Dear Mr. O’Leary,

As you are aware, Clearpower Ltd have been contracted by Staunton Foods, Timoleague, West Cork to manage and recycle the Staunton Foods waste water treatment plant (WWTP) sludge and to compile the 2012 nutrient management plan (NMP).

The enclosed NMP for the Dan Joe O’Sullivan Farm was prepared using S.I. 610 of 2010 fertiliser application rates. The NMP is calculated based on the following factors:

the phosphorus level in the soil and the crop fertiliser nutrient requirements and the phosphorus and nitrogen concentration of the Staunton Foods WWTP sludge Please note that there are no livestock on the farm as detailed in the enclosed NMP.

Please find enclosed an original and two copies of details with respect to the Staunton Foods 2012 NMP for EPA approval which includes:

I have been informed by Staunton Foods, Timoleague, West Cork, that the estimated volume of sludge to be produced during 2012 is approximately 570 m3, based on the volume produced in 201 1 and a review of proposed production levels on site for 2012. The total recovery capacity of the enclosed 2012 NMP for EPA approval is 720 m3.

Attachment 111: Sign-off on lands

I have completed Fertiliser Plans (Nutrients Management Plans) for the farm reference l ( a s per Attachment 2) t o receive organic fertiliser from Staunton Foods site, Register Number PO947-01 during 2012. These Fertiliser Plans comply with the requirements of the European Communities (Good Agricultural Practice for Protection of Waters) Regulations, 2010 (S.I. No. 610 of 2010).

In my professional opinion, organic fertiliser may be used to fertilise any of those farmlands, and the application of organic fertiliser from the licensable site to any of those lands in a quantity identified in the Fertiliser Plan and manner that complies with the requirements of the Code of Practice and Buffer Zones of IPPC licence Reg. No. PO947-01, and European Communities (Good Agricultural Practice for Protection of Waters) Regulations, S.1 No. 610 of 2010 will not cause, and is not likely to cause, significant environmental pollution.

3.0 HYDROGEOLOGY ASSESSMENT

The hydrogeology assessment of the Dan Joe O’Sullivan farm involved (i) a desk study and (ii) a comprehensive site survey (undertaken by Serena Silke, Clearpower Environmental Engineer and an independent surveyor, Niall Kelleher on 2Sth November 2011).

4.0 NUTRIENT MANAGEMENT PIAN (NMP)

4.1 Soil analysis

Soil samples for the identified field areas were taken and sent to FBA Laboratories Ltd. of Cappoquin, Co. Waterford for analysis. The soil analyses are given in Appendix I l l of this NMP.

4.2 Summary of farm activities

4.3 Nutrient management plan (NMP) 2012

The nutrient management plan (NMP) as shown overleaf is prepared using S.I. 610 of 2010 European Communities (Good Agricultural Practice for Protection of Waters) Regulations 2010 (Nitrates Directive) recommendations for phosphorus and nitrogen fertiliser.

The NMP calculations are based on the phosphorus and nitrogen crop fertiliser requirements, an analysis of the WWTP sludge to be applied by landspreading and the P index of the soil in the fields.

The concentration of the P and N in the Staunton Foods WWTP sludge is approximately 2.7 kg/t of phosphorus and 1.9 kg/t of Nitrogen. Nitrogen is considered to be 40% available. The sludge analysis is given in Appendix II of this NMP.

A total of 720 tonnes of Staunton Foods WWTP sludge can be recycled a t the farm across the identified land parcels, as shown overleaf.

Source protection area: This is an area around a groundwater source that is divided into two sub areas: The inner protection area (SI) and the outer protection area (SO). The SI is designed to protect the source against the effects of human activities that may have an immediate effect on the source in particular in relation to microbiological pollution. It is defined by a 100-day time of travel (TOT) from any point below the water table to the source. The SO covers the complete catchment area or the zone of contribution (ZOC) of the groundwater source. It is defined as the area required to support an abstraction from long-term groundwater recharge.
