Jim Gange, Office of State Court Administer: (Testimony 1) within testimony is committee's

grant awards. The Chief is asking that you consider changing his appointee position. For

the Chief Justice is more limited and so what HB 1074 suggests is rather then providing

that the Chief Justice will make an appointment, The State Court Administrator would be a

permanent member of the committee, and not be subject to term limits.

Chairman Koppelman: What about an incident when this individual is unable to serve,

are we running a risk in changing the language?

Jim Gange: That was discussed, there is a weight to this position, and there could be an

incident where you wouldn't want this individual to serve on the group. One would assume

that the chief and the court would not select someone of this kind, extremely rare.

Rep Larson: It seems like this would provide some consistency?

Jim Gange: That is true, I want to emphasize, looking at the HB 1074 way down to the last

line, subsection 5 on page 2.

Bonnie Staiger- American Institute of Architects - Says she would like to see an architect on the advisory committee. She says the downside of adding an architect would be that it makes six people and they may allow for a potential tie. She suggests that the architect could be a non-voting member.

Committee calls on Jim Ganje to answer questions. Mr. Ganje says they would have to amend the statute because the members are compensated. He doesn't think an architect is needed and thinks they would find it less than interesting.

Senator Lyson - Mentions he has served on that committee and says this is absolutely necessary to pass as written.

Supreme Court Chief Justice Gerald VandeWalle - Said he requested this bill and states that the continuity on the commission is very important. It concerned him to appoint someone else. He asks that this bill be passed.

HOUSE BILL NO. 1 074 - SUMMARY

House Bill No. 1074 amends N.D.C.C. Section 27-05.2-09 governing the membership of the Court Facilities Improvement Advisory Committee. The Advisory Committee is an independent group created by statute to receive applications for grants requesting funds for court facility improvement and maintenance. Funds available to the Committee for grant awards are derived from a share of a $1 00 fee assessed in all criminal cases except infractions. A summary of the Committee's grant awards is attached.

The Advisory Committee is comprised of five members: two members appointed by the North Dakota Association of Counties to represent counties with populations, respectively, fewer and greater than 7 ,500; a member appointed by the State Bar Association; a member appointed by the chairman of Legislative Management, and a member who serves as chairman and who is appointed by the Chief Justice. All members are subject to term limits. Each member cannot serve more than two three-year terms.

The term limit provision of Section 27-05.2-09 is problematic with respect to the Chief Justice's appointee, who also serves as chairman of the Advisory Committee. Each of the other appointing authorities has substantially more possible "candidates" for appointment than does the Chief Justice. The judicial system is relatively small with respect to possible system representatives, particularly ifthe representative is also to serve as chairman of the Committee. House Bill No. 1074 would replace the generic appointee of the Chief Justice with the state court administrator, who would not be subject to the term limit provision. In addition to providing stability in membership, the state court administrator would be generally well-suited to provide a system-wide awareness of the state of court facilities in the various counties.

COURT FACILITIES IMPROVEMENT GRANTS

-BY COUNTY-

Section 27-05.2-10, NDCC, authorizes grants from the Court Facilities Improvement and Maintenance Fund for county projects to improve or maintain court facilities. The Fund receives revenue from a share of a $ 1 00 fee applied to all criminal cases except infractions. The Court Facilities Improvement Advisory Committee is established under Section 27-05.2-09, NDCC, to receive applications for grants and make awards for projects that qualify for grant funds. The Committee is currently comprised of the following members: Sally Holewa, State Court Administrator and Committee Chair; Jerome Gruenberg, Ward County Commissioner; Randi Suckut, Wells County Commissioner; William E. Kretschmar, State Representative; and Charles G. DeMakis, State Bar Association representative.

Briefly stated, the basic project requirements are that the improvement or maintenance project must be a necessary_ improvement to court facilities or essential to remodel or maintain existing court facilities. The county is required by statute to provide local funding for the project in an amount equal to at least 25% of the project's total cost. Additionally, Section 27-05.2-10 requires that at least 25% of the available grant funds be available for counties with a population of less than 7,500.

Through 8 rounds of grant applications, the Committee has reviewed two hundred sixty-one applications. The amount of grant funds requested was $9,468,275 and the amount awarded was $4,746,750.

HOUSE BILL NO. 1 074 - SUMMARY

House Bill No. 1074 amends N.D.C.C. Section 27-05 .2-09 governing the membership of the Court Facilities Improvement Advisory Committee. The Advisory Committee is an independent group created by statute to receive applications for grants requesting funds for court facility improvement and maintenance. Funds available to the Committee for grant awards are derived from a share of a $100 fee assessed in all criminal cases except infractions. A summary of the Committee's grant awards is attached.

The Advisory Committee is comprised of five members: two members appointed by the North Dakota Association of Counties to represent counties with populations, respectively, fewer and greater than 7,500; a member appointed by the State Bar Association; a member appointed by the chairman of Legislative Management, and a member who serves as chairman and who is appointed by the Chief Justice. All members are subject to term limits. Each member cannot serve more than two three-year terms.

The term limit provision of Section 27-05 .2-09 is problematic with respect to the Chief Justice's appointee, who also serves as chairman of the Advisory Committee. Each of the other appointing authorities has substantially more possible "candidates" for appointment than does the Chief Justice. The judicial system is relatively small with respect to possible system representatives, particularly if the representative is also to serve as chairman of the Committee. House Bill No. 1 074 would replace the generic appointee of the Chief Justice with the state court administrator, who would not be subj ect to the term limit provision. In addition to providing stability in membership, the state court administrator would be generally well-suited to provide a system-wide awareness of the state of court facilities in the various counties.

COURT FA CILITIES IMPROVEMENT GRANTS

- BY COUNTY-

Section 27-05 .2- 1 0, NDCC, authorizes grants from the Court Facilities Improvement and Maintenance Fund for county projects to improve or maintain court facilities. The Fund receives revenue from a share of a $100 fee applied to all criminal cases except infractions. The Court Facilities hnprovement Advisory Committee is established under Section 2 7-05.2-09, NDCC, to receive applications for grants and make awards for projects that qualify for grant funds. The Committee is currently comprised of the following members: Sally Holewa, State Court Administrator and Committee Chair; Jerome Gruenberg, Ward County Commissioner; Randi Suckut, Wells County Commissioner; William E. Kretschmar, State Representative; and Charles G. DeMakis, State Bar Association representative.

Briefly stated, the basic project requirements are that the improvement or maintenance project must be a necessary_ improvement to court facilities or essential to remodel or maintain existing court facilities. The county is required by statute to provide local funding for the project in an amount equal to at least 25% of the project's total cost. Additionally, Section 27-05 .2-10 requires that at least 25% of the available grant funds be available for counties with a population of less than 7,500.

Through 8 rounds of grant applications, the Committee has reviewed two hundred sixty-one applications. The amount of grant funds requested was $9,468,275 and the amount awarded was $4,746,750 .
