January 27, 2016: Arrive in BangkokTravelers will be met at Suvarnabhumi International Airport by an Abercrombie & Kent guide after clear-ing immigration and customs. Your guide and private air-conditioned vehicle will then transfer you to the famous Mandarin Oriental Bangkok to check in.

Bangkok is one of the most cosmopolitan Asian cities: a steamy, pulsating, yet welcoming metropolis of more than ten million people—intense at first, but addictive.

Evening activities include cocktails and dinner on the private Menorah Boat Cruise.

January 28, 2016: BangkokEnjoy a quintessentially Thai experience by observing a Buddhist ceremony in the morning.

After breakfast, you will attend a two hour Panel Discussion & Guests’ Speech on aspects of the history and culture of Bangkok at the Function Room of the Mandarin, Oriental. Following the panel discussion lunch will be served at the Mandarin Oriental.

After lunch, site visits include: the Grand Palace, the royal palace of the kings of the Chakri dynasty, found-ed in 1782 and the current ruling house; a boat cruise to explore the Thonburi Klongs and the Chao Phraya River (the River of the Kings); the Wat Arun (Temple of Dawn), a dramatic temple on the south bank of the river; and the Royal Barge Museum, one of Bangkok’s most fascinating sights, providing a rare insight into Thai history and culture.

Dinner will be served at the Mandarin Oriental and will be followed by a visit to a Muay Thai arena to explore the country’s national sport ingrained deep within Thai society.

Please note: appropriate attire must be worn when visiting the Grand Palace. Short skirts, shorts and sleeveless attire are not permitted. Some buildings within the Grand Palace are only open to visitors from Monday-Friday.

January 29, 2016: Bangkok / Chiang Mai

Visit Prasart Museum, a private family gallery and garden that highlights the artistic splendor of Thai culture. Lunch will follow at an authentic Thai restaurant with dishes that will include local and home-grown cuisine and specialties.

Guests will then check out of the Mandarin Oriental and and be driven to Suvarnabhumi International Airport for the flight to Chiang Mai.

Check in at the Four Seasons Chiang Mai.

Chiang Mai is Thailand’s gateway to its great north country; a region of rugged mountains, rich stands of hardwood forest, and the last domain of the complex web of tribal groups which have migrated into the relatively isolated region of the north over the past 1,000 years from their original bases in central and southern China.

Dinner will be held at The Gallery, one of Chiang Mai’s most famous local restaurants.

January 30, 2016: Chiang MaiDepart the hotel for a morning trip into the northern Thai countryside, beginning with a visit to the Chiang Dao Elephant Training Camp. The visit to the camp will include some time for bamboo or river rafting on the river, which flows through the campsite. Guests will then visit the Hilltribe Villages.

Lunch will be served at the Rinrade Resort.

Afternoon activities will include a visit with Patricia Cheeseman, an expert on textiles, and her dyeing work-shop. Guests will have an opportunity to see her collection of rare costumes and learn about the “Weaving for the Environment” project that she founded to preserve her ancient craft.

Dinner will be served at the unique Whole Earth restaurant.

January 31, 2016: Chiang Mai / YangonAfter breakfast at the hotel, guests will visit the Waroros Market, also known as “Kad Luang” (Big Market) on the banks of the River Ping.

From the market, guests will travel to Doi Suthep. At 3,500 feet above sea level the temple grounds provide fine views over Chiang Mai and the surrounding Lanna Kingdom. The morning will conclude with a rick-

shaw ride to Wat Phrasing, situated in the center of the city.

Lunch will be served at an authentic local restaurant prior to returning to the hotel to check out.

From the hotel guests will transfer to the Chiang Mai Airport and travel to Yangon.

Yangon is a city where contemporary and colo-nial Myanmar (19th and 20th centuries) continue to coexist decades after British departure. It is a handsome city with a history of over two millennia, though it has been a capital for a mere 100 years.

Rebuilt on a grid plan in the 1850s, the wide tree-lined boulevards are bordered by fine stone buildings. In the 1880s, Yangon was renowned as the “Queen of the East”.

Guests will check in at the Governors Residence.

February 1, 2016: Yangon

Morning activities include a visit to Botataung Pagoda, followed by a trip to the Sule Pagoda and the Scott Market (Bogyoke Aung San Market).

Lunch will be served at the Strand Hotel.

