SCOTTISH STATUTORY INSTRUMENTS 2010 No. 456 I ROADS AND BRIDGES SPECIAL ROADS The M74 Special Road (Junction b, Raith) (Side Roads) Order 2010 Made Coming into force 13 D cember 2010 The Scottish Ministers make the foUowing Order in exer~ise of the powers conferred by sections 9(1)(c), (d) and (f), 70(1) and 143 of the Roads (Scotland) Act 1984(a)and of all other powers enabling them to do so. In accordance with section 9(3) of that Act, they are sa isfied, as the case requires, that another reasonably convenient route is available or "Ube provided before any road is stopped up pursuant to this Order. In accordance with section 71(3) of that Act, they are sa isfied, as the case requires, that no access to the land is reasonably required or an ther reasonably convenient means of access to the land is available or will be providet In accordance with sections 20A(') and 55A(I:)of that Ac t they have determined that the project falls within Annex I to Council Directive No 85/337/EEC(d) on the assessment of the effect of certain public and private proje ts on the environment. In accordance with sections 20A(2) and 55A(2) of that let, they have prepared an environmental statement and published notice of it on 123 March 2007 and have complied with all other provisions of sections 20A and 55.A.ofthat Act. The Scottish Ministers make the foUowing Order in exer~ise of the powers conferredby sections 9(1)(c), (d) and (f), 70(1) and 143 of the Roads (Scotland) Act 1984(a)andof all other powers enabling them to do so.

In accordance with section 9(3) of that Act, they are sa isfied, as the case requires,that another reasonably convenient route is available or "Ube provided before anyroad is stopped up pursuant to this Order.

In accordance with section 71(3) of that Act, they are sa isfied, as the case requires,that no access to the land is reasonably required or an ther reasonably convenientmeans of access to the land is available or will be providet

Citation and commencement

1. This Order may be clcd as the M74 Special Road (Junction 5 Raith) (SideRoads) Order 2010 and come into force on 11 January 2011.

Side roads and means of ac ess

2. The Scottish Ministers as special roads authority are authorised:

a. to construct those len ths of road (hereinafter referred to as "the new sideroads") along the rout described in Part 1 of the Schedule;

b. to improve those lengtlilsof road described in Part 2 of the Schedule;I

c. to stop-up those lengths of road described in Part 3 of the Schedule when thenew side roads are op~n for through traffic;

d. to stop-up those Priva~emeans of access described in Part 4 of the Schedule;and

e. to provide those new eans of access described in Part 5 of the Schedule.

3. Where immediately be ore the date this Order comes into force there is under,in, on, along or across any of e lengths of road in Parts 2 and 3 of the Schedule anyapparatus belonging to a statut ry undertaker, any rights of the statutory undertaker inrespect of such apparatus shall be preserved.

4. On 1st April next after e date that the new side roads described in paragraphs19, 20 and 21 of Part 1 of th~ Schedule are open for the purpose of through traffic,those new side roads shall b transferred to North Lanarkshire Council as roadsauthority for those roads.

INTERPRETATION I

In this Schedule:- I''the plan folio" means the plan folio numbered OTG/1554/1 comprised of key planOTG/1554/1003 - and plans SRI to SR2 and entitled thelM74 Special Road (Junction5 Raith) (Side Roads) Order 2010, signed with reference to this Order and depositedat the offices of Transport Scotland, Buchanan HoJse, 58 Port Dundas Road,Glasgow.

''the existing A725 Bellshill Trunk Road" means tjhat length of the existingA725/A726 Shawhead - East Kilbride - Phillipshill Rm!mdabouttrunk road betweenthe existing A8 and East Kilbride. I

"the existing Bellshill Road" means the section of the exi~ting Bellshill Road betweenthe junction with the B7071 Hamilton Road and the existing Whistleberry TollRoundabout.

"the existing Hamilton Road" means the section of the e isting B7071 Hamilton Roadbetween its convergence with the existing B7071 Bothw 11Road and the junctionwith the existing Blairston Avenue.

''the existing Old Bothwell Road" means the section of e existing Old BothwellRoad between its intersection with the existing Hamilton Road and its intersectionwith Blairston Avenue.

"the existing Bothwell Park Road" means the section 0 existing road from BothwellPark Farm to the intersection with LaigWand Road.

"the existing Raith Junction Roundabout" means the e isting A725 Bellshill TrunkRoad Roundabout.

"the existing B754 Road" means the section of the existi g B754 Airbles Roadbetween its convergence with the existing Raith Junction Roundabout and a junctionwith the existing access to the Caravan Park.

''the existing Whistleberry Toll Roundabout" means th existing roundabout to thesouth-west of the existing Raith Junction Roundabout.

"the existing M74 northbound diverge slip road" means the existing northboundmotorway diverge slip road from the M74/A74(M) Glasgow - Carlisle Trunk Road tothe existing Raith Junction Roundabout.

"the existing M74 southbound diverge slip road" me s the existing southboundmotorway diverge slip road from the M74/A74(M) Glas ow - Carlisle Trunk Road tothe existing Raith Junction Roundabout.

"point 'A'" means the interseltionof the centrelines of the existing A725 BellshillTrunk Road and the existing B 071 Bothwell Road.

"point 'B'" means the intersetion of the centrelines of the existing A725 BellshillTrunk Road and the existing "tt Coast Mainline Railway.
