Director of Public Works/City Engineer Lundeen provided the committee with verbiage

corrections from the Mayor on the Ordinance.

Alderman Bushee questioned the status of persons staying overnight in the park and where

that stood in the agreement. He also stated his preference that the only people permitted to

stay the night would be security.

Director of Public Works/City Engineer Lundeen stated that the template agreement does not

include any waivers to the ordinance. Requested exceptions would require an agreement

approved by Park and Open Space Board, Public Works, and Common Council as an

amendment to the agreement template for consideration.

Alderman Bushee wanted to have clarification on the statement of no smoking in a park

facility, he felt it would be point to the City ordinance because the smoking includes e-

cigarettes and vaping. It is clear of what the definition of what smoking means in the

ordinance.

Director of Public Works/City Engineer Lundeen stated that there needs to be a good way to

incorporate standard language with respect to any escalation in cost, whether that is a 2%

increase on an annual basis so that doesn't have to come back through for approval and

addressing increased costs over time.

a. RESOLUTION 3681 A Resolution Approving a Second Amendment to the Cell Tower

License Agreement with Cellco Partnership d/b/a Verizon Wireless, Extending the

License Term and Expanding the Licensed Area for the Tower Located at 11800 N. Port

Washington Road

Assistant City Administrator Schoenemann provided an overview on the existing cell tower

location at the Fire Station on Port Washington Road. This contract would extend the lease

for another 25 years. If the lease amendment is approved the City would realize a significant

increase in revenue over the life of the 25 year lease as there is a 5% acceleration rate applied

to the base rent annually. The lease includes two proposed easement amendments.

Deputy Director of Public Works Weyker stated staff utilized the state contract for this

purchase. The City fleet currently includes a John Deere with a good performance record and

which is compatible with City operational needs.

Alderman Mayr inquired regarding the life expectancy of the current tractor. Also stating in

the future staff should look at other quotes aside from the state contract.

Director of Public Works/City Engineer Lundeen presented the proposal which was omitted

from the January award and stated if staff had been aware of the proposal at the time of the

original resolution, it would have been included for consideration. Staff is looking for a

recommendation for approval of Resolution 3699A or 3699B.

Alderman Bushee stated the initial contract with TADI and the contingency was not to

exceed $68,000. The TES propsoal would have come out to $31,000. TADI has already

started on the project. Alderman Bushee stated he had reached out to TES for more

documentation and provided a sample of work that was previously done to promote bike and

pedestrian safety. He stated they do have a good background in what they are implementing.

Alderman Hanser inquired why there is such a price difference.

Director of Public Works/City Engineer Lundeen stated since TES did not provide a detailed

breakdown of their proposal she could not speak to the price difference.

Alderman Mayr made a motion to accept Resolution 3699A.

maintenance contracts for award in March. Maintenance contracts include the crack sealing,

GSB-88, and flex patching. Staff will bring back the road rating map at the same time so the

Committee can see both.

SUBJECT: RESOLUTION 3698 A Resolution Awarding 2020 Construction Inspection

Contracts to Ruekert-Mielke, Kapur and Associates, and R.A. Smith

Background

Several developments are planning for public infrastructure work in the 2020 construction

season. There are potential overlapping construction timelines that may require inspection

services beyond the availability of City staff. There are two projects remaining from 2019 that

require construction inspection and there are two potential projects slated for 2020 construction:

Foxtown Site D and the Enclave Phase IV. The specific construction schedules have not been

determined for either of the proposed projects.

Analysis

City staff requested three firms provide construction service rates for the 2020 construction

season: Ruekert-Mielke, Kapur and Associates, and R.A. Smith. All three firms have provided

services to the City of Mequon in the past and are qualified to perform inspection services. The

construction service rates were used to compare the cost of inspection services between each of

the three firms. Ruekert-Mielke has the lowest rates of the three firms, followed by Kapur and

Associates and R.A. Smith.