OPTIONAL: A UNIQUE LECTURE WITH DEBBIE AUNG DIN AND JIM TAYLOREnjoy a stimulating lecture and conversation with Jim Taylor and Debbie Aung Din, the founders of one of Myanmar’s most prominent social and economic enterprises, Proximity Designs.

In the afternoon, guests will visit the National Museum, the showpiece of which is the Lion’s Throne, a striking example of the Myanmar art of woodcarving.

The day will end with a visit to the Shwedagon Pagoda. This architectural masterpiece is a golden fantasy of gilded stupas, serene Buddhas and mythical beasts said to be 2,500 years old.

OPTIONAL: 1,000 OIL LAMPS TO ILLUMINATE SHWEDAGON PAGODA At sunset, guests have the option to visit Shwedagon Pagoda and take part in the lighting of 1,000 special oil lamps to illuminate this magnificent structure at dusk.

Dinner will be at Le Planteur Restaurant.

February 2, 2016: Yangon / Bagan Early morning flight from Yangon airport to Bagan.

Upon arrival in Bagan, guests will visit the local market in Nyaung Oo and then continue to Shwezigon Pagoda, which was built to house the Buddha’s collarbone, frontal bone and tooth gathered from various countries. Also included in the expedition is a visit to Kubyaukgyi Temple, which is located in the little village of Wetkyi-In.

Lunch will be served at BBB Restaurant.

The afternoon will include a visit to the last “Bur-man-style” temple built in Bagan—the Htilominlo

Temple—which is 150 feet tall and 140 feet wide at its base. Guests will then take a horse cart ride to Anan-da Temple, one of the best preserved temples in Bagan. Special activities include a visit to a lacquerware workshop to witness the process of this ancient craft in its spiritual home.

The evening will close with a sunset cruise on the Ayeyarwaddy River. Dinner will be at the hotel.

February 3, 2016: Bagan OPTIONAL: BALLOON RIDE OVER BAGAN Enjoy an early morning sunrise over Bagan from a hot air balloon. Guests will have a magnificent “bird’s-eye” view of the thousands of pagodas and temples and the mighty Ayeyarwaddy River as they float serene-ly across the “Golden Land”.

A follow-on excursion will lead to the environs of Mount Popa. Lunch will be served at Popa Mountain Restaurant.

The afternoon will be filled with sightseeing in Bagan. In the village of Minnanthu, just a few miles southeast of Bagan, guests will visit the Sulamani Temple, one of the largest temples among the many ruins in the vicinity.

February 4, 2016: Bagan/Yangon Departure In the morning, guests will depart Bagan for a flight to Yangon. Upon arrival in Yangon guests will be trans-ferred for final sightseeing and last minute shopping in Yangon.

In the afternoon guests will be transferred to Yangon international airport to connect to international flights of departure.

January 24, 2016: Bangkok/Siem ReapArrive at the Bangkok airport in the afternoon and travel to Siem Reap.

On arrival at the Siem Reap Airport, VIP assistance and a visa on arrival will be arranged. Meet and transfer to Raffles Grand Hotel.

Nestled between rice paddies and stretched along a river, this former sleepy riverside provincial town of Siem Reap serves as the gateway to the ancient magnificent Angkor and other ruins which formerly the seat of power for the once vast and glorious Khmer empire through the 9th and 15th centuries AD. Enjoy a magical evening with dinner and a performance of Apsara dancers.

January 25, 2016: Siem Reap The morning will start with a visit to Angkor Thom complex. Visit the mysterious Bayon Temple, which was constructed during the reign of King Jayavarman VII. Situated in front of the east entry tower of the enclos-ing wall at the Royal Palace is the Terrace of the Elephants.

Enjoy a picnic lunch at Sras Srang.

Conclude your sightseeing this morning to Ta Prohm. Its modern name, meaning “Old Brahma,” is quite inaccurate, as the temple was built by Jayavar-man as a Mahayana Buddhist sanctuary.

Later in the afternoon visit a local Buddhist monas-tery with alms offering and monks blessing. Once

inside the pagoda, take a seat on the floor in front of Buddhist monks who sit in saffron robes. Then embark on a boat ride on Tonle Sap Lake (Great Lake) to observe local life as it unfolds along the floating villages

that dot the shoreline.

On the way back visit Les Artisans d’Angkor—a school for underprivileged youth where they are taught the ancient crafts of wood and stone carving, creating lacquerware, painting and silk weaving.

