1 SCOPETenders are hereby invited for the drilling and/or rehabilitation of boreholes in ________________ Municipality’s area of jurisdiction in the North-West Province.

This tender calls only for rates on specified items. The contract entered into between the client and contractor shall be binding for ______ year(s) from the appointment of the contract, but may be extended for another year.

The order that will be given to the successful tenderer will be based on the accepted rates and scope of work as decided by the Client in consultation with the Department of Water Affairs and Forestry.

The value of work to be carried out as stipulated in the order will include ten per cent to be used as contingencies in accordance with the general conditions of contract.

Details regarding the works as well as the way in which it must be done are described in clause PS3 - Details of the contract" (See section 4.2, portion 1 of this document).

2 ISSUING OF DOCUMENTS(a) One set of tender documents, one set of drawings, and one copy of the Schedule of

Rates are issued to each prospective Tenderer. These documents are obtainable upon payment of a deposit of R______ per set from:

(b) These tender documents contain pages numbered consequently. Tenderers must satisfy themselves that the documents are complete. Should any figures or writing be indistinct or should any pages be missing from this document or should this document or the drawing(s) contain any obvious errors, the Tenderer must immediately notify the Implementing Agent in order to have any discrepancy rectified as no claim whatsoever, will be entertained for faults in the tender price resulting from the abovementioned discrepancies.

(c) This tender is to be left intact in its original format and no pages are to be removed or rearranged. Should there be inadequate or no space for the Tenderer to enter a particular item then such information shall be submitted in a covering letter and referred to in Part 9 : 'Alterations by Tenderer.'

(d) All Tenderers shall be deemed to have waived, renounced and abandoned any conditions printed or written upon any stationery used by them for the purpose of or in connection with the submission of tenders, which are in conflict with the conditions laid down in this document.

(e) The drawings issued with the tender are for tendering purposes only. They form part of the tender and shall be read in conjunction with the standard specifications. The drawings will take precedence over the standard specifications although the latter shall not to be deleted.

Notes:(i) All prices quoted shall be in South African currency and are to exclude for Value Added

Tax.

(ii) The tender must be signed and witnessed on the Form of Tender annexed hereto with all blanks in the tender and appendix filled in.

(iii) All spaces in the State Tender Board forms and other annexures shall be completed in full.

(iv) The Schedule of Rates must be fully priced out.

6 AUTHORITY FOR SIGNATORYIf the Tenderer is a company, a certified copy of the resolution of the board of directors (personally signed by the Chairman of the Board) authorising the person who signs this Tender, as well as any contract resulting from this Tender and any other documents and correspondence in connection with this Tender and/or Contract requiring such signature, to do so on behalf of the company, must be submitted with its Tender.If the Tenderer is a close corporation a certified copy of the resolution of the Board of Officials (personally signed by the Chairman of the Board) authorising the person who signs this Tender, as well as any contract resulting from this Tender and any other documents and correspondence in connection with this Tender and/or Contract requiring such signature, to do so on behalf of the close corporation, must be submitted with its Tender.If the Tenderer is a partnership, a certified copy of the resolution of the partners (personally signed by all the partners) authorising the person who signs this tender to do so, as well as to sign any contract resulting from this tender and any other documents and correspondence in connection with this Tender and/or Contract on behalf of the partnership, must be submitted with this Tender.Where the Tenderer constitutes a one-man business, certified proof must be submitted that the person signing this tender as well as any contract resulting from this tender and any other documents and correspondence in connection with this tender and/or contract is the sole owner of the one-man business.

If the Tender is submitted by a joint venture of more than one person(s) and/or companies and/or firms, it shall be accompanied by the following:

(a) The original or a copy of the document certified by a Notary under which such joint venture was constituted, which must define precisely inter alia the conditions under which the joint venture will function, its period of duration and the participation of the several constituent persons and/or companies and/or firms;

(b) A certificate signed by or on behalf of each participating person and/or company and/or firm authorising the person(s) who signed the tender to do so.

The form provided for this purpose in Part 9 (as Annexure 9.13), shall be completed.

7 ___________MUNICIPALITY TENDER CONDITIONS AND PROCEDURESThe Contract shall be governed by the "General Conditions of Contract for Works of Civil Engineering Construction, Sixth Edition (1990)". The only variations from these General Conditions of Contract shall be as given in the Special Conditions of Contract as contained in Part 3 of this document.

The pro forma Appendix contained in the General Conditions of Contract is replaced by the Appendix contained in Part 9.14 to this document.

8 ALTERNATIVESA Tenderer who has duly submitted an offer which in all respects complies with the specification may, at his own initiative, also submit an alternative offer at the same time or any time prior to the closing time of tenders. Provided that the tenderer's offer to specification is acceptable to the ______________________ Municipality in every respect, his alternative offer may also be considered for purposes of the award of the contract. Any deviation from specification or alternative condition of tender must be clearly stated. Any saving or additional expenditure for the Municipality brought about by each deviation or alternative proposal must be quantified in the tender documents.

Should the Tenderer wish to offer any other alternatives, he shall include with his tender a complete schedule of rates, formal design calculations as well as all other relevant details pertaining to such alternative(s).

Failure to comply with this clause may disqualify the alternative offered from further consideration.

9 VALIDITYThis Tender shall remain valid for the number of calendar days indicated in the Appendix to Tender (Annexure 9.14), calculated from the date and time of tender endorsed on the front cover of this document. Should the tender validity expire on a Saturday, Sunday or public holiday, the tender shall remain valid and open for acceptance until the closure of business on the following working day.

In submitting a tender, the Tenderer expressly agrees that he shall be committed to these tender conditions and to his offer to execute the Works at his tender price, as may be adjusted in terms of the Preamble and Form of Tender, for the period of validity as calculated above, and that should he unilaterally withdraw his tender during this period, the Employer shall, without prejudice to any other rights he may have, be entitled to nominate any less favourable tender for the Works from those received, or to call for fresh tenders, or to otherwise arrange for execution of the Works from those received, and the Tenderer shall pay on demand any additional expense incurred by the Employer on account of the adoption of the said courses, as well as either the difference in cost between the tender withdrawn (as corrected in terms of the Preamble and the Form of Tender) and any less favourable tender accepted by the Employer, or the difference between the tender withdrawn (as corrected) and the cost of execution of the Works by the Employer as well as any other amounts the Employer may have to pay to have the Works completed.

10 FORM ST8The copy of Form ST8, annexed to these documents (as Annexure 9.17), must be completed and signed by the Tenderers. In the event of a conflict between the terms and conditions of Form ST8 and the terms and conditions of the rest of the bound document, the terms and conditions of the rest of the bound document will take precedence over the said Form ST8.

11 PREFERENCE FOR PRODUCTS MANUFACTURED OR ASSEMBLED LOCALLYTenderers desirous of claiming preference for products manufactured or assembled in the RSA and/or a territory granted independence by or under any Act of Parliament of the RSA must complete and sign the Preference Certificate, Form ST11 (as Annexure 9.11) or no preference will be allowed.

12 TENDERERS TO COMPLY WITH DOCUMENTSTenderers must allow in their Tenders for all labour, materials, machinery and everything necessary for the execution and completion of the Contract in accordance with the tender documents. No alterations may be made in the Form of Tender, Schedule of Rates or other documents and the tender will be deemed to comply entirely with the terms of the documents.

13 SUB-CONTRACTORSTenderers must submit with their Tenders (Part 9) the names and addresses of any Sub-Contractors which they propose to employ and the section of the works on which they would be

employed. The abovementioned Sub-Contractors are not to be confused with the Emerging Contractors as mentioned in the document.

14 ACCEPTANCE OR REJECTIONTenders may be rejected if they show any departure from the conditions or specifications contained in the tender documents or are incomplete in any way. The ________________ Municipality does not bind itself to accept the lowest or any tender and reserves the right to accept any tender it may deem expedient, nor will it assign any reason for the acceptance or rejection of any tender.