As developments request inspection services, City staff will contact the firms on a case by case

basis for inspections services if the services cannot be provided by City staff. Ruekert-Mielke

would be contacted first, followed by Kapur and Associates and then R.A.Smith.

The two continuing projects from 2019 will continue to be inspected by R.A.Smith. Continuity

of the inspection team reduces the need for redoing work and bringing a new consultant up to

speed.

Fiscal Impact

The inspection services are a pass-through cost to developers. With a potential that the contracts

may total more than $25,000, staff is seeking Common Council approval. There is no fiscal

impact to the City of Mequon.

Recommendation

Staff recommends that the Public Works Committee and Common Council authorize staff to

negotiate contracts with Ruekert-Mielke, Kapur and Associates or R.A. Smith as needed to

facilitate inspection services for the City of Mequon.

B. There are potential overlapping construction timelines that may require inspection

services beyond the availability of City staff.

C. The City of Mequon Engineering Division received three construction service

rates from three qualified firms.

D. Staff has reviewed the construction service rates and found all firms to be

qualified to perform the inspection services.

E. The total expenditure of construction inspection fees incurred by the City for any

one firm and/or a combination of firms may exceed $25,000 requiring Common Council

approval.

F. The inspection fees are billed to the developer.

G. R.A.Smith will continue to inspect projects that began in 2019.

H. Based upon inspection rates, Ruekert-Mielke will be contacted first, followed by

Kapur and Associates and then R.A. Smith.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of

Mequon, that:

1. The above proposals, as recommended by the Public Works Committee, be

accepted and that the proper City officials be authorized to sign the appropriate contract

documents.

2. The Finance Department authorized to process all invoices under these contract

documents that may exceed $25,000 in total to any one firm or combination of firms without

further Common Council approval.

SUBJECT: RESOLUTION 3707 A Resolution Awarding the 2020 Flex Patch Contract to

Fahrner Asphalt Sealers, Waunakee, Wisconsin in an Amount Not-to-Exceed

$20,000

Background

At its February meeting, the Public Works Committee authorized staff to advertise the 2020

Annual Road Program. For the Flex Patch Contract, staff advertised for 6.63 miles of Flex Patch

Sealing at an estimated cost of $15,160. A flex patch is used to fill “u” shaped cracks in the

roadway. These cracks are too large for traditional crack filling.

Please see the attached location map and street list for roads included in the base bid.

Analysis

The City received 2 bids for the 2020 Flex Patch Seal Contract, with a low base bid of $16,890

from Fahrner Asphalt Sealers of Waunakee, WI. The low bid is approximately 11% higher than

the original estimate. The estimate was based on the volume of cracks and the width of the road.

Fahrner Asphalt Sealers $16,890.00

As a result of several recent contract awards, the Public Works Committee and Common Council

have requested consideration of adding a contingency to the award amounts. Therefore, staff is

recommending that the resolution approve an amount not to exceed $20,000, which includes a

contingency of approximately 18% for additionally authorized efforts. The contingency provides

for additional services that may result from the spring thaw. Additive bid items would not be

added to the award to utilize the contingency.

Work on this contract can start as soon as the contract is fully executed. The completion date for

this work is July 31, 2020. The base bid summary is attached.

Fiscal Impact

There is adequate funding available in the Annual Road Program account to award this project.

Recommendation

Staff recommends awarding the 5.52 miles of base bid streets for this contract. It is staff’s

recommendation that the Public Works Committee favorably endorse, and the Common Council

A Resolution Awarding the 2020 Flex Patch Contract to Fahrner Asphalt Sealers, Waunakee,

Wisconsin in an Amount Not-to-Exceed $20,000

A. The City of Mequon Engineering Division has advertised and received bids for

the 2020 Flex Patch Seal Contract.

B. Staff has reviewed the various bids and contractor qualifications for the contracts.

C. Staff has determined that the bids received are in accord with the estimates and

that adequate funds are available to accomplish the work and on that basis has made a

recommendation to the Public Works Committee.

