scheduled program reviews of PERFORMING AGENCY.

PERFORMING AGENCY shall provide services to clients who live or receive services in thefollowing county(ies)/area: Dallas.

SECTION II. SPECIAL PROVISIONS:

General Provisions, Reports Atiicle, is revised to include the following:

PERFORMING AGENCY shall develop and submit a service delivery plan and detailedbudget justification for continuation of this contract Attachment during the next fiscal year.The plan and budget shall be prepared in the format approved by RECEIVING AGENCY'SProgram; an original and one (1) copy shall be submitted to RECEIVING AGENCY'SProgram, upon request. The plan shall describe PERFORMING AGENCY'S servicedelivery and activities toward meeting the objectives outlined in SECTION 1. SCOPE OFWORK above, including updated outcome performance measure targets and detailed lineitem budget justifications.

PERFORMING AGENCY shall mail all initial reports of confirmed TB cases, and suspectedTB cases to RECEIVING AGENCY'S Program within fifteen (15) working days ofidentification or notification. Any updates to initial RECEIVING AGENCY'S Report ofCases and Patient Services Form (TB400) (e.g., diagnosis, medication changes, x-rays, andbacteriology) and case closures shall be mailed to RECEIVING AGENCY'S Program.

PERFORMING AGENCY shall mail reports of contacts on all Class 3 TB cases and smearpositive Class 5 TB suspects within thirty (30) days of identification using RECEIVINGAGENCY'S Report of Contacts Form (TB340). All subsequent reports of contacts shall bemailed as contacts are identified. Refer to the latest edition of Standards of Performance forinformation on reporting intervals.

One (1) copy of each quarterly Financial Status Report, State of Texas Supplemental Form269A, shall also be submitted to RECEIVING AGENCY'S Program. Copies shall be mailedto the Department of State Health Services, Attention: Infectious Disease Intervention andControl Branch, Mail Code 1939, 1100 West 49th Street, Austin, Texas 78756. Reportperiods and due dates are as follows:

Funding from this Attachment shall not be used to supplant (i.e., used in place of fundsdedicated, appropliated or expended for activities funded through this contract Attachment)state or local funds, but PERFORMING AGENCY shall use such funds to increase state orlocal funds cU1Tently available for a particular activity. PERFORMING AGENCY shallmaintain local funding at a sufficient level to SUppOlt the local program. If the total cost ofthe project is greater than RECEIVING AGENCY Program's share set out in SECTION Ill.BUDGET, PERFORMING AGENCY shall obtain funds for the remaining costs in order toaccomplish the objectives set forth in this contract Attachment.

Social Security Fraud Investigators

Background Information

In FY 1998, the Social Security Administration (SSA) office of Operations, Office of Disability and theOffice of the Inspector General created the Cooperative Disability Investigations (CDI) Program. In Five(5) years time, 16 Investigative Units have become operative in Atlanta, Baton Rouge, Chicago, Houston,Nashville, new York City, Trenton, New Jersey, Oakland, California, Roanoke, Virginia, Salem, Oregon,St. Louis and Tampa.

The CDI program relies on the combined skills and specialized knowledge of OIG and state or local lawenforcement investigators and state Disability Determination Services (DDS) officials to combat disabilityfraud in their respective areas.

The Social Security Administration intends to establish a Cooperative Disability Investigation (CDI) unit inthe Dallas-Fort Worth metroplex.

The Social Security Administration (SSA) proposes to contract with the Dallas County Sheriff's Departmentto provide investigative services for the Cooperative Disability Investigations (CDI) programs.

Financial Compact

All costs related to the investigative positions will be reimbursed to Dallas county monthly. Costs includesalary, all benefits, overtime, vehicle with insurance and gas.

Funding

The Social Security Administration (SSA) has received funding thru September, 2006. The SSA pays allcosts relating to the two (2) investigator and there's no cost to Dallas county.

The investigative unit will strive to remain within all local margins of local, state and federal laws. At alltime, the laws ofrites governing all peace officers are adhered to, ensuring all citizens are equally protectedaccording to the laws ofthe land. All documents pertaining to the contract and inter-local agreements, mustbe signed by the Social Security Administration Project Director and the County Judge on behalf of theCounty.

BackgroundThe Purchasing Department briefed Commissioners Court on October 31, 2000concerning a sole source exemption for Air Performance to perform inspections, repairsand maintenance on several Flakt fans located at Frank Crowley, Lew Sterrett, andCook/Chill (Attachment A). The recommendation was accepted, but a court order wasnot submitted to formalize the exemption. The purpose of this briefing is to present theexemption again and recommend its approval.

Operational ImpactThe Flakt fans are used to control the temperature in the buildings listed. An annualinspection is required on each fan to determine the necessary repairs to keep the fansoperational. In the past, the Purchasing Department attempted to obtain competitive bidsbut has been unsuccessful. It was determined that Air Performance was the only servicecompany authorized by FlaktlAerovent Company in the Dallas area. The PurchasingDepartment contacted FlaktlAerovent again and confirmed that Air Performance is theonly authorized local service company.

Legal ImpactLocal Government Code 262.024(a)(7)(D) authorizes sole source exemptions for itemsthat can only be obtained from one source. The Purchasing Department has determinedthat the required service on these Flakt fans can only be obtained from a authorizedservice company.

