Metropolitan Regional Information Systems (MRIS)- FAAR is a stockholder member of MRIS which provides agents with member pricing

In order to comply with a new NAR mandate FAAR and REALTORreg associations across the country have added an ombudsman program to their list of services FAAR and five other associations in the area Northern Virginia Greater Piedmont Prince William Blue Ridge and Dulles Area Associations of REALTORSreg already have a regional professional standards agreement in place The group now has launched an ombudsman program Several FAAR members have been trained in the program and are ready to review requests from members and the public Diane K Disbrow 2015 National Association of REALTORSreg Professional Standards Committee Chair explained the Ombudsman program best in the following article

So what is an ombudsman program

The Ombudsman Program in its simplest definition is informal telephone mediation In some cases it can address and solve minor complaints from the public The ombudsman can also solve inter-REALTORreg conflicts before they become serious problems Some complaints do not allege specific articles of the NAR Code of Ethics and many times they are transactional technical and procedural questions that can be addressed by communication Like a mediator an ombudsman helps parties find solutions that everyone can be happy with

How does it work

In most cases the designated contact person at the local association often the Professional Standards Administrator listens to

the callers complaint or concerns and then explains the ombudsman service if the complaint meets the associations criteria for an ombudsman to handle The staff person also explains that if the ombudsman service is not successful in resolving the problem the complainant may still file a formal written ethics complaint with the Association If the complainant accepts the ombudsman service the staff person then relays the concerns to the ombudsman who contacts the complainant listens to their concerns clarifies that they understand the situation and ascertains what their desired outcome is The ombudsmanrsquos role is to communicate the concerns of one party to the other and seek a resolution so that a positive relationship between the parties can be restored Letrsquos face it most people donrsquot like conflict so itrsquos easier for a consumer or REALTORreg to contact the local association of REALTORSreg to vent or voice their concerns than bring the problem up directly with the REALTORreg they are upset with Itrsquos so much easier with a neutral person who can be the go-between

Who are these ombudsman

Typically Associations of REALTORreg appoint members to be ombudsman who have a certain number of years of real estate experience and are familiar with the REALTORSreg Code of Ethics the professional standards process and have knowledge of their state real estate regulations and are active in the real estate business and understand the current real estate practices The ombudsman

must be fair and credible avoid making a judgment of who is right or wrong and can also not give legal advice to any party Careful listening summarizing the situation determining what is most important to resolve the situation or make everyone satisfied and working toward that goal

Why now

The main reason is because itrsquos been so successful for associations that have a program in place It seems that many members of the public are reluctant to file a written ethics complaint for several reasons the process is too cumbersome and the paperwork is too hard to understand They really just want someone to listen and help solve their problem They do not want to fill out paperwork Many times the problem is not a violation of our Code of Ethics and the complaint is dismissed Even REALTORSreg are often reluctant to file ethics complaints for similar reasons and also because they would rather not ldquorock the boatrdquo and cause conflict with other members that they cooperate with on transactions Many ethics complaints might be averted with enhanced communications and initial problem-solving capacity at the local Association level

In reality many association staff people have been providing services similar to that of an ombudsman for years since they are the first point of contact when a REALTORreg or consumer wants to file a complaint In many instances staff is successful in alleviating the concerns However that isnrsquot always the case Consumers and our members really just want their story to be heard and having a team or

committee of qualified REALTORreg members serving as ombudsman available to assist in resolving disputes has met with great success It shows that we really care about trying to help resolve the problem and also overcomes the perception that one REALTORreg may be trying to cover up for another and reopens communications between the parties

The goal is to accelerate the ethics enforcement process and provide a means to clear up misunderstandings that members may not know exist This is a valuable service which can get a transaction back on track so the consumer has a positive real estate experience Itrsquos an opportunity to improve our professional reputation as REALTORSreg

