    ARTICLE I.This organization shall be known as the Amateur Athletic UnionOF THE United States. ARTICLE II.

    objects.The objects of this Union are :1. The encouragement of systematic physical exercise and educa-

    tion in the United States.2. The improvement and promotion of athletic sports among

    amateurs.3. Tlie incorporation of all eligible amateur athletic clubs in the

    United States into such separate Associations of clubs, with activemembership and representation in this Union, as may, from time totime, be deemed best adapted to advance the cause of amateur athleticsthroughout the United States, and to foster and promote the interestsof the several clubs.

    4. The establishment and maintenance, by allied membership orotherwise, of alliances with associations of general or special jurisdic-tion, and composed of clubs or otherwise designated bodies of individ-ual members, devoted wholly or partially to physical culture, or tosome specialty in athletics.

    5. The establishment and maintenance throughout the UnitedStates of a uniform test of amateur standing, and uniform rulesfor the government of all athletic sports within its jurisdiction.

    MEMIJKRS.1. This Union shall consist of allied and active members.2. Allied members are such associations (described in Section 4,

    Article II., of this Constitution) as may enter into alliance with thisUnion, as h.ereinafter provided.

    ARTICLE IV.CONDITIONS OF MEMBERSHIP.

    1. An allied member may at any time be admitted by a two-thirdsvote of the Board of Governors of this Union, upon such conditions,consistent wdth the provisions of this Constitution, as may be agreedupon between such proposed allied member SiwA the Board of Governors.

    2. An active member may at any time be admitted upon the follow-ing conditions : [a) That application in writing, in the form pre-scribed by the By-l>aws of this Union, be made to the Secretary ofthe Union. [l>) That such membership shall be subject to suspensionor forfeiture in the event of failure to comply -with any requirementsof this Constitution, or of any By-Law hereunder, or any decree orruling of tlie Board of Governors ; and it is expressly stipulated thatany decree of suspension or forfeiture, when ai'firmed by two-thirds of

    3() CONSTITUTION.tlie l>oard of Governors, sliall be final and binding, (c) That it shallnot make any amendment of its Constitution, By-Laivs or Rules,without first submitting the proposed amendment to the Board ofGovernors of this Union, and that any such amendment made withoutthe vote of a majority of the Board of Governors shall be void, (d) Thatin the event of its club membership being reduced to less than fourclubs its membership in this Union shall cease, and this Union shallbe entitled to allot its surviving clubs and territory to any other activemember, {e) That in the event of any clubs making formal applica-tion to be admitted, as a separate association, to active membership inthis Union, this Union shall be empowered, in its discretion, by a tico-thirds vote of its Board of Governors, to admit the same as an activemember, and to allot its territory. (/) That all games or athleticmeetings given or sanctioned by such member, and the qualificationsof all persons competing at such meetings, either as members of itsclubs or as unattached athletes, shall be in conformity with the " Con-ditions of Competition" prescri1)ed by this Constitution, and the By-Laws and Rules adopted and prescribed by the Board of Governors.(^g) That such membership shall take effect upon the election of theapplicant by a two-thirds vote of the Board of Governors. (//) Theprescribed form of Constitution, By-Laws and Rules of each of theAssociations, specified in Section 3 of Article III. of this Constitution,upon their assuming active membership in this Union, is appended tothis Constitution. ARTICLE V.

    OBLIGATION, SUSPENSION AND EXPULSION OF MEMBERS.1. The acceptance of allied membership in this Union by any allied

    Association shall operate as an agreement binding upon this Unionand such allied member ; that both will abide by the terms of thealliance until either party, upon .f//r/^ notice as agreed ufo)i in the termsof alliance, shall voluntarily withdraw therefrom.

    2. The acceptance of active membership in this Union shall bindsuch member to abide by all the conditions thereof as set forth inSection 2 of Article IV. of this Constitution, and also all other pro-visions of this Constitution and of the By-Laws and Rules of thisUnion ; and to accept and enforce all decisions of the Board ofGovernors.

    CONSTITUTION. 313, Any violation of the Constitution, By-Laws or Rules of this

    Union, or decisions of the Board of Governors, by any active memberof this Union, shall render such member liable to suspension by theBoard of Governors until the next annual or special meeting of thisUnion, and to expulsion by a two-thirds vote of all the active mem-bers represented at such meeting.

    ARTICLE VLREPRESENTATION OF MEMBERS.

    1. Every allied member shall be entitled (unless otherwise pro-vided in the terms of alliance) to be represented at every meeting ofthis Union by not more than four delegates or duly appointed alter-nates of such delegates, having, collectively, one vote.

    2. Every active member must appoint six delegates to represent itat every meeting of the Union, and such delegates must be amateurmembers in good standing of clubs belonging to such member, andmay also appoint six alternates of such delegates, who must be aiiia-tcur members of any of its own or of any other active member's clubs,except that no member of the Board of Governors shall be ap.pointedan alternate, and in no case shall any delegate or alternate representmore than one active or allied member. All the representatives of oneactive member shall collectively have one vote.

