TTLA’ s 2005 Annual Convention is highlighted by an innovative CLE program guaranteed to enhance your professional skills.

Wednesday afternoon is designed to enhance your skills and techniques in preparing your witnesses. Jury Consultant, Gillian Drake will offer suggestions in analyzing witnesses and improving their credibility, while giving tips on rehearsal techniques and working with diffi cult witnesses.

The Bench/Bar Program starts Thursday morning with a discussion on the American Jury Project.

Thursday afternoon’s sessions with David Randolph Smith, Mark Kosieradski and Marling Santiago, will bring you up to speed on electronic briefs, document management, and effectively using PowerPoint for trial and mediation.

Friday concludes a dynamic program with informative sessions on Subrogation Law with Evan Meade, Medical Negligence Law with David High and Jury Attitudes on Health Care Reform with Phllip Miller. Ethics with the Honorable Joe Riley will conclude the morning program.

GILLIAN DRAKEGILLIAN DRAKE is the founder and director of ON TRIAL ASSOCIATES, INC., and Acting for Lawyers™. She was an accomplished theater director who, for over 17 years, has worked with lawyers and witnesses to elicit persuasive performances from even the most unwilling speakers. Gillian Drake is a nationally recognized expert on courtroom behavior of witnesses, lawyers, and juries. She has consulted on hundreds of cases since 1985 - many of them high-profi le and diverse: from spies to priests accused of sexual abuse, from Indian tribes suing for federal recognition to mega-telecommunications companies trying to break up an industry. Ms. Drake lectures on trial strategy, witness preparation, courtroom “drama,” and oral advocacy.

ON TRIAL grew from Ms. Drake’s recognition of the parallels between the persuasive presentation techniques used by actors and those required of lawyers and witnesses in the courtroom. So, she began coaching lawyers and they began winning cases. She expanded her transformation of performances to attorney’s witnesses and to business executives, professionals, CEO’s, and governmental front-persons.

In the public communication sector, Ms. Drake and her associates use basic theater techniques to teach presentation and interpersonal communication skills - the same techniques actors traditionally use to perfect speeches, improve storytelling skills, gain self-confi dence, learn to concentrate before groups, and develop a “performance image.” cWith witnesses, the transference of performance skills is even more direct, i.e., stage fright, anxiety, presence, and authenticity are basic areas to master on stage or witness stand.

The success of Ms. Drake’s unique approach has been overwhelming. ON TRIAL’s clients include major corporations and law fi rms, non-profi t organizations, government agencies, federal and state prosecutors, public defenders/defense attorneys, and legal trade and bar associations.

ON TRIAL has been featured on NBC’s “Today Show,” The Wall Street Journal Report, and National Public Radio. The fi rm has been chronicled in the nation’s leading newspapers, magazines, and legal journals.

Before earning an MFA in directing from Carnegie-Mellon University, she studied for three years in New York City with the legendary acting teacher Stella Adler and received a BA from Bennington College in Vermont. Ms. Drake is a professional theater director and voice coach. While on the artistic staff of Arena Stage several years ago, Ms. Drake began applying her professional skills in a course called “Acting for Lawyers.” The course was enormously successful and soon after expanded into On Trial Associates, Inc. - a trial consulting and speech communication company.

2005 Silent AuctionTasha Blakney, Chair

The Tennessee Judicial Conference Foundation has been selected as the recipient of this year’s Silent Auction proceeds. Trial and appellate court judges from across Tennessee established the Tennessee Judicial Conference Foundation in 1995 to provide need-based scholarships to law students in Tennessee. The foundation is supported entirely through private gifts, pledges, memorials, shirt and cap sales, and an annual golf tournament held in memory of the late Judge Dick Jerman, Jr., of Humboldt, who passed away in 1999.

David E. High, a Life Member of TTLA, practices in Nashville, TN. He earned his BA from the University of TN, Knoxville and his J.D. from the Nashville School of Law. A former member of TTLA’s Board of Governors, David is also a member of the Nashville Bar Association, the Assoc. of Trial Lawyers of America, the TN Assoc. of Criminal Defense Lawyers and a Fellow of the Nashville Bar Foundation.

