INNOVATION

We worked closely with the General Counsel’s office of the New York City Housing Authority (NYCHA) to craft an innovative financing structure under the American Recovery and Reinvestment Act that made possible one of the largest public-private partnership tax-credit bond deals in U.S. history. Proceeding under a tight deadline, a team of attorneys from NYCHA and Ballard Spahr closed this complex financing only three months after HUD’s initial approval. The result? NYCHA received federal, state, and private funding to modernize and maintain more than 20,000 public housing units.

RESOURCEFULNESS

When market conditions delayed construction of a $1 billion timeshare project in the West, the developers called on Ballard Spahr to preserve crucial entitlements, including land-use approvals, water and sewer rights, and building permits, which saved tens of millions of dollars in the project budget. We worked closely with elected officials and governmental agencies to secure needed extensions and keep the project moving forward.

LEADERSHIP

We represented developer Wexford Science & Technology in a 250,000-square-foot office and research center at the University of Miami Life Science and Technology Park. We negotiated and prepared transaction documentation, including a development agreement, a ground lease, space leases, and financing documents. The nine-acre park is now a vibrant urban research community where innovative companies and researchers from across the life sciences industry work together in state-of-the art labs, offices, and ancillary facilities.

COMMITMENT

We represented the National Center for the American Revolution (ARC) in acquiring land and obtaining entitlements to build a $100 million museum project, initially located in Valley Forge, Pennsylvania. We helped ARC acquire a 78-acre parcel, drafted zoning legislation that was adopted for the museum and education center, and successfully defended challenges to the legislation and approvals in state and federal courts. When ARC was presented with the opportunity to swap its property for a site in Philadelphia’s Independence National Historical Park, we negotiated a land exchange with the National Park Service that involved consultation with City and community leaders and several Native American Nations.

SERVICE

Replacing a Cold War-era nuclear security facility in Kansas City, Missouri, with a 1.5 million-square-foot manufacturing and research facility was a top priority for the National Nuclear Security Administration. Ballard Spahr helped make it happen. We assisted CGA Capital Corporation and its affiliates with financing for the construction and long-term operation of the facility. We drafted and negotiated the loan documents and played a major role in the lease and construction documents for the project, one of the largest ever undertaken by the U.S. General Services Administration.