15 TELEGRAPHIC TENDERSTelegraphic, telexed, faxed or e-mail tenders will not be considered.

16 REFUND OF DEPOSITSThe tender deposit is non-refundable.

17 CHEQUESAll payments and deposits are to be made in the currency of the Republic of South Africa and cheques are to be made payable to ______________________.

18 DETAILS OF DOCUMENTS TO BE KEPT CONFIDENTIALAll recipients of the tender documents, whether they submit a tender or not, must treat the details of the documents as private and confidential.

19 EMPLOYMENT OF LOCAL LABOURThe Government has indicated a desire to stimulate the local economic activities in the area and for this reason a high rate of local labour will be a pre-requisite for the activities which are to be executed by means of LIC-methods.

20 FINANCIAL STANDINGThe Tenderer must, within 7 days from the date on which he was requested to do so, submit a full report on his financial standing from his banker. The ______________________ Municipality may, in its discretion, and subject to the provisions of section 4(1)(d) of the State Tender Board Act 86 of 1968, condone any failure to comply with the foregoing condition.

The _________________ Municipality also reserves the right to approach the tenderer's banker or guarantor(s) as indicated in the tender document, with a view to ascertaining whether the required guarantee will be furnished. Tenderers shall indicate relevant details of their bankers in Part 9.14, Appendix to Tender.

21 COST INCURRED BY TENDERERThe Employer will not be responsible for any expenses or losses which may be incurred by any tenderer and/or supplier in the preparation and submission of the tender or visiting the site in connection therewith.

22 ABILITY TO PERFORMIn the adjudication of tenders, due account will be taken of the Tenderer's past performance in the execution of similar engineering works of comparable magnitude and the degree to which he possesses the necessary technical, financial and other resources to enable him to complete the work successfully within the contract period.

Tenderers are required to satisfy the _________________ Municipality and the Engineer of their ability to perform and complete the Works satisfactorily, and shall furnish details in Part 9.2 - List of Works Previously Executed, of contracts of a similar nature and magnitude which they have successfully executed in the past.

23 VALUE ADDED TAXValue added tax at a rate of 14% was introduced with effect from 7 April 1993. The tenderers are to note that the tendered rates are to exclude VAT. _________________ Municipality has the right to reject any tender if the Form ST5, Declaration of Good Standing regarding Tax (Part 9.16) has not been completed or if the tenderer has no VAT registration number.

24 RESULTS OF TENDERSNotice of non-acceptance of tenders will not be sent to individual unsuccessful tenderers, but particulars of accepted tenders will be made available upon written request by bona fide tenderers.

26 TENDER ADVERTISEMENTA copy of the official tender advertisement is bound into this document directly after the Contents List.

27 IMPORTANT CONDITIONS : MISCELLANEOUS REQUIREMENTS (FORM ST6)(a) The tender forms are drawn up so that certain essential information is to be furnished in

a specific manner. Any additional particulars shall be furnished in the enclosed questionnaire or in a separate annexure.

(b) Should tender forms not be filled in by means of mechanical devices, for example typewriters, ink, preferably black, must be used to fill in tenders.

(c) Tenderers shall check the numbers of the pages and satisfy themselves that none are missing or duplicated. No liability shall be accepted in regard to claims arising from the fact that pages are missing or duplicated.

(d) The forms ST 10 and ST 11, if attached, shall be completed and submitted with the tender.

(e) In terms of paragraph 17 of the General Conditions and Procedures (ST 36) firm tender prices and delivery periods are preferred. Consequently tenderers shall clearly state whether prices and delivery periods will remain firm for the duration of the contract or not.

(f) If non-firm prices are tendered, paragraphs 52.1 to 52.4 of the General Conditions and Procedures (ST 36) shall apply.

(g) Where items are specified in detail, the specifications form an integral part of the tender document and tenderers shall indicate in the space provided whether the items offered are to specification or not.

(h) In respect of the paragraphs where the items offered are strictly to specification, tenderers shall insert the words "as specified".

(i) In cases where the items are not to specification, the deviations from the specifications shall be indicated.

(j) The tender prices shall be given in the units shown.

(k) With the exception of basic prices, where required, all prices shall be quoted in South African currency.

(l) Delivery basis:

(i) Supplies which are held in stock or are in transit or on order from South African manufacturers at the date of tender, shall be offered on a basis of delivery into consignee's store or on his site within the free delivery area of the tenderer's centre, or carriage paid consignee's station if the goods are required elsewhere.

(ii) Notwithstanding the provisions of paragraph 12(a), tender prices for supplies in respect of which installation/erection/assembly is a requirement, shall include ALL costs on a basis of delivered on site as specified.

(m) Unless specifically provided for in the tender document, no tenders transmitted by telegram, telex, facsimile or similar apparatus shall be considered.

(n) These conditions form part of the tender and failure to comply therewith may invalidate a tender.

(o) Tenderers are requested to promote local content optimally. In terms of paragraphs 25 to 25.2 of the General Conditions and Procedures (ST 36) tenderers who use locally manufactured components, products, equipment and systems, including electronic components and systems, may claim preferences as set out in the preference certificate, form ST 11. A list of products and names of local manufacturers of such components, products, equipment and systems are available from the Office of the State Tender Board on request.

28 BASIS OF TENDER ADJUDICATIONAs already stated in Clause 1, page 2.1 (i.e. Scope of Contract), this contract will be executed on a "Bill of Rates" basis and not a "Bill of Quantities" basis. It is also mentioned in the same clause that no guarantee can be given regarding the amount of expenditure for this contract.

The reason for the possible variation in expenditure is that at the tender stage a number of unknown factors prevailed regarding quantities and materials related to the drilling of new boreholes and rehabilitation of existing boreholes. This is mainly due to the fact that hydrogeological field investigations in the communities to be served under the scheme, had not commenced at the tender stage.

PART 3 SPECIAL CONDITIONS OF CONTRACTThe following additions to and variations from the SAICE General Conditions of Contract (sixth edition-1990) apply to the Contract. Certain pro-formas that are contained in the General Conditions of Contract 1990 are also replaced by the corresponding pro-formas that are bound into this document.

1(1) Definitions1(1)(c) “Commencement Date” means the date of receipt by the Contractor of the Letter of Acceptance

from the Employer or the Engineer.

1(1)(e) Add onto after the word "parties" in the last sentence : “...... and shall include any written instruction by the Engineer to the Contractor to execute any specified portion of the Works".

1(1)(g) "Contract Price" means the total value of different portions of the Works executed by the Contractor and approved by the Engineer.

1(1)(k) Due Completion Date

Add the following to the end of this definition:

This clause shall apply mutatis mutandis to any portion or phase of the Works that may be described in the Project Specification or in the Appendix to the Tender, or agreed subsequently between the Contractor and the Employer, and committed to writing.

1(1)(l) “Employer” means ______________________ Municipality acting on behalf of the Department of Water Affairs and Forestry and shall include the Employer’s duly authorised representative.

1(1)(m) For this specific contract only the word “Engineer” means any Geo-hydrologist appointed generally or specifically by the management of the firm _______________________or directly by the __________________ Municipality to fulfil the functions of the Engineer/Geo-hydrologist in terms of the Conditions of Contract.

1(1)(w) "Schedule of Rates" means the document so designated in, and forming part of the written instruction by the Engineer to the Contractor to execute the specified portion of the Works.

1(1)(z) "Works" means the Permanent Works, or any specified portion thereof together with the Temporary Works.

1(2) Delivery of NoticesAdd the following to this sub-clause:

(c) sent by facsimile, electronic mail or any like communication irrespective of it being during office hours or otherwise.

(d) posted to the Contractor's address, and delivered by the postal authorities.

(e) delivered by a courier service, and signed for by the recipient or his representative.

1(4) Governing LawThe law which is to apply to the Contract and according to which the Contract is to be interpreted shall be the law of the Republic of South Africa.

2(1)(c) Duties and Powers of the EngineerIn terms of his appointment the Engineer is required to obtain the specific approval of the Employer for the following of his functions or duties under this Contract.