Over the years the mediation of monetary disputes between REALTORSreg has been a huge success and mediation is the ldquopreferred dispute resolutionrdquo process of the National Association of REALTORSreg Hopefully the ombudsman program will have similar success Itrsquos a very positive step in providing an opportunity for the public and our members to resolve disputes without anyone having to file a formal complaint and insuring

that our customers and clients continue to have great relationships with REALTORSreg who truly want to make sure they have a great real estate experience

The Graduate REALTORreg Institute (GRI) is an education program and designation sponsored by Virginia Association of REALTORSreg (VAR) It is a nationally recognized by NAR and is one of the most popular designations among REALTORSreg This program focuses on developing and increasing participantsrsquo professionalism and skill level in ways that positively affect their bottom line

As business standards legal regulations and technology changes VAR is determined to maintain the best GRI program In order to provide an exceptional learning experience to our REALTORSreg the GRI curriculum is currently under development and will be unveiling the new curriculum in May 2016

VAR has taken the original 14 classes that were each 8 hours long and completely revised the content To meet NARrsquos new standards VAR has updated its REALTORreg Institute program to offer 10 classes with most being six hours long totaling 60 hours of coursework for the completion of the designation VAR will continue to offer the program in partnership with our local associations and is excited to announce all 16 hours of CE or 30 hours of PL requirements will be met when attending the 10 modules

Current GRI students if your 5 year completion deadline was in 2014 2015 or 2016 VAR will grant you an extension to 2017 VAR will work one-on-one with all students to make sure that you have the courses needed to complete your designation within a timely manner

A Staunch Defender

From the start organized real estate has been concerned with promoting the message of trust and value to the public One of the main topics discussed at the associationrsquos first national meeting in 1908 was methods for publicly highlighting the benefits of working with members on real estate transactions When he coined the word ldquoRealtorrdquo in 1915 Minnesota practitioner Charles Chadbourn had that goal firmly in mind Chadbourn not only embraced the ideals of NARrsquos foundersmdashthat an association would separate the true professionals from the ldquocurbstoners riffraffs and sharksrdquo that were out to swindle the publicmdashhe felt the members needed a professional title of their own The National Association of Real Estate Boards as NAR was known at that time agreed The association adopted the term in 1916 paying Chadbourn one dollar for the rights

ldquoA news urchin on the street thrust a paper under my noserdquo he later wrote in the National Real Estate Journal ldquobearing the flaming headline lsquoReal Estate Man an Embezzlerrsquo and importuned me to buy and read lsquoall about the big scandal in a real estate officersquothinsprdquoTwo years earlier the National Association of Real Estate Exchanges (as NAR was then called) had approved a Code of Ethics vowing to operate by the Golden Rule But ldquobuyer bewarerdquo still ruled the marketplace

How he wondered might the public understand the difference between a mere real estate agentmdashwith no commitment to professionalismmdashand an association member He wanted a concise way to convey the trust and authority that defined the professional practice of real estate So in the model of ldquodoctorrdquo and ldquolawyerrdquo he coined the term ldquoRealtorrdquo Chadbourn successfully petitioned his local board in Minneapolis to begin using the word and in 1916 he signed over rights to the term making the national association its defender

Talk about the deal of the century NAR has been the proud keeper and staunch defender of the ldquobrand truthrdquo ever since ldquoIf you look back at the old Board of Directors minutes itrsquos clear that trademark protection has been of utmost importance since the beginningrdquo says NAR General Counsel Katherine Johnson ldquoREALTORSreg were definitely on the forefront of establishing and protecting membership trademarks even before the US government was ready to tackle the issuerdquo

In fact NAR couldnrsquot legally apply for federal registration rights to ldquoREALTORregrdquo for three decades after it officially obtained the name The trademark was granted in 1949 after passage of the Lanham Act of 1946 allowed collective membership marks to be registered (The Trademark Act of 1905 had prohibited registration of ldquosymbols of collective groupsrdquo until 1938)