BackgroundThe Judicial Support Personnel Panel has submitted a request to modify Section 82-964 ( JudicialSupport Personnel Salary Plan) of the Dallas County Code. The Panel has requested thefollowing modifications:

(1) Change the number of years of experience required to become a Court Coordinator II fromfour to three years;

(2) Clarify the underfill salary for a COUli Coordinator I stating it as a percentage of the entrysalary rather than a dollar amount, which will require constant updating in the policy if theentry level salary is changed; and

(3) Expand the number of months from 12 to 50 that a Court Coordinator can be re-hired in aCourt Coordinator position at the same salary level.

Of the requested modifications, the Human Resources/Civil Service Department recommendsadoption of #1 and #2. However, we do not recommend adoption of #3. Currently, non-lawenforcement employees have one year to return to their old positions and retain the same salarylevel held when they left the position. Law Enforcement employees have two years and this wasbased on the time, cost, testing requirements and complexity of their training. To extend thisoption to 50 months for this group of employees would far exceed that which is available to othercounty employees.

Impact on OperationsThe amended policy language will provide the Judicial Support Personnel Panel more flexibilityin administering the Judicial Support Personnel Salary Plan.

Financial ImpactAdoption of these modifications will directly impact two employees if the policy is adoptedretroactively, with a cost of approximately $6,188.05.

Sec. 82-964. Court coordinators.

(a) All court coordinators for court sections participating in the plan shall comply withthe qualifications and salary rates established in the plan.

(b) Minimum qualifications for court coordinators are as follows:

(1) A four-year college degree from a post-secondary institution that hasbeen accredited to grant degrees by one of the regional institutionalaccrediting agencies in the United States, as recognized by the UnitedStates Department of Education. A degree in criminal justice, publicadministration or a related field is highly desirable. A combination ofeducation and related experience may be used to meet this qualificationrequirement, with two years of related experience being equal to one yearof college.

Education obtained outside the United States must be converted to theequivalent U.S. educational level by a recognized accrediting agency ororganization in the United States.

(2) Strong organizational, interpersonal and communication skills.

(3) Extensive knowledge of or demonstrated ability to learn statutes, rulesand procedures governing administration of court processes andservices.

(4) Independent judgment, initiative and discretion are crucial.

(5) Managerial experience in the private or public sector is preferable.

(c) To be considered related, experience must be from the following agencies andjobs:

(1) District or county clerk's office as at least a court clerk;

(2) Legal assistant or paralegal in a private law firm;

(3) The district attorney's office as a clerk, paralegal, legal secretary. or legalassistant;

(4) Community supervision and corrections department as a communitysupervision officer, court clerk, paralegal, legal secretary, or legalassistant;

(5) The local, state, or federal public defender's office as a court clerk,paralegal, legal secretary, or legal assistant; or

(6) Trial or appellate court as a court clerk, paralegal, legal secretary, or legalassistant.

(7) The state or federal attorney general's office, as a court clerk, paralegal,legal secretary, or legal assistant;

(8) A law enforcement division reporting to the state or federal attorneygeneral's office in a clerical/administrative capacity directly supportinglegal counsel in preparing court cases;

(9) A clerical/administrative assistant who works directly supporting legal

(e) An applicant for a court coordinator position who does not meet the minimumqualifications for court coordinator I may be employed as a court coordinator(probationary) if they can reasonably obtain the minimum qualifications for acourt coordinator within 24 months, and the JSP panel finds that there are notother satisfactory applicants who meet the minimum qualifications. The salary ofan applicant under this rule shall be $23,800.00 85% of the salary of a courtcoordinator I as set out in the current judicial salary schedule, until such time asthe person meets the requirements of a court coordinator I.

(f) All persons hired as a court coordinator under this plan will initially be employedas court coordinator I or court coordinator II based on qualification, except that aperson previously employed as a court coordinator for a Dallas County CourtootlfIty Gourt may be re-employed within +2--50 months from their date ofseparation at the same salary the person was earning at the time of separation.

(g) A court coordinator that transfers from another county court shall be placed in theappropriate step under the plan according to qualifications and experience. Thissubsection also applies to grant funded court coordinators who move from oneposition to another.

Proposed 90-Day Ban on Outdoor Burning

BACKGROUND:1. Dallas County is currently experiencing moderate to extreme drought conditions which has

created a higher potential for wildland fires. Currently, all counties around Dallas and TarrantCounties are still under Outdoor Burning Bans. We have surveyed the unincorporated areas ofthe County and found the grass and crops to be very dry and dangerous. However, at this time,we have only experienced a few small grass fires in the unincorporated areas ofDallas County.

2. This office monitors the Texas Forestry Service Fire Risk Levels and the Keetch-Byram DroughtIndex (KBDI). Under this Drought Index, Dallas County is currently shown to be at 685, whichplaces our County within the Extreme Drought Level. The Index Scale goes from 0 800.According to the Texas Forestry Service, Dallas County is at a Very High Fire Risk Level.

3. The 600 - 800 Index Range is associated with more severe drought with increased wildfireoccurrence. Intense, deep-burning fires with significant downwind spotting can be expected.Live fuels can also be expected to bum actively at these levels.