Dinner will be served at the Foreign Correspondents Club, a haven for expatriates in Cambodia. This exclusive eatery is housed in the former French Governor’s mansion and filled with historical allure.

Special note: visitors are required to have their photo taken on-site before being allowed admittance into the Angkor Wat complex. Women are suggested to dress modestly during the visit to temples- no

see-through clothes, bare shoulders and must be skirts below knee length. Over the next two days your itinerary is kept flexible in order to enjoy the magnificent surroundings of Siem Reap without following the tourist masses and upon your pace.

January 26, 2016: Siem Reap Visit Ankor Wat at sunrise and the “crowning jewel” of Khmer architecture—one of Asia’s most magnificent archaeological ruins. Return to hotel for a late breakfast.

Drive to the outskirts of Siem Reap for a visit to the pink sandstone, Banteay Srei, standing apart from the other monuments of the Angkor region. Also visit Sam’s Brothers Clean water project, an A&K Philanthropy project that provides local communities with clean water on the way back to hotel.

Lunch will be served at the Bong Thom House. Following lunch visit the Roluos Group including Prah Ko, Bakong and Lolei Temples along with an Oxcart Ride.

Dinner will be served at the Athakorn House (Local House). The Athakon house is built on two large rice-fields, which for many years were fed by streaming water originating from the Phnom Kulen holy mountain.

January 27, 2016: Siem Reap / Bangkok Return to Bangkok International Airport early in the morning where you board your flight from Siem Reap back to Bangkok.

February 4, 2016: Yangon / Ho Chi Minh CityUpon arrival in Yangon from Bagan those joining the Vietnam Extension will be transferred to the Yangon Airport International Terminal where they will board their international flight from YANGON to HO CHI MINH CITY (Saigon).

Tonight, your welcome dinner will be served in the Drawing Room of the Park Hyatt.

February 5, 2016: Ho Chi Minh CityEarly in the morning, enjoy a one-hour speedboat ride to the Cu Chi Tunnels. While travelling on a luxuri-ous modern boat, as you pass the mangrove and palm trees that line banks of the river, you’ll feel you have been transported back in time.

After your visit you will be transferred back to Ho Chi Minh City by private coach. Enjoy lunch at the popu-lar Cuc Gach Quan Restaurant upon arrival.

In the afternoon, begin a half-day guided tour of Ho Chi Minh City which starts with a visit to the powerful War Remnants Museum. Make a brief photo stop at the Notre Dame Cathedral in the heart of Ho Chi Minh City and continue to visit other historic sites around the City. The tour will finish with a visit to the bustling Ben Thanh Market. Following this visit you will return to your hotel.

Dinner will be at the Ly Club Restaurant known for its authentic “Saigon” style cuisine—the ingredients are all locally sourced and the chef has an innovative flair in creating unique dishes. Following dinner you will have the option to enjoy Ho Chi Minh City after Dark and take in the vibrant night environment from

the back of a motorcycle—just as locals do. The tour will take you through the lively nightlife and busy streets where you can enjoy streetfood and sites hardly seen by foreigners. The tour will end with a hidden Vietnamese-style coffee shop to enjoy Vietnamese live music as a local.

February 6, 2016: Ho Chi Minh City / Hanoi

Upon arrival in Hanoi, you will be met by an Abercrombie & Kent representative and transferred to the elegant Sofitel Legend Hanoi to check in and have some time to freshen up and get settled.

Lunch will be served at the lovely Club Opera restaurant.

After lunch, enjoy a Cyclo Ride (the most traditional mode of transportation) through Hanoi’s colourful Old Quarter. The Old Quarter, with its thousand years of history, remains one of Vietnam’s liveliest areas.

Following your cyclo ride enjoy visits to:

Hoan Kiem Lake: This is a small lake located in the middle of Hanoi stretching between the Old Quarter and the French Quarter where a Turtle Pagoda stands on one of the lake’s two islands. Not only does the lake serve as a gathering point but it also is a performance venue during major festivals.

Ngoc Son Temple: Situated on an island in Hoan Kiem Lake, this quiet 18th-century shrine, whose name means “Jade Mountain,” is one of Hanoi’s most picturesque temples. This shrine is dedicated to 13th-cen-tury military hero Tran Hung Dao, the scholar Van Xuong, and to Nguyen Van Sieu, a Confucian master who assumed responsibility for repairs made to the temple and the surrounding areas in 1864.

