Defendants each agreed to provide certain goods and services to the Plaintiff
involving the construction of the Ella Barnes Elementary School which was completed in
1992 and is owned and operated by Plaintiff Corpus Christi Independent School District,
but failed to use ordinary care in the construction of the school as required by law and by
their agreements with the Plaintiff and as a direct result of their conduct, breach of
warranty and breach of contract, the school has suffered physical damage to the school
property and the Plaintiff Corpus Christi Independent School District has suffered
substantial financial loss and loss of use. Such damages are within the jurisdictional
limits of this Court.
Plaintiff prays that upon trial the Plaintiff have judgment against the Defendants
jointly and severally for actual damages including direct, incidental and consequential
damages, for costs of court, for pre-judgment interest, and for all the other relief to which
it is justly entitled.