4. The Keetch-Bryam Drought Index Scale and the current KBDI Ratings are attached. Alsoattached is a current map ofall Texas counties under bum bans.

5. Also, during the last several weeks the National Weather Service has issued Red Flag Alerts,which are issued when there is an extreme fire risk due to low humidity and high winds.

FINANCIAL IMPACT:Grass and wildland fires in the unincorporated areas of Dallas County, where we contract with local citiesfor coverage, will impact our budget due to the possible increase in fire activity. There could befinancial impact due to fire damage or loss ofproperty with the fire area.

LEGAL/POLICY:Local Government Code - Chapter 352 Sub-Chapter D - Outdoor Burning - Section 532-081(c):

The Commissioners Court of a county by order may prohibit or restrict outdoor bumingin general or outdoor burning of a particular substance in all or part ofthe unincorporatedareas ofthe county if:(1) Drought conditions have been determined to exist as provided by Subsection (b);

or(2) the Commissioner's Court makes a finding that circumstances are present in all

or part ofthe unincorporated area creates a public safety hazard that would beexacerbated by outdoor buming.

An order adopted under this section must specify the period during which outdoorburning is prohibited or restricted. The period may not extend beyond the 90th day afterthe date the order is adopted. A Commissioner's Court may adopt an order under thissection that takes effect on the expiration of a previous order adopted under this section.

LEGALIPOLICY (Coot.)(f) This section does not apply to outdoor burning activities:

(l) Related to public health and safety that are authorized by the Texas Commissionof Environmental Quality for(A) Firefighter training;(B) Public utility, natural gas pipeline, or mining operations; or(C) Planting or harvesting ofagriculture crops.

(h) A person commits an offence if the person knowingly or intentionally violates aprohibition or restriction established by an order adopted under this section. An offenseunder this subsection is a Class C misdemeanor.

ADDITIONAL EXCEPTION under the Texas Administrative Code - Chapter 22 - Texas AirControl Act - Outdoor Burning:

Residents within the unincorporated areas of Dallas County would still be allowed toburn domestic waste at a property designed for and used exclusively as a privateresidence, housing not more than three families, when collection of domestic waste is notprovided or authorized by the local governmental entity having jurisdiction, and when thewaste is generated only from that property.

Burning done in a safe manner under this section would be allowed only in proper fifty-five (55) gallonmetal containers with the proper protective screening over the top.

RECOMMENDATION:Based on the above cited conditions, I respectfully recommend the Dallas County Commissioners Courtissue a Court Order for an Outdoor Burn Ban effective November 29,2005, for a period not to exceed 90days, unless conditions exist which would allow for the extension of such ban, or the lifting ofthe bandue to improved conditions.

John L. Keetch and George Bryam designed a drought index specifically for fire potential

assessment. It is a number representing the net effect of evapotranspiration and

precipitation in producing cumulative moisture deficiency in deep duff and upper soil

layers. It is a continuous index, relating to the flammability of organic material in the

ground.

The KBDI attempts to measure the amount of precipitation necessary to return the soil to

full field capacity. It is a closed system ranging from 0 to 800 units and represents a

moisture regime from 0 to 8 inches of water through the soil layer. At 8 inches of water,

the KBDI assumes saturation. Zero is the point of no moisture deficiency and 800 is the

maximum drought that is possible. At any point along the scale, the index number

indicates the amount of net rainfall that is required to reduce the index to zero, or

saturation.

The inputs for KBDI are weather station latitude, mean annual precipitation, maximum

dry bulb temperature, and the last 24 hours of rainfall. Reduction in drought occurs only

when rainfall exceeds 0.20 inches (called net rainfall). The computational steps involve

reducing the drought index by the net rain amount and increasing the drought index by a

drought factor. KBDI levels and its relationship to expected fire potential are reflected in

the following table:

• KBDI = 0 - 200: Soil moisture and large class fuel moistures are high and

do not contribute much to fire intensity. Typical of spring dormant season

following winter precipitation.

• KBDI = 200 - 400: Typical of late spring, early growing season. Lower

litter and duff layers are drying and beginning to contribute to fire intensity

• KBDI =400 - 600: Typical of late summer, early fall. Lower litter and duff

layers contribute to fire intensity and will burn actively.

• KBDI = 600 - 800: Often associated with more severe drought with

increased wildfire occurrence. Intense, deep-burning fires with significant

downwind spotting can be expected. Live fuels can also be expected to

burn actively at these levels.

Approximately nineteen (19) property owners (a.k.a. the Wagonwheel Lane Home Owners) live onWagonwheel Lane, a private road, in the Dallas County Unincorporated Area off of Whitley Road, a CountyRoad. Wagonwheel Lane is a substandard road with open drainage ditches on each side, and is a narrow road,dilapidated, and lacking in roadway maintenance with many potholes throughout its 1650-ft. length. TheWagonwheel Lane Home Owners applied with the County of Dallas in 2002 for a HUD / CommunityDevelopment Block Grant (CDBG) for the paving and drainage improvements of this private road. CountyStaff conducted a LowlModerate Income Survey and the Home Owners subsequently qualified for a grant.