Hanoi Ancient House: Located within Hanoi Old Quarter, the ancient house at 87 Ma May Street which was built at the late of the 20th century is quite intact with typical architecture of ancient houses.

End the day with a visit to the historic Thang Long Theatre for a special Water Puppets Performance, a uniquely northern Vietnamese art form designed for depicting scenes from rural life and many episodes of national history.

Dinner will be at 1911, a popular local restaurant located close to the historic Opera House. Following dinner you will return to your hotel.

February 7, 2016: HanoiIn the morning after breakfast, set out for a full day of informative sightseeing that will start with a visit to the historic Ho Chi Minh Mausoleum. The next stop will be to Ho Chi Minh’s official house which was built using the finest wooden materials and modelled on a hill tribe house from the Tonkinese Alps in northern Vietnam. Continue on and visit the his-toric One Pillar Pagoda—built in the 11th century by King Ly Thai To, the pagoda known to locals as “Chua Mot Cot” is one of Vietnam’s most iconic temples.

You will also visit the most popular temple site in Hanoi, Quoc Tu Giam, a Confucian temple otherwise known as Temple of Literature. Recognized as Hanoi’s first university, the temple hosts the Imperial Acade-my and has educated Vietnam’s royalty and members of elite society for nearly 700 years.

Following the morning tour enjoy lunch at charming, Madame Hien Restaurant which serves some of the best “home style” Vietnamese cuisine in the city.

After lunch you will visit Hoa Lo Prison, immortalized during the Vietnam War as the “Hanoi Hilton”.

February 8, 2016: Hanoi/Halong BayIn the morning your guide will meet and transfer you overland from Hanoi to Halong Bay. Over 3,000 islands dapple the crystalline waters of the bay (which is part of the Gulf of Tonkin) covering 1,500 square kilometers of beach, forest and mountain. The limestone formations—washed by the sea for thousands of years—that dominate the landscape are richly celebrated in local folklore. Ha Long Bay has twice been recognized by UNESCO as a World Natural Heritage Area for its exceptional scenic beauty and outstanding geological and geomorphic values.

At noon, you will check-in at your private cruise center Tuan Chau Marina, Tuan Chau Island. Meet your private butler who will assist with your embarkation onto the Indochina Sails Junk and enjoy a wel-come cocktail. Savor a delicious fusion lunch and then sail to Vung Ha Beach. Your day will include visits to some of the more noted grottoes and will include time to relax and take in the scenic beauty of northern Vietnam. The islands that dot the bay are home to many species of animal seldom found on the mainland including monkeys, tropical birds and a rich abundance of marine life in the bay itself.

In the evening, dinner will be on a private islet in a cave and will include a traditional music band that will entertain you with some popular Vietnamese folk songs.

February 8, 2016: Hanoi/Halong BayEarly this morning enjoy a private Tai Chi class on deck before sitting down to brunch as your boat sails back to the mainland.

After disembarking you will be transferred to the Noi Bai International Airport where you will check-in for your departure flight from Hanoi to Bangkok.

Terms & ConditionsIndividual FIT Bookings

CONTRACTING PARTIES

These Terms and Conditions are legally binding between the traveler(s) and A&K Thailand, herein after referred to as A&K.

1. ACCEPTANCE OF THESE TERMSPLEASE NOTE: Acceptance of a quotation from A&K constitutes acceptance of these Terms and Conditions which take effect immediately.

2. ACCOMMODATION:All accommodation, room type(s) and specification are as shown in the itinerary.

3. MEALS:Meals are as shown in the itinerary.

4. TRANSFERS:Transfers are provided on arrival and departure from airport to hotel and return only where specified in the itinerary.

5. ITINERARY:Accommodation and arranged sightseeing are subject to change at any time due to unforeseen circumstances or circumstances beyond A&K’s control. Every effort will be made to operate tours as planned, but alterations may occur after the final itinerary has been issued. A&K also reserves the right to withdraw a tour or any part of it, to make such alterations to the itinerary or the tour inclusions as it deems necessary or desirable, and to pass on to tour members any expenditures or losses caused by delays or events beyond its control.

In case of any appreciable variation in the tour price due to these circumstances, A&K reserves the right to make adjustments to the tour costs as necessary.

6. SPECIAL REQUESTS:Specific requests should be advised at time of booking. Please note that every effort will be made to secure special requests, however; they cannot be guaranteed.