    3. The appointment of every delegate and alternate shall be dulycertified by the principal executive ofiicer of the appointing member.

    4. All members of the Board of Governors shall be elected fromthe duly appointed delegates. No alternate shall be elected a mem-ber of the Board.

    5. Election of members of the Board of Governors shall occur atthe annual meeting and by majority vote of delegates present andentitled to vote. The Board of Governors, upon the occurrence of avacancy therein, from any cause, may elect a new member of saidBoard, but only from the member's delegation in which the saidvacancy shall have occurred. Such member so elected shall, if hecontinues eligible, serve until the next annual meeting thereafter.

    6. Any allied or active member may at any time, on noticeaddressed to the Secretary of this Union by the chief executive officerof such member, withdraw any or all of its delegates, provided a like

    7. No allied or active member, delegate, alternate, officer or mem-ber of the Board of Governors shall at any time be entitled to berepresented by proxy, and in no case shall any delegate or alternaterepresent more than one active or allied 7/iember.

    ARTICLE VII.GOVERNMENT.

    1. The government and general direction of the affairs of the Unionshall be committed to a Board of Governors constituted as follows :One representative from each allied member and five delegates-at-large ; three representatives from each active member, and oneadditional representative from each active member for each twenty-five clubs above the four clubs required to constitute an active mon-ber, belonging to said active member.

    2. The Board of Governors shall be elected at each annual meetingof the Union, for a term of one year, or until their successors areelected.

    3. The Bo^rd of Governors, so elected, shall from among its num-ber elect a President, /c/zr Vice-Presidents, a Secretary and a Treas-urer, each of whom sliall serve for a term of one year or until hissuccessor is chosen, and each of whom shall perform the duties pre-scribed by the By-Laws.

    ARTICLE VIII.DUTIES AND POWERS OF BOARD OF GOVERNORS.

    The Board of Governors shall, in addition to the powers elsewherein this Constitution prescribed, have power, and it shall be theirduty :

    1. To admit to allied or active membership any Association eligibleunder this Constitution applying therefor, if by a two-thirds vote theydeem proper.

    2. To prescribe and amend By-Laws and Rules for the governmentof the Union, not inconsistent with or beyond the scope of the pro-visions of this Constitution.

    CONSTITUTION. 353. To fix and enforce ])cnaUies for any violation of the Constitu-

    tion, By-Laws or Rules of the Union.4. By a majority vote to remove an^ suspension, remit any penalty,pertaining to any athlete, and to reinstate any disqualified athlete.5. To reject any entries to competition (if deemed objectionable)

    at any national championship meeting, and to delegate this power toits sub-committees.

    6. By a two-thirds vote to remove from office on fifteen days'written notice any member of the Board of Governors who, by neglectof duty or l>y conduct tending to impair his usefulness as a memberof such Board, shall be deemed to have forfeited his position.

    7. By a majority vote to declare vacant the position of any memberof the Board of Governors (a) who shall have ceased to be a delegate,or {b) who shall have ceased to be a member of any club belonging tothe member which elected him a delegate, or {c) when the memberwhich elected him a delegate shaU have ceased to be a member ofthis Union.

    8. To fill vacancies in the Board of Governors occurring from anycause.g. To collect the dues or funds of the Union and to expend the

    same.10. To call regular and special meetings of the Union and to fix

    the time and place for holding all meetings not fixed by this Consti-tution. At any such meeting five duly elected members shall consti-tute a quorum. At any meeting of the Board of Governors a quorumshall consist of those zvho answer the roll call.

    11. To institute, locate, conduct and manage all amateur nationalchampionship meetings.

    12. To establish and define rules for the government of athleticsports.

    13. To explain, define and interpret any provision of this Constitu-tion or any By-Law or Rule.

    14. To appoint committees from its own number iiwd fro //i membersof clubs within this Union or its allied members,15. To appoint from among the mejnbership of each active or allied

    meniber of this Union five delegates-at-large, who shall have all therights andprivileges of the Board of Governors.

    CONSTITUTION. 3716. The Board, or any committee of the Board, appointed by it for

    the purpose, shall have jurisdiction as trial judges as follows : (a)Original jurisdiction to try causes hetween two active members,or between an allied member and an active member, or betweenone active meiiil)er and a club memljer or member of aclub of another active meml)er, or between club membersof two active members, or as to the amateur standing of any personentering for competition at any meeting held under A. A. U. rules.(/>) Appellate jurisdiction on appeal of either complainant or defendantfrom the judgment of any active member as to the amateur standingof any athlete, or on any agreed case submitted to it on voluntaryappeal by or with the sanction of any member. In any of the fore-going cases affecting the rights or duties of a meml^er, judgmentaffirmed by two-thirds of the Board shall be binding to suspend themember ; and by a majority of the Board, or its Committee, in anycase affecting the amateur standing of aii athlete, to disqualify, tosuspend for a stated period, or to censure such athlete.

