WWOR-TV: A STRONG COMMITMENT AND RECORD OF SERVICETO THE VIEWERS OF NORTHERN NEW JERSEY

The following outline sets forth the legal standard applicable to the renewal applicationfiled for WWOR-TV, Secaucus, New Jersey ("WWOR-TV"), and clarifies that no specialobligations have ever been imposed by the FCC outside of the requirement, adopted in1983 as to the then licensee, that WWOR-TV's primary service area extended beyond itscity of license (the primary service area for all other stations) and encompassed northernNew Jersey. The outline then highlights WWOR-TV's impressive record of service tothe viewers of northern New Jersey - a service which the station is committed tocontinuing for the indefinite future. Finally, it demonstrates that Section 309(k) of theCommunications Act requires renewal of WWOR-TV's license without specialprogramming conditions.

I) No Special Programming Obligation. WWOR-TV's obligation to serve the issuesand interests of its community of license, Secaucus, is no different in kind or degreefrom any broadcaster's obligation to serve its community oflicense.

a) Opposition to WWOR-TV's pending renewal application is premised on amisapprehension of the station's programming obligations. Opponents haveattempted to manufacture special programming obligations for WWOR-TV,when in fact the station, at most, has a larger primary service area (northernNew Jersey) than other licensees (their community oflicense).

b) WWOR-TV became licensed to Secaucus under unique circumstances.Pursuant to Section 331 of the Communications Act, the Commission in 1983reallocated WWOR-TV from New York to Secaucus. The enactment ofSection 331 enabled the station's then licensee, RKO General, to terminate apending renewal of license proceeding, avoiding possible loss of license, byagreeing to move the station from New York City to the state ofNew Jersey.In connection with the reallocation, the Commission observed that RKOGeneral had a primary obligation to serve not only its city oflicense, but all ofnorthern New Jersey lying within its Grade B contour. l

c) In 1986, the Commission, acting upon an application for consent to assign thestation's license to a subsidiary of MCA, considered and rejected argumentsthat RKO General had assumed a "higher obligation" to be responsive to theissues and concerns of its service area.2 The Commission stated that RKOGeneral's higher obligation was one only of the geographic coverage area towhich the station was required to be responsive. Unlike other stations, which

are required primarily to serve the needs of their "city of license," RKOGeneral's primary obligation extended not only to Secaucus, but to all of itsGrade B service area encompassing most of northern New Jersey.3

d) The Commission made clear that RKO General's "obligation to serve theissues and interests of northern New Jersey is no different in kind or degreefrom any licensee's obligation to serve its community oflicense.,,4

e) Most importantly, the Commission's decision related only to the question ofwhether RKO General, as seller of the station, had met its obligations asdelineated in the decision allocating WWOR-TV to Secaucus and should bepennitted to assign the license. As to the programming obligations of thebuyer, MCA, the FCC refused a request by the State ofNew Jersey that itcondition approval of the assignment on MCA's compliance withrepresentations that it had made in the assignment application with respect toservice to New Jersey. The FCC indicated that "it is apparent that [MCA]understands its service obligations," mooting any need for the imposition of acondition.5

f) The FCC again rejected complaints that WWOR-TV had failed to providesufficient New Jersey programming in its review of a petition to denyWWOR-TV's spin-off to MCA shareholders in 1990. In its decision, theCommission detennined that the petitioner had failed to demonstrate, basedon WWOR-TV's publicly-available issues/programs list, that the station hadignored New Jersey issues. In granting the consent to the transfer of control,the Commission imposed no conditions with respect to either aNew Jerseyphysical presence requirement or special programming obligation.

g) In fact, since RKO General's acceptance of the reallocation of the station'slicense to New Jersey in 1983, the Commission has not once imposed anyprogramming condition on the grant of an assignment of license for WWOR­TV or on the grant of its renewal applications. The Commission granted thestation's 1987, 1994 and 1999 renewal applications without imposing anyprogramming conditions. Nor did the Commission impose any specialconditions with respect to New Jersey programming in connection with itsgrant of consent to the transfer of control of the station in 200 I to FoxTelevision Stations, Inc. ("FTS") or in the grant of consent in 2006 to thetransfer of control ofFTS from K. Rupert Murdoch to Fox EntertainmentGroup. While FTS intends to continue its exemplary service to all ofNewJersey within the Grade B contour ofWWOR-TV and maintain its presence in

the state, it is subject to no unique requirements with respect to service to NewJersey.

