    5b. Committee Report Nr. EDUC-2015-006Oral motion of Hon. Betty Lourdes F. Tabanda as amended during the 13 April 2015 Regular Session to refer tothe Honorable City Mayor and the Committee on Education, Culture and Historical Research all issues raisedduring the discussion of the ongoing construction project at the City Hall ground which was declared as one ofthe national heritage sites of the Philippines.The Committee on Education, Culture and Historical Research, taking into consideration developments

    following the issuance by the National Commission on Culture and Arts (NCCA), particularly themanifested no objection by the National Historical Commission of the Philippines (NHCP) on theimplementation of the subject project that is seen to provide factual understanding in the resolution of thepending motion for reconsideration filed by the city with the NCCA to lift the cease and desist order,recommending that all issues arising from the deliberations of the Council be simply NOTED.

    For clarification though, committee recommends to further note in advance the following observations, towit:

    1. City Hall was marked as an important cultural property in 2009 as shown from the list submittedby Atty. Ludovico D. Badoy, Executive Director III of the National Historical Commission of thePhilippines, in compliance to the request made by the city for the same; from the said list, onlyMansion House will appear as a declared historical landmark or cultural property in the city;

    2. Burnham Park is not a declared heritage site as stated in the letter of Dr. Ronaldo A. Paraan of 29April 2015. The letter of Atty. Badoy of 17 April 2015 to the Honorable City Mayor referred to inthe letter of Dr. Paraan was merely to inform the city that the National Historical Commission ofthe Philippines has recognized the national historical significance of the park that it will beinstalled with a historical marker, the text of which was attached to the letter received by the cityfor information;

    3. It is hoped that the resolution of the motion for reconsideration filed by the city with the NCCAwill also resolved all other issues, including the scope or limitation of restrictions or protectionunder the heritage act and the need of environment impact under Presidential Decree No. 1586,that arose in the deliberations that were all aimed for the protection and conservation of national,as well as, city cultural heritage for a clearer understanding and interpretation of the provisionsand processes of Republic Act 10066, better known as the "National Cultural Heritage Act of2009".

    Hon. Faustino A. Olowan, Member of the Committee signified, "for discussion en banc." (Item 6b, 13 July 2015 Agenda)

    6. Committee Report Nr. EDUC-2015-003Letter dated 29 April 2015 of Dr. Ronaldo A. Paraan, Chair, Baguio Heritage Foundation, Inc., regarding thedeclaration of Burnham Park as national heritage site by the National Historical Commission of the Philippines.Attached is the letter dated April 17, 2015 of Executive Director Ludovico D. Badoy, National HistoricalCommission of the Philippines, informing among others that the Commission has recognized the nationalhistorical significance of Burnham Park.

    The Committee on Education, Culture and Historical Research recommends that the letter be returned tothe Baguio Heritage Foundation, Inc. for the simple reason that the information intended to be relayed,that is the declaration of Burnham Park as a national heritage site, is not accurate as will be noted in theattached letter of Executive Director Ludovico B. Badoy of the National Historical Commission of thePhilippines (NHCP) which simply mentions of the NHCP recognizing the national historical significance ofBurnham Park through a proposed installation of a historical marker. The Committee thus furtherrecommends that the Baguio Heritage Foundation be requested to clarify the declaration of BurnhamPark as a national heritage site it manifested or to otherwise provide the Sanggunian a copy of theappropriate resolution or document showing such declaration as to merit further action on the matter. (Item 7, 13 July 2015 Agenda)

    7. Committee Report Nr. LAWS-2014-0041st Indorsement dated 18 November 2013 of the Office of City Mayor Hon. Mauricio G. Domogan, forwardingfor information and appropriate action the Supplemental Memorandum of Agreement between the CityGovernment of Baguio represented by Hon. City Mayor Mauricio G. Domogan and R & R Management andSanitary Services represented by its General Manager, Ruperto V. Alvar, for the proposed putting up of comfortroom at Block 4, Baguio City Public Market.

    The Committee on Laws recommends confirmation of the above stated Supplemental Memorandum ofAgreement. (Item 8, 13 July 2015 Agenda)

    8. Committee Report Nr. UPLH-2014-010SECOND READING BEFORE PUBLICATIONProposed Ordinance Nr. PO 0038-14 authored by Hon. Leandro B. Yangot Jr. entitled, "Requiring all personsoperating or doing business within the territorial jurisdiction of the City of Baguio for the mandatory submissionof environmental sustainability action plan upon securing or renewing business and/or Mayor's permit and

    providing penalties for violations thereof."(NOTE: [a] FIRST READING - 09 June Regular Session [Agenda Item Nr.78]; and[b] Rule IV, Sec. 2A of the Internal Rules of Procedures states "On second reading before publication of anordinance shall be open for discussion, proposals and amendments to know whether or not the proposed ordinancewill be approved before publication. Amendments may be allowed prior to publication.")

    The Committee on Urban Planning, Lands and Housing recommends APPROVAL of the above proposedordinance on SECOND READING BEFORE PUBLICATION.Hon. Joel A. Alangsab, Member of the Committee, signified "clarifications on some issues".(Item 9, 13 July 2015 Agenda)

    9. Committee Report Nr. LAWS-2014-0403rd Indorsement dated 17 July 2014 from the Office of the Honorable City Mayor Mauricio G. Domogan,forwarding to the Hon. Vice Mayor Edison R. Bilog, inviting attention to the advice of the Legal Office, forinformation and appropriate action on the 2nd Indorsement dated 16 July 2014 of Atty. Melchor Carlos R.Rabanes, OIC- City Legal Office, Re: Draft Memorandum of Agreement (MOA) on the Program to Grant theSale of Rice on Credit between the National Food Authority and the City Government of Baguio.

    entitled, "Amending Ordinance Numbered 13, series of 2012 entitled, 'Furthermore amending the TradeFair Ordinance of 1994'."