    In deciding upon the amateur standing of any athlete this Unionrecognizes as athletic sports the following games :

    CONDITIONS OF COMPETITION.I. No person shall be eligible to compete in any athletic meeting,

    game or entertainment given or sanctioned by this Union or by anyactive member thereof, who has (i) received or competed for compen-sation or reward, in any form, for the display, exercise or example ofhis skill in or knowledge of any athletic exercise, or for renderingpersonal service of any kind to any athletic organization, or for be-coming or continuing a member of any athletic organization ; or (2)has entered any competition under a name other than his own, or froma club of which he was not at that time a member in good standing ;or (3) has entered any competition open to any professional or pro-fessionals, or has competed with any professional for any prize ortoken. Nor shall any person residing within the territory of anyactive member of this Union be eligible to compete for, or to enterany competition as a member of any club in the territory of any otheractive member of this Union, unless he shall have l>een elected tovieinbership in stich elub priqr to April i, l8gi, provided, hozvever, thatthis restriction as to residence shall not apply to undergraduates ; or(4) has pawned, bartered or sold any prize won in athletic competi-tion, or (5) is not a registered athlete.

    2. N'o one shall he eligible to compete in any athletic /neeting, gauieor entertainment, given, or sanctioned by this Union, or by anv activemcDiber thereof, tin less he shall be a duly registered a?nateitr athlete,a member of the club from 7ohich he enters, and sJiall not have competedfrom any other club in this Union during a period of three monthsnext preceding such entry; nor shall any 77iember of any club in thisUnion or any chib in any district in this Union be allowed to competein case he has within one year competed as a member ofany other clubthen in this Union, except zvith the consent of such other club, zinlesssuch other club shall have disbanded or practically ceased to exist; pro-vided that this requirement shall not apply to athletes competingfromcollege athletic organizations; provided, further, that the requirementsof this section shall not apply to any athletic meeting, game or enter-tainment, the entries /'or w]ii( h are confined to members of the club ororganizations giving said meeting, game or entertainment.

    CONSTITUTION. 41N'o person shall be eligible to compete for or to enter any competition

    as a member of any club in the territory of any actire me:iiber of thisUnion, unless he shall have resided zvithin the territory cf said activemember at least 30 days pirvious to entering for competition.

    3. No prizes shall be given by any individual, club, committee orassociation, or competed for or accepted by any athlete, except suitablyinscribed -a'reaths, diplomas, banners, badges, medals, timepieces andmantel ornaments, or articles of jewelry, silverii'are, table or toilet ser-vice, and said prizes shall not exceed the cost of ^35 for first, %2.o forsecond, and %\o for third prize. Suitable team and individual prizesmay be aToardeilf'r team competitions in a single specialty.N'o more than three prizes in all shall be given in any event or com-petition, except in runnijtg or walking races of fve miles or 07'e>-, andin swimming races of one 7nile or over {counting a team prize, allowedas above, as one prize).

    4. The prohibitions of this article shall not apply to tokens or prizes{^other than money), composed in whole or in- part of metal, and bearim^-inscriptions denoting the event or contest, in any case cohere such tokensorprizes shall ha7'e been given or sanctioned by this Union, or any ofits members, or prior t.> the formation- of this Cliion, by any recognizedamateur organization ; provided, that if any person shall, at any timeafter April \, l^C)!, sell, pledge or exchange for any other thing, anysuch token or prize, he shall thereafter be ineligible, and he shall like-raise be ineligible if at the time of the competition or entry therefor hebe disqualified or under suspension by this Union, or any of its mem-bers, or any organization allied with or approved by it.

    5. Persons not debarred by any of the foregoing provisions of thisArticle, or who, having become ineligible by violation thereof or ofany heretofore recognized rule of amateur standing, and have been dulyreinstated^ and shall in other and all respects conform to the rules andregulationj of this Union and its members, will be deemed by thisUnion and by its //lembers amateurs.

    6. The term '' any athletic exercise,'' as used in tJie first section ofthis Article, shall be held to include such sports or exercises, athletic inform or substance, as the Board of Gorernors may define.

    7. The prohibitions of this article shall not be construed to debarthe teams of Union base ball and foot ball clubs from playingprofes-

    ARTICLE XL. DUES AND EXPENSES.

    1. Allied niemhers shall be exempt from the payment of dues.2. Each active member shall annually pay to the Treasurer, at least

    ten days before the annual meeting, as annual dues for the ensuingyear, a sum equal to $5 for each club member of such active member,provided that every applicant for active membership shall remit w itliits application to the Secretary the amount of its annual dues, accord-ing to the foregoing schedule ; and shall not again be liable for thepayment of dues until the year following the next ensuing annualmeeting.

    3. A failure to pay such dues within the time prescribed shalloperate to forfeit the right to a representation of and a vote by thedelinquent member at any meeting of the Union ; and a continuecl in-debtedness for dues or other charges for a period of t7oo months shalloperate as a loss of membership by the delinc[uent member.

    4. The receipts from dues and from national championship meet-ings shall be devoted to defraying tlie cost of nation.al championshipmedals or other tokens, and for printing and other necessary expensesincurred by the Board in behalf of the Union.