Evan Meade, received his BA from the Univrsity of Tennessee, Knoxville and his law degree from the University of Memphis School of Law. Evan has served on the Board of TTLA continuously since 1989 and is a member of ATLA. His fi rm, Evan Meade & Associates, is in Johnson City, TN where he has practiced law for over 28 years. He limits his practice to signifi cant injury cases including medical malpractice, products liability, trucking collisions, auto collisions, and other cases involving serious injury.

Phillip H. Miller, 2005 TTLA Annual Convention Program Chair, practices in Nashville. His fi rm has been recognized by Martindale-Hubbell as one of the “Pre-eminent fi rms in the United States”, and he was recognized by the Nashville Business Journal as one of the “Best of the Bar” in 2003. He has tried some 46 personal injury jury trials to verdict, and he has been certifi ed and recertifi ed as a specialist 3 times by our Supreme Court. During the last 24 years before the bar, Phillip has written, published, and presented papers on trial practice from California to Florida. He has been a repeat speaker at programs at Harvard University, the National Judicial College and ATLA.

Honorable Joe G. Riley, serves as independent Disciplinary Counsel for the Tennessee Court of the Judiciary, a body that investigates and prosecutes allegations of ethical improprieties against TN judges. Joe retired in July 2004 from the bench, having served seven years on the TN Court of Criminal Appeals and 18 years as a Circuit Court Judge. A frequent lecturer and author, Joe is Past-President of the TN Judicial Conference, a Fellow of the TN Bar Foundation, and Chairman of the TN Judicial Performance Program Committee.

Enjoy a great lunch while you network with top at-torneys from across the state at the Past Presidents’ Luncheon. This year, the featured speaker is Peter Perlman. Mr. Perlman practices law in Lexington, Ky. His expertise in products liability has made him a sought-after speaker at national events for numer-ous trial lawyer associations. He is a past president of the Association of Trial Lawyers of America and the Kentucky Academy of Trial Attorneys.

Mark R. Kosieradzki, Kosieradzki Law Firm, Minneapolis, Minnesota is a nationally rec-ognized trial attorney, who has served as lead counsel in multimillion dollar cases involving products liability, wrongful death, spinal cord injuries, and burns. He is a NBTA certifi ed trial specialist, chair of the ATLA national Nursing Home Litigation Group, past president of the Minnesota Trial Lawyers Association, ATLA Board of Governors and past president of MN-ABOTA. As a Diplomat in the National College of Advocacy, Kosieradzki has lectured throughout the U.S., Canada and Mexico on issues of nursing home negligence, products liability, medical malpractice, and trial advocacy. Kosieradzki is co-author of the Nursing Home Litigation chapter of West Publication’s Treatise, Tort Litigation; and is the author of the text book, Litigating Spinal Cord Injuries: Law, Medicine and Economics.

Marling Santiago, has been a medical investigator with the law fi rm of Grossman and Roth, P.A. for over 15 years and was their IT Director for six and a half years during which time she networked their four offi ces as well as providing a program, which still runs that fi rm’s case management data. Presently, she continues to develop computer animations and graphic digital support for trials and mediations for Grossman & Roth and for law fi rms all over the United States. A premed graduate of Smith College, whose two de-cades of experience in the area of medical malpractice have given her great insight in the presentation of complex medical cases. In addition, she is president of Systematic Com-puter Animations, Inc., an IBM business partner, which developed computer programming still being utilized by IBM clients nationally. Her training under Emmy winning animators developing movies such as Jurassic Park, Star Trek, Titanic and others has helped her achieve success in this area.

David Randolph Smith has been a trial attorney for 26 years. For the past sixteen years he has represented primarily individuals in plaintiff’s personal injury litigation. He was recently named one of the Best Lawyers in Tennessee by Business Tennessee, a statewide business journal, in both the 2004 and 2005 editions. The Business Tennessee Best Lawyers List for 2004 described Mr. Smith as “An all-star across the state.” The list identifi ed attorneys from all regions of the state and recognized Mr. Smith as one of fi ve “best lawyers” in Tennessee in the area of Personal Injury (Plaintiff) practice. He has tried over 100 cases in state and federal courts throughout the nation. Mr. Smith has served as an Associate Professor of Law teaching Torts, Evidence and Professional Responsibil-ity at Vanderbilt University School of Law (1983-1988) and has testifi ed as a legal expert on product liability law (joint and several liability) before the 100th Congress (House of Representatives) Subcommittee on Commerce, Consumer Protection, and Competitive-ness. His testimony and paper appeared in the Congressional Record.

