Local funds in the amount of $169,230 are currently available in the project budget. In 2013, the City received a grant from the County of San Diego Vector Habitat Remediation Grant Fund in the amount of $500,000 to supplement the construction phase of work. The Hazard Mitigation Grant Program will provide funds in the amount of $830,430 for the project, and requires a local match in the amount of $276,810. The matching obligation will be provided through the Vector Habitat Remediation Grant. BACKGROUND: The El Camino Real Channel Improvement project was initiated in 2005 in response to heavy rain events that forced closure of the intersection of El Camino Real at Leucadia Boulevard. The project will provide creek restoration enhancements and necessary flood control protection to reduce the potential for flooding and road closures at this heavily utilized intersection (Vicinity Map, Attachment A). The project is located in an environmentally sensitive area at the northwest and southeast corners of El Camino Real and Leucadia Boulevard and will involve stream restoration of the natural floodplain through vegetation and sediment removal. The work will involve grading activities to create stream beds and channel embankments that will propagate natural habitat establishment and enhance flow capacity in the creek. Furthermore, over 95% of the 4.72 acre site will be permanently restored through habitat establishment, enhancement, restoration, and preservation. (Concept Plan, Attachment B) The project budget lacks adequate funding to construct the proposed improvements. In 2012, City staff applied for a Hazard Mitigation Grant through the California Governor’s Office of Emergency Services (Cal OES) in order to supplement the project budget. In September, 2014, Cal OES notified the City that the grant application was fully approved in the amount of $830,430, with a local match requirement of $276,810. Additionally, the project activities will effectively reduce the presence of stagnant water at culvert outfalls, thereby eliminating mosquito breeding opportunities; such objectives were consistent with the County of San Diego’s Vector Habitat Remediation Grant Program. As such, in 2013, City staff applied for and received a grant from the County of San Diego in the amount of $500,000 to construct the project. There is no match requirement associated with the grant. The project is currently in the final phase of the resource agency permitting process. A nationwide permit from the Army Corps of Engineers was issued on October 27, 2014, authorizing construction of the project; permits with the San Diego Regional Water Quality Control Board and the California Department of Fish and Wildlife are currently in final processing. Construction is anticipated for Spring 2015. ANALYSIS: The Hazard Mitigation Grant Program is managed through the Federal Emergency Management Agency (FEMA) and administered through Cal OES. Hazard mitigation activities are aimed at reducing or eliminating future damages. The El Camino Real Channel Improvement project was identified as a viable hazard mitigation project because the project will result in improved channel capacity and reduction of flooding at one of the City’s busiest corridors: El Camino Real and Leucadia Boulevard. In order to execute the grant application and subsequent agreements, Cal OES requires designation of the City’s authorized agent through adoption of a resolution. The resolution will designate the Director of Public Works as the City’s authorized agent in order to execute for and on behalf of the City of Encinitas all applications, agreements, and contracts for the Hazard Mitigation Grant Program. (Resolution 2014-63, Attachment C) ENVIRONMENTAL CONSIDERATIONS: There are no environmental considerations associated with this agenda report. A Mitigated Negative Declaration, dated December 2009, has been completed for the project activities in compliance with California Environmental Quality Act (CEQA) guidelines. Furthermore, use of federal funds requires compliance with National Environmental Policy Act (NEPA); as such, FEMA as the lead agency has determined that the project is categorically

excluded (CE) from the need to prepare either an environmental assessment or environmental impact statement, in accordance with 44 CFR 10.8(d)(2)(xvi). ATTACHMENTS:

RESOLUTION 2014-63

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ENCINITAS

FOR

DESIGNATION OF APPLICANT’S AGENT

WHEREAS, the City of Encinitas has applied for grant funding from the California

Governor’s Office of Emergency Services;

WHEREAS, the California Governor’s Office of Emergency Service has selected the

project for funding; and

WHEREAS, the California Governor’s Office of Emergency Service requires the City of

Encinitas to appoint an authorized representative to enter into contract with the State;

NOW, THEREFORE, be it resolved by the City Council of the City of Encinitas:

1. THAT the Director of Public Works, or his designee is hereby authorized to execute

for and on behalf of the City of Encinitas, a public entity established under the laws

of the State of California, this application and to file it with the California

Governor’s Office of Emergency Service for purpose of obtaining certain federal

financial assistance under Public Law 93-288 as amended by the Robert T. Stafford

Disaster Relief and Emergency Assistance Act of 1988, and /or state financial

assistance under the California Disaster Assistance Act;

2. THAT the City of Encinitas, a public entity established under the laws of the State

of California, hereby authorizes its agents to provide to the California Governor’s

Office of Emergency Service for all matters pertaining to such state disaster

assistance the assurances and agreements required.

3. THAT this is a universal resolution and is effective for all open and future

Disasters/Grants up to three (3) years following the date of approval below.