The Wagonwheel Lane Property Owners combined their time and financial efforts contracting with aconsulting engineering firm to provide engineering plans and roadway easement document attachments (metesand bounds with survey parcel exhibits) for County Approval. Each of the property owners has submitted thefollowing executed forms: "Property Owner's Voluntary Dedication", "Roadway Easement Dedication","Consent to Roadway Easement" (for the lienholder's release ofliens), and Title CommitmentJPolicy to theCounty of Dallas for proper easement dedication.

PROJECT SCHEDULE

The Wagonwheel Lane project is currently on the CDBO Spending Schedule, is critical in meeting therespective yearly schedule's funding deadline, and with construction completion projected by July 31, 2006.

OPERATIONS AND MAINTENANCE

This project will reconstruct Wagonwheel Lane with a rural paving section of two 12-ft. wide lanes with 2-ftshoulders for a total width of 28-ft. with open drainage ditches on each side within a 60-ft. width roadwayeasement as required by the County of Dallas. Upon acceptance of the Contractor's construction of the pavingand drainage improvements, a two-year Maintenance Bond shall go into effect. After the Bond expires,Wagonwheel Lane shall be maintained by the Road & Bridge District No.2 forces.

FINANCIAL IMPACT

The HUD / Community Development Block Grant (CDBG) Program has allocated $449,091 in funding forthe paving and drainage improvements for the reconstruction of Wagonwheel Lane.

RECOMMENDATION

Upon Close of the Public Hearing, and if the Commissioners Court is in agreement, a Court Order acceptingWagonwheel Lane, a private road, as a new Public Dallas County Road, shall be placed on next week'sFormal Agenda authorizing the public bidding and awarding of the construction contract for the WagonwheelLane Paving and Drainage Improvements.

BACKGROUND

In 2003, the State Legislature created Section 11.1825 ofthe Tax Code so the terms and conditionsunder which a property tax exemption could be provided to non-profit organizations that own low­income housing could be improved. This new section has tightened the eligibility criteria for suchnon-profit organizations, defined what constitutes low-income housing, and established how muchof the housing must be reserved for people in the targeted income group. The statute also nowallows taxing units in counties with populations ofat least 1.4 million to have some discretion as towhether to provide the exemption and at what level (previously, the exemption was mandatory andwas for the full assessed valuation).

These new conditions first went into effect in 2004, and the Commissioner Court authorized theprovision ofa 50% County and Hospital District exemption for the 2004 tax year. So that the Courtcan determine whether to continue or modify these exemptions for the 2005 tax year, the followingbriefing material has been prepared.

IMPACT ON OPERATIONS

To be eligible for the Section 11.1825 exemption, an organization must have had IRS non-profit tax­exempt status for at least three years, the provision of low-income housing must be one of itspurposes, and at least two ofits board members must be oflow-income. It must also have an annualfinancial audit performed.

Ifthe organization produces single-family housing which it intends to sell, it cannot sell this housingto anyone with an income greater than the Dallas area's median family income (which is currently$66,500 for a family of four). If it owns rental housing, then at least 50% of the units must bereserved for people who own no more than 60% ofthe Dallas area's median income (e.g.-- $39,900for a family of four). The maximum rent that can be charged for such units is 30% of the area

median family income which would currently result in a maximum rent of approximately $1000.The organization must also set-aside a reserve fund of at least $300 per unit for maintenance.

The organization is responsible for annually filing for the exemption, and DCAD is responsible fordetermining whether the organization is eligible. Unlike some other exemptions like freeport whichcannot be rescinded once a taxing unit has decided to authorize its general provision, the taxing unitdetermines each year whether it wishes to provide this exemption to all eligible organizations.Please note that if a taxing unit wishes to provide this exemption, it must do so to all eligibleorganizations; it cannot determine which projects or organizations it wishes to assist.

The statute also allows the taxing unit to determine at what level it wishes to provide this exemption;under the statute, the taxing unit can either:

(1 ) Provide a fifty percent exemption;(2) Provide an exemption in "a reasonable amount" other than fifty percent;(3) Deny the exemption if"the taxing unit cannot afford the loss ofad valorem revenue"

that would result; or(4) Deny the exemption if additional housing for people meeting the statute's income

eligibility requirements is not needed.

The Civil Section reviewed this matter for the County last year and believes that the CommissionersCourt has broad enough authority to decline providing this exemption if it so desires.

IMPACT ON FINANCE

The new law applies only to housing completed or propertypurchased for low-income housing afterJanuary 1, 2004. Property that is acquired for the purpose of constructing or rehabilitating rentalproperty must have housing to rent within three years, otherwise the property is no longer eligiblefor the exemption.

In 2004, four organizations (Builders of Hope, St. Philips Neighborhood Corporation, Habitat forHumanity, and East Dallas Community Organization) claimed the County/Hospital District 50%exemption for twenty properties. A total of $589,860 was exempted for these properties.

DCAD reports that for 2005 the same four organizations/twenty properties have applied for andwould potentially be eligible for the exemption; the amount of assessed value that would beexempted if the incentive were continued would remain at $589,860 and would result in a $1262reduction in property tax revenue for the County and a $1498 reduction in property tax revenue forthe Hospital District. The Auditor's Office has also reported that its FY2006 revenue projectionstake into account the continuation of the exemption at its current scale should the County wish tocontinue this exemption.