D. To provide for additional services that may result from the spring thaw, the

contract award amount shall be affirmed with a contingency, for a total not-to-exceed cost of

$20,000.

E. Adequate funds for this contract are available from the Capital Project - 0410,

Project: Local Road Program - 10001 account.

F. The Committee on Public Works at its meeting on March 10, 2020, approved

staff's recommendation.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of

Mequon that:

Staff is authorized to award and sign the appropriate contract agreement to Fahrner

Asphalt Sealers, Waunakee, WI for the total cost not to exceed $20,000.

SUBJECT: RESOLUTION 3708 A Resolution Rejecting All Bids for the City of

Mequon's 2020 Crack Sealing Contract

Background

At its February meeting, the Public Works Committee authorized staff to advertise the 2020

Annual Road Program. For the Crack Seal contract base bid, staff advertised for 51.84 miles of

Crack Sealing at an estimated cost of $173,200.

Analysis

Staff held a pre-bid conference on February 18, 2020 which was attended by only one potential

bidder, Fahrner Asphalt Sealers of Waunakee, WI.

A bid opening was conducted on February 27, 2020 and staff received two bids, one from

Fahrner Asphalt Sealers of Waunakee, WI and one from Thunder Road of Waukesha, WI. The

low base bid was $117,592 from Thunder Road of Waukesha, WI. The low bid is approximately

32% less than the original estimate. The estimate was based on the volume of cracks and the

length of the road.

The low bid total was determined to not include one full page of bid items on the bid list. An

approximate amount of $85,000 was not included in the low bid amount. The City Attorney

reviewed the contract language and has determined that the contract requires that the contract

award be based on the total base bid as written. Thunder Road has indicated that they would

retract the bid if it was awarded in the amount of $117,592. If Thunder Road retracted the bid,

the award would need to be either made to Fahrner Asphalt Sealers or rebid.

Staff recommends rebidding the contract in March and awarding the contract in April. The

rebidding the contract could bring in two equitable bids at a contract less than the current high

bidder. There is a chance that the rebidding efforts could result in a higher bid. Some streets

included in the base bid will be moved to the alternate bid to account for the possibility of an

increase in bid amounts.

Fiscal Impact

The next lowest bid amount of $257,331 is approximately 48% more than City’s estimate.

Recommendation

Staff recommends that the Public Works Committee favorably endorse, and the Common

Council approve the resolution rejecting the bid for the 2020 Crack Seal contract. Subsequently,

staff will re-advertise the project allowing more competitive bids. Pending adoption of the

proposed resolution, staff intends to bring back additional project bids for consideration and/or

A. The City of Mequon Engineering Division has advertised and received bids for

B. Staff has reviewed the various bids and contractor qualifications for the contracts.

C. Since the lowest bid amount had missing amounts of approximately $85,000, staff

has been notified that the bid is withdrawn, and on that basis, has made a recommendation to

reject the bid to the Public Works Committee.

D. The Committee on Public Works at its meeting on March 10, 2020, agreed with

staff's recommendation.

NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of

Mequon that:

1. The bid for the City of Mequon’s 2020 Crack Sealing Contract is rejected.

2. Staff is authorized to re-advertise to solicit bids for the project with a potential

award in April 2020.

Background

At its February meeting, the Public Works Committee authorized staff to advertise the 2020

Annual Road Program. For the GSB-88 Bituminous Seal contract base bid, staff advertised for

9.88 miles of GSB-88 Bituminous Pavement Sealing at an estimated cost of $149,363.

Additive bids included 2.49 miles of additional GSB-88 Bituminous Sealing. The total estimate

for the additional streets is $36,633. However, the additive bids are per street so that any number

of streets may be added. These additive bids were included to allow more work to be completed

within budget depending on bid prices received for the entire 2020 Annual Road Program.

Please see the attached location map and street list for roads included in the bid.