2) WWOR-TV Has Provided Exemplary Service to the Residents of Northern NewJersey.

a) Daily News. Since FTS acquired WWOR-TV in 2001, the station hasbroadcast more than 2000 hours of regularly scheduled newscasts; more than200 hours ofpublic affairs programming and in the last two years alone, morethan 20,000 public service announcements benefiting local charities andresidents.

i) Nightly News, Seven Days a Week. WWOR-TV's one hour nightlynewscasts spend a substantial amount of time covering issues ofimportance to northern New Jersey viewers, including extensivecoverage of elections and local events.

ii) News Updates. During the last two years WWOR-TV has increasedits news gathering capabilities, adding new staff and enhancing itsmobile satellite coverage. As a result, the station had added regularlyscheduled local news updates running between 4:00 and 7:00 p.m.weeknights. WWOR-TV also interrupts regularly scheduledprogramming for breaking news reports of importance to northernNew Jersey viewers. Examples of breaking news segments includesevere weather warnings, Amber Alerts, and live addresses by theGovernor ofNew Jersey. The station also carries live coverage of theGovernor's annual State of the State address.

iii) Partnership with the Record. In 2007, the station has also partneredwith a local newspaper, The Record and Rasmussen, a provider ofpolitical data, to enhance its local coverage.

iv) News Crawls. WWOR-TV regularly runs news crawls to provideviewers with up-to-date coverage of news developments such as,school closings, major traffic and New Jersey election results.

b) Weekly Public Affairs Programming. WWOR-TV broadcasts weekly half­hour public affairs programs New Jersey Now (formerly Ask Congress) andReal Talk. Each airs for one-half hour on Sundays at noon and 12:30 p.m.,respectively. NJ Now provides a forum for New Jersey politicians to addressissues of importance to New Jersey residents. Real Talk presents local social,economic and cultural issues, as well as local personalities, providing viewersaccess to civic and community leaders. Recently, the station moved the airtime for each of these programs from early Sunday morning to Sunday mid­day.

c) Local Sports and Entertainment. WWOR-TV provides a wide variety ofentertainment and sports programming, including regular coverage of the NewJersey Nets, New York Giants and New York Yankees sporting events. Thestation also covers entertainment programs responsive to our diverse audience- for example, each year WWOR-TV brings the community coverage of theNational Puerto Rican Day Parade and the MDA Telethon; in 2007 the stationbegan carrying the McDonald's Gospelfest which it also plans to broadcast ona yearly basis. The station also recently broadcast the United Negro CollegeFunds' Tribute to Smokey Robinson.

d) WWOR-TV Is Committed to New Jersey. The following examples, while notexhaustive, are representative ofWWOR-TV's commitment to New Jersey.

i) WWOR-TV's Presence in New Jersey. WWOR-TV's main studio islocated in a 110,000 square foot office complex in Secaucus, NewJersey. The station has invested nearly $12 million dollars toward thecapital improvement of the facility since 2001.

ii) WWOR-TV currently employs over 250 individuals at the Secaucusfacility and employees often take part in a variety of events in andaround northern New Jersey. For example, several employees workwith the New Jersey Task Force on Fire Prevention, Leadership NewJersey and the NJ Mental Health Institute. The station also haspartnered with the Community Food Bank ofNJ, The New JerseyCenter for Performing Arts and the Three Doctors Organization,among others, to help serve the community.

iii) Training and Internships. WWOR-TV operates a paid apprenticeprogram to identify qualified individuals for work in the broadcastingfield. The program has successfully increased opportunities forminorities and women, which have been underrepresented in the field.The station also provides internship opportunities for college studentsand supports the Emma Bowen Foundation for Minority Interest inMedia, which helps fund ajob and career development program, andpartners with One Hundred Black Men on a mentoring program.

3) The FCC Should Renew WWOR-TV's License Without Conditions.

a) Standardfor Renewal. Section 309(k) of the Communications Act, whichgoverns television broadcast license renewals, was adopted as part of theTelecommunications Act of 1996. Section 309(k)(l) requires the Commission togrant a renewal application if specified requirements are satisfied: "If the licenseeof a broadcast station submits an application to the Commission for renewal ofsuch license, the Commission shall grant the application if it finds, with respect tothat station, during the preceding term of its license -

(A) the station has served the public interest, convenience, and necessity;