Some factors to consider in deciding whether to continue providing these exemptions include:

(1) Determining the short-term and long-term impact to the non-profit organization ofcontinuing these exemptions; and

(2) Determining the short-term and long-term impact to the County/Hospital District ofcontinuing these exemptions.

Ifa number of local taxing units like the County, Hospital District, and the local municipality wereto provide the exemption, the value ofthis exemption to the non-profit organization could potentiallybe significant given that the financial resources of many non-profits are often limited, that a 50%reduction in City/County/Hospital District property taxes can reduce a project's operating costs byabout 5%-10%, and that the exemption could be equivalent to the $300 reserve requirement for arental home and to the reserve requirement for about 20-to-100 units in an apartment complex.However, if only one taxing unit like the County provides the exemption, the impact, as shownbelow, is much less.

Because this exemption can be financially important to a non-profit organization, a problem couldarise in future years if the use of this exemption increases significantly and a taxing unit finds thatit no longer can afford the exemption. Discontinuing this exemption for the taxing unit couldprovide immediate relieffor the taxing entity, but it could cause a problem for the non-profit and forspecific properties if the provision of this exemption was a key component in theorganization's/property's financial operations.

When the County chose to provide the exemption last year, a number ofother taxing entities werealso considering providing the exemption. However, DCAD reports that the County and theHospital District turned out to be the only taxing entities that actually provided the exemption in2004. DCAD also reports that it is unaware that any other entity is going to provide this exemptionin 2005. In addition, since the County's decision last year to have it and the Hospital District providethis exemption, the County has adopted a new policy of eliminating Hospital District participationin various economic development-related tax incentives.

Because no taxing entity other than the County has elected to provide this exemption and becauseHospital District participation in other tax incentives is being reduced, the impact ofthis exemptionto the housing non-profit is greatly reduced (the County exemption would only have the impact ofreducing the tax obligation of the average qualifying property by about $60). Accordingly, theCounty may wish to consider discontinuing this exemption at least until other taxing jurisdictionschoose to grant it or the impact ofa County exemption significantly increases.

RECOMMENDATION

It is recommended that for the 2005 tax year Dallas County and the Hospital District discontinueproviding the 50% tax exemption authorized under Section 11.1825 of the Tax Code and that staffcontinue to monitor the impact ofa potential County exemption and the degree to which other taxingjurisdictions provide this exemption.

BACKGROUND

On October 4, the Commissioners Court instructed staffto develop a Request for Qualifications forthe development ofa Dallas County strategic plan. In accordance with these instructions, staffhasdeveloped the attached RFQ for the Court's consideration.

IMPACT ON OPERATIONS

The RFQ has been developed so that a consultant would have the primary responsibility offacilitating and leading the County and the Commissioners Court through the development of astrategic plan. County elected officials and personnel would assist the consultant by participatingin the planning process and bypreparing background information on the County's finances, existingprograms, and population trends. The completed plan would then be used by the CommissionersCourt to help determine which activities, programs, and projects the County should undertake overthe next ten years.

Firms interested in responding to this RFQ will be required to submit their qualifications and tooutline the process/methodology that they would utilize in order to develop the strategic plan. Uponreceiving this information, staffwill provide the Court with a summary ofeach submitted response,and the Court will select approximately three-to-four firms to interview. Following the completionof these interviews, the Court will begin negotiating with what it considers to be the most qualifiedfirm.

schedule could have the County receiving responses at the beginning of January and being in theposition ofdetermining which firms to interview by the end ofthat month. Once a firm is awardedthe contract for the project, it is thought that it will take approximately nine-to-twelve months todevelop a strategic plan.

IMPACT ON FINANCE

Based upon a review of other county strategic plans, the cost of engaging a consultant to helpdevelop a Dallas County plan could cost from about $100,000 to $300,000 depending upon howintensive the planning process is and how many meetings are conducted.

RECOMMENDATION

It is recommended that the attached RFQ be used in the procurement of a consultant for thedevelopment ofa Dallas County strategic plan.

REQUEST FOR QUALIFICATIONS AND PROPOSALSFOR THE DEVELOPMENT OF A STRATEGIC PLAN

DALLAS COUNTY, TEXAS

IntroductionDallas County, which contains 900 square miles, thirty-one cities, and a population of 2.3million people, is one of the largest counties in the United States.

Over the last thirty years as the Dallas area has become more urbanized, the County's rolehas changed. Instead of just principally acting as the State's local administrative arm,which requires it to conduct such functions as operating the State court system, registeringmotor vehicles, recording property transactions, and housing prisoners as they await trialor transfer to State correctional facilities, the County has become active in regionaltransportation, air quality, and pUblic health matters and has helped create a consolidatedsuburban/City of Dallas job training agency. Now, as some of its cities are beginning tomature, it is being asked to become involved in even more non-traditional Texas countyactivities like financing an NFL stadium and assuming control of the local municipal zoo.At the same time that it is being asked to undertake these new responsibilities, the StateLegislature is seriously considering limiting the method by which all Texas cities andcounties raise revenue.