Analysis

The City received one bid for the 2020 GSB-88 Bituminous Seal contract with the low base bid

of $184,357.00 from Fahrner Asphalt Sealers, of Waunakee, WI. It is common that only one bid

is received for the GSB-88 sealing contract. In the past, there has been only one other company

that provides the sealing service.

The low bid is approximately 23% more than the original estimate. Asphalt prices and asphalt

based product prices have increased in the last year, resulting in an increased cost for the GSB-

88 sealant. Staff recommends awarding the 9.88 miles of base bid streets, additive item A5 for

the Mequon DPW Combined Facility Lot and additive item A6 for the Mequon Nature Preserve

Parking Lot for this contract.

The Department of Public Works Parking Lot was included in the bid as an alternate bid item.

The prices are favorable for sealing the parking lot. The sealing will utilize the funds earmarked

for parking lots in the 2019 road program borrowing.

The Mequon Nature Preserve has also requested that asphalt treatment of the parking lot be

included in the City's contract. Upon approval from the Mequon Nature Preserve, the treatment

will be added and paid for by using the Mequon Nature Preserve fund. A Memorandum of

Understanding (MOU) will be executed prior to any work being completed at the Mequon

Nature Preserve.

As a result of several recent contract awards, the Public Works Committee and Common Council

have requested consideration of adding a contingency to the award amounts. Therefore, staff is

recommending that the resolution approve an amount not to exceed $250,000, which includes a

contingency of approximately 17% for additionally authorized efforts. The contingency will not

be used for additive bid items, it is intended for additional work needed as a result of spring

thaw.

Fahrner Asphalt Sealers has applied GSB-88 bituminous sealer in Mequon in the past and has

provided a quality work product.

Work on this contract can start as soon as the contract is fully executed. The completion date for

this work is August 31, 2020. The bid opening sheet is attached.

Fiscal Impact

There is adequate funding available in the Annual Road Program account to award this project.

Recommendation

It is staff’s recommendation that the Public Works Committee favorably endorse, and the

Common Council approve the attached resolution awarding the 2020 GSB-88 Bituminous Seal

contract to Fahrner Asphalt Sealers, of Waunakee, WI, for an amount not-to-exceed $250,000.

of the parking lot at 8200 W. County Line Road through a memorandum of understanding.

E. Adequate funds for this contract are available from the Capital Project - 0410,

Project: Local Road Program - 10001 account.

F. To provide for additional services that may result from the spring thaw, the

contract award amount shall be affirmed with a contingency, for a total not-to-exceed cost of

$250,000.

G. The Committee on Public Works at its meeting on March 10, 2020, approved

staff's recommendation.

Background

Mequon Nature Preserve, LLC (MNP, LLC) leases and manages the Mequon Nature Preserve.

Recently, MNP, LLC identified various parking lot maintenance needs and requested that the

City bid the work as a part of its annual road program contracts. The City holds funds for MNP,

LLC, which is requesting that the funds be utilized for the project. The terms of this maintenance

work to be performed in 2020 are summarized in the attached Memorandum of Understanding

(MOU).

Analysis

City staff coordinated with MNP, LLC staff to outline the pavement maintenance work as a part

of its contracts. The proposed Memorandum of Understanding (MOU) confirms the bid amount

and outlines the funding terms.

Please note that while the City is considering rebidding one of the maintenance contracts, the

MOU would still be valid for any remaining work and for the rebid.

Fiscal Impact

The MOU is fiscally neutral for the City.

Recommendation

Staff recommends that the Public Works Committee favorably endorse and the Common Council

approve the resolution authorizing a memorandum of understanding with the Mequon Nature

Preserve for parking lot maintenance projects to be completed during the 2020 road maintenance

and construction season.

MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF MEQUON AND

MEQUON NATURE PRESERVE, INC.

Articles of agreement made and entered into this _____ day of ___________, 20__, by and between

Mequon Nature Preserve, Inc., hereinafter called MNP Inc., and the City of Mequon, a municipal

corporation of Ozaukee County, Wisconsin, hereinafter called the City and collectively called the Parties.

