AHMEDABAD A day after two persons were killed and at least ten others were injured in clashes between two com- munities in and around Hansot town of Bharuch district, police on Thursday registered five separate FIRs for murder and rioting but no arrests have been made . "A case of murder has been registered against 16 persons for their alleged involvement in killing two local youths yesterday dur- ing the riot. We have also registered four FIRs sepa- rately against a mob com- prising more than 150 per- sons for their involvement in assault, rioting, attempt to murder and damage to property," said police inspector of Hansot N D Chaudhari. However, police are yet to make any arrests. Police also scaled down the death toll in yesterday's clashes, triggered after a scuffle between two groups in nearby Ambetha village on the issue of catching kites during Makarsankranti festival, to two from three as was ear- lier reported. Tytler on Thursday told aDelhi court that there wasno legally admissible evi-dence to frame chargeagainst him in a defama-tion complaint filed by asenior advocate represent-ing the victims in 1984anti-Sikh riot cases.

Tytler's counsel arguedthat the complaint wasfiled by senior counsel H SPhoolka regarding allegeddefamatory statementsmade against him by theCongress leader in a TVnews programme aired onSeptember 7, 2004 andthere was a long and "inor-dinate delay" in the pro-ceedings of this matter.

"The court has to seewhether notice is to beframed against myclient...There is no materi-al to frame charge," hiscounsel told AdditionalChief MetropolitanMagistrate (ACMM)

Gaurav Rao during thearguments on framing ofnotice. Tytler's counselalso argued that primaryevidence filed by the com-plainant was based on avideo cassette which is anelectronic evidence but itcannot be filed in the courtwith proper certificate, asmandated by law.

Phoolka's counsel, how-ever, countered his submis-sions contending that the

complaint, statement of thecomplainant and other wit-nesses corroborating it,were enough to framecharge against Tytler in thematter. "There is sufficientevidence to proceed withframing of notice,"Phoolka's counsel said.

The court has now fixedthe matter for further argu-ments on January 24.

of the TV programmewhich was aired by thenews channel in bothEnglish and Hindi.

In an earlier hearing,Tytler had told the courtthat he was ready to tender"unconditional apology" toPhoolka to settle the matteras no public interest wasinvolved in the complaintfiled by an individual.

Phoolka, however, hadrefused to accept Tytler'soffer, saying "any compro-mise" in a serious matterlike this would send awrong message to the peo-ple. In his complaint filedin 2006, Phoolka hadalleged that Tytler had lev-elled "false and derogato-ry" allegations against himto harm his reputation inthe society. His counselhad earlier told the courtthat Tytler should also beprosecuted for the offenceof criminal intimidationunder section 506 of theIPC.

The allocation was regu-larised in May 2004, whenhe was inducted as a UnionMinister.

Following his disqualifi-cation as an MP inNovember 2013, the houseallocation was cancelled.

Cabinet Committee onAccommodation allowedhim to retain the bungalowfor one year from the dateof cancellation till October,2014.

RBI surprises...much-awaited move, state-owned Union

Bank and United Bank within hours loweredtheir respective benchmark lending rates bysimilar margin, giving relief to borrowers.

Others, including the PSU giant SBI andprivate sector major ICICI Bank indicatedthey will look at rate cuts soon to pass on thebenefit to their customers from RBI's lower-ing of repo rate, at which banks borrow fromthe central bank.

"Reduction in the rates is a positive devel-opment. It will lead to more money in thehand of the consumers and greater spending.It's positive for the Indian economy," saidFinance Minister Arun Jaitley, who has beennudging RBI for a rate cut for months now.

The industry has also been demanding aninterest rate cut to lower their cost of capitaland help revive the investment cycle.

Jaitley said that the RBI decision would"certainly help in reviving investment cyclethat the government is trying to restore".

The Reserve Bank cut the repo rate by 25basis points to 7.75 percent with immediateeffect, cheering the stock markets where thebenchmark sensex soared by 847 points to28,194 points during the intra-day trade.

RBI had last reduced the repo rate on May,3, 2013, when it was lowered from 7.5 per-cent to 7.25 percent. Thereafter, the rateswent higher and had remained steady at anelevated level of 8 percent since January2014.

RBI Governor Raghuram Rajan, who hadbeen maintaining a hawkish stance till now,decided to go in for rate cut a fortnight aheadof the scheduled date of announcement ofmonetary policy review on February 3.

The surprise early morning move, beforethe markets opened, came amid softeninginflation levels and a reiteration by theFinance Ministry to stick to its fiscal deficittarget of 4.1 percent for the current financialyear.

Commenting on the rate cut, SBI ChairmanArundhati Bhattacharya said the country'slargest lender "will look at how and whenbase (lending) rates can be cut", while ICICIBank CEO Chanda Kochhar said that themuch-awaited lowering of lending anddeposit rates would definitely take placenow.

As a result of the rate cut, the reverse reporate, the rate at which the central bank drainsexcess liquidity from the banking system,also moved down by 25 basis points to 6.75percent.