So that Dallas County can successfully determine what its role should be and how it canpursue this role over the next ten years, it wishes to develop a strategic plan. Accordingly,it is requesting that parties interested in helping the County develop such a plan submittheir qualifications and proposals for consideration.

Structure of Texas County GovernmentCounties in Texas do not have "home rule" authority. As a result, they can only undertakeactivities that are specifically authorized by statute or the State constitution.

A county's budget and its property tax rate are approved by an elected five-member"commissioners court." This commissioners court also approves major purchases andcontracts, establishes certain policies, and allocates funds. Many key county officials likethe treasurer, district attorney, county clerk, district clerk, tax assessor/collector, and thesheriff are elected, as are the judges, justices of the peace, and constables.

Counties do not have the authority to adopt zoning ordinances, and they typically do notprovide water, sewer, or trash service which is usually the responsibility of the municipality.Counties are responsible for police and fire protection in their unincorporated areas, which,in Dallas County, accounts for less than ten percent of its total geographic jurisdiction andless than 10,000 of its total population.

Texas counties do not collect income taxes and most, like Dallas County, do not havesales taxes. As a result, most of Dallas County's revenue is provided by property taxes(35%) and fines/fees (14%) with its FY2006 operating budget being $432 million and itsFY2006 capital budget being $116 million.

Scope of Proposed ServicesDallas County wishes to retain a firm (or firms) that will lead the County and itsCommissioners Court through the development of a strategic plan. This plan will be usedby the Commissioners Court to determine which activities, programs, and projects theCounty should conduct over the next ten years.

County staff will be responsible for providing the selected firm(s) with backgroundinformation on population/demographic trends, the local economy, County finances, andCounty program levels. County staff will also be responsible for identifying theorganization's core functions, identifying what activities/programs constitute these corefunctions, and for determining which County activities/programs are legally required andwhich are discretionary.

The engaged firm(s) will be responsible for developing a glossary of common terms andworking with the Commissioners Court to help it identify the strengths, weaknesses,opportunities, and challenges of each core function, to determine what the critical issuesare for each core function, and to establish goals and priorities for each core function. Theengaged firm(s) will be responsible for developing a strategy for implementing the plan'spriorities and recommendations into the County's management structure and decision­making process and for producing the final strategic plan document.

Submission RequirementsInterested firms shall outline the process/methodology that they propose to use to developthe County's strategic plan. This outline should identify the components of the planningprocess and include a time-line for conducting each component and producing the finalplan.

Submitted proposals shall describe what services will be provided for each component andby what party, the qualifications of the firms and individuals involved in providing theseservices, the experience of these firms and individuals in developing strategic plans forlocal government, and their familiarity with county government, particularly in Texas.Submitted proposals should also describe what pre-planning/orientation activities will beconducted for the County and how the firm will seek to facilitate consensus.

Firms interested in submitting their qualifications and proposals must do so no later than_______________ at 2:00 p.m. Fifteen (15) copies of a firm'squalifications/proposal must be submitted to Shannon Brown, Dallas County PurchasingDirector, 509 Main Street, 6th Floor, Dallas, Texas, 75202, by the stated deadline. Failureto do so will prevent a firm from being considered for this engagement.

Submitted responses/proposals shall become the property of Dallas County and shall besubject to any applicable open records law. A firm may also not be reimbursed for the costof developing a response/proposal.

Selection ProcessThe County shall have the authority to reject any/or all proposals and to waive anyformalities or minor irregularities. The County may schedule interviews with some or allresponding firms. The Commissioners Court shall be responsible for selecting the partiesto be hired under this engagement and will begin contract negotiations with what itconsiders to be the most-qualified firm. The Commissioners Court shall base its selectiondecision on the respondent's experience, qualifications, MWBE participation, proposedprocess, and interviews. In the eventthese negotiations are unsuccessful, the County willthen sequentially negotiate with the next most-qualified firm and will continue in thismanner until either a contract is awarded or this Request for Qualifications is canceled.

ATTACHMENT A

Additional Requirements for Request for Qualifications (RFQ)and Proposals for the Development of a Strategic Plan

This is a Professional Services solicitation with the award of a contract based ondemonstrated competence and qualifications for a fair and reasonable price. Work to beperformed will be agreed to by a contract between the parties.

1. FEE STRUCTUREDallas County will pay based on the negotiations either as an overall cost of theconsultant services with additional hour rates for work outside the scope of thecontract or hourly rates determined in the contract with units to be determined upontask assignment. This fee should include all travel and other expenses forperforming the contract.

2. AWARD OF CONTRACTUpon completion of negotiations, the results will be reduced to a written contract forthe services to be rendered. Such contract may contain additional requirementsfrom the County. Dallas County will not be liable for, nor will it pay for, any amountof work commenced prior to the approval of the contract by the Dallas CountyCommissioners Court.

A,. The contract will be awarded to the proposer who provides the consultingservices at the best value and meets Dallas County's qualifications andrequirements.

B. Dallas County reserves the right to reject any and all proposals and to waiveany formalities or minor irregularities.

C. In the event the Consultant/Firm does not execute the contract as hereinrequired, the award of the contract shall be made to the next best-evaluatedproposer or Dallas County may decide to reject all proposals and may call fornew proposals and/or qualifications.