    ARTICLE XII.MEETINGS OF THE UNION.

    1. The annual meeting of the Union shall be held at 2 o'clockV. M. on the third Monday in November of each year, in a placeto be designated by a majority of all the members of the Board ofGovernors.

    2. Special meetings of the Union may be called by a two-thirdsvote of the Board of Governors upon not less than te7t days' notice toall members, or upon the written request of at least one-quarter ofall the members of the Union must be called upon like notice, suchnotice to contain the date and a statement of location of such meetingand the object thereof.

    CONSTITUTION. 453. Notice of every meeting of the Union shall be sent hy the

    Secretary of the Union, at the time provided by the Constitution andliy-Laws, to the Secretary of every allied and active member thereof ;and every such mem?)er shall promptly notify the Secretary of theUnion of any cliange in ofifice or address of the Secretary ; and anotice sent by the Secretary of the Union to the address last given bysuch meml)er shall lie deemed a full compliance on his part with theConstitution and By-Laws as to sending such notices.

    4. At all meetings of the Union a quorum shall consist of one ormore delegates from a majority of the combined active and alliedmembers of the Union.

    5. At all meetings of the Union the following shall be the order ofbusiness :

    1. Roll Call of Delegates.2. Reading of Minutes.3. Report of Board of Governors.4. Treasurer's Report.5. Reports of Committees.6. Resolutions, Orders and General Business.7. Election of Board of Governors (if annual meeting).8. Adjournment.

    6. In the interval between two annual meetings of the Union, anyaction that miglit be lawfully taken at a special meeting may be sotaken by mail vote ; ])rovided that where this Constitution retjuires amajority vote, the vote so taken must, to be effective, be a majorityof all members of the Union ; and where this Constitution requires atwo-thirds vote, the vote so taken must, to be effective, be a two-thirds vote of all members of the Union ; and provided further, thatin every instance such mjlil vote shall be taken by the Secretary, andthe ballots of each member must be preserved in his files.

    ARTICLE XIII.PROCEEDINGS OF BOARD OF GOVERNORS.

    I. The annual meeting of the Board of Governors shall be con-vened immediately after the adjournment of the annual meeting ofthe Union.

ARTICLE XIV.

    AMENDMENTS.No amendment shall be made to the Constitution at any meeting

    except l)y a two-thirds vote of the members represented, or l)y mailvote, except by a two-thirds vote of all members of the Union. Andl)efore a vote is taken on any proposed amendment, by mail vote or ata meeting, the said proposed amendment must have been submittedto the Board of Governors, and at least thirty days' notice thereofgiven by the Board to all members of the Union.

    I.

    ELECTION OF OFFICERS.The officers of the Union, viz.: President, fotir Vice-Presidents,

    Secretary and Treasurer, shall be elected by ballot, by a majorityvote, at the annual meeting of the Board of Governors.

    II.DUTIES OF OFFICERS.

    Section i. The President must order meetings of the Board ofGovernors upon request of not less than five of the members thereof ;shall preside at all meetings of said Board and of the Union, andgenerally shall perform such other duties as appertain to the office ofPresident.

    Sec. 2. The Vice-Presidents in their order shall have all thepowers and perform all the duties of President, in the absence or in-ability to act of the latter.

    BY-LAWS. 51of all athletic events held under the auspices of the Union ; and per-form such other duties as may be prescribed by the Constitution, By-Laws and Rules of said Union. He shall turn over to his successor,when elected, all books, records and papers appertaining to his office.

    Sec. 4. The Treasurer shall receive all moneys of the Union andpay all bills approved by tJie President or the Board of Governors,provided that necessary minor expenses, which may necessarily bepaid by any committee, may be turned in to the Treasurer as cash, ifrecorded in detail, duly attested by such committee and approved bythe Board. He shall, whenever required by the Board or its FinanceCommittee, submit and turn over to said committee all moneys,accounts, books, papers, vouchers and records appertaining to hisoffice, and shall turn the same over to his successor when elected.He shall he bonded {at the expense of this Union) in a sum to be fixed

    COMMITTEES.Section i. At the first meeting of the Board of Governors after

    each annual meeting of the A. A. U., the Board shall appoint from itsown members a Nominating Committee, consisting of one man fromeach active and allied member, who shall prepare and submit at thesame meeting, nominations as follows :

    (a) Committees composed exclusively of members of the Board, andeach consisting of three menFinance, Schedule,. Legislation, Trials,Reinstatement, Records, aJid a Registraiioji Coimnittee, consisting ofnot less than three nor more than eight Governors.

    (b) Committee consisting oi five members of the Board, to be kno7imas the Conference Co7nmittee, to serve in all cases tinder existing orproposed alliances and to confer on all questions arising 7oith amateurorganizations.