The RBI, however, has decided to keep thecash reserve ratio (CRR), the portion ofdeposits which the banks are required to havein cash with the central bank, unchanged at4.0 percent.

Rajan had during the previous monetarypolicy review on December 2 hinted at a pos-sible easing in rates early in 2015, includingoutside of planned meetings.

Elaborating on the price situation, a RBIstatement said "inflation outcomes have fall-en significantly below the 8 percent targetedby January 2015. On current policy settings,inflation is likely to be below 6 percent byJanuary 2016."

Lower-than-expected inflation has beenenabled by decline in prices of vegetablesand fruits, cereals and the large fall in inter-national commodity prices, particularlycrude oil, it said, adding barring geo-politicalshocks, they are expected to remain low overthe year.

Welcoming the rate cut, Ficci PresidentJyotsna Suri said, "this measure will help inimproving the investor sentiment. Ficcihopes that this will be the beginning of fur-ther cuts in the policy rate by the centralbank, and will enable its transmission intolower lending rates by the banks."

Falling oil ...will be leakages and other set-offs. But our

external situation undoubtedly improves. Thewelcome development enhances our dispos-able income (which will increase consumerdemand for other goods and services), reduceinput cost of our businesses (which willincrease margins and help to enthuse invest-ment demand), and aid government financesby reducing the energy subsidy burden in thebudget.”

This paragraph needs a detailed discussion.On 26 May 2014, the day Narendra Moditook oath as the Prime Minister of India, theprice of the Indian basket of crude oil stoodat $108.56 per barrel. Since then the price ofthe Indian basket has fallen dramatically andon 13 January 2015, it stood at $ 43.48 perbarrel.

Hence, the oil price has fallen by nearly60% since the Modi government came topower. This, as Patel puts it, has led to a dra-matic fall in our oil import bill. He goes on tosay that it also increases our disposableincome, which in turn will increase consumerdemand.

The logic here is very straightforward—people will spend a lesser amount of moneyto buy oil products, and the money thussaved would be spent on other goods andservices. Nevertheless, things aren’t exactlylike that. The government hasn’t passed onthe entire fall in the price of oil to the endconsumer.

As mentioned above the price of the Indianbasket of crude oil has fallen by 60% sinceMay end. Nevertheless, petrol prices haven’tfallen by 60%. In Mumbai, the petrol pricehas fallen by around 14% since April 2014.

The same logic stands true for diesel as well.This has happened because the government

has increased the excise duty on petrol anddiesel thrice since October 2014, in order toshore up its revenues. The tax growth hadbeen assumed to grow at 16.9% at the timethe budget was presented, whereas the actualgrowth in tax collections between April toNovember 2014 has been around one-fourthof that at 4.3%.

Analysts Chetan Ahya and UpasanaChachra of Morgan Stanley estimate that theModi government will collect nearly Rs14,600 crore between December 2014 andMarch 2015 through the higher excise dutyon petrol and diesel.

What this tells us is that the major benefitof the fall in oil price has gone to the govern-ment and has not led to the disposableincome of the citizens going up majorly assuggested by Patel. I don’t see this increasein disposable income being big good enoughto lead to an increase in the consumption ofgoods and services.

The RBI had been under pressure fromgovernment and business leaders to reducerates to increase lending and help kickstartthe economy, but RBI governor RaghuramRajan insisted that his priority was bringinginflation under control.

She said this was a God-sent moment thatshe accepted.

There is speculation in Delhi circles thatformer AAP leader Shazia Ilmi may also jointhe BJP.

The latest success comes a day after secu-rity forces eliminated a Pakistani militant ofLashker-e-Toiba (LeT) outfit in Sopore areaof north Kashmir's Baramulla district.

An ayush wing was being established in allthe hospitals of Haryana for which 550 doc-tors would have to do a refresher courseunder the supervision of the yoga guru, MrVij said, adding that Anaganvadi teacherswould also be imparted training in yoga.

I-T probes ...Corporation Pvt Ltd received cash from

certain companies of the Group through theangadias/hawala operator in Delhi.

The report of February last year, however,does not say what the money was used for.

The I-T department investigation said com-pany's Deputy General Manager (Accounts)Anand Kumar Saxena admitted "that theunaccounted cash used to be received by himat the office premises of ABMCPL throughvarious angadias."

The probe put the undisclosed income atRs 203.18 crore in hands of different persons.

When contacted, the company reacted say-ing, "in some quarters of the media, reportshave been quoted totally out of context."

The company said the Group has alreadymade it clear through its press release on

October 17, 2013 that it was both takenaback and concerned about the money seizedin one of the group company's premises.

"We are aware that some of the employeesof the group company's Delhi office havebeen questioned by the investigating agency.We are not privy to what they have stated tothe investigating agency which has beenreported in one of the newspapers. And there-fore we would not wish to comment at thisstage," it said.

The company would continue to extendfull cooperation to the agencies as and whenrequired, it said.