(i) No extension of time to the contract period may be granted by the Engineer without the written consent of _________________ Municipality.

(ii) No variation order with a value exceeding either R1 000-00, or 10 % of the amount allowed for as contingencies for each separate task in terms of the contract, whichever is less, may be issued by the Engineer without the written consent of _________________ Municipality.

3(1) Available DataIn line 1 substitute “The Employer shall” by “The Engineer shall”

3(5) Compulsory Site Inspection / Briefing MeetingAdd to Clause 3 the following Sub-clause 3(5) :

"Should the Tender Briefing meeting be compulsory (as stipulated in the Tender Conditions) the Contractor is required to sign the official Tender Briefing Meeting Attendance List on the day of the official Site Inspection and obtain the Engineer's signature on the Tender Briefing Certificate, included in section 9 of this document. Failure to comply with the aforementioned conditions shall lead to the disqualification of a tender"

4(4) LanguageAdd the following additional sub-clause to Clause 4:

(4) The Contract shall be construed to be interpreted in English.

5 AgreementIn Clause 5 delete the words “when called upon to do so” and insert the words “within the time stipulated in the Appendix to Form of Tender, as calculated from the date of the Letter of Acceptance”.

10 SuretyshipParagraph 1 line 6 shall be continued after the words “..... the Employer” with the words “This ap-proval or otherwise shall be based upon legal opinion to be provided by the Engineer”.

Delete the word “Surety” from the penultimate line of the last paragraph and substitute “Contractor”.

12(2) Commencement of WorksOmit the contents of Sub-clause 12(2) and insert:

"The Commencement Date of the Contract shall be taken as the date of delivery of the Letter of Acceptance issued by __________________ Municipality."

The work to be carried out during the currency of the contract may be given as separate tasks. Each task to be undertaken will be issued as a written instruction by the Engineer and will consist of a detailed scope of work and relevant drawings for each particular task.

The commencement date of a particular task shall be the date the Contractor receives the instruction from the Engineer (i.e. Form BH14). The completion date for a particular task shall be mutually agreed by the Contractor and the Engineer. The penalty clause stipulated shall be applicable to each task.

(4) Property beacons and trigonometrical survey beacons that are disturbed or destroyed during the course of the contract shall be replaced at the Contractor's cost by a registered land surveyor who shall verify such replacement.

16(12) Scaling from drawingsAdd the following additional sub-clause to Clause 16:

(12) Only dimensions shown on the drawings may be used for the construction of the Works, and no dimension may be scaled without the written instruction of the Engineer.

16(13) CopyrightAdd the following additional sub-clause to Clause 16:

(13) The copyright in all documents, drawings and records related in any manner to the Works shall vest in the Employer or the Engineer or both (according to the dictates of the contract that has been entered into by the Engineer and the Employer for the Works), and the Contractor shall not furnish any information in connection with the Works to any person or organisation without the prior approval of the Employer to this effect.

21(1) Facilities for other ContractorsAdd the following to clause 21(1):

"The Contractor's attention is drawn to the fact that other services may be executed concurrently by independent Contractors under separate Contracts.

The other works which will be in progress or come into operation in the areas during the progress or tenancy of this Contract are likely to include, but are not limited to the following :

(i) Maintenance services done by ESCOM and/or the Telecommunication Services.

(ii) Activities by the Local Water Board and/or _____________________ Municipality regarding existing water infrastructure.

(iii) Equipping of boreholes by Contractors and the Water Board teams or other Contractors on an emergency basis.

(iv) Drilling or testing of boreholes in all the regions, districts and villages in the _________________ Municipality’s area of Jurisdiction.

The Contractor shall ensure that neither his operations nor his employees shall interfere with or hinder the operations of the Employer or of other Contractors and he shall indemnify the Employer against all claims arising through default of this requirement.

The Contractor shall hand over portions of the Site or Works (whether completed or not), or com-pleted portions of Works, to these Contractors when required by the Employer. The Contractor shall cause no interference with or delays in the execution of these Contracts.

No discount or commission for the Contractor is allowed on these Contracts and it will be assumed that he has fully allowed in the Contract Price for the presence of these Contractors on Site. Any services rendered or assistance given by the Contractor to these Contractors save as are contained in the Project Specifications, shall be for their accounts only since the Employer shall in no way be responsible to the Contractor for any payments in this respect.

The Contractor shall protect all existing services and all work being carried out and structures being erected on the Site by other Contractors. Any damage caused to these services or structures or any obstructions or hindrance caused to other Contractors by the Contractor and claims arising therefrom will be the sole responsibility of the Contractor.

Any repair work, improvement or removal and replacement of unsatisfactory work shall be carried out at the Contractor's expense to the entire satisfaction of the Engineer.

The same obligations shall be imposed on the Employer and on other Contractors in respect of the Works being executed under this Contract."

The Contractor shall use local sub-contractors and labour and labour intensive construction methods to the maximum extent compatible with good workmanship. The Contractor will be required to comply with the requirements of Portion 1 of the Project Specifications in this regard.

The Contractor shall indicate in his tender the extent of local employment that he expects to effect during the duration of the Contract. The sub-contract and employment data that is indicated by the Contractor in his tender will be taken into consideration during the evaluation of tenders for construction of the Works.

The Contractor will be expected to generally achieve the levels of local employment that are indicated in the Project Specifications and in his tender for the Works, failing which the Engineer shall have the right to suspend the progress of the Works or of any part thereof until the situation has been remedied and the Contractor shall not be entitled to make any claim in accordance with clause 51 in this regard. In addition the penalties referred to in Sub-Clause 46(2) shall become applicable.

23(3) Information in respect of EmployeesDelete the contents of Subclause 23(3) and insert:

The Contractor shall deliver to the Engineer, on a monthly basis, a return in detail of supervisory staff and the numbers of categorised classes of labour employed each day for the said period by the Contractor for execution of the contract. Such return shall be submitted by the seventh day of the month following the month to be reported.

24(1) Training of Local LabourAdd the following to Clause 24 :

It is expected from the Contractor that all people employed for the execution of labour based work, shall be properly trained and assisted in the execution of the works. (This must be done for all levels of employment).

26(3) Information in respect of PlantDelete the contents of Sub-clause 26(3) and insert the following :

The contractor shall deliver to the Engineer, on a monthly basis, a detailed inventory of Constructional Plant kept on site, full particulars given for each day of the month. Distinction shall be made between plant in working order and plant out of order. Such inventory shall be submitted at the monthly site meeting or by the seventh day of the month following the month to be reported on.

38(1) InsuranceAdd to Subclause 38(1)(a)(ii)bb :

The value of materials to be provided by the Employer shall be deemed to be R0-00 for insurance purposes.

Delete Subclause 38(1)(d) and substitute :

The following additional or varied insurances are to be provided by the Contractor under this Contract : None

38(3) Employer to approve Insurance CompanyClause 38(3) shall be deleted and replaced by :

The insurance’s referred to in Subclause (1) shall be effected with an insurance company registered in the Republic of South Africa and the terms thereof shall be subject to approval by the Employer based on legal opinion to be provided by the Engineer. The approval shall not be unreasonably withheld.

38(4) Proof of PaymentAdd the following paragraph to Sub-Clause 38(4):

Proof of insurance shall be submitted to the Employer prior to Commencement of the Works (Clause 12), and copies of the policies and proof of due payment of all premiums shall be presented to the Employer within twenty eight (28) days of the Date of Commencement.

38(7) Workmen's CompensationAmend Clause 38(7) to read as follows:

The Contractor shall provide proof that he has paid all contributions that are required in terms of the provisions of the Workmen's Compensation Act (Act No. 30 of 1941, as amended) within 28 days of the Commencement Date.

46.3 Notwithstanding the above, should the Contractor fall behind schedule on the programme furnished in terms of Clause 15 hereof or any adjustment thereto in terms of Clause 45 hereof, then the Engineer shall give the Contractor 7 days, after written instructions to make up the leeway. Should the Contractor fail to draw level with the said programme, then the Engineer shall have the right to appoint any other Contractor to assist the Contractor under this Contract to recover lost time, or execute the remainder of the Contract on the Contractor's behalf.