RECITALS

1. The City has a lease with MNP Inc. which governs the relationship between the two Parties.

2. The PieperPower Education Center (PPEC) parking lot needs to be repaired. MNP Inc. requested

that the City’s Public Works Committee place PPEC parking lot maintenance project on its agenda

for inclusion in the 2020 road and parking lot maintenance program.

3. MNP Inc. further requested that this project be funded using the City’s Mequon Nature Preserve

Fund whose current balance is $46,535. To defer the needed maintenance will result in additional

costs for even more substantial future repairs if parking lot maintenance is not addressed soon.

4. Both Parties have a vested interest in the infrastructure investment and proper protection thereof.

NOW, THEREFORE, in consideration of these Recitals, the mutual agreements, benefits and

responsibilities outlined herein, and other good and valuable consideration, receipt or sufficiency of which

is hereby acknowledged, the Parties agree:

1. The City will complete the bidding, contract administration and inspection of the parking lot

maintenance project as a part of its annual road program.

2. Bids for the PPEC parking lot maintenance project will be presented to MNP Inc. for consideration

and approval prior to awarding the contract.

3. There are sufficient funds in the City’s Mequon Nature Preserve Fund to pay for MNP Inc.’s share

of the maintenance contract.

4. Upon approval of this agreement, as indicated by the signatures below, City staff will begin the

procurement of bids for the Crack Seal, GSB-88 and Asphalt Patch. It is the intent of the City to

have the Crack Seal, GSB-88 and Asphalt Patch completed before the deadline for each contract.

The Annual Road Program addresses both road reconstruction/rehabilitation and road

maintenance. This memo provides an overview of the status of the 2020 Annual Road Program

and the current estimates.

At the last meeting there was a request for the current SCR for the City streets. The 2019-2020

SCR Map is attached. There was also a request to provide the current 5-year Road Plan. The

plan years are approximate and are used as a general guidance for the selection of the roadways

in any given year.

Analysis

Business Park –

Phase 1 of the Business Park was built in the late 1980s. With the roadway construction a

lighting system, irrigation system, curb and gutter, catch basins, storm sewer and pavement were

installed. City staff has been working through the various components of the Business Park and

have determined that separating the Business Park into a two year project allow for the best final

product. The lighting, irrigation, catch basin repair and curb repair would be in Year 1 and the

pavement repair in Year 2. This would allow for the coordination of the various items to take

place ahead of the road surface. Each of the repairs is described below.

Lighting

When the Business Park was constructed the lighting was installed by the City and maintained

by the City. When phase 2 of the business park was completed, WE Energies owned the lights.

Currently, the lighting in the Business Park is in poor condition, it does not match the second

phase, and is becoming increasingly difficult to repair.

City staff has prepared the following costs relating to the lighting replacement:

Estimate of Cost to Demolish $30,000

Estimate of Cost to Install by WE Energies $223,800*

Estimate of Cost to Install Independently $206,100*

*The WE Energies estimate includes fiberglass poles, the City installation quote includes

Aluminum poles.

While the estimate to install the lighting independently is lower than the cost for WE energies

installation, The City would need to maintain the lights and poles. The maintenance would well

exceed the differences in the installation costs. The fiberglass poles included in the WE Energies

estimate are also preferred and would match phase 2 of the Business Park.

City staff is currently working with WE Energies on the installation of new lighting in the

business park. The removal of the existing lighting and conduit are included as alternative bids

in the Road Improvements Contract. The demolition is included as an alternate bid since the

timing will need to coincide with the installation by WE Energies. This would be consistent with

Phase 2 of the Business Park.

If WE Energies declines the application for service, the demolition and installation of street

lighting will be combined and issued under a separate contract. Both options allow for the

coordination between contractors and reduces the risk of road cuts in a fresh pavement surface.