On a tip off from CBI, which was probingallocation of coal blocks to Birla's HindalcoIndustries, the I-T department had onOctober 16, 2013 carried out search atABMCPL's office here and claimed to haverecovered over Rs 25 crore in cash and anumber of "incriminating" documents.

The probe says a local hawala operator hadadmitted that he used to deliver cash toSaxena after receiving it from Mumbai.

Of the Rs 203 crore undisclosed income,Rs 55.73 crore was attributal to Amitabh forfiscal years from 2007-08 to 2013-14, whileRs 34.63 crore was related to SunbeamTrading & Investments Pvt Ltd for four yearsbeginning 2007-08. Another Rs 1.73 crorewas attributed to one Vijay Mundhra.

However, hours after the press conferenceKejriwal took a swipe at Ilmi by re-tweetingone of her tweets, dated November 21, 2013titled 'Hypocrisy, thy name is BJP'. The tweetby Ilmi, who was in AAP at that time, criti-cises the BJP and the Congress over theirfunding.

Ilmi, a prominent woman and minority faceof the AAP, had contested the 2013 Assemblypolls from RK Puram and lost by a slendermargin. The party then wanted to pit heragainst Congress president Sonia Gandhi in2014 Lok Sabha polls from Rae Bareli, butshe refused. Rejecting her demand to contestfrom Delhi, the party finally fielded her fromGhaziabad. From there also, Ilmi suffered adrubbing.

Ilmi quit the party lashing out at a "coterie"surrounding Kejriwal, just days after theparty faced a severe drubbing in the LokSabha polls.

The former AAP leader had also participat-ed in Delhi BJP's Swachch Bharat Abiyaanrecently, but did not join the party then.Sources in the BJP said the former AAPleader could join the party in two or threedays.

The skill of doing research,the hard preparation need-ed for doing new and

original work — going beyondthe old established knowledge,and indeed the courage to thinkin novel and daring lines — areall immensely helped by goodand exciting teaching. For me,this began at home. My grandfa-ther Kshiti Mohan Sen, whotaught at Santiniketan, couldexcite my interest in Sanskritstudies, including heretical textsin Sanskrit, which still inspiremy engagement in that wonder-ful language, as I pick up a bookin Sanskrit today. Sanskrit, wehave to remember, is not onlythe language in which the Hinduand many of the Buddhist textscame; it is also the vehicle,among many other radicalthoughts, of comprehensivedoubts about the supernaturalexpressed in the Lokayata texts,and also the medium in whichthe questioning of class andcaste and legitimacy of powerwould be expressed with spec-tacular eloquence by Shudrakain his profound play,“Mricchakatikam” (“The LittleClay Cart”). It was great for meto be taught at a very early agethe distinction between a greatlanguage as a general vehicle ofthought and the specific ideas —religious or sceptical — thatmay be expressed in that lan-guage. That distinction remainsimportant today.

I also have to acknowledge mydebt to my other teachers — inSantiniketan, at PresidencyCollege, and at Trinity Collegein Cambridge — in helping meto find my way. I am delightedthat the Infosys Foundation hasinitiated a new scheme for thetraining of rural teachers ofmathematics and science. Sinceour school education is the basisof all our education — no matterhow “high” our higher educationmaybe — the fruits of invest-ment in good school educationcan be extraordinarily high.

Narayana Murthy, who like megrew up in a family of teachers,knows that with visionaryinsight.

Wider role of teaching

I also want to say a few thingsabout the wider role of teaching— in linking different nationsand different cultures together.Teaching is not just a matter ofinstruction given by teachers totheir individual students. The

progress of science and ofknowledge depends in generalon the learning that one nation,one group of people, derivesfrom what has been achieved byother nations and other groupsof people.

For example, the golden ageof Indian mathematics, whichchanged the face of mathematicsin the world, was roughly fromthe fifth to the 12th century, andits beginning was directlyinspired by what we Indianswere learning from work done inBabylon, Greece and Rome. Tobe sure, there was an Indian tra-dition of analytical thinkinggoing back much further, onwhich the stellar outbursts ofmathematical work in Indiafrom around the fifth centurydrew, but we learned a lot abouttheorems and proofs and rigor-ous mathematical reasoning

from the Greeks and the Romansand the Babylonians. There is noshame in learning from others,and then putting what we havelearned to good use, and goingon to create new knowledge,new understanding, andthrillingly novel ideas andresults.

Indians of course were teach-ing other Indians. Perhaps themost powerful mathematician ofancient India, Brahmagupta,

would not have been able to dosuch dazzling work without hishaving been influenced by theideas of his own teachers, in par-ticular Aryabhata, the pioneer-ing leader of the Indian schoolof mathematics. Alberuni, theIranian mathematician, whospent many years in India fromthe end of the 10th to the earlyyears of the 11th century (andhelped to make Arab mathemati-cians learn even more fromIndian mathematics than theywere already doing) thought thatBrahmagupta was perhaps thefinest mathematician andastronomer in India, and possi-bly in the world, and yet (arguedAlberuni), Brahmagupta couldbe so productive only by stand-ing on the shoulders of the greatAryabhata, who was not only anextraordinary scientist andmathematician, but also a superbteacher. Learning from each

other continued over centuries,involving — in addition toAryabhata and Brahmagupta —Varahamihira and Bhaskara,among many others.