D. All contracts related to partnership, joint ventures and agreements withMWBE registered firms must be documented in the County's MWBEproposal packet that is attached to this RFQ.

E. County reserves the right to award a contract to more than oneConsultant/Firm as necessary to receive all services as required herein.

3. OBSERVANCE OF LAWS, RULES, AND REGULATIONSThe Consultant/Firm shall at all times comply will all applicable laws, ordinances,rules, regulations, and orders of the Federal government, State of Texas, DallasCounty, and the appropriate municipalities.

4. ASSIGNMENT OF CONTRACTA. The Consultant/Firm shall not assign, transfer, convey, or otherwise dispose

of the contract or any part therein or its right, title, or interest therein or itspower to execute the same to any other person, company, or corporationwithout the previous written consent of Dallas County.

B. Should the Consultant/Firm assign, transfer, convey, or otherwise disposeof its right, title, or interest or any part thereof in violation of this restriction,Dallas County may cancel the contract and all rights, title, and interest of theConsultant/Firm shall therein cease and terminate, and the Consultant/Firmshall be declared in default.

5. DISCLOSURE OF PROPOSAL CONTENTSA. All proposals and other materials submitted in the response to this RFQ

procurement process become the property of Dallas County. Selection orrejection of a proposal does not affect this right.

B. All proposal information, including detailed price and cost information, shallbe held in confidence during the evaluation process. Upon the completionof the evaluation process and award, the proposals and associated materialsshall be open for review by the public in accordance with the Texas PublicInformation Act.

C. By submitting the proposal, the proposer acknowledges and accepts that thefull contents of the proposal and associated documents shall become opento public inspection.

6. PROPOSAL WITHDRAWALIf, at any time prior to the submission deadline of this proposal, a proposer decidesto withdraw its proposal, that proposer shall give written notice that is signed by anauthorized representative to the Dallas County Purchasing Department at 509 MainStreet, 6th Floor, Dallas, Texas, 75202. After withdrawing a previously submitted

proposal, the Consultant/Firm may submit another proposal at any time up to thedeadline for submitting proposals.

7. PROPOSAL ERRORSA. Due care and diligence have been used in the preparation of the RFQ and

this Attachment, and it is believed to be substantially correct. However, theresponsibility for determining the full extent of the exposure and theverification of all information presented herein shall rest solely on theproposer.

B. The proposer shall not be allowed to take advantage of any errors oromissions in the specifications. Where errors or omissions appear in thespecifications, the proposer shall promptly notify the Dallas CountyPurchasing Department in writing of the error or omission that it discoversand request modifications or clarification of the document. Any significanterrors, omissions, or inconsistencies in the specifications are to be reportedno later than ten (10) days prior to the proposal submission deadline.

8. OMISSIONProducts and services not specifically mentioned in this RFQ, but which arenecessary to provide the services described by this RFQ, shall be included in theproposal. It is intended that this RFQ generally describes the requirements and theresponse format. Consultants/Firms will be evaluated on their understanding oftheservices needed for this type of project and their ability to convey what the servicewill be and how the service will be delivered.

9. PROPOSAL FOR ADDITIONAL SERVICESIf a proposer indicates an offer of services in addition to those required by anddescribed by this RFQ, these additional services may be added to the originalcontract at the sole discretion of Dallas County. At any time after the award of thiscontract, the Consultant/Firm and County may agree for the Consultant/Firm toprovide additional services. Such additional services shall be described in writingand approved by the Commissioners Court.

10. INDEMNIFICATION AND INSURANCESuccessful proposer shall be required to indemnify County for Consultant's/Firm'sactions and furnish insurance in the type and amount as required by the Countyincluding, but not limited to, Worker's Compensation, Commercial General Liability($500,000), and Professional Liability coverage ($500,000).

11. ASSURANCESCollusion, gratuities, kickbacks, or conflicts of interest shall not be permitted eitherduring the selection process or during the term of the contract or any extensionthereof.

12. TERMINATIONContract shall be subject to termination for cause, violation of law, mutual consent,failure of funding, end of term, or upon thirty (30) days notice for any reason orwithout cause.

13. AUDITCounty, its Auditor, or its designated representative(s) shall have the unrestrictedright to audit any and all accounting or other records regarding any funds paid orclaimed under this agreement, including, but not limited to, all books, records,reports, tickets, deposits, expenditure, budget or any item therein, supporting data,computer records and programs, and all items of hardware, software, or firmware,or any other item utilized by the successful proposer regarding this agreement. Thesuccessful proposer shall maintain all records for not less than four (4) years fromthe date of the termination of this contract. Such records shall be provided to theCounty in Dallas County, Texas and be available for any audit at any time uponrequest. The results of any audit may be furnished to Consultant/Firm for comment.The audit provisions of the contract shall survive any termination of this contract.