Irrigation

Irrigation lines were installed in the Business Park in 1993. City staff have reviewed the

landscaping plans and the approval by common council for the system and have found that the

irrigation system is no longer needed. The irrigation has not been used in the last 15 years and

likely has several areas of failure. The age of the system and the limited use would likely require

extensive repairs of the overall system. The cost to find and repair the failures would be

significantly higher than replacement. An irrigation contractor confirmed that repair cost are

generally higher than the replacement costs. Two other contractors have not responded to the

inquiries on repair costs.

Estimate of Cost to Abandon the Existing System $25,000

Estimate of Costs to Replace the System $59,000

The connections for the irrigation system are within the roadway and would need to be dug up to

be abandoned properly. City staff has prepared the estimates of the costs to abandon, or replace

the existing system.

Catch Basins, Storm Sewer, and Curb and Gutter

The catch basin and curb and gutter repairs can be completed independently of the pavement

replacement. The volume of catch basin, storm sewer and curb and gutter repairs are significant

enough that they are going to be released in a separate contract. Separating the repairs into a

separate contract allows for specialty contractors to bid on the work. Typically this leads to a

more competitive bid. The contract is proposed to be advertised in March with award in April.

Estimate of Catch Basin Repair $186,000

Estimate of Cost for Storm Sewer Repair $3,500

Estimated Cost of Curb and Gutter Repair $107,500

Total Cost $297,000

Revised Road Program –

With the removal of the streets in the Business Park in the Road Improvements contract, there is

opportunity to move other projects into the base bid. Staff is proposing to include the following

streets in the Road Program: Range Line Court (stand alone contract), Wauwatosa Road,

Eastbrook Drive, Woodberry Drive, Range Line Terrace, Essex Court and Essex Drive.

River Lake Subdivision was removed to allow for further review of the policies and procedures

relating to subdivisions with private water trusts.

Westchester Lakes is on the 5-year road program and will include catch basin repairs. Staff is

proposing to include the Westchester lakes catch basin repair in the 2020 Catch Basin, Storm

Sewer and Curb Repair contact. The pavement repair and replacement will follow in future

years.

The Mequon Nature Preserve requested that the parking area be part of the bidding for Crack

Seal, GSB-88 and Asphalt Patching. If approved, these additive items would be funding using

the Mequon Nature Preserve account and a Memorandum of Understanding (MOU) would be

executed before beginning any work.

The maintenance contracts for GSB-88 and Flex Patch are recommended for award March 10.

The Crack Filling, Range Line Road Improvements, 2020 Road Improvements and 2020 Catch

Basin, Storm Sewer and Curb and Gutter contracts will be bid in March with award in April.

City staff is also planning to issue a sidewalk repair contract and a parking lot repair contract

within the next 3 months. The sidewalk repair contract

Fiscal Impact

The City of Mequon has applied for Local Roads Improvement Program Entitlement Project

(LRIP) funding for the reconstruction of the Mequon Business Park. The construction costs are

estimated at $833,788 which includes improvements to street lighting and storm sewer repairs.

The LRIP reimbursement amount is approximated to be $85,746.64 which equates to 10.3% of

the total estimated cost. The approval of the LRIP funding was approved in March 2020 and is

required to be utilized by June 30, 2025. The LRIP application is available by request from the

Engineering Division.

On February 12, 2019, common council approved a $5.1 million bond issuance for a 3-year

borrowing for the road program. This is the second year of the aforementioned three-year

program funded by long term bonding. Below are the costs associated with the 2019 Road

Program.

The net total expenditures for 2019 were under the overall budget for the road program. The

budget allocations will be utilized over the 3 year borrowing cycle. Additive bidding will be

utilized when possible to maximize the yearly expenditures.

The program shown on the chart below is the anticipated costs for 2020:

Recommendation

Staff is providing the road program descriptions for information and discussion. Authorization

and approval of each of the contracts will come back before the Public Works Committee for

recommendation following each bidding cycle. Additive bids will be included with the Road

Improvements contract and Crack Seal contract that can be added at the time of award if funding

allows.