All costs thus incurred shall be for the account of the Contractor under this Contract.

If the provision of Sub-clause 58(1)(i), (ii) or (iii) apply, the employer shall be entitled to cancel the contract without further notice to the contractor, his trustee or liquidator, and to appoint another contractor, as determined in the sole discretion of the employer, to complete the works.

In such event, and notwithstanding any other provisions contained in this contract, the Employer shall be entitled to retain any and all amounts which may then be due to the contractor, whether certified or not, and to utilise such amounts for purposes of making payment to the other contractor appointed by the employer to complete the works.

PORTION 1: THE WORKS[This portion to be adjusted to suite the project]

1 PS1 GENERAL DESCRIPTION OF THE WORKSThis contract comprises the drilling of boreholes in ____________________ Municipality’s area of jurisdiction. Detail of the Works is included in clause PS3 hereof.

2 PS2 DESCRIPTION OF SITE AND ACCESSThe work to be undertaken is generally in or near existing villages in the magisterial districts of _______________, _____________________, _______________________, ____________________, ________________ and _________________ . The access to the individual sites is generally ____________ and it can be expected that four wheel drive vehicles would generally be required.

The drilling positions will be marked on the ground and pointed out to the Contractor by the En-gineer.

Should access to a site prove to be difficult the onus is on the Contractor to make a genuine at-tempt to reach that site. In the event that access cannot be gained, the Contractor will have the right to charge standby time if no other positions are available to him. The attempt will be monitored by the Engineer who will rule whether such an attempt was satisfactory and will give appropriate instructions. Refusal to make an attempt to gain access to a site will be treated as breach of Contract.

3 PS3 DETAILS OF THE CONTRACTThe contract is a term contract of works to be executed in accordance with the tendered Bill of Rates. The contract entered into between the client and contractor shall be binding for _______ year(s) from date of letter of appointment but can be extended for another year.

The work comprises the drilling or rehabilitation of boreholes, installation of casing, construction, development and sealing of boreholes as part of __________________________ Municipality "Community Water's Supply Programme". Boreholes to be rehabilitated might be equipped in which case equipment shall be removed and possibly reinstalled after rehabilitation in full working condition as before rehabilitation.

It is anticipated that borehole depths will range between 40 m and 150 m, but no guarantee can be given in this regard.

The operational area is reflected in the locality plans.

Tenderers are to take note of the fact that the drilling of boreholes is to be executed by established contractors from whom it will be expected to allocate a part of their work to emerging contractors.

The proportionate distribution of work between the established contractor and emerging contractors will be discussed in detail at the tender briefing meeting. Although not foreseen at this stage, it may happen that it will be expected of the Contractor to execute some work outside the existing borders of the __________________ Municipality‘s Area of Jurisdiction. If the Tenderers have any objection to this issue, these must be clearly indicated in Part 9, i.e. Alterations by Tenderer, in this document.

The works orders given to the successful tenderer or tenderers will be based on the accepted rates and scope of work as decided by the Client. The work to be carried out during the currency of the contract may be ordered as separate batches. Each batch to be undertaken will be issued as a written instruction by the Engineer/Hydrogeologist and will consist of drilling operations within selected communities and districts.

The value of work to be carried out as stipulated in the order will include ten percent to be used as contingencies in accordance with the general conditions of contract. The estimated value of total work to be done in this Municipality’s Area of Jurisdiction is : R_____________ . No guarantee can however be given regarding the expenditure of this amount. The actual expenditure for the contract period may exceed or may be less than the estimated amount.

4 PS4 GEOLOGICAL AND GEOHYDROLOGICAL DATAExisting geological data are available on request. These include reports of the anticipated drilling conditions from existing records and no claims for misinterpretation will be entertained. The fol-lowing descriptions are intended to assist the Contractor in preparing his Tender only and depar-tures in depth and geological conditions are to be expected.

No claims for extra payment for such variations will be entertained nor do such variations relieve the contractor from any responsibility hereunder nor from fulfilling any or all of the terms and re-quirements of this Contract. The major rock types present within the region include:

5 PS5 CONSTRUCTION PROGRAMME5.1 PS5.1 Information to be made available

A large number of boreholes to be drilled are still to be sited. Prior to the drilling activities, target borehole drilling rates will be provided by the Engineer to the drilling Contractors indicating the various drilling sites. The drilling programme to be undertaken within a specific area/district will only be available approximately one week in advance. Close collaboration between the Project Engineer (or his representative), the nominated Geohydrologist and the Contractor must be maintained at all times.

5.2 PS5.2 Interruption in work scheduleIf information or particulars on new drilling sites as mentioned in clause PS4, or boreholes to be rehabilitated, is not available from the Client for any period of time, the Contractor will be ordered in writing to discontinue work in that specific region or site. When the Contractor is requested to resume work, establishment costs will be paid as if the Contractor had moved in from another borehole or his base camp, which ever the situation may be. Establishment costs shall be as per tendered rates. No adjustment will be made to any of the rates in the Bill of Rates.

No Time Related Preliminary and General charge will be payable for the period from discontinuation of work until re-continuation of work.

5.3 PS5.3 Format and ApprovalAs soon as information is available with regard to a batch of boreholes to be drilled, the Contractor shall supply within one week a suitable and realistic construction programme for the consideration of the Engineer. This programme shall show the proposed scheduling and methods of execution of the Works and the resources to be allocated to each item or phase of the work. Quantities proposed for execution during each month and the anticipated cash flow based upon these quantities should be shown, due allowance being made for price escalations and retention moneys.

The Contractor will be expected to progress with the Works in accordance with the approved programme and shall not deviate from the order of execution shown in the programme without the prior approval of the Engineer or his Representative. Should such approval be given, an adjusted programme shall be produced within 7 days and submitted to the Engineer for evaluation. Progress in advance of the programme on a certain portion or phase of the Works shall not be con-sidered adequate reason for poor progress on another portion or phase.

5.4 PS5.4 Partial Completion and Monthly take overBoreholes that have been drilled will be taken over once per month in a batch for which a Certifi-cate of Completion will be issued. The maintenance period on the work completed will commence with the issuing of the Certificate of Completion. The retention on the completed work will be reduced to fifty percent of the amount of retention (ten percent) to a maximum of five percent of the estimated value of work. Boreholes that have been drilled will not be taken over by the ________________ Municipality or paid for unless the drilling reports on the boreholes have been signed and handed over to ___________________ Municipality.

6 PS6 SITE FACILITIES AVAILABLE6.1 PS6.1 Camp and Depot

No specific area can be made available within the ____________________ Municipality’s Area of Jurisdiction to the Contractor for erection of his camp and depot, where materials and plant can be stored and from which the administration of the contract could be undertaken by the Contractor. All arrangements in this regard must be made by the Contractor himself.

6.2 PS6.2 Water SupplyWater supply will not necessarily be available at the camp or depot and all arrangements in this regard must be made by the Contractor, to his own account.

6.3 PS6.3 Power SupplyPower supply will not necessarily be available at the camp or depot or at boreholes to be drilled and all arrangements in this regard must be made by the Contractor, to his own account.

6.4 PS6.4 Ablution FacilitiesNo ablution facilities are available at the camps and depots or at boreholes to be drilled and all arrangements in this regard must be made by the Contractor, to his own account.

6.5 PS6.5 HousingShould the Contractor wish to house personnel on site, he shall make the necessary arrangements with the controlling authorities for any approval that may be required.

7 PS7 SITE FACILITIES REQUIRED7.1 PS7.1 For the Contractor

Whatever may be required for the satisfactory execution of the Contract.

