1. 2. The con tract is to be m ade for One Year w . e . f . 01.01.2016 to31/12/2016. However, thecuttings, if any, in th e Techn ical Bid Ap plica t ion must be in it ia led by theperson a u thorized to sign the te n der bids. -3-B. TECHNICAL REQUIREMENTS FOR THE TENDERING COMPANY ! FIRM!

AGENCY

The te ndering Service Provider Company / Firm / Agency should fulfill thefollowin g techni cal specifications :

I . The Registered Office or one of the Branch Offices of the Service Provider Com pany/ Firm / Agency shou ld be located within the Natio nal Capital Territory of Delh i.

2. Th e Service Provid er Com pany / Firm / Agency sho u ld be registered with thea ppro pria te re gistration authority with regard to provid in g manpower to theGovernment offices .

3. Service Provider Company / Firm/ Agen cy shou ld h a ve at least five years /ex pe rience in p roviding similar services to private /public secto r Company /Banks/ Governmen t De partmen ts etc .

4 . Service Provide r Company / Firm / Agency should hav e its own Ban k Accou n t.5. Service Provide r Company / Firm / Agency should exist on th e record s of Income

Tax a n d Service Ta x Departments.6. Service Provider Company / Firm / Agency should be registered wit h appropriate

au thorit ies u nder Employees Providen t Fund and Employees State In su ra n ce Acts .7 . The Service Provide r Company / Firm/ Agency shou ld have completed at least one

service con tract of va lue not le ss than Rs .20 lakh or two service contract of 10lakh each per annum related to providing similar services.

8 . Th e Service Pro vider Com pany / Firm / Agency m u s t hav e a tu rnove r ofRs. 1 crore per year during the la s t three financial years i.e . F.Y. 20 12- 13, 20 13- 14& 2014-15.

9 The Service Provider Com pa ny / Firm / Agency sha ll su bm it a ffidav it on Non ­Judicial Stamp Paper of Rs .IO/ - s ta t ing that the agency is / h a s n ot been blacklisted /previous cont ract penali zed by Ce n tral Government / Sta te Governmen t /a ny PSU etc in a ny of its previous con tract.

Non compliance with any of the above conditions by the Service ProviderCompany ! Firm ! Agency will amount to non-eligibility for the services forwhich tender has been floated and its tender will be ignored summarily.

C. FRAUD AND CORRUPT PRACTICES

1. The a pplican t a nd their respective officers, em ployees, agen ts a nd advisers shallobserve the hi ghes t standard of et h ics during the Bidding Process. Notwithsta ndi nga ny th ing to the con trary con tained herein , the Office m ay reject a n Appli cationwithout being lia ble in a ny manner wh atsoever to the Appli cant if it determines thatthe Applicant has, d ire ctly or indirectly or th ro ugh a n agen t , e ngaged in co rr u ptpracti ce . fraudulent pract ice, coe rc ive practice, u ndesira ble pra ct ice or restrictivepract ice in the Bidding Process .

2 . Without prejudice to the righ ts of this Office under Clause I. herein a bove, if anApplicant is found by the Office to have directly or indirectly or through an agent,engaged or indu lged in any co rrupt practice, fraudu lent practice, coercive practice,undesirable practice or rest rictive practice during the Bidding Process , suchApplica nt sha ll not be eligible to participate in any tender issued by th is Officed u ri ng a period of 2 (two) years from the date such Applica n t is found by the Office toh ave directly or in di rectly or through a n agen t, e ngaged or ind ul ged in any corruptpract ice . fraudulent practice. coercive practice. undesirable prac tice or res t rictivepractice a s the case may be.

-4-3. For the purposes of this clause 1., the following terms shall have the meaning

h ereina fte r respectively assigned to then:4. "Co rru pt prac tice" means (I) th e offering, gtvmg, receivmg, or so lici ting, di rectly or

indirectly , of a ny th ing of val ue to in fluence the actions of any person connected withthe Bid ding Process or (II) save and except as permitted, engaging in any mannerwha tsoever, whether during the Bidding Process or after the issue of the LOA or afterthe execu t ion of the Agreement , as the case may be, a ny pe rson in respect of a nymatter relating to the Proj ec t or the LOA or the Agree ment , who at any time has beenor is a legal , financial or technical advisor of the Authority in relation to any matterconcern ing the Project;

5 . "fraudulent pra cti ce" means a m isrepresentation or omission of facts or suppressionof fac ts or di sclosu re of in complete facts, in order to in fluence the Bidd ing Process ;

6 . "coercive practice" means impairing or harming or threatening to impair or harm,d irectly or indirectly, any person or property to influence to any person'sparticipation or action in the Bidding Process ;

7 . "u n de s irable practice" means (II establis hing contact with any pe rson con nected withor employed or engaged by the Authority with the objective of canvassing, lobbying orin any manner infl uencing or attempting to influence the Bidding Process; or (II)having a Conflict of Interes t ; and

8. "res trictive prac tice" means forming a cartel or arriving at any understanding orarrangement among Applicant with the objective of restricting or manipulating a fulland fai r co m pe tition in the Bidding Process;

D. LEGAL

Th e Service provider shall be responsible for compliance of a ll statutory provisionsre la ting to Minimum Wages , Em ployees Provident Fu nd, Employees St a te Insurance ,Service Tax a nd a ny other Laws/ Taxes / Acts / Rules etc . Governing the matter/issues etc. If at any point of time it is noticed that the Contractor is awaying from anyproced ures / taxes/ Acts / Rules then that will be met out, out of the Pe rforma nceSecurity Depos it ma de by the con tractor.

ii. The Service provider shall also be liable for depositing all taxes, levies, Cess etc. onaccount of service rendered by it to the office of th e Directorate of Incom e Tax(PR,PP&OL), 6 th Floor, Mayur Bhawan, Connaught Circus, New Delhi- l 100 0 I toconcerned tax collection authorities from time to time as per extant ru les andregulation s on the matter.

iii. Th e Service provider shall maintain a ll s ta tu tory regis te rs u nde r the applicable la ws .The Age ncy shall produce the same, on demand, to the concerned authority of thisOffice or any ot her authority under Law.