She expanded her transformation of performances to attorney’s witnesses and to business executives, professionals, CEO’s, and governmental front-persons.

In the public communication sector, Ms. Drake and her associates use basic theater techniques to teach presentation and interpersonal communication skills - the same techniques actors traditionally use to perfect speeches, improve storytelling skills, gain self-confi dence, learn to concentrate before groups, and develop a “performance image.” cWith witnesses, the transference of performance skills is even more direct, i.e., stage fright, anxiety, presence, and authenticity are basic areas to master on stage or witness stand.

The success of Ms. Drake’s unique approach has been overwhelming. ON TRIAL’s clients include major corporations and law fi rms, non-profi t organizations, government agencies, federal and state prosecutors, public defenders/defense attorneys, and legal trade and bar associations.

Before earning an MFA in directing from Carnegie-Mellon University, she studied for three years in New York City with the legendary acting teacher Stella Adler and received a BA from Bennington College in Vermont. Ms. Drake is a professional theater director and voice coach. While on the artistic staff of Arena Stage several years ago, Ms. Drake began applying her professional skills in a course called “Acting for Lawyers.” The course was enormously successful and soon after expanded into On Trial Associates, Inc. - a trial consulting and speech communication company.

The Tennessee Judicial Conference Foundation has been selected as the recipient of this year’s Silent Auction proceeds. Trial and appellate court judges from across Tennessee established the Tennessee Judicial Conference Foundation in 1995 to provide need-based scholarships to law students in Tennessee. The foundation is supported entirely through private gifts, pledges, memorials, shirt and cap sales, and an annual golf tournament held in memory of the late Judge Dick Jerman, Jr., of Humboldt, who passed away in 1999.

David E. High, a Life Member of TTLA, practices in Nashville, TN. He earned his BA from the University of TN, Knoxville and his J.D. from the Nashville School of Law. A former member of TTLA’s Board of Governors, David is also a member of the Nashville Bar Association, the Assoc. of Trial Lawyers of America, the TN Assoc. of Criminal Defense Lawyers and a Fellow of the Nashville Bar Foundation.

Evan Meade, received his BA from the Univrsity of Tennessee, Knoxville and his law degree from the University of Memphis School of Law. Evan has served on the Board of TTLA continuously since 1989 and is a member of ATLA. His fi rm, Evan Meade & Associates, is in Johnson City, TN where he has practiced law for over 28 years. He limits his practice to signifi cant injury cases including medical malpractice, products liability, trucking collisions, auto collisions, and other cases involving serious injury.

Phillip H. Miller, 2005 TTLA Annual Convention Program Chair, practices in Nashville. His fi rm has been recognized by Martindale-Hubbell as one of the “Pre-eminent fi rms in the United States”, and he was recognized by the Nashville Business Journal as one of the “Best of the Bar” in 2003. He has tried some 46 personal injury jury trials to verdict, and he has been certifi ed and recertifi ed as a specialist 3 times by our Supreme Court. During the last 24 years before the bar, Phillip has written, published, and presented papers on trial practice from California to Florida. He has been a repeat speaker at programs at Harvard University, the National Judicial College and ATLA.

Honorable Joe G. Riley, serves as independent Disciplinary Counsel for the Tennessee Court of the Judiciary, a body that investigates and prosecutes allegations of ethical improprieties against TN judges. Joe retired in July 2004 from the bench, having served seven years on the TN Court of Criminal Appeals and 18 years as a Circuit Court Judge. A frequent lecturer and author, Joe is Past-President of the TN Judicial Conference, a Fellow of the TN Bar Foundation, and Chairman of the TN Judicial Performance Program Committee.