7.2 PS7.2 For the EngineerAs specified under PSAB. [This clause to be filled in if required].

8 PS8 FEATURES REQUIRING SPECIAL ATTENTION8.1 PS8.1 Bill of Rates Contract

The Contractor’s attention is drawn to the fact that the contracts are Bill of Rates Contracts. The individual rates for drilling of boreholes shall not be altered for any reason or claim. Additional payment for time related preliminary and general aspects and establishment costs will only be paid as specified in the contract document.

The standard drilling method to be employed for the drilling of boreholes for rural community water supplies will be that of rotary air percussion. The use of other drilling methods (mud-rotary and odex) and specialised borehole construction methods may be required in some instances where specialised geological drilling conditions prevail. The use of and rates for specialised drilling and borehole construction methods must be approved by the Client prior to their application.

Tenderers are to take note that the drilling contractor should have at all times two complete drilling rigs available for this contract.

9 PS9 APPLICABLE STANDARDISED AND PARTICULAR SPECIFICATIONSFor purposes of this contract, the standardised Specifications listed under Part 4 of this docu-ment shall apply to the Works.

10 PS10 MINIMUM WAGESContractors must always keep in mind that the minimum wages payable to labourers must at all times adhere to “Minimum Wage Legislation” for the particular area in question.

It is also expected/required from all tenderers to submit, with their tender, a detailed breakdown of rates, which is connected in some or other way to remuneration or labourers. The reasons

therefore being that, if necessary, “rate adjustments” can be made if there is a change in the minimum rate legislation.

11 PS11 ABNORMAL RAINFALLThe extension of time to be allowed for due to abnormal rainfall shall be calculated by the formula:

V = (Nw - Nn) + (Rw - Rn) /20

Where

V = Extension of time in calendar days for the calendar month under consideration.

Nw = Actual number of days during the calendar month on which a rainfall of 10mm or more has been recorded.

Rw = Actual total rainfall in mm recorded during the calendar month under consideration.

Nn = Average number of days for the calendar month on which a rainfall of 10mm or more has been recorded, as derived from existing rainfall records.

Rn = Average total rainfall for the calendar month, as derived from existing rainfall records.

Where the extension of time due to abnormal rainfall has to be calculated for portion of a calendar month, pro rata values shall be used. Should V be negative for any particular month and should its absolute value exceed the corresponding value of Nn then V shall be taken as being equal to minus Nn. The total extension of time to be granted shall be the algebraic sum of all the monthly extensions, provided that if this total is negative then the extension of time to be granted for abnormal rainfall shall be taken as zero.

PORTION 2: VARIATIONS TO STANDARD SPECIFICATIONS AND ADDITIONAL CLAUSESPA DRILLING OF BOREHOLES

1 PA1 SCOPEThe specifications are for the drilling or rehabilitation of boreholes, installation of casing, con-struction, development and sealing of boreholes for rural water supply. No guarantee as to the final number of boreholes to be requested under this contract is made. Boreholes to be rehabilitated might be equipped in which case equipment shall be removed and possibly reinstalled after rehabilitation.

The Contractor shall provide all labour, transport, plant, tools, materials and appurtenances, and shall perform all work necessary to satisfactorily construct and complete the boreholes in accordance with this Specification and to any further details as may be ordered by the Engineer. The borehole depths will be dependent on results and the strata intersected.

2 PA2 MATERIALS TO BE USED2.1 PA2.1 General

All materials to be used shall be new and undamaged and shall be supplied and delivered as such on site.

2.2 PA2.2 Steel Casing (Plain)(a) All casing shall be new and of an approved standard and shall be as specified in the

Schedule of Rates. All casing shall have a minimum wall thickness of 4 mm and shall be bevel edged with lugs or threaded to accomplish positive mechanical interlock. Casing shall be installed to depths as specified by the drilling supervisors. After completion of the work, the casing shall protrude a minimum of 500 mm above natural ground level.

(b) The casing shall be of the diameter specified, manufactured of high tensile steel, self-aligning and suitable for ramming and from approved suppliers. It must be possible to uplift, disconnect and re-use the casing.

2.3 PA2.3 Slotted Steel CasingWhere collapsing conditions are present at the water bearing horizon, slotted casing shall be installed over the affected zone to depths determined by the Engineer. The manner in which slots are to be cut is shown in drawing __________________. Width of the slots shall be 3 mm minimum and 4 mm maximum. Wall thickness shall be 4 mm minimum. The slots shall be of uniform width with no resultant protrusions and shall be clear of debris. Steel casing shall comply with the requirement of clause PA2.1.

2.4 PA2.4 uPVC CasingUnder certain geohydrological conditions the contractor may be instructed by the Engineer to install uPVC causing into a borehole. The casing shall be of standard diameter and wall thickness as supplied by approved suppliers. Design stress will range between 9 and 16 bar, and joining shall be thread designed, to be flush internal and external.

2.5 PA2.5 Temporary CasingDue to particularly difficult drilling conditions in certain areas, the insertion of temporary casing during drilling conditions may be necessary. This casing must also comply with the requirements of clauses PA2.1 & PA2.2 with the exception that the wall thickness may be less than 4 mm.

2.6 PA2.6 Other materialsCasing clamps and all other such items as are required in the construction of the boreholes shall be assembled in an approved manner and in accordance with normal groundwater engineering practice.

3 PA3 DRILLING EQUIPMENT(a) The equipment to be used must be of such standard that the requirements as set out in

paragraph PA1 can be accomplished without any disruption of the works.

(b) The Contractor shall specify in the Schedule of Plant and Equipment the type of plant he intends to use as well as the method of operation. Its capacity shall be sufficient to cope with the work as specified for each particular drilling programme. It shall be kept at all times in full working order and good repair. The Engineer will reserve the right to inspect the equipment to be used for the completion of the Works prior to the commencement of the Works.

(c) If the Engineer considers that the plant in use on the site of the Works is in any way inefficient or inadequate in capacity, he shall have the right to call upon the Contractor to put such equipment in order within seven (7) days, or alternatively, to remove such plant and replace it with additional plant or equipment which he considers necessary to meet the requirements of the Contract. In the event that this requirement is not satisfied, the Engineer reserves the right to advise the Client to terminate the Contract immediately.

Equipment brought onto the site may not be removed therefrom without the Engineer's specific permission in writing.

(d) It will be the responsibility of the Contractor to arrive on site with all equipment and chemicals required to complete the work without interruption, an arc welding machine and oxyacetylene torch must be available on site at all times.

(e) Where existing equipped boreholes are to be rehabilitated, the Contractor must provide suitable plant to enable the installed pumping equipment to be removed and reinstalled. This includes the removal and reinstallation of hand pumps, windmills and motorised pumps.

(f) It will be the responsibility of the Contractor to ensure that all drilling related equipment and tools (including vehicles, trucks, compressors, etc.) are clean and do not pollute the environment in any way. In the event of such pollution (including oil leaks, spillage, etc.) it will be the responsibility of the Contractor to clear up such pollution at his cost.

4 PA4 BOREHOLE CONSTRUCTION4.1 PA4.1 Design and Depth

Various borehole design options will be employed. These are shown in drawings ____________________ to ____________________. The decision as to which design to use will be made by the Engineer while drilling is in progress. The Engineer will base his decision(s) on geological conditions encountered as well as the final diameter to which the borehole must be completed.

It is anticipated that borehole depth will vary between 40 m and 150 m. The final borehole depth will be determined by the Engineer and shallower boreholes than requested will not be acceptable and will not be paid for, unless it can be proved that the hole cannot be drilled to the required depth.

The final choice of borehole design can only be made when drilling has penetrated below the water table in the overburden or into the hard bedrock, whichever occurs first.

4.2 PA4.2 DiameterDrilling diameters will be 152mm(6"), 165mm(6,5"), 203mm (8"), 254mm(10") and 305mm(12”). Any variation must be acceptable to the Engineer.

4.3 PA4.3 Drilling TechniquesThe standard drilling technique shall be the air percussion rotary drilling technique unless otherwise ordered by the Engineer. The standard drilling technique shall further include the necessary facilities with adequate capacity to consistently introduce lubrication water and/or foam as required. A full foam and water system must therefore be fitted to the drilling rig.