And just as Indian mathemati-cians learned something fromBabylonians, Greeks andRomans, they also taught somebrilliantly new ideas to mathe-maticians elsewhere in theworld. For example, Yi Xing [I-Hsing], who lived in China

between the seventh and theeighth century, and who was, asJoseph Needham describes him,probably the finest Chinesemathematician of his time, knewall the relevant Indian texts. TheChinese mathematicians as wellas the pioneering Arab mathe-maticians, including AlKhwarazmi (from whose namethe term “algorithm” is derived),all knew Sanskrit and theSanskritic literature in maths.What we are admiring here isnot Indian mathematics done insplendid isolation (that rarelyoccurs anywhere in the world),but mathematics done with ahuge role of international andinterregional exchange of ideas.Indian research was deeplyinfluenced by the knowledge offoreign works on the subject,and in turn, Indian maths influ-enced mathematical work evenin those countries, including

Greece and Rome and Baghdad,from where Indians themselveshad learned many things.

Interconnections of traditions

Let me end with an example.The history of the term “sine” inTrigonometry illustrates how welearn from each other. Thattrigonometric idea was welldeveloped by Aryabhata, whocalled it jya-ardha, and some-times shortened it to jya. TheArab mathematicians, usingAryabhata’s idea, called it“jiba,” which is phoneticallyclose. But jiba is a meaninglesssound in Arabic, but jaib, whichhas the same consonants, is agood Arabic word, and since theArabic script does not specifyvowels, the later generation ofArab mathematicians used theterm jaib, which means a bay ora cove. Then in 1150, when theItalian mathematician, Gherardoof Cremona, translated the wordinto Latin, he used the Latinword “sinus,” which means abay or a cove in Latin. And it isfrom this — the Latin sinus —that the modern trigonometricterms “sine” is derived. In thisone word we see the intercon-nection of three mathematicaltraditions — Indian, Arabic andEuropean.

Teaching and learning areactivities that link people togeth-er. Even as we celebrate scienceand research, we have to recog-nise the role of teaching and thatof learning from each other —from our teachers, from our col-leagues, from our students, fromour friends, and from our fellowhuman beings. There is some-thing extraordinarily great inthese interconnections.

The Union government has agreed, “in letter andspirit”, to implement the Supreme Court directionand the Election Commission’s recommendation to

allow Non-Resident Indians to vote from overseas throughpostal ballots. Given the large NRI community dispersedglobally, this move will undoubtedly have an impact onthe country’s electoral politics in significant ways.Parliament passed the Representation of the People(Amendment) Act in 2010 to introduce Section 20A thatenables a person who is a citizen of India, and is awayfrom her ordinary residence in India for employment, edu-cation or other reasons, to be eligible to be registered as avoter in the constituency mentioned in her Indian pass-port: before that amendment, only “ordinary residents”could cast their vote. Although the 2010 amendmentintended to include NRI participation in national politics,Section 20A had required NRIs to be physically present intheir respective constituencies at the time of elections.Making it impractical for voters, this requirement defeat-ed the intention of the legislature. A petition was filed inthe Supreme Court praying that Section 20A of the Act beread down so as to allow NRIs to vote from abroad with-out having to be present in India. The petition argued thatthe provision was in violation of Article 14 of theConstitution to the extent that it impliedly treated personson a different footing based on economic classifications.The Supreme Court and the government agreed with thiscontention without hesitation. The traditional argumentagainst such external voting has been that only citizenswho are present in the territory and affected by the conse-quences of their vote should be entitled to vote. As per thisargument, since NRIs lacked sound knowledge aboutdomestic conditions, they would be irresponsible in theirelectoral choices. But this argument is fast being dis-proved by empirical evidence. With the rapid increase incross-border migrations, the concept of nationhood andpolitical membership is increasingly being decoupledfrom territorial locations. India’s move towards enablingvoting from overseas is an instance of a larger global trendtowards increased citizen participation. The InternationalInstitute for Democracy and Electoral Assistance, an inter-governmental organisation, lists different voting methodsthat can be employed, such as “personal voting”, wherevoters can cast their vote at diplomatic missions abroad;“postal ballot method”, where votes are sent by regularpost; “proxy vote” and “electronic voting”. From amongstthese alternatives, the government has decided to employthe postal ballot route that the electoral system alreadyuses for absentee-voters on official duty.

This article will not go into thequestion of the propriety of theordinance route to legislation

in this case, but will try to present abroad-brush picture of what the ordi-nance does to The Right to FairCompensation and Transparency inLand Acquisition, Rehabilitation andResettlement Act 2013, hereafterLARR Act 2013.