(B) there have been no serious violations by the licensee of this Act or therules and regulations of the Commission; and(C) there have been no other violations by the licensee of this Act or therules and regulations of the Commission which, taken together, wouldconstitute a pattern of abuse."7

b) LimitedAuthority to Deny or Condition a Renewal. Only if the licensee fails tomeet the standard of Section 309(k)(I), may the Commission deny the application- after notice and opportunity for a hearing under Section 309(e) of the Act - orgrant the application "on terms and conditions that are appropriate, including arenewal for a term less than the maximum otherwise permitted.,,8

c) WWOR-TV Has Satisfied the Requirements Section 309(k)(1) for Renewal. Sincethere can be no finding of a serious rule violation or rule violations amounting toa pattern of abuse, the FCC must find that WWOR-TV did not serve the publicinterest in order to impose conditions pursuant to Section 309(k)(2) - a standardthat it simply cannot meet. As demonstrated above, WWOR-TV's license issubject to no express conditions as to its programming to New Jersey. And quiteapart from the question of whether it is subject to requirements applicable to noother television station, it is indisputable that WWOR-TV has providedexceptional service to northern New Jersey. Accordingly, imposition of specialprogramming conditions on the grant ofWWOR-TV's pending renewalapplication would violate Section 309(k)(2) of the Communications Act.

4) Even if the Commission Had the Authority-Which It Does Not-to ImposeConditions on the Grant ofWWOR-TV's License Renewal. the FCC Must, ifWWOR-TV Requests, Vacate Any Conditional Grant and Afford WWOR-TV a FullEvidentiary Hearing.

a) Under Section 1.110 of the Commission's rules, if the FCC grants any applicationsubject to terms or conditions other than those requested by the applicant, theapplicant may reject the grant and request an evidentiary hearing before anadministrative law judge.9 "Upon receipt of such request, the Commission willvacate its original action upon the application and set the application forhearing.... "10 The hearing would be a trial-type and include introduction of oraland written testimony with full right of cross-examination.

b) An applicant may then request Commission review of the outcome of the hearingprocess 11 and appeal a final Commission decision imposing conditions to the

United States Court of Appeals for the District of Columbia Circuit. 12 Anapplicant may also seek review of any court of appeals decision by filing apetition for writ of certiorari with the Supreme Court.

5) Subjective Review of a Broadcaster's Editorial Choices Is Not within the Purview ofthe Commission.

a) The First Amendment and Section 326 of the Communications Act prohibitthe Commission from interfering with broadcasters' free speech rights orimproperly interfering with the programming decisions of licensees. 13

b) The Supreme Court has recognized the degree to which Congress has directedthe Commission to steer clear of oversight of broadcast news- "Congressintended to permit private broadcasting to develop with the widest journalisticfreedom," and - since it is not physically possible to provide time for allviewpoints - "the right to exercise editorial judgment was granted to thebroadcaster." 14

c) The Commission itself has stated that, "the general rule is that theCommission [will) not sit to review the broadcaster's news judgment, thequality of his news and public affairs reporting, or his taste. ,,15

6) The Commission Has No Basis to Make Quantitative Judgments About WWQR-TV'sProgramming

a) The Commission long-ago eliminated its quantitative guidelines for non­entertainment, local and informational programming. Prior to its 1984deregulation order, the Commission maintained renewal applicationprocessing guidelines specifying the amount of non-entertainmentprogramming that television stations were required to broadcast to ensureroutine processing of their renewal application and avoid additional review. 16

The Commission ultimately concluded that the processing guidelines imposedburdensome compliance costs and raised potential First Amendment concernsby unnecessarily infringing on the editorial discretion of broadcasters. 17

b) FTS has clearly demonstrated that it has provided programming responsive toissues of concern to viewers in northern New Jersey. Moreover, WWOR-TVprovides more local news on average than other similarly ranked commercialtelevision stations in the United States and carries more local news and publicaffairs programming than other full power stations licensed in New Jersey.

i) A brief review of the programming oflocal New Jersey stations'reveals that, on average, WWOR-TV currently broadcasts over 8.0hours of local news and public affairs programming per week. Otherfull-power commercial stations licensed in New Jersey broadcast lessthan 3.0 hours of local news and public affairs programming per week.

ii) WWOR-TV carries significantly more news than other similarlysituated stations. Nationally, over 60 percent of stations ranked fifthor below in a market provide no local news at all. 18 The FCC's own2005 study reveals that the remaining 40 percent of stations rankedfifth and below average 458 minutes over a two week period. 19 Incontrast, WWOR-TV, which is ranked sixth in the DMA, currentlyprovides over 850 minutes oflocal news over any given two weekperiod.