    (NOTE: [a] FIRST READING - 11 November 2013 Regular Session [Agenda Item Nr. 85];[b] Rule IV, Sec. 2A of the Internal Rules of Procedures states "On second reading before publication of anordinance shall be open for discussion, proposals and amendments to know whether or not the proposedordinance will be approved before publication. - The above proposed ordinance was published in the Sun.Star Baguio issue of 13 November 2014and was posted on the bulletin boards of City Hall, Public Market, Post Office, City Library and the HealthServices Office starting 10 November 2014.)

    The Committee on Laws recommends approval on SECOND READING AFTER PUBLICATIONand POSTING of the above stated proposed ordinance. (Item 45, 13 July 2015 Agenda)

    45. Committee Report Nr. MARKET-2015-006Board Resolution No. 09, series of 2015 of the Liga ng mga Barangay- Baguio City Chapter entitled,"Resolution strongly urging the City Government of Baguio to allow the Liga ng mga Barangay- BaguioCity Chapter to conduct a trade fair at Juan Luna Drive on March 15, 2015 to May 15, 2015 for the

    purpose of raising funds for the benefit and provisional grant of honorarium for barangay tanods and s treetsweepers of the 128 barangays of City of Baguio."

    The Committee on Market, Trade and Commerce puts forward the following observations:1. The proposed trade fair activity from March 15 to May 15, 2015 is a two-month timeframe

    that patently violates the 15-day timeline restriction provided under Section 2 of OrdinanceNo. 13, series of 2012 entitled, "Furthermore amending the Trade Fair Ordinance of 1994."

    2. The same activity which is requested to be held at Burnham Park is also violative of thevenue-restriction provided for in the same Section under the said Ordinance, which I quote,"to totally disallow the conduct of trade fairs and other similar activities in all city-owned orcity-managed public parks..."

    3. The noble intention as explained in proponent's Board Resolution No. 09, series of 2015 ---which is to raise funds for the benefit and provision grant of honorarium for barangaytanods and street sweepers of the 128 barangays in the City --- cannot justify the patentviolation of an existing City Ordinance. No goal, no matter how lofty, can ever make theactivity as legal and in conformity of the law. Other law-abiding means of fund-raisingshould instead be fostered by government frontline service deliverers, least of all barangayassociations such as the Liga proponent.

    4. It is made to appear before us that the protected activity may qualify as among the activitiesunder the Summer Vacation Program annually conducted under the city government'sauspices. The implication is misguiding and has no basis in fact. Nowhere is it providedunder the Sumvac 2015 program that trade fair may be among such summer activities.Furthermore, it should be noted that through the years, the Sumvac has never had anytrade fair as part of its activity list.

    In view thereof, the committee recommends DENIAL. (Item 46, 13 July 2015 Agenda)

    50. Committee Report Nr. EDUC-2015-002Proposed Resolution Nr. PR 0059-15 introduced by Hon. Vice Mayor Edison R. Bilog entitled,"Requesting the Commission on Higher Education (CHED), through Secretary Luistro for the immediaterelease of the educational benefits of the family members of the SAF 44."The Committee on Education, Culture and Historical Research recommends discussion en banc ofthe proposed resolution to consider the following observations, to wit:

    1. While DepEd Secretary Armin A. Luistro was directed by the President to assist inproviding the relatives and families of the SAF 44 also with college educational benefits,the program that was identified and coordinated for the purpose is with the Commissionon Higher Education (CHED) that the request may have to be directed to CHEDChairperson Dr. Patricia B. Licuanan;

    2. The financial assistance that may be extended will be in the form of a scholarship in whichdependents may be found to qualify to or a grants-in-aid or "Tulong Dunong" ofP12,000.00 each under the Student Financial Assistance Program (STUFAPS);

    3. The release of the financial assistance or benefit will therefore be in accordance with thescholarship program to which the dependent may qualify to or with the "TulongDunong" program;

    4. To avail of the benefits, dependents will have to file their respective applications with theRegional Offices of CHED where they reside which will collate all the applications and

    transmit the same to the central office of the CHED;5. In the Cordillera Administrative Region (CAR), eight (8) of the nine (9) applications were

    transmitted to the central office on May 28, 2015. The last application that wasaccordingly received recently was likewise transmitted to the CHED, also recently;

    6. It will further appear that the processing of the applications will require the applicant tofirst enroll in a chosen school. His enrolment form and a certification of enrolment willthen have to be submitted to the CHED. In short, the financial assistance will be in thenature of a reimbursement;

    7. The immediate release of the financial assistance to the dependents of SAF 44 will nottherefore be in accordance with the CHED system or program which the Committee findswill be destructive to the cause of SAF 44 for reasons that need not be mentioned;

    8. The financial assistance being provided by the CHED is in addition to educational aids orgrants being provided the dependents of the SAF 44, including from funds beingadministered by the NAPOLCOM. (Item 52, 13 July 2015 Agenda)