The general industry view, accept-ed by the present government, is thatthe LARR Act 2013 was a radical anddraconian law which will bringindustrial development to a halt. Thatview led to the conclusion that theAct needed to be urgently amendeddrastically. It is therefore necessaryto take a brief look at the history ofthe Act.

Attempt at fair resolution

The inter-ministerial debate on anational displacement/rehabilitationpolicy and on the related issue of aneed to overhaul the colonial LandAcquisition Act 1894 began in the1980s and continued over nearlythree decades under successive gov-ernments. In parallel, there were con-ferences and debates in civil societytoo. The attempt to find a generallyacceptable compromise which wouldreconcile the conflicting interests ofindustry and farmers/landownerscontinued intermittently. Eventuallythis resulted in the LARR Act 2013.This was generally considered a well-meant attempt at a fair resolution of adifficult and almost intractable con-flict, though it continued to be criti-cised by both sides to the conflict.The point to note is that the LARRAct 2013 was not a hasty doctrinaire,ill-considered piece of legislation,but the final outcome of almost threedecades of debate and consultationwithin government, among politicalparties and between state and civilsociety. The Bharatiya Janata Party(National Democratic Alliance) wasa party to the passing of the 2013 Act.Barely a year later, with little experi-ence of its working, that Act is nowregarded as wholly retrograde, unac-ceptable and in need of root-and-branch “reform”. This arises out ofindustry’s impatient desire for the

easy acquisition of land for its proj-ects, and the centrality of industry inthe present government’s view of“development”.

It is not being argued that the con-

cerns expressed by industry and bycommentators sympathetic to itshould not be considered, or that thegovernment’s desire to accelerateindustrial projects is illegitimate.However, given those concerns, thegovernment could have reopened thedebate, held wide-ranging consulta-tions all over the country, and tried toarrive at a fresh compromise betweenconflicting interests. Instead, it haswholly accepted one perception ofthe conflict, and sought to undo thecompromise embodied in the 2013Act without a review. Apart from themerits of the ordinance, this is anauthoritarian, partisan and undemoc-ratic procedure.

Losing a way of life

It has been argued that develop-ment necessarily entails the transferof land from agriculture to industry,but this is something that happensover a period of time. It does not fol-low that this must be actively facili-

tated, supported and actually broughtabout by the state using its sovereignpowers. It is curious that those whoargue for reducing the role of thestate and “deregulating” industrywant the state to take land away from

farmers and give it to industry.

Should the process of diversion ofland from agricultural use to industri-al use be in fact easy? Should therenot be some salutary difficulty here?First, there is the question of foodsecurity. The transfer of land fromagriculture to other use cannot andshould not be prevented, but someconsideration of what the unregulat-ed transfer of land away from agri-culture implies for the food securityof the country seems necessary.LARR 2013 ruled out the acquisitionof multi-cropped agricultural land.That provision has been criticised,but it showed a certain concern thatwas legitimate. That concern has dis-appeared in the present ordinance.

A second justification for a degreeof difficulty in land acquisition is theprotection of the interests of thelandowner. No doubt the ordinanceretains the generous compensationprovisions of the 2013 Act, but is it

solely a question of money? Theacquisition of land means not merelyloss of land and homestead, but alsoloss of livelihoods, loss of a commu-nity and cultural continuities, loss ofa way of life. This is bound to be a

traumatic experience. The SocialImpact Assessment (SIA) provisionsof the 2013 Act would have broughtto notice the wider social and cultur-al implications of the acquisition ofland, but that Act itself had exemptedirrigation projects from this require-ment, and now SIA has been virtual-ly dropped in the amendment ordi-nance, considering the very largenumber of cases to which it will notapply.

The role of the state should surelybe not merely to facilitate the avail-ability of land for industry but also tominimise pain to the landowners(who are also citizens), protect theirfundamental and human rights andensure justice to them. Should thestate use its sovereign powers only tomake things easy for industry? Anysuch impression, if it gains ground,would unwittingly lend weight tocriticisms (doubtless wrong) of thepresent government as pro-industryand anti-farmer, and as holding

“development” to be synonymouswith industrial projects.

Acquisition by the state

Let us turn to eminent domain,which means the sovereign right of

the state to override private property.In the intermittent debate during theyears from the 1980s to 2013, thiswas a prominent issue. It was felt bymany that the continued use of theold colonial Act of 1894 for theacquisition of land was unfortunate,and that there was no case at all forthe state to exercise its sovereignpower to take over private propertyand give it to companies in the pri-vate sector for “projects” regarded bythe state as serving a “public pur-pose”. While this was not the univer-sal view, there was a strong body ofopinion in favour of limiting acquisi-tion by the state for private entities.The 2013 Act met this partially bylimiting the acquisition by the state to20 per cent in the case of a privatecompany and 30 per cent in that of apublic-private partnership (PPP)project, if the owners’ consent for thetransfer of 80 per cent in the case ofthe former and 70 per cent in that ofthe latter had been obtained. Thismeant that the view of the communi-

ty as a whole on the transfer of landhad a certain weight. This safeguardvirtually disappears in the ordinancebecause it will not apply in mostcases. Apart from the virtual drop-ping of community consent, thischange also means the return of theeminent domain of the state in fullstrength. This again is a non-demo-cratic, authoritarian stance.