The Engineer may alternatively order the use of Odex air percussion drilling techniques. Mud rotary drilling techniques could also be employed.

In exceptional cases, the Engineer may permit the use of cable tool (jumper) rigs. The latter method may also be applicable for cleaning and rehabilitation of existing holes (as and when permitted by the Engineer).

4.4 PA4.4 Drilling MediaThe Contractor may not use drilling media which may cause hole erosion or involve the use of clay, oil, salt or any lost circulation agent, sawdust, cement, or any form of plugging that could affect the production capacity of the water bearing strata intersected.

In the event of circulation losses, commercially available foam can be introduced during drilling operations. Steel tanks or an approved equivalent with a capacity of 4 000 litres shall be used in which to mix and hold all drilling fluid.

4.5 PA4.5 Sanitary SealEach borehole shall be completed with a sanitary seal as indicated on drawings __________________ to ________________. The purpose of a sanitary seal is to prevent the ingress of potentially contaminated surface water into the borehole via the annular space between the borehole side wall and the outside of the casing.

The seal shall extend to a minimum depth of 5m below surface, and will entail the drilling of a 305mm diameter hole, in which a 254mm diameter steel casing will be placed using centralisers at the bottom to ensure that the casing is placed in the centre of the hole. In exceptional cases the Engineer may decide to alter the drilling and casing diameters, but will not exceed the aforementioned diameters. Four equally spaced flat bars of appropriate size, welded to the sides of the casing can be used as centralisers. The seal must consist of Portland Cement (quick drying) mixed to a slurry with bentonite and water which is free of oil and organic matter. The bentonite and water should be thoroughly mixed prior to adding and mixing with cement. The Contractor is to use a suitable method in placing the sanitary seal to ensure complete filling of the void between the casing and borehole. Care should be taken not to leave any voids in the sanitary seal.

4.6 PA4.6 Formation StabiliserWhere collapsing conditions are found, formation stabiliser is to be inserted in the annular space at a depth specified by the Engineer. Formation stabiliser material shall be rounded, uniform and clean gravel with a grain size varying between 6 and 14 mm. Sieved and washed river gravel can also be accepted. Samples of formation stabiliser must be submitted to the Engineer for approval before placement.

The purpose of a formation stabiliser is to prevent collapsing particles from entering the borehole through the slotted casing. Such collapsing particles may have an effect on the boreholes yield.

4.7 PA4.7 Drilling and Construction of BoreholesThe drilling shall be carried out with the least possible delay in order to run the casing as re-quired.

All boreholes shall be presented for testing, free of all bridging and obstruction to the bottom. Any time spent in conditioning holes or removing obstructions shall be at the Contractor's ex-pense.

In case where the drilling and/or the final construction of a borehole are contentious or being disputed it may be necessary to carry out Down-hole Geophysical Logging exercises to resolve the problem.

Should Down-hole Geophysical Logging be required, the consulting Engineer / Hydro-geologist will issue specific instruction in writing to the Contractor.

If the Down-hole Geophysical Logging indicates borehole construction not to specification the Contractor shall re-drill the borehole or remediate the borehole construction of the borehole in question at his own cost to specification and bear the cost of Down-hole Geophysical Logging. Should Down-hole Geophysical Logging indicate borehole construction to specification the Contractor will be paid for the cost of the Down-hole Geophysical Logging.

4.8 PA4.8 Straightness and Verticality(a) Straightness

Boreholes shall be sufficiently straight to permit a steel tube 6 m in length and with outer diameter no more than 15 mm smaller than the inner diameter of the cased borehole, to be lowered without hindrance to the full depth of the particular borehole. Any deviation

which prevents the lowering of such plumb to the bottom of the borehole will not be accepted, and the hole declared a lost borehole. The Contractor shall, in such case, re-drill the hole at his own cost to specification.

The Contractor shall supply the above piping, complete with the necessary attachments and equipment required for testing straightness, and ensure that it is available at the drilling machine and such piping shall form part of his standard equipment.

All cost involved to perform a straightness test (i.e. supply/manufacturing of required equipment and the test procedure) will be at the Contractor’s expense, and should be included in the drilling rates as specified in the Schedule of Rates (Part 7).

(b) Verticality

The centre of the borehole at any depth shall not deviate from the vertical through the centre of the borehole at the top by more than one-third (1/3) of the borehole diameter per 30 m of depth.

The diameter of the deviation of a borehole from the vertical shall be carried out in accordance with latest issue of SABS 045. The apparatus referred to in SABS 045 shall be supplied by the Contractor and shall form part of his standard equipment under this Contract.

In the event that these requirements for verticality are not met, the borehole will be declared a lost borehole. The Contractor shall thereupon re-drill the hole at his own cost, to specification.

All cost involved to perform a verticality test (i.e. supply/manufacturing of required equipment and the test procedure) will be at the Contractor’s expense, and should be included in the drilling rates as specified in the Schedule of Rates (Part 7).

4.9 PA4.9 DevelopmentOn completion of construction the water borehole shall be developed to a maximum yield of water, free of suspended materials. Development shall be carried out using either air surging, double swab air jetting, water jetting or such other standard techniques as may be directed by the Engineer.

Development shall be continued for the period directed by the Engineer.

4.10 PA4.10 Formation SamplingWhere directed by the Engineer, representative samples of the strata intersected shall be collected every one metre. The Contractor shall take every possible precaution to guard against sample contamination due to hole erosion or collapse. These samples shall be placed at sequential piles in ordered rows at a location away from the immediate area of activity. Cuttings samples shall be bagged, labelled with the borehole number and depth increment, and stored in a position where they will not be contaminated by site conditions or drilling operations.

4.11 PA4.11 DisinfectionOn completion of development the borehole shall be disinfected with a solution of 0.5kg of HTH mixed in 250 litres of water.

4.12 PA4.12 Protection and marking of boreholesDuring the contract period when work is not in progress, the boreholes shall be kept capped in such a manner as to prevent the entrance of foreign material. The Contractor shall remove any foreign matter at his own expense. On completion of each borehole, the Contractor shall cap the borehole with a 4 mm thick metal plate, adequately welded to the protruding borehole casing. Upon completion of the above, the borehole number allocated by the Engineer will be affixed as detailed on drawing no. ____________________ to ___________________. The following information must be punched (i.e. 10 mm letter/fig size) or script-welded onto the borehole cap :

(i) Borehole number

(ii) Depth of borehole

By neglecting to close a borehole after drilling, or if the borehole was not closed according to the specifications, the contractor will be responsible to rehabilitate the borehole or drill a new borehole at his own expense, if it is found that the contractor was at fault.

4.13 PA4.13 Concrete CollarEach successful borehole shall be completed with a concrete collar of dimensions not less than indicated and sunk into the ground. The collar shall be made of approved aggregate, river sand and cement. The strength must be 20 MPa after 28 days.

4.14 PA4.14 Finishing and TrimmingOn completion, the sealed casing must protrude a minimum of 500 mm above the natural ground level.

All completed work shall be trimmed and all the debris of construction, such as unsuitable or rejected materials, spillage and cuttings shall be removed.

The site of the work shall be cleaned of all rubbish, excess materials, false works, temporary structural installations and abandoned equipment.

All construction scars resulting from this contract shall be treated to blend with the contour and vegetation of the surroundings.

4.15 PA4.15 Stone Plugging Of Unsuccessful BoreholeWhere directed by the Engineer, an unsuccessful borehole shall be plugged as detailed on drawing no __________________. The following information must appear on the concrete :

(Letters can be scratched in concrete while still wet)

(i) Borehole number with the affix "D"

(ii) Depth of borehole

(iii) Date drilled

5 PA5 CESSATION OF DRILLING ACTIVITIESThe termination, at any stage, of drilling operations on a particular borehole shall rest with the Engineer.

