Who is protected by the ADA?

• The ADA Protects Qualified Individuals with Disabilities From Discrimination

• How do we define a qualified individual?

Great Plains ADA Center

Individual with a disability: Three-part definition

1) Has a physical or mental impairment that “substantially limits” one or more major life activities .

2) Has a record of such an impairment

3) Is regarded as having such an impairment.

Great Plains ADA Center

What is a Major Life Activity? Activities that an average person can perform with little or no difficulty:

Harmonization Federal ADAAG and the IBC and ANSI A117

• ICC/ANSI A117.1-2003 IBC 2003

Harmonizing ADA Standards and the Building Code: Different Approaches

• IBC is ostensibly for the protection of lives and property.

• Contains enforcement protocols and administration

• Code Official at the local level.

• Plan review and inspection

• Mediation

• Scoping is for accessibility only.

• Rarely enforced locally.

• Outcomes based on litigation

• Court based complaint system.

Great Plains ADA Center

Section 103 – Equivalent Facilitation

• Nothing in ADAAB/ABAAG prevents the use of designs, products or technologies as alternatives.

• Performance vs. prescriptive

• Must result in substantially equivalent or greater:

• Accessibility and Usability

• ADAAG 103 is similar to IBC 104. 10 and 104.11

Great Plains ADA Center

ADAAG section 103 – Equivalent Facilitation, Similar to IBC 104.10

• IBC 104.10 Modifications.“Wherever there are practical difficulties involved in carrying out the provisions of this code, the building official shall have the authority to grant modifications”

• “… provided the building official shall first find that special individual reason makes the strict letter of this code impractical and the modification is in compliance with the intent and purpose of this code and that such modification does not lessen health, accessibility, life and fire safety, or structural requirements. “

Great Plains ADA Center

Section 103 – Equivalent Facilitation.Similar to IBC 104.11

• ADAAG 103 is similar in application to IBC 104.11

• IBC 104.11 Alternative materials, design and methods of construction and equipment. The provisions of this code are not intended to prevent the installation of any material or to prohibit any design or method of construction not specifically prescribed by this code…

• …and that the material, method or work offered is, for the purpose intended, at least the equivalent of that prescribed in this code in quality, strength, effectiveness ,fire resistance, durability and safety.

Definitions: Accessibility and Usability

• Usability is a new term: “…Usable by.”

• Intended to fill the niche between prescriptive and performance.

• To guide decision making processes.

• Element or feature that can still be manipulated.

• Takes maintenance into account.

Great Plains ADA Center

Definitions: Accessibility and Usability

• What is the most finite standard of measurement for slope and cross slope in a parking lot, sidewalk or maneuvering space?

• 30” X 48” ?

Great Plains ADA Center

ADAAG section 104 - Conventions

• Dimensions – range instead of absolute

dimension where possible

• Construction and manufacturing

tolerances

• Calculation of percentages

• Figures – informational; text governs

Ranges instead of absolute dimensions

Water closet centerline (16-18”)

Width of ambulatory accessible stall (35”- 37”)

Great Plains ADA Center

Some absolute dimensions remain

Transfer shower stall (36” x 36”) and combination

transfer/roll-in design with seat on front wall (36” deep)

measured to center points; manufacturing tolerances

recognized

Great Plains ADA Center

ADAAG 104.1.1 - Conventional Industry

Tolerances: Construction and Manufacturing

For field conditions and manufacturing

process (not design work)

• Don’t apply to ranges (min. and max.)

• For absolute dimensions or where only a

min. or max. specified

• Avoid specifying tolerances (e.g., “36 inches

plus or minus X inches”)

• Should specify above max. or below min. (to

factor in tolerance)