7. TRANSPORTATION:Transportation will be as specified in the itinerary.

8. BAGGAGE:A&K provides handling of baggage only as specified in the quotation. Weight restrictions for baggage on some routes on internal/domestic flights may apply; details of which will be provided with pre-tour documentation. Baggage and personal effects are at the owner’s risk throughout the tour and A&K assumes no liability for lost or damaged baggage. Baggage insurance is strongly advised.

Please check with your international carrier for other baggage restrictions applicable to your international flight.

9. TAXES AND GRATUITIES:Hotel taxes as imposed by city and state governments are included. Airport taxes are included where specified in the itinerary.

Gratuities for guides, drivers, porters, camp staff, ship crew and Tour Managers are not included and are at the discretion of the traveler.

10. PRICES & ARRANGEMENTS:The tour price includes planning, handling and operational charges and is quoted based on the current rates of exchange and tariffs. Entrance fees as part of scheduled sightseeing tours are also included in this price. This price is subject to revision in line with significant changes in foreign currency, tariff rates, taxes etc.

11. EXCLUSIONS:The cost of obtaining passports, visas, excess baggage charges, items of a personal nature such as drinks, laundry, telephone calls, fax charges and excess baggage charges unless expressly included in writing, are not included in the tour price.

12. PHOTOGRAPHY:A&K reserves the right to take photographs during the operation of any program or part thereof and to use them for promotional purposes. By booking a program with A&K, travelers agree to allow their images to be used in such photographs. Travelers who prefer that their images not be used are asked to identify themselves to A&K prior to final payment and they will be exempted from this photography waiver clause.

13. REGISTRATION:A non-refundable deposit of 10% is required at the time of booking. The remainder of the tour cost is payable 60 days prior to departure. If the reservation is made within 60 days of departure, the entire tour price must be paid at the time of confirmation.

14. PAYMENT METHOD:Payments may be made by the following methods:

• Credit card

• Cheque

• Bank transfer

A&K cannot guarantee that all payment methods will be accepted and A&K will therefore advise of the most suitable payment method at the time of deposit.

15.1 For payment by credit card A&K reserve the right to charge a levy of up to 3%.

15.3 For payment by bank transfer please confirm with A&K by fax or email the date on which payment has been made.

15.4 Travelers are liable for all bank and related transaction charges.

15. CANCELLATION:All cancellations must be received in writing.

16.1 Cancellations received between the date of booking and 61 days prior to departure will result in the loss of the deposit. 16.1.1 Cancellations received 60 - 46 days prior to departure will be subject to a cancellation charge of 15% of the tour price. 16.1.2 Cancellations received 45 - 29 days prior to departure will be subject to a cancellation charge of 25%of the tour price. 16.1.3 Cancellations received 28 - 15 days prior to departure will be subject to a cancellation charge of 50% of the tour price. 16.1.4 Cancellations received 14 days or less prior to departure will be subject to a forfeiture of the entire tour price. 16.2 Cancellation of airline tickets will be subject to the refund policy of each individual

airline and may be greater than the percentages above particularly when low cost/net based fares are used. 16.3 The purchase of special event tickets is subject to the refund policy of each individual event. Please refer to the specific event policy for details. 16.5 A&K reserve the right to charge for financial penalties, fees and losses incurred as a result of cancellation.

16. CLAIMS AND REFUNDS:Refunds are not made for any missed services, except for verifiable extenuating circumstances. Please see our LIMITS ON ABERCROMBIE & KENT’S RESPONSIBILITY clause below. For verifiable claims to be considered, they must be received in writing within 30 days of the termination of the program. Any adjustment considered will be based on the actual price of the services involved and not on a per diem basis. Adjustments will not be made for unused sightseeing trips or meals. A&K will not accept any liability for any claims that are not received within 30 days of the termination of your program. All claims for days missed while travelling should be made in writing within 30 days of the program.

17. LIMITS ON ABERCROMBIE & KENT’S RESPONSIBILITY:A&K Thailand, its employees, shareholders, officers, directors, successors, agents and assigns (collectively A&K), does not own or operate any entity which is to

or does provide goods or services for your trip with the exception of a limited number of vehicles. It purchases transportation (by aircraft, coach, train, vessel or otherwise), hotel and other lodging accommodations, restaurant, ground handling and other services from various independent suppliers (including from time to time other affiliated Abercrombie & Kent companies). All such persons and entities are independent contractors. As a result, A&K is not liable for any negligent or willful act of any such person or entity or of any third person.