IV. The Tax Deduction at So u rce (T.D .S .I shall be done as per the provisions of Incom eTa x law, as amended from time to tim e and a certificate to this effect shall beprovided to the Age ncy by this Office.

v. In case. the te ndering Agen cy fai ls to comply with a ny statutory provision/ taxationliability under a ppropriate law and as a resu lt thereof the Office is p ut to any los s , /obligation, monetary or otherwise, the Office will be entitled to get itself reimbursedout of the outstanding bills or the Performance Security Deposit of the Agency, to theex te n t of the los s or obligation in monetary terms.

E. FINANCIAL

I. The Technica l Bid shou ld be accompanied with an Earnest Mon ey Deposit (EMD),refundable , of Rs .50 ,OOOI - (Rupees Fifty Thousa nd on ly) for DEOs , Un-skilledworkers and Semi-skilled Multi Tasking Staff in the form of Demand Dra ft Z Pay Orderdrawn in favour of the ZAOI CBDT, New Delhi failing which the tender shall berejec te d out righ tly .

2 . The EMD in respect of th e Agen cy wh ich does not qualify the Technical Bid (FirstSta ge) I Financia l Bid (Second competitive stage) shall be retu rned to it withouta ny interest. However, the EMD in respect of the successful tenderer shall bereturned after submission of the Performa nce Se curity Deposit towards thePerformance Sec urity Depos it. Further, if the Agen cy fails to provide servicesagain s t the initial requirement from requisite d ate, the EMD a s we ll as performancesecu ri ty deposit shall s tand forfeited without giving a ny fu rt her not ice .

3 . Bids, offering rates which a re lowe r than the minim um wa ges (a s a pplica ble for theNCT of Delhi) for the pertinent category , would be rejected .

4. Th e successful tend erer will have to de posit a Performance Sec urity Deposit for asum of Rs . 1,00,000/ - (Rupees One Lakh on ly) for DEOs , Un-skil led workers andSemi-skilled Multi Tasking Staff with in 2 days of th e receipt of the formal order. Th eperformance security will be fu rn ished in the form of the Account Payee DemandDraft or Bank Guarantee drawn in fa vour of the ZAO /C B DT, New Delhi. Th eperformance secu rity shou ld remain va lid for a period of 60 days beyond the dateof co m pletion of a ll the con t ractua l obligations of the supplier. The Departmentsh a ll not pay a ny interest on the Performance Security Deposit.

5 . In case of breach of any terms and con ditions stipulated in th e contract , theperformance secu rity Deposit of the Agen cy will be liable to be forfeited by thisOffice besides a n n u lme n t of the con tract.

6. The Agency shall raise the bill , in triplicate, along with attendance sheet to theDivision under wh om the ou tsou rced personnel ha s been deployed by the 3'" of thesuccee d ing m onth. The con cerned office /office r will se n d the bills d u ly verified tothe office of Directorate of Income Tax (PR,PP&OL), 6 '" Floor , Mayur Bh awa n,Connaught Circus, New Delhi-I 10 00 1 for sanction and payment. As far as possiblethe payment will be relea sed a fte r receipt from th e Accounts Office r, DIT's Field PayUni t , New Delhi .

7 . The Cla im s in bills regarding Employees State Insurance , Provident Fund, a n dService Tax e tc . should be n eces sa rily accompan ied with documenta ry proofpertain ing to the previous month bill. A requisi te port ion of the bill I whole of thebill a m ou n t shall be held up t ill the proof is fu rnis hed, a t the d iscre tio n of thisOffice . The copies / tax receipts I tokens deposited in respective offices should besho wn to th is office on month ly basis.

8. Settlement of d isputes will be as pe r Ind ia n Arbitration and Conciliation Act-1996and ven ue will be th e Office of the Add!. DG(PR,PP&O L) 6'" Floor, May ur Bh awan ,Con naugh t Circus, New Delhi- l 1000 1. 9 . The Office of the Add!. D.O . of Income Tax (PR,PP&OLI New Delhi , 6'" Floor, MayurBhawan , Connaught Circus , New Delhi-II 000 1 reserves the right to withdraw Ire lax any of the terms and con d it ions mentioned in the tender document so as toovercome any problem encountered at a ny sta ge .

A) Data Entry Operator

I) PERSONNEL REQUIRED:1.1 ) The personnel to be deployed should ha ve sou n d m edical fitness, good physique ,moral character, experience and training to handle any type of Data Entry Operatorworks .

1.2 ) Proper uniform and identification ca rds must be provided to the Da ta Entry Operatorsand Supervisor. If any .