    Sec. 2. The Finance Comittee shall, within two weeks next fol-lowing the first day of September in each year, audit and examine theaccounts of the Treasurer, and make its report to the Board of Governorsprior to the annual meeting next ensuing said date, for the fiscal yearending on said first day of September. Said Committee shall also atany other times when requested by the Board, make an examinationof the accounts of the Treasurer, and report to the Board thereon, andmay in such cases require the Treasurer to turn over to it all moneys,accounts, books, papers, vouchers and records appertaining to his office.

    Sec. 3. The duties of other committees shall be such as are specifiedin the Constitution and By-Laws, or maybe delegated to them by theBoard.

    IV.MEMBERSHIP IN UNION.

    Section i. Any collection of not less than four clubs which mightas an Association be eligible for membership under Article IV. of theConstitution, may make application therefor in writing to the Secre-tary, stating :

    (a) The territory which they desire included in such proposedAssociation.

    (b) The names of the Union or other clubs applying for the crea-tion and admission of such Association.

    (c) The reasons why the creation of such proposed Association isdesired or desirable.

    Sec. 2. If said application shall be passed favorably by a two-thirdsvote of the Board of Governors, the President and Secretary of theUnion shall call a meeting of all the clubs within the territory ofsuch proposed Association, upon not less than thirty days' notice, forthe purpose of organizing such Association, and adopting the Con-stitution, By-La7ii

    BY-LAWS. 55Board of Governors, must submit to a vote by mail any specific ques-tion or matter which might be passed upon at a special meeting ofthe Board. Such request shall be delivered to the Secretary of theUnion and by him at once laid before the President.

    (b) Where a vote by mail is required or decided to be taken asaljove, the Secretary shall mail to cacli member of the Board a clearstatement of the question to be voted upon, with the request thateach member send his vote thereupon to the Secreta-ry of the Union ;and the said request shall state upon what day the voting with theSecretary shall be closed (which shall not be less than twenty days-after the mailing of said question). /;/ casfs ivhcre the Board ofGovernors may deem it necessary, a vote may be taken by telegraphinstead of by mail; in such cases the vote to close within forty-eighthours. All mail and telegraph votes received by the Secretary shallbe preserved and filed. The Secretary may at any time 7ohen sufficientvotes have been received to either carry or reject a mail or telegraphvote, announce the result of the same, and the result so announced shallbe decisive.

    (c) Within five days after the closing of said vote with the Secre-tary, said Secretary shall mail to each member of the Board a copy ofthe question and the result of the vote thereon, to wit : the numbervoting for and in opposition thereto, with a statement of whether saidquestion has been carried or defeated.

    Sec. 2. By the Union.(a) The President may of his own motion, and upon the written

    request of not less than three members of the Union, or direction ofthe Board of Governors of the Union, must submit to a vote by mailany specific question or matter which might be passed upon at aspecial meeting of the Union. Such request shall be delivered tothe Secretary of the Union and by him delivered to the President.

    (b) In such a case the Secretary shall mail the question to the sec-retary of each member of the Union, with a request in form as setforth in clause "b" of this article above. The secretary of eachmember shall at once submit the question to its duly appointed andregistered delegates to the Union (or alternates in proper cases), whoshall indicate in writing their votes thereupon, and said secretaryshall at once forward the same to the Secretary of the Union, who

Said schedule shall be submittedby the President, for adoption, at a special meeting of the Board, orby mail vote, as may be proper.

    VIII.CHAMPIONSHIP MEETINGS.

    Section i. The Board of Governors shall hold annually a field andtrack championship meeting, at such a time and place and includingsuch events as they may determine. They may hold such otherindoor and outdoor championship meetings as they may deem best.

    Annual Championship Committees.Sec. 3. All entries shall be sent to the Chairman of said Commit-

    tee, who may reject any entries which they deem objectionable.Sec. 4. Said Committee shall choose the officers at all champion-

    p^.ip meetings, deliver all prizes and decide, for that event only, all(. jcctions to eligibility and qualification of entries, but must reportthe same to the Board of Governors at their next meeting.

    Sec. 5. All entries shall be made from and by the club of whichthe proposed contestant is a member, and each entry shall be accom-panied by the declaration of the Captain or other proper official ofsuch club that said entry conforms in all respects to the rules, regu-lations and conditions of competition of the Union ; and no entry ofan individual other than a regularly registered athlete shall be acceptedfor any championship meeting.

    IX.TRIALS.

    Section i. In cases where the Board of Governors has originaljurisdiction as trial judges, pursuant to Section 15 of Article VII. ofthe Constitution of this Union, the complainant shall submit to theBoard the charges in writing and in detail.