By way of a digression it may beadded that property rights are pre-sumably sacrosanct in capitalism, butevidently this does not apply to afarmer’s right to his or her land. Theproperty of an industrialist is invio-lable, and nationalisation is socialismand therefore anathema; but theacquisition of land from a farmer —which corresponds to nationalisationin the industrial sector — is evident-ly good capitalism!

One has to ask: after the amend-ment what is left of the Act? If weconsider the huge exemption list(Section 10A introduced by the ordi-nance), and the concomitant disap-pearance of the SIA and the 80 percent/70 per cent consent provision inmost cases, it becomes clear that theAct has become purely ornamental.What the ordinance does is not toamend the 2013 Act, but virtuallyrepeal it. Having done so, the ordi-nance sanctimoniously brings acqui-sitions under a number of other Actswithin the purview of the amendedAct and claims much credit for this.The Congress Party says that the cov-erage of those Acts was already fore-seen in the 2013 Act. That responsemisses the point, which is that thereis not much virtue in first renderingthe Act toothless and then bringingother Acts within its purview. This isdisingenuous, to say the least. Onecan only hope that the ordinance willbe withdrawn or lapse for want ofparliamentary support to the neededlegislation. Alas, the hope is not veryrobust.

The inter-ministerial debate on a national displacement/rehabilitation poli-cy and on the related issue of a need to overhaul the colonial Land

Acquisition Act 1894 began in the 1980s and continued over nearly threedecades under successive governments. In parallel, there were conferences

and debates in civil society too. The attempt to find a generally acceptablecompromise which would reconcile the conflicting interests of industry and

farmers/landowners continued intermittently. Eventually this resulted in theLARR Act 2013. This was generally considered a well-meant attempt at a

fair resolution of a difficult and almost intractable conflict, though it contin-ued to be criticised by both sides to the conflict.

the Kerala High Courtseeking further extensionof four months time tocomplete investigation inthe multi-crore land grab-bing cases against SalimRaj, former gunman ofchief minister OommenChandy.

The court had earliergranted six months timefor investigation, whichwill end on January 28.

According to CBI, thereare 27 accused in the caseand voluminous recordsand documents have to beperused for which moretime was required.

The court had directed

the CBI probe on a petitionby some persons whichmade serious allegationsagainst RevenueDepartment officials ofcolluding and conspiringwith Salim Raj in forgingand fabricating false docu-

ments and records for thepurpose of defeating thetitle deeds of their lands atKadakampally andEdapally. The court hadobserved that the accusa-tions have prima facieground of evidence.

MANGALURU, JAN 15A local Congress leader has

launched Bharatiya HinduParishad, in a move touted asan attempt to counter theaggressive growth of SanghParivar outfits.

The new outfit, described asa "secular" organisation topromote the "true Hindu spir-it" was launched at Puttur inMangaluru district with thetrappings of a Sangh Parivarevent amid chanting of hymnsin the presence of religiousleaders. The organisation waslaunched by ShriKeshavananda Bharati ofEdneer Math in Kerala'sKasaragod district. The func-tion was also attended byEsha Vithaladasa Swamiji ofShri Kemaru Math.

The initiative for floating

the outfit has been taken byprominent Congress workersbelonging to the Hindu com-munity spearheaded by theparty's Puttur block CongressPresident Kavu HemanathShetty who says Hinduismwas "no one's property."

At the function, Shetty,BHP founder president, saidthe organisation was apoliti-cal and not connected toCongress. Shetty said hisorganisation would worktowards social harmony andpeaceful coexistence with dif-ferent communities.

The coastal districts ofMangaluru and Udupi havebeen strongholds of BJP witha widespread influence ofSangh Partivar outfits, partic-ularly of its ideological foun-tainhead RSS.

The development hasstirred a hornet's nest in thedistrict. Chief MinisterSiddaramaiah has saidCongress believed in the phi-losophy of secularism andtreats all castes and religions,including Hinduism, equally.There was no need for theparty to tilt towards any reli-gion, he said. Launching theoutfit, Bharati said religionand faith should not be themonopoly of any politicalparty or groups. Comparingorganisations with attiresadorning the body, he said theattires could be removed butfaith would be unflinching.

He hoped the new organisa-tion would strive to createawareness among 'genuine'Hindus and would not be anaffiliate of any political party.

vest festival, was celebratedThursday with pomp and gaietyacross Andhra Pradesh andTelangana.

The countryside in both the Telugustates wore a festive look with deco-rated houses, kite-flying, cockfights,bull-fights and other rural sports.

On the second day of the three-dayfestival, people dressed in their bestthronged temples to offer prayers.

This is the first Sankranti afterbifurcation of Andhra Pradesh toform Telangana as a separate state.

Villages in both the states camealive with Sankranti, one of themajor festivals. It was time for fami-lies to come together. People fromdifferent parts of the country and

even abroad joined their near anddear ones for the festival.