SUMMARY

Fox has paid close attention to community needs and provided exemplary

service to the residents of northern New Jersey since it acquired WWOR-TV six and one­

half years ago. In particular, the station airs a one-hour nightly newscast each day, and

broadcasts one hour of public affairs programming each week. Collectively, these

programs spend a substantial amount oftime covering issues of importance to WWOR­

TV's New Jersey viewers. As but one example, the station airs New Jersey Now, a

weekly one-half hour program providing interviews with state and local elected leaders

and political candidates. WWOR-TV also offers viewers a wide variety of entertainment

programming and serves as the free, over-the-air home for the New Jersey Nets

basketball team. In addition, in recent years the station has provided game coverage for

sports teams from local universities Rutgers and Seton Hall.

Notwithstanding the station's record of service to New Jersey, Voice for

New Jersey (the "Petitioners") filed a petition to deny the station's license renewal

application, alleging that WWOR-TV has failed to serve the needs of its community. The

Petition, however, relies on subjective assessments of the station's news coverage and is

based on only a selective - and faulty - review of the station's record. Accordingly, the

Petition cannot possibly meet the high burden imposed by the Commission on those

seeking to challenge renewal applications on the basis of a licensee's content selection.

First, the Petition intrudes on vital constitutional principles that protect a

free press from govemmental interference. Indeed, the Commission has long made clear

that it will not sit in judgment of a licensee's editorial choices, and that the First

Amendment provides licensees with broad discretion to select what programs and issues

to cover on their stations.

Equally important, the Petitioners appear fundamentally to misapprehend

the legal standard applicable to review of WWOR-TV's renewal application. The

Petition argues that the station should be subject to heightened scrutiny to determine

whether it has adequately served New Jersey viewers. The Commission, however,

already has had opportunity to consider and reject this very argument, making clear that

WWOR-TV's "obligation to serve the issues and concerns ofnorthern New Jersey is not

different in kind or degree from any licensee's obligation to service its community of

license." In any case, WWOR-TV's record of service to New Jersey leaves no doubt that

it has provided a substantial amount of issue-responsive programming specifically

targeted toward viewers in the state.

Finally, the Petitioners' specific criticisms ofWWOR-TV's coverage over

the past six and one-half years can easily be dismissed. To the degree that the Petition

finds fault in the station's election coverage, its analysis is ba.sed.on patently inadequ<!te

monitoring of WWOR-TV's programming - the Petitioners rely on a study that evaluated

just 30 days of regularly-scheduled newscasts (out of thousands ofhours news

programming) and that excluded entirely every other type of election coverage, including

WWOR-TV's public affairs programs. Likewise, the news programming analyzed by

Petitioners during a 12-day window in April 2007 constitutes far too limited an amount of

time to serve as the basis for conclusions about WWOR-TV's overall record. In any

event, despite the flaws inherent in the Petition's analysis, even the Petitioners' own data

confimls that the station provided ample coverage ofNew Jersey elections and other

local issues during the limited periods of review.

The Petitioners fare no better in their attempt to calculate the precise

number of the station's news stories related to New Jersey based solely on an

examination ofissues/programs lists and local service reports. Most critically, the

Petitioners incorrectly assume that the issues/programs lists constituted an exhaustive

recount of every single story aired by WWOR-TV, when in fact the lists were only meant

to be exemplary of the station's efforts. The Petitioners' flawed analysis also defies logic,

for it classifies any story that did not take place within the geographic boundaries ofNew

Jersey as irrelevant to the station's effort to serve viewers in the slate. Quite clearly,

though, coverage of important regional, national and international issues is responsive to

the needs and interests ofNew Jersey residents. Regardless, even the unduly narrow

analysis conducted by the Petitioners reveals that WWOR-TV broadcast more than 1,000

New Jersey-focused news stories over its most recent license term - clearly more than a

"nominal" amount that would call into question whether the station defaulted on its

obligation to serve its community.

In sum, the Petition fails to allege a prima facie case that WWOR-TV's

overall programming effort falls short of its public interest obligation. Not only does the

Petition conflict with critical First Amendment principles, it also attempts to evaluate

WWOR-TV based on erroneous assumptions and an entirely too limited review of the

station's record. When all of Fox's efforts to serve New Jersey viewers are taken into

account, there can be no question that WWOR-TV is deserving ofrenewal, and the

Petition should be dismissed.

Fox takes seriously its obligation to provide programming that meets the

tastes, needs and interests of viewers in northern New Jersey, and in particular, to keep

New Jersey citizens informed by broadcasting important local news and informational

programming. Since Fox acquired WWOR-TV in July 2001, the station has dedicated

substantial resources to producing programming specifically targeting the various New