    In case the Board shall deem such charges Avorthy of investigation,it shall send a copy thereof to the accused, who shall, W\\\\\\\. five daysafter the receipt thereof, file with the Secretary of this Union ananswer in detail thereto.The Secretary shall at once forward the charges and answer to the

    Committee having charge of investigations, which Committee shall,upon not less than ten days' notice to both parties, appoint a timeand place when evidence shall be taken upon such charges, and shallhave discretion to adjourn from time to time, as may seem just andproper.Within y?7'^ days after the closing of the evidence such Committee

    shall make and file its report with the Secretary of the Union, whichreport shall be submitted to the Board of Governors at the next meet-ino", at wd-iich due notice of intended submission of such rei^ort can begiven, unless a mail vote shall be taken upon the acceptance of the

    In case no decision has been reached by the Board within ninetydays after the charge was first filed by the complainant, the accusedshall be deemed to have been acquitted, and said charge stand asdismissed, as though formal action had been taken to that effect by avote of the Board.Should the accused fail to appear and defend, they shall be con-

    sidered as having admitted the truth of tlie charges, and in case ofsuch default, or their conviction, they shall suffer the penalty fixedby the Board of Governors under the Constitution of the Uni(jn.

    Should the accused be found innocent, they shall at once be sodeclared, and the fact made public by the Board of Governors in suchmanner as they may determine.

    And, in such case, the expenses of such trial, or so much thereof asshall be determined by the Board of Governors, shall be paid by thecomplainant.

    Sec. 2. Appellate jurisdiction.(a) In cases of appellate jurisdiction, all papers and documents, and

    the facts in writing upon which the decision appealed from was made,together with a copy of such decision, shall, on the request of theappellant and at his expense, be prepared and certified by the originaltrial tribunal and submitted to the Board of Governors.

    (b) The Board shall thereupon, upon not less than ten days' noticeto the appellant and respondent, hear argument itself, or by its com-mittee, upon the question or matter involved, and may call for otheror further evidence or witnesses, but such evidence or witnesses mustbe produced within a period to be fixed by the Board or its committee,which shall not be more than twenty days from the date of such firsthearing.

    (c) The final decision of the committee (if the trial be before acommittee) shall be filed with the Secretary of the Union within tendays after the final hearing, and, in any case, the decision of theBoard of Governors shall be rendered within thirty days after suchfinal hearing, the vote being taken by mail, or at a special meeting, asshall be proper.

    BY-LAWS. 6l(d) In case either the appellant or respondent fails to appear at the

    first hearing, the appeal shall go against him by default, unless bothshould fail to appear, in which case the appeal shall stand dismissed.The Board of Governors may adjudge that the expenses of the appeal,or so much thereof as shall seem to them proper, shall be paid by theunsuccessful party. The decision upon such appeal shall be at oncetransmitted by the Secretary to every member of the Union, and shallbe otherwise made public in such manner as the Board of Governorsshall determine.

    Sec. 3. Refusal to testify.Any person who shall refuse to testify before the Board or its com-mittee, or to answer any question which the Board or its committee

    shall rule to be proper, or to declare in writing his belief as to theamateur standing of any individual upon trial by the Union in theexercise of either its original or appellate jurisdiction, or any partywho upon appeal shall fail to ]i;iy the expenses adjudged against him,shall be lial)le to suspension from competition until he has purgedhimself of such failure or refusal.

    X.INDEBTEDNESS.

    If any member of the Union shall have been suspended or expelledfor indebtedness, no one of its clubs shall be allowed to make anyentries in any national cham]5ionships, and in case of persistentdefiance of directions of the Union, such Association may be expelled,and the territory thereof reorganized or divided between the othermembers of the Union, consistently with the Constitution.

    XI.AMENDMENTS.

    These By-Laws may be amended at any meeting of the Board, orby mail vote, by a majority of the members present or voting, pro-videil that at least ten days' notice shall have been given to everymember of the Board of the proposed amendment.

    RULE I.AFFILIATED, REGISTERED AND APPROVED ORGANIZATIONS.Any one competing or exhibiting at open sports, or any entertain-

    ment of any character whatever, held by any club or managing bodywhich is not an allied member of the Amateur Athletic Union, or amember of one of the Associations of the Amateur Athletic Union, orof the Intercollegiate Association of Amateur Athletes, or any otherAssociation or body to be hereafter approved of, or registered as anapproved organization, shall thereby disqualify himself from compet-ing at any sports given by organizations approved by the AmateurAthletic Union. The Board of Governors shall have power to reinstateany one so disqualified if it shall think fit.Any organization desiring to be registered as an "approved " Club

    or Association shall make application through the Secretary to theBoard of Managers of the Association of the Amateur Atliletic Unionin whose territory the applying club is situated, and at the discretionof such Board may be admitted to such registration. The fee forsuch registration shall be fixed by the Board of Managers of the As-sociation of the A. A. U., in whose territory the applying club is

This riile does not apply to Associations ofschools or col Leges.No Association of the Amateur Athletic Union shall be allowed torecognize any League or Association of Clubs within its jurisdiction.Each Association of the Amateur Athletic Union shall have power,

    in the discretion of its Board of Managers, to register, schedule andsanction games given by any reputable club, association, firm orcorporation.The vSchedule Committees of the several Associations of the Ama-

    teur Athletic Union are advised not to schedule, for any Sunday,ganies at which members of more tlian one club are allowed to com-pete or exhibit.