Lakhs of people from Hyderabadleft for their homes in neighbouringAndhra Pradesh for the celebrations,leaving the city's roads almost desert-ed.

Womenfolk decorate the front-yardof houses with Rangoli. They setcow-dung balls called as'Gobbemma' and placed among theRangoli patterns. They also put freshharvest of rice, turmeric and sugar-cane.

The houses were decorated withmarigold flowers and mango leaves.

The women also prepared'chakkara pongal' or rice kheer, a spe-cial dish made of new rice, jaggeryand milk. The dish is allowed to boilover which symbolises abundance.

World Bank to giveaid for building toiletsin ChhattisgarhRAIPUR, JAN 15

World Bank will extend finan-cial aid to build toilets in tribal-dominated villages ofChhattisgarh under Centre's flag-ship 'Swachh Bharat Abhiyan'.

World bank will give an aid ofRs 240 crore in next five years tothe Centre for constructing toi-lets in households in the tribalareas and also for running pro-posed awareness campaigns, anofficial release said here onThursday.

Under the programme, cam-paigns will be run to encouragevillagers to build toilets in theirhouses and use them instead ofgoing for open defecation. Itshall be ensured that by 2019 nota single household in tribal areasis left which without a toilet.

Chhattisgarh is among fivestates in the country which willbe given aid by the World Bank,it said.

GUWAHATI, JAN 15In major breakthrough,

the National InvestigationAgency (NIA) on Thursdaysucceeded in nabbing a topcommander of bannedNDFB-S militant outfitallegedly responsible ofkilling of women and chil-dren at Sonitpur of Assamin December last year.

Some other reports saidthat three Bodo militants -Ajoi Basumatary, DilipBasumatary and KhamreiBasumatary – were arrestedin a joint operation by theNIA and Nagaland Police.

The fresh arrest comesdays after the chief recruit-ing officer of militant outfitNDFB(S), who is believed

to be the brain behind theDecember killings ofAdivasis in Assam, wasarrested along with sevenothers in a joint-operationby the army and the statepolice. Self-styled 2ndLieutenant Enon Bargoyary

alias Erkhang, ChiefRecruiting Officer ofNDFB(S), and self-styledplatoon commander ofAmteka area, RinenBasumatary alias Majhiwere apprehended by jointteam of army troops of Red

Horn Division and AssamPolice along the jungles ofAssam?Bhutan Border, inChirang District.

Enon is also the militantgroup's Central CommitteeMember, army sourcessaid. A senior army officerdescribed him as number 3in hierarchy within the mil-itant organisation.

Enon was allegedlyinvolved in recruiting andmotivating NDFB(S) ter-rorists, including womencadres, and sending them tovarious camps outside thecountry, the sources said.Another key NDFB(S)member apprehended isRinen of the outfit's 20thbatch trained in Bhutan,

who surrendered afterOperation All Clear in 2003but rejoined the group twoyears back.

Four weapons -two AKrifles and two pistols -andlarge quantity of ammuni-tion were recovered fromthe apprehended persons,the sources said.

The army has been carry-ing out operations in diffi-cult and inaccessible forest-ed areas of Kokrajhar andChirang Districts which hasforced NDFB(S) terroriststo flee from their safe hide-outs and move to more vul-nerable areas, where theyare being apprehended orneutralised by the securityforces.

He said that extra vigil is beingmaintained at every entry and exitpoints of Jammu and every vehicle

entering or leaving the region isbeing frisked.

The army today said that 200heavily armed militants were wait-ing in 36 launching pads across theLine of Control (LoC) on the otherside of Pir Panchal range to sneakinto the Indian Territory to launcha terrorist attack on the Indian soilahead of Obama's India visit.

"There are general inputs thatterrorists might try to attack softtargets including schools, religiousplaces, army convoys and othercivilian areas. There are 200 terror-ists waiting in 36 launching padsacross the border on the other sideof the Pir Panjal range to sneakinto Indian side, we have so farbeen able to foil their attempts,"General Officer Commanding(GOC), 16 Corps, Lt Gen K HSingh said.

He said that the army was fullyprepared to deal with any sucheventuality and that security agen-cies have increased their vigil so as

to thwart the nefarious designs ofmilitant outfits.

In the wake of spike in cross bor-der firing from the

Pakistani side, the BorderSecurity Force (BSF) too hasintensified its vigil along theInternational Border in the region.

"Taking advantage of the crossborder firing, the militants try tosneak into the Indian side to createdisturbances. Despite the increasein the firing incidents, we havemade sure that they don't succeedin their attempts," a BSF officialsaid.

He said that in view of the spe-cific inputs that infiltration bidsmay increase ahead of theRepublic Day, the paramilitaryforce has escalated its vigil on thefrontier.

"The vigil along the IB is neverdown, there is always an increasedvigil there and in view of the intel-ligence inputs, the monitoring hasbeen intensified," he said.