1. GOOD FAITH EFFORT

Prior to an award, all bidders/proposers will be required to document a "Good Faith Effort" to secureminority/women-owned businesses as subcontractors/subconsultants. Building Assessment of Cliff House Property

BACKGROUNDThe Juvenile Department moved its probation offices from the Cliff House earlier thisyear. The building was originally built in 1932 and subsequently expanded. It wasoriginally used as an orphanage. A portion of the building is used by the FacilitiesMaintenance construction crew as a shop, warehouse and staging area. The overallbuilding is over 28,000 square feet. Staff has been asked to investigate severalpotential uses of the property. The first is a potential sight for housing for clients ofDallas Metrocare. A second option is to use the facility for a training academy forthe Sheriff's Department.

Either use will require certain modifications to make the building functional and tocomply with City code requirements. To determine what would need to be done toaddress various building issues, it is necessary to conduct a building assessmentstudy. Attached is a proposal from Basye & Associates, Inc., the County's vendor forIndefinite Delivery, Indefinite Quality (IDIQ) Architectural Service to perform thisstudy.

IMPACT ON OPERATIONSThe Cliff House building needs to be upgraded before it can be reoccupied. Thisstudy will identify building problems and code issues that will need to be addressedin any building renovation project.

We will review available documents and information provided by or in the possession ofDallas County or others. Our review of these documents will not include commenting onthe accuracy of the documents. These documents may include:

In keeping with ASTM E2018-01, any opinions of probable cost that are either individuallyor in the aggregate less than a threshold amount of $3,000 of like items are to be omittedfrom the PCR. If there are more than four separate items that are below this thresholdrequirement, but collectively total over $10,000, such items will be included.

Opinions of probable costs should only be construed as preliminary budgets. Actual costslikely will vary from opinions of probable costs depending on such matters as type anddesign of suggested remedy, quality of materials and installation, manufacturer and type ofequipment or systems selected, field conditions, phasing of work, quality of contractor,quality of project management, market conditions, and method of obtaining competitivepricing.

Opinions of probable costs may be based on the extrapolation of representativeobservations, conditions deemed by us as highly probable, results from informationreceived, and the commonly encountered expected useful life or remaining useful life ofthe components and systems observed. It is not the intent of our service to prepare orprovide exact quantities or identify the exact locations of items or systems as a basis forpreparing opinions of probable costs.

For some physical deficiencies, determining the appropriate suggested remedy or scopemay warrant further study/research or design, testing, exploratory probing, or exploration ofvarious repair schemes. In these instances, the opinions of probable costs for additionalstudy will be provided.

We will also report any visual observation of possible existence of asbestos and otherhazardous substances. However, our observations will not constitute an environmentalassessment in accordance with federal, state, and local standards.

EXCLUSIONS

The activities listed below are excluded from or represent limitations to the scope ofservices:

1. Accessing manholes or utility pits or observing operating conditions of anysystems in such locations.

2. Entering crawl or confined space areas, determination of previous substructureflooding or water penetration unless easily visible or such information isprovided.

3. Walking on pitched roofs, or any roof areas that appear to be unsafe, or roofswith no built-in access, or determining any roofing design criteria.

4. Determining adequate pressure and flow rate, fixture-unit values and counts,verifying pipe sizes, or verifying the point of discharge for undergroundsystems.

5. Observation of flue connections, interiors of chimneys, flues, or boiler stacks, ortenant-owned or maintained equipment.

6. Assessing air conditioning process related equipment or condition of tenantowned/maintained equipment.

7. Removal of electrical panel and device covers, except if removed by buildingstaff, EMF issues, electrical testing, or operating of any electrical devices, orproviding opinions on process related equipment or tenant owned equipment.

8. Examining of elevator cables, sheaves, controllers, motors, inspection tags, orentering elevator pits or shafts.

9. Determining NFPA hazard classifications, classifying or testing fire rating ofassemblies.

10. Operating appliances or fixtures, determining or reporting STC (SoundTransmission Class) ratings, and flammability issues/regulations.

11. Seismic considerations, design considerations for natural disasters, ADArequirements other than mentioned previously, and indoor air quality.

Taking measurements or quantities to establish or confirm any information orrepresentations provided by the owner or user, such as size and dimensions ofthe property or building; any legal encumbrances, such as easements; buildingproperty line setbacks or elevations; number and size of parking spaces, etc.

15. Reporting on the presence or absence of pests such as wood damagingorganisms, rodents, or insects unless evidence of such presence is readilyapparent during the course of the field observer's walk-through surveyor suchinformation is provided to us by the owner, user, property manager, etc. We willnot provide a suggested remedy for treatment or remediation, determine theextent of infestation, nor provide opinions of probable costs for treatment orremediation of any deterioration that may have resulted.

16. Reporting on the condition of subterranean conditions, such as undergroundutilities.

17. Entering or accessing any area of the premises deemed to pose a threat ofdangerous or adverse conditions for the field observer or to perform anyprocedure that may damage or impair the physical integrity of the property, anysystem, or component.

18. Provide an opinion on the condition of any system or component this isshutdown, or whose operation by the field observer may increase significantlythe registered electrical demand load; however, we will provide an opinion of itsphysical condition to the extent reasonably possible considering age, obviouscondition, manufacturer, etc.

19. Evaluating acoustical or insulating characteristics of systems or components.

20. Providing an opinion on matters regarding security of the property andprotection of its occupants or users from unauthorized access.
