12. FILM AND TELEVISION TAX CREDIT AGREEMENT

For the purpose of allowing the Film Division of the New Mexico Economic Development Department to determine its eligibility for the Film and Television Tax Credit, __________________________________, the film production company, hereby agrees, with respect to its production listed above, that:

(1) it will pay all obligations the film production has incurred in New Mexico;(2) outstanding obligations are not waived should a creditor fail to file by the specified date;(3) it will submit, at the completion of principal photography, a post-accounting phone

number and email address to be posted on nmfilm.com; and(4) outstanding obligations will delay the filing of a claim for the film and television tax

credit until the Film Division delivers written notification to the Taxation and RevenueDepartment that the film production company has fulfilled all requirements for the credit.