    All games, meetings, benefits or entertainments of any kind whereathletes compete or exhiljit must be scheduled, except lohere thegames, meetings, benefits or entertainments are held bv a club memberof the A. A. U., or of its allied bodies, and the entries are confined tomembers of the club giving such games, meetings, benefits or enter-tainments.No club which is a meml)er of any of the .Vssociations of the

    Amateur Athletic Union will be allowed to give games jointly withan outside club, unless the outside club has been regularly registered.Open sports are those in which the events are open to members of

    more than one club, school, college or other organization.RULE 11.

    SUSPENSION OR DISQUALIFICATION OF INDIVIDUALS.No person shall be allowed to compete at any meeting held under

    Amateur Athletic Union Rules while disqualified or under a sentenceof suspension passed by any one of the Associations of the AmateurAthletic Union, or by the Amateur Athletic Union, IntercollegiateAssociation of Amateur Athletes, National Amateur Skating Associa-tion, League of American Wheelmen, National Association of Ama-teur Oarsmen, National Lawn Tennis Association, and such otherAssociations as the Amateur Athletic Union or any one of its Associa-tions may hereafter approve of.Any person knowingly competing against one who is disqualified or

    -inder sentence of suspension l>y the Amateur Athletic Union, or anyof the aforementioned Associations, shall be held to have suspendedhimself until the expiration of such sentence, or for such period asthe Board of Managers of one of the Associations of the AmateurAthletic Union may deem proper.Any person who issues, or allows to be issued in his behalf, any

    athletic club, or in any capacity in connection with athletic games,will be ineligible to compete in games under the rules of the AmateurAthletic Union until he shall have permanently abandoned suchemployment.

    If, during any athletic contest under the rules of the AmateurAthletic Union, a competitor shall conduct himself in a manner unbe-coming a gentleman or offensive to the officials, spectators or com-

    GENERAL RULES. 65petitors, the referee shall have the power to disqualify him fromfurther competition at the meeting ; and, if he thinks the offenceworthy of additional punishment, shall promptly make a detailedstatement of the facts to the Board of Managers of the Association inwhose territory the offence was committed.Any member of any club of either of the Associations of the

    Amateur Athletic Union who shall have been expelled from said clubfor unpaid indebtedness shall not be eligible to membership in anyother club of any of the Associations of the Amateur Athletic Union,nor shall his entry be received in any games given by any Associationof the Amateur Athletic Union, or by any club of any Association ofthe Amateur Athletic Union, until such indebtedness is liquidated."Whenever it shall seem reasonably certain that any amateur athlete

    has violated the rules of the Amateur Athletic Union, the Board ofGovernors of the Amateur Athletic Union, or the Board of Managersof any of the Associations of the Amateur Athletic Union, shall havepower to suspend the suspected athlete from further competition untilhis case shall have been tried in the manner prescribed in the Con-stitution and By-Laws of the Association of the Amateur AthleticUnion in whose territory the offence was committed.When charges are brought against an individual which affect his

    status as an amateur, and suspicious circumstances are shown, which,in the judgment of the Board of Governors of the Amateur AthleticUnion, or the Board of Managers of any of its Associations, renderhis real status a matter of reasonable doubtinasmuch as the AmateurAthletic Union or its Associations have no power to compel theattendance and testimony of witnesses, and because the real facts arepeculiarly within the knowledge of the accused, and therefore by himsusceptible of proofhe shall be required to explain such suspiciouscircumstances and remove such reasonable doubt.

    RULE IV.REGISTRATION OF ATHLETES.

    On and after March i, 1897, in no meeting, game or entertainmentthat has been sanctioned or scheduled by the Amateur Athletic Unionor any of its branches as an open athletic meeting shall an athlete'sentry be accepted unless he shall have received from the Secretary of

The provisions of this paragraph do not apply to eventsthat are "closed," that is, open only to members of the organizationgiving the said games.

    All organizations giving open games or competitions under Ama-teur Athletic Union rules and sanction must state on their announce-ments and entry blanks that no entries to open events can be acceptedexcept from registered athletes.Each athlete applying for registration and receiving same shall be

    assigned a numljer, which number shall be plainly written on hisregistration certificate. Managers of all open athletic meetings mustleave a space on their entry blanks for recording the name and num-ber of each registered athlete who enters.

    All applications for registration must be accompanied by a $i feeand endorsed by the Secretary of the club of which said applicant isa member and approved by the Secretary of the Union Associationwithin whose jurisdiction said club is located. Should the applicantfor registration not be a member of an athletic club, he must procurethe endorsement of three reputable citizens of the locality in whichhe resides, and the approval of the Secretary of the Union Associationwithin whose jurisdiction his place of residence is located.

    Fi'om the fee of one dollar paid by each athlete for registration,one-half shall be diverted to the treasury of the Amateur AthleticUnion and one-half to the treasury of the Association from which theathlete registers.