In addition and without limitation, A&K is not responsible for any injury, financial or physical loss, death, inconvenience, delay or damage to personal property in connection to the provision of any goods or services whether resulting from but not limited to acts of God or force majeure, illness, disease, acts of war, civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of services, food poisoning, mechanical or other failure of aircraft or other means of transportation or for failure of any transport mechanism to arrive or depart on time.

There are many inherent risks in adventure travel of the type involved here, which can lead to illness, injury or even death. These risks are increased by the fact that these trips take place in remote locations, far from medical facilities. Passenger assumes all such risks associated with participating in this trip.

18.1 In the event of a cancellation or material alteration to the trip as a result of the circumstances as described in this clause A&K may in their sole and absolute discretion:

a) offer the traveler(s) alternative travel arrangements or products of comparable standard as may be appropriate in the circumstances; or

b) if alternative travel arrangements or products are not offered by A&K, A&K will make a prompt proportional refund of monies paid by the traveler.

18.2 A&K may charge a reasonable fee to cover the administration costs associated with providing alternative travel arrangements or products.

18.3 If a material alteration becomes necessary within 90 days of the departure date for any reason other than the circumstances described in this clause, A&K will endeavor to offer comparable products or a full refund of all monies paid by the traveler(s).

HEALTH PRECAUTIONS:Please ensure that you consult your personal physician about anti malaria precautions and other inoculations and vaccinations before travel. Where applicable, please ensure that whilst travelling you carry a valid Yellow Fever certificate.

TRAVEL ADVISORIES/WARNINGS:It is the responsibility of travelers to become informed about the most current travel advisories and warnings by referring to their respective government agencies. In

the event of an active State Department or government agency Travel Warning against travel to specific destination location(s) of the trip, should the traveler still choose to travel, notwithstanding any travel advisory or warning, the traveler assumes all risk of personal injury, death or property damage that may arise out of the events like those advised or warned against.

TRAVELLERS’ REPRESENTATIONS:Traveler(s) represent(s) that neither he nor anyone traveling with him has any physical condition or disability that could create a hazard to himself or other members of the tour. A&K reserves the right to remove from the trip, at the sole expense of the traveler, anyone whose condition is such that he or she could create a hazard to himself or others, or otherwise impact the enjoyment of other passengers on the trip.

AIR TRANSPORTATION:Airlines concerned are not to be held responsible for any act, omission or event occurring while passengers are not on board their aircraft. International air carriers are also subject to international air conventions limiting their liability. These limitations of liability are explained on the e-ticket or on the reverse of the airline ticket and when issued, this constitutes the sole contract between the respective air carrier(s) and their passengers.

PASSPORT & VISASPlease note that passport holders are responsible for obtaining the required documentation applicable for entry. Please note also that passports must be valid for six (6) months before departure and should also have sufficient blank pages for visas and immigrations stamps. A&K cannot be held responsible should you be denied entry to a country due to non-compliance with these requirements.

TRAVEL INSURANCE:A&K strongly recommend all clients take out comprehensive travel insurance prior to date of travel. This insurance should cover cancellation and curtailment, all medical expenses including evacuation/repatriation, personal baggage, personal liability, death and permanent disability and travel document insurance. A&K cannot be held responsible for any costs arising from such loss or injury.

ARBITRATION AGREEMENT:Any claim arising out of or relating to these Terms and Conditions, to the Limits on A&K’s Responsibility clause, to the brochure, to any information relating in any way to the trip, to the trip itself or to any products or services related to the trip, shall be settled in the first instance by binding arbitration in the applicable legal forum as detailed in clause 26 of these Terms and Conditions. In lieu of a personal appearance at arbitration the arbitration may be conducted by telephonic means. Arbitration is the exclusive forum in the first instance for dispute resolution and except as otherwise provided by statute, each party shall bear its own costs and expenses and an equal share of the arbitrator and administrative fees.

APPLICABLE LAW AND FORUM:This agreement shall be construed, interpreted and enforced in accordance with, and shall be governed by the laws of Thailand. It is agreed between A&K and the travelers that all lawsuits against A&K arising under, in connection with, or incidental to the tour shall be filed, if at all, in the courts of Thailand to the exclusion of the courts of or in any other country or jurisdiction