6 PA6 ABANDONMENTThe Engineer shall have the right at any time during the progress of the work to order the abandonment of the borehole. The Contractor shall thereupon remove the plant, withdraw the casing and salvage or attempt to salvage all such materials as the Engineer shall direct and/or up until the Engineer revokes such direction, and shall fill up or leave the borehole to the satis-faction of the Engineer. No payment will be approved for any casing left in the borehole which has been abandoned or has an inadequate water supply unless the Engineer has satisfied him-self that the casing cannot be salvaged and has certified this in writing. An abandoned borehole shall be plugged as per drawing ______________________ and paid for as per tendered rates.

7 PA7 LOST BOREHOLEShould accident to the plant, behaviour of the ground, jamming of the tools or casing, non-compliance of the straightness on verticality test (as specified in clause PA4.8) or any other cause, prevent the satisfactory completion of the works, the borehole shall be deemed to be lost and no payment shall be made for the drilling costs nor for any materials, nor for any time. The cost of materials which have been recovered but are in a damaged state are borne by the Contractor. Should the materials recovered be in good order, then the Contractor shall have no claim for such materials and will have the option to re-use such materials within the scope of the project. A lost borehole shall be plugged as per drawing ________________.

In the event of a lost borehole, the Contractor shall construct a new borehole adjacent to the lost borehole, on a site indicated by the Engineer. The option of declaring any borehole lost shall rest with the Contractor, subject to directions from the Consultant.

No payment whatsoever will be made for the lost borehole. Measurement and payment for the construction of a borehole adjacent to the lost borehole, shall be in accordance with the specifications of any other borehole included in this document, provided that the specifications therefore are met.

8 PA8 WATER SAMPLESTwo types of water samples shall be collected on completion of the development of each borehole, as directed by the Engineer. A one litre sample shall be collected for analyses of the main chemical element concentrations, and a separate sample shall be collected for bacteriological analysis.

9 PA9 REPORTSThe contractor shall provide the following reports to the Engineer :

Construction Long An accurate record of all casing and screens run into the borehole, and quantities of all other materials used, such as cement.

Daily and summary completion submitted to engineer for signature

The Contractor shall not be paid for any boreholes drilled or casing installed unless the above-mentioned reports have been submitted within 14 days after the commencement of the drilling of a borehole. A drilling report form BH13, must be submitted with each payment certificate.

10 PA10 SAFETY STANDARDSThe contractor shall adhere to the Mines and Works Act Safety Regulations and the Occupational Health and Safety Act (Act 85 of 1993).

11 PA11 REHABILITATION OF EXISTING BOREHOLESWhere existing boreholes are ordered by the Engineer to be rehabilitated payment will be made on a time basis, to cover all time spent carrying out the rehabilitation, including the setting up of the drilling rig, drilling and cleaning, insertion of casing, developing and removal of drilling equipment. The Contractor must make provision in his rates for all risks attached to the rehabilitation of boreholes.

This clause does not cover the return of the Contractor during the 12 month maintenance period to a borehole previously drilled by the Contractor. Payment for additional casing inserted into the borehole shall be made as per the Bill of Rates.

12 PA12 DECOMMISSIONING OF BOREHOLESAny borehole whether production, exploratory or observation shall be properly decommissioned when it is no longer useful or productive. Typical reasons for decommissioning could include the following:

(i) The water production ceases or falls to an unacceptably low level and rehabilitation is not possible;

(ii) Water quality deteriorates to a level where it is not suitable for use;

(iii) When equipment is lost down the hole and cannot be recovered, making pump installation or use as an observation hole impossible;

(iv) When deemed not useful for monitoring of water level or water quality;

(v) When deemed necessary by the Engineer/Client;

(vi) When a borehole intercepts a water strike of undesirable water quality and threat of contamination of good quality water exists, or;

(vii) The boreholes becomes redundant.

One or more of the following techniques for decommissioning may be instructed by the Engineer:

12.1 PA12.1 Capping(a) Welded steel capping

This technique will be applied when the borehole construction is such that it does not pose a threat to the aquifer, and the possibility of future use exists for the borehole (e.g. Observation Borehole). The method shall consist of welding a cover to the top of the protruding casing in such a manner that no surface water or pollution may enter the borehole. The cap shall have a number welded onto it so that the borehole can be positively identified.

(b) Concrete capping (when future use does not exist)

This technique will be applied when the borehole construction is such that it does not pose a threat to the aquifer, and the possibility of future use does not exists for the borehole, the borehole shall be capped with a concrete surface plug. The method shall consist of removing or cutting the surface casing, removing surface material for a diameter of not less than one metre and a depth of not less than one metre or to solid rock, plugging the borehole with concrete to a minimum thickness of 0.5m, and filling the excavation up to the natural ground surface level. For detail see drawing No. __________________.

12.2 PA12.2 BackfillingWhen the borehole requires backfilling, this shall be done with either the original drill cuttings or suitable material, which will not pose a pollution threat to the aquifer. After backfilling the borehole shall be capped as described in PS12.1(b) above.

12.3 PA12.3 GroutingGrouting shall consist of introducing cement grout to the threatened borehole section(s) by means of a tremie pipe or similar means. The borehole section(s) where no pollution threat exists can be backfilled and the borehole capped as described in PS12.1(b) above.

12.4 PA12.4 BentoniteBentonite may be used instead of grout in sensitive aquifers, with a high risk of pollution from the surface.

13 PA13 MEASUREMENT AND PAYMENT13.1 PA13.1 General

The Contractor under this Contract is considered to be an experienced water well driller and is expected to organise and carry out the work specified hereunder in an expert manner. Drilling problems encountered will be overcome entirely within the framework of this Specification and Schedule of Rates, and no claims for extra payments will be entertained for problems foreshadowed in the Specification or due to limitations placed by this Specification.

13.2 PA13.2 DrillingThe rates for drilling are based on diameter and shall cover all the costs involved in drilling, including foam mixing, injection mixers, bit sharpening, for tripping in and out of the hole and all other works as are associated with the drilling, and are not covered under other payment items,

The rates for Odex drilling are based on diameter and shall cover all the cost involved in drilling, supply and installation of at least 6mm side-wall odex casing Unit: m

13.3 PA13.3 Supply, Delivery and Installation of borehole casingThe rates for casing of varying sizes shall cover the cost of supply, transport, delivery, safe storage on site, and the installation of casing in boreholes. Payment will be made only for materials used and shall be calculated for each completed hole. No claim for extra payment will be entertained by reason of remoteness, wharfage, insurance etc. or by reason of omission in calculating the tender rates Unit : m

13.14 PA13.14 Standing TimeThis time rate is to cover only those items when the rig and crew or, if more than one rig and crew are fielded, when all rigs and crews are idle waiting for decisions by the Engineer or Employer where those decisions or whose presence is required before the commencement of drilling operations or for the continuation of the work. Under no circumstances will Standing time be payable for any delays other than those incurred by the Engineer's or Employer's decisions Unit : Hr

Important Notes : The Contractor must make provision for one hour standing time per borehole to allow time for logging of the borehole geophysically and to determine optimum casing installation (slotted and blank casing). Provision for this must be made in the per metre drilling rate. No separate payment will be made for standing time (up to 1 hour) resulting from the abovementioned activities.

No standing time will be payable due to inclement weather, or prevention of access to site by the Contractor or Engineer due to inclement weather.

13.15 PA13.15 Inter-hole MovesPayment shall be made as follows :

(a) A unit rate per borehole for a move up to 10 km Unit : No

(b) Moves in excess of 10 km, a kilometre rate to be paid over and above PA13.15 (a) above from kilometre 11 and thereafter (payment to be made only for full kilometres and not portions of kilometres) Unit : km

13.16 PA13.16 Reaming of BoreholesWhere a borehole has previously been drilled to a smaller diameter than that required, the original borehole shall be reamed to the required diameter. The rate for the hole to be reamed shall include all the costs incurred for the reaming as more specifically set out in paragraph PA11. The Contractor shall be paid a rate per linear metre for each hole to be reamed to a specified diameter. It may happen that the original borehole diameters will vary from site to site. See item 2.15 in Schedule Of Rates Unit : m

13.17 PA13.17 Rehabilitation of BoreholesWhen instructed by the Engineer, the Contractor is to rehabilitate existing boreholes.