App ranking and analytics firmappFigures has revealed thatGoogle's Play store in 2014 jumped

ahead of Apple's App Store in terms of thetotal number of apps for the first time, withover 1.43 million apps compared to 1.21million. The report also claims thatGoogle's Android developer communitygrew faster than Apple's iOS counterpartfor the third year in a row.

In a report titled "App Stores GrowthAccelerates in 2014", the company haspublished a growth chart showing how thethree major app stores - Amazon Appstore,Apple's App Store, and Google Play -placed themselves in terms of number ofapps. The firm claims that Amazon'sAppstore despite being the third showed agrowth of nearly 90 percent to reach293,000 apps.

With Google Play visibly behind Apple'sApp Store at the end of 2013 (as seen in theabove charts), and it now being ahead, it isimplied Google added more apps thanApple in 2014. appFigures adds that thiswas the first time Google Play added moreapps in a year than Apple's App store.

The report also reveals the number of appdevelopers who published apps in the dif-ferent stores. "Google Play's developercommunity grew tremendously in 2014,exceeding Apple for the 3rd year in a row.In fact, Google Play is distributing appsfrom nearly 400k different developers," itadded. In 2014, Google saw more develop-ers joining than Amazon and Apple com-bined, says the report.

Currently, Google Play has 388,000developers compared to Apple with282,000 developers and Amazon with48,000 developers, adds the report.Additionally, Google also saw a rise in

Android apps released in 2014 with moredevelopers releasing their apps on GooglePlay than Apple and Amazon combined.appFigures claims that Google Play dou-bled the number of apps in 2014.

Xiaomi's 2014 flagshipsmartphone, the Mi 4,will be launching in

India by the end of this month.The news was confirmed toNDTV Gadgets by XiaomiIndia Head Manu Kumar Jain atthe sidelines of the Beijingevent. Unfortunately, no specif-ic release date or pricing infor-mation was revealed.

Jain also revealed thatXiaomi's first R&D (Researchand Development) centre inBengaluru will be ready byApril this year. He claimed thatthe centre is spread over 20,000square feet.

On being asked about theXiaomi Mi Note launch inIndia, Jain declined to reveal atime frame, and only said,"India is a priority market andthe launch is definitely in thepipeline".

Considering that Xiaomi is nolonger selling its former flag-ship in India, the Mi 3, thelaunch of the Xiaomi Mi 4 cer-tainly fits in with the company'sstrategy as it needs a flagship inits India portfolio to make up.

Intense mosturisers: Massage a mix of castor oil and cocoa butter

on the area. This will provide intense hydration.

Aloe vera: Aloe vera has healing and soothing properties.

You can take a stem of aloe vera and scoop outthe fresh pulp. Rub this gently on the marks foraround 10 minutes. Leave it on for another fiveminutes, then rinse off.

Vitamin application:Break open a few Vitamin E and A capsules.

Now, mix both and apply on the marks till it getsabsorbed totally.

Oil massage: Sweet almond oil, mixed with wheatgerm and

argan oil can help. When this is massaged twiceevery day on the stomach, from the firsttrimester of pregnancy, stretch marks are not

formed.

different issue that they hesitate toadmit their condition in public. Butthe reigning queen of Bollywood,Deepika Padukone accepted in aninterview with Hindustan Times thatshe has gone through depression dur-ing the shooting of ‘Happy New Year’and consulted a psychologist andcame out of the disease as a winner.

Deepika said in the interview, "Inearly 2014, while I was being appreci-ated for my work, one morning, Iwoke up feeling different. A day earli-er, I had fainted due to exhaustion; itwas all downhill from there. I felt astrange emptiness in my stomach.

I thought it was stress, so I tried todistract myself by focusing on work,

and surrounding myself with people,which helped for a while. But the nag-ging feeling didn’t go away. Mybreath was shallow, I suffered fromlack of concentration and I brokedown often. Over a period of time, itgot worse. When my parents visited, Iwould put up a brave front becausethey were worried about me livingalone and working long hours.

Then, once, while talking to mymother (Ujjala Padukone), I brokedown. She realised the problem, andgot in touch with a psychologistfriend, Anna Chandy, to get to the rootof the cause. Every morning, it was astruggle to wake up, and shoot forHappy New Year’s (HNY; 2014) cli-max. Finally, I had a word with Annaaunty. She flew to Mumbai fromBengaluru, and I talked mya heart out

to her. She concluded that I was suf-fering from anxiety and depression.

When she suggested I take medica-tion, I was resistant. I thought talkingwas enough. Later, I met another psy-chologist, Dr Shyam Bhatt, inBengaluru for a second opinion.

There were days when I would feelokay, but at times, within a day, therewas a roller-coaster of feelings.Finally, I accepted my condition. Thecounselling helped, but only to anextent. Then, I took medication, andtoday I am much better".

Depression is a widespread disease,the actress feels that at times, thepatient just wants to talk, and isn’tseeking advice. But, well-wisherssaying things like, ‘Don’t worry, itwill all be alright,’ might be detrimen-tal.