    All registrations shall expire on the last day of February of eachyear.A Registration Committee, consisting of not less than three normore than eight Governors, shall be appointed at each annual meet-ing of the Board of Governors, whose duties it shall be to receive,examine and decide upon all applications for registration. Infringe-ments upon the intent of registration shall be decided by the Regis-tration Committee. The decision of the Registration Committeeshall be final in all cases, and sul)ject to appeal only to the Board ofGovernors.The Registration Committee shall file with the Secretary of the

    advance.It shall be the duty of the Secretary of the Amateur Athletic Union

    to furnish to the Secretary of eacli of the different Associations fromtime to time, a printed list of all registered numbers, names andaddresses, and duplicate lists shall be forwarded to the handicappersof each Association.

    It shall be the duty of the Committee to make, or have made,inquiry regarding any athlete whose amateur status is questioned, andall charges shall be entered with the Chairman of the Committee,who shall provide for an investigation by a member or members ofthe Committee. Pending investigation, the athlete against whomcharges are brought may be suspended. Suspicious circumstances,which are, in the judgment of any member of the Committee, suffi-cient to make the status of any athlete a matter of reasonabledoubt, shall be the basis of investigation in the absence of formalcharges.The member or members to whom the investigation is assignedshall immediately communicate with the party under suspicion, eitherin person or by registered letter, lay all charges before him or setforth the circumstances which lead to a reasonable doubt and call foran answer to the charges or a satisfactory explanation of the circum-stances which gave rise to the doubt.

    If the athlete cannot prove his innocence to the satisfaction of theRegistration Committee, the Committee may inflict such punishmentas is in their judgment fitting.

    It shall be within the province of the Registration Committee tosuspend from competition for such a time as it may deem proper anyperson guilty of unfair dealing in connection with athletic competi-tion or for violation of the rules of the Amateur Athletic Union.A failure to pay entrance fees shall be considered as unfairdealing.Any person who has been declared a professional or suspended forviolation of the rules shall have the right of appeal only to the Boardof Governors.

    THE OFFICLA.L HANDICAPPER.Each Association of the Aniatciir Athletic Union shall have power to

    appoint one or more official handicappers.It shall be his duty to keep a book, containing the names andper-

    formances of all registeredathletes, and to handicap all handicap gamesor events. This book shall be the property of the Association. Theofficial handicapper shall check the entries of all novices 7vithout charge,being sure that they are registered.

    The committee in charge of all open handicap games or events, givenunder the rules of the Amateur Athletic Union, must employ theofficial handicapper, andpay him the following rates:

    The total number of entries in all handicap events added togethershall determine the number of entries, each name in each event count-ing separately.All fees for handicapping must be paid to the handicapper before he

    delivers the handicaps.When for any reason the official handicapper shall fail to hajidi-

    PRIZES.Any athlete found guilty of pawning or using his prizes in any way

    for a pecuniary gain shall he held to have thereby suspended himselffrom all the rights and privileges of an amateur.

    RECORDS.No performance which record is of time shall be accepted unless

    timed by at least three official timekeepers, and no performance whichrecord is of distance or height shall be accepted unless measured byat least three field judges.The Record Committee shall investigate every performance to

    which their attention is called, and shall be empowered, in their dis-cretion, to reject any record *vhich shall not be supported by the affi-davits of at least six witnesses, including the officials, certifying as tothe place, time of day, state of weather, condition of path or field,force and direction of wind, level or grade of grounds, weight,measurement and material of implement, and correctness of announcedlime or distance.No record shall be accepted unless made in open competition.

    RULE IX.ELIGIBILITY TO LIMITED EVENTS.

    The eligibility to compete in events that are limited to men whohave never accomplished a certain time, distance or height in a givenevent, shall be determined by the competitor's record when the entriesfor such event closed.

The Secretaries of the several Associationsof the Amateur Athletic Union must forward to the Secretary of theAmateur Athletic Union copies of all official notices issued from theirofifices, at the time of such issue, said notices to include all thosesent to the members of the Board of Managers, as well as to the clubsof the Association. RULE XIV.

    REPORT OE GAMES.The Official Scorers and Measurers at all games given under the

    rules of the Amateur Athletic Union shall be required to deliver tothe Official Handicapper of the Association in whose territory theframes are held, or to the Secretary of such Association, withintwenty-four hours after the close of the games, the official scores ofall contests at such meeting. The clerk of the course at such meet-ing shall also be required to deliver in the same manner a completelist of all starters in each event. J nv clitb that shall fail to file thenecessary report ofgames shall be refused further safictiojis until suchreport be fled. RULE XV.

    RESTRICTIONS ON COMPETITION.The restrictions of Section 2, Article X., of the Constitution refer

    to all sports over which the Amateur Athletic Union claims jurisdic-tion. For instance, a man who had rowed, or played lacrosse, orl)ase ball for one club could not run or jump, or swim for any otherclub within three months in any case, and not within twelve monthswithout the consent of his former club.

    In all competitions where men classify by weight, contestants mustweigh in for both trials and finals within three hours of the beginningof each competition. RULE XVI.

    It should be the duty of the clerk of the course to see that each andevery contestant is properly attired; and under no circumstance sliallathletes be allowed to dress or undress in the inner circle.