By the mid-1920s an annual consumer outreach effort known as ldquoREALTORreg Weekrdquo was being used as a convenient moment each year for state and local associations to launch initiatives and advertising campaigns The first national version was held in March 1956 eventually replaced by Private Property Week in 1976 and in 1986 American Home Week

In addition to running ads and helping local associations get the word out NAR had the foresight to make connections with dictionary creators editors and publishers to ensure that the term ldquoREALTORregrdquo was used correctly in print

NAR and state and local boards have worked hard to enforce the associationrsquos and membersrsquo exclusive rights to the term Federal and state courts have upheld those rights more than two dozen times In 2015 NAR was a finalist for World Trademark Reviewrsquos Not-for-profit Organization Team of the Year award

New Reality New Strategy

REALTORSreg began advertising nationally in 1998 with the ldquoReal Estate is our Liferdquo campaign Over the years the advertising has enjoyed overwhelming member supportmdashand no wonder For national promotion the $35 annual assessment that members pay is a bargain But while the campaign message changed over the years to reflect the times the medium remained largely traditional television and radio spots

So in 2015 NAR tapped Arnold Worldwide to formulate a new media strategy Arnold began by extensively researching the REALTORreg brand diving into

the fundamental elements of trust and dynamism They found that consumers rated REALTORSreg more trustworthy than both other real estate professionals and four real estate portal websites But in terms of dynamism (as measured by innovation convenience technological advancement accessibility and other factors) the REALTORreg brand came out somewhere in the middle of that same group Lisa Unsworth chief marketing officer at Arnold says the REALTORreg brandrsquos strong score on the trust measurement is a rare demonstration of market saturation ldquoAny other brand would be enviousrdquo she says

agrees that the goal of the campaign isnrsquot to convince more people to use a REALTORreg as much as projecting a sense of vitality ldquoThis isnrsquot a lsquowe need market sharersquo branding campaign This is about being relevant to the contemporary consumer and [ensuring] they understand our value propositionrdquo

The result is an effort to engage DIY-minded consumers who are used to resolving issues with a quick search or the click of a button and

who may be fearful of reaching out to another human being for help achieving their goals Arnold Worldwide contends that online real estate aggregators have given these consumers false hope that the homebuying process is simple The ldquoGet Realtorregrdquo campaign aims to show them a bit of the complexity of the process and the competitive advantage that comes from working with a REALTORreg The name is both a cheeky take on this wake-up call (as in ldquoget realrdquo) and a more literal call to action to ldquogetrdquo a REALTORreg

The campaign approaches outreach and market saturation in a new way For decades advertising was devised with TV commercials at the center bolstered by ancillary radio spots

billboards and other media The strategy for ldquoGet Realtorregrdquo recognizes that consumers now have more control of their media intake ldquoConsumers are at the center and their networks radiate out from thatrdquo Unsworth says Content will be present in social media and other digital spaces where they are already spending their time as well as traditional ad environments

How the Past Builds the FutureWhile working with 100 years of history can be a challenge Unsworth says highlighting the legacy of the REALTORreg mark is an exciting task for Arnold Worldwide ldquoThose are the fun brands to work withrdquo she says ldquoSome clients come to us and say lsquoWe need you to create a brandrsquo and wersquore like lsquoUh ohrsquo You donrsquot invent brands Itrsquos about revealing a brand truthrdquo

She compares the trademark to a diamond that only needs a little polishing to show its true value in todayrsquos marketplace ldquoThe equities of the REALTORreg brand are incredibly strong The DNA of the brand is 100 yearsrsquo worth of workrdquo she says ldquoWersquore tasked with honoring that work in a way that is culturally relevant and contemporizing the vehicles we userdquo

Despite the many changes to the media landscape since the mark was created a century ago the spirit of 1916 remains alive and well in the new campaign ldquoThough wersquore using digital video and social media posts