The rates is to include the temporary establishment of the Contractor at the specified borehole, the setting-up of the drilling machine and the drilling actions required to clean the borehole to the

PREAMBLE TO SCHEDULE OF RATES(i) This Schedule of Rates forms an integral part of the Contract Documents as listed in the

Schedule of Documents and shall be read in conjunction with the General Conditions of Contract, the Special Conditions of Contract and Subcontract, the Specifications and the Drawings.

(ii) For the purposes of this Schedule of Rates, the following words shall have the meanings hereby assigned to them:

Unit : The unit of measurement for each item of work as defined in the Specifications.

Quantity : The number of units of work for each item.

Rate : The payment per unit of measurement at which the Tenderer tenders to do the work.

Amount : The product of the quantity and the rate tendered for an item.

Sum : An amount tendered for an item, the extent of which is described in the Schedule of Rates or in the Specifications or elsewhere, but the quantity of which is not measured in any units in the Schedules.

(iii) The short description of the items in the Schedule of Rates are for identification purposes only, the work covered by the items being fully specified in the relevant payment clauses in the Specifications. Orders shall only be placed for materials by the Contractor in accordance with wings issued for construction, and not from the scheduled quantities.

(iv) The payment references appearing in the Schedule of Rates refer to the corresponding payment references in the Specifications.

(v) The units of measurement indicated in the Schedule of Rates are metric units.

The following abbreviations are used in the Schedule of Rates:

(vi) Unless otherwise stated, items are measured nett in accordance with the Drawings, and the Contractor must allow in his rate for waste.

(vii) All rates and sums of money quoted in the Schedule of Rates shall be in Rands and whole cents. Fractions of a cent shall be discounted.

(viii) Except for Sum Amounts the quantities set out in the Schedule of Rates are approximate and do not necessarily represent the actual amount of work to be done. The quantities of work accepted and certified for payment, and not the quantities given in the Schedule of Rates, shall be used for determining payments to the Contractor.

(ix) Excepting where Sum Amounts are required or where Provisional Sums have been indicated, the Tenderer shall enter an applicable rate in the Rate Column of the Schedule of Rates for each scheduled item. He shall also enter an applicable sum in the Amount column for each scheduled item. The Contractor will not be paid for items against which no rate or lump sum has been entered in the tender, as it is assumed that the Contractor does not wish to receive payment for any such work.

Should the Tenderer group a number of items and tender one lump sum for such group of items, this single lump sum shall apply to that group of items and not to each individual item.

Should the Tenderer indicate against any item that compensation for such item is included in another item, the rate for the item included in another item shall be deemed nil.

The Tenderer shall fill in a rate against all items where the words "rate only" appear in the Amount column, which rate will constitute payment for work which may be done in terms of this item. Such "rate-only" items are used where it is estimated that little or no work will be required under the item or where the item is to be considered as an alternative to another item for which a quantity is given.

A tender may be rejected if any rates or lump sums in the Schedule of Rates are, in the opinion of the Employer, unreasonable or out of proportion.

(x) The Tenderer is at liberty to insert a rate of his own choosing for each item in the Schedules; in this regard his attention is drawn to the fact that the Contractor has the right, under various circumstances, to payment for additional works carried out and that the Engineer is obliged to base his assessment of the rates to be paid for such additional work on the rates inserted in the Schedules by the Contractor.

(xi) Errors of extension and addition as entered in the Tender will be corrected by the Employer in determining the Accepted Tender Value; but rates shall be binding.

(xii) Payment based on the rates tendered in this Schedule of Rates shall cover all the services and incidentals included in the Works covered by the Contract and shall be made in accordance with the General Conditions of Contract, the Special Conditions of Contract, the Specifications and Drawings and the Agreement pertaining to the Contract.

(xiii) The Contract Price for the completed Contract shall be computed from the actual quantities of authorised work done to the satisfaction of the Engineer, valued at rates tendered against the respective items in the Schedule of Rates and shall include such authorised Provisional Sums and items of extra work as have become payable in terms of the Contract Documents.

(xiv) Where the Contractor is required to furnish detailed drawings and designs or other information in terms of the Contract Documents, all costs thereof shall be deemed to have been provided for and included in the unit rates and sum amounts tendered for the items scheduled in the Schedule of Rates, and separate additional payments will not be made.

(xv) The Tenderer must price each item in the Schedule of Rates in BLACK INK.

(xvi) Value Added Tax shall be excluded from the rates and sums tendered for the various items of work included in the Schedule of Rates.

Value Added Tax shall be entered as a single item, calculated at 14% on the total tendered amount, as provided for in the Summary of Schedules- Part 7.

(xvii) The approximate expected value of works as set out in the Appendix to the Tender, is to provide the tenderer a basis for determining whether a tender should be submitted. The individual rate tendered for all work to be done or material to be supplied shall not be adjusted if the actual contract price for the completed contract is different from the approximate expected value of the works, or any other reason, but shall remain fixed for the period of the contract.

WHEREAS

1. The Employer is desirous that the Works included in the Contract should be supplied, delivered, constructed, completed and maintained by the Contractor; the Parties and the Contract being as defined above; and

2. The Employer has accepted a tender by the Contractor for such supply, deliver , construction, completion and maintenance of the Works.

NOW THIS AGREEMENT WITNESSETH as follows:

1. In this Agreement words and expressions shall have the same meanings as are respectively as-signed to them in the Conditions of Contract that are referred to below.

2. All the documents that are listed in the SCHEDULE OF DOCUMENTS (Part 1 of Volume 1 of the tender and contract documents) shall be deemed to form and to be read and to be construed as part of this Agreement.

3. In consideration of the payments that will be made by the Employer to the Contractor for completed work as hereinafter mentioned, the Contractor covenants with the Employer to supply, deliver, construct, complete and maintain the Works in conformity in all respects with the provisions of the Contract.

4. The Employer hereby covenants to pay to the Contractor, in consideration of the supply, delivery, construction, completion and maintenance of the Works, the Contract Price at the times and in the manner prescribed by the Contract.

6 LABOUR UTILISATIONLabour Categories - Definitions

NOTE: These definitions serve as a guideline to complete the following table and will in no respect alter the Project Specifications or Standardised Specifications

6.1 General Foreman / ForemanAn employee who gives out work to and directly co-ordinates and supervises employees. His duties encompass any one or more of the following activities :

(a) Supervision;

(b) maintaining discipline;

(c) being responsible to the Contractor for efficiency and production for his portion of the works; and

(d) performing skilled work, whether in an instructional capacity or otherwise.

6.2 Charge handAn employee engaged in any one or more of the following activities :

(a) Being primarily employed in a supervisory capacity, but who may also be doing the work of an artisan;

(b) giving out work to other employees under his control and supervision;

(c) maintaining discipline; and

(d) being directly responsible to a general foreman or foreman or the Contractor or the Contractor's representative for efficiency and production for his portion of the works.

6.3 ArtisanAn employee who has successfully completed all prescribed courses at a practical institutional training centre for a particular trade and who has successfully completed the on-site period of training as prescribed and who has successfully passed the prescribed trade tests.

6.4 Team LeaderAn employee engaged in any one or more of the following activities :

(a) Being employed in a supervisory capacity, but who may also be doing the work of a skilled person;

(b) giving out work to other employees under his control and supervision;

(c) maintaining discipline;

(d) being directly responsible to a Charge hand or a foreman or a general foreman or the employer's authorised representative for efficiency and production for his portion of the works.

6.5 Skilled EmployeeAn employee engaged in an ancillary trade or an assistant artisan.

6.6 Semi-Skilled EmployeeAn employee with any specified skills, an apprentice or a trainee-artisan.

6.7 Unskilled EmployeeAn employee engaged on any task or operation not specified above.

6.8 Imported EmployeePersonnel permanently employed by Contractor (Refer to clause PS9.1)
