    Undergraduate Emphasis: As a predominantly undergraduate university,Cal Poly is known nationally for the quality of its baccalaureate degreeprograms in a variety of disciplines. We also offer outstanding master’sdegree programs.

    A Guide to Using the CatalogAcademic terminology and a university catalog can be confusing tosomeone first entering the University. This section explains some of thejargon you will quickly come to know and explains briefly how the catalogis organized.

    Colleges and DepartmentsThe faculty who supply instruction at Cal Poly hold positions in academicdepartments, which in turn are grouped into Colleges. All of the academicprograms offered by the University are described in the catalog. Acomplete listing of academic programs at Cal Poly may be found on thePrograms A-Z (http://catalog.calpoly.edu/programsaz) page.

    In the catalog, Colleges are listed in alphabetical order.  Departments arealso arranged alphabetically within their respective College.

    DegreesA degree is an academic rank which the University confers on astudent who satisfactorily completes a designated curriculum, orprogram of study. Cal Poly grants undergraduate degrees – also calledbaccalaureate degrees – as well as master's degrees.

    At the undergraduate level, Cal Poly grants the• Bachelor of Arts (BA),• Bachelor of Science (BS),• Bachelor of Architecture (BArch),• Bachelor of Fine Arts (BFA), and• Bachelor of Landscape Architecture (BLA).

    At the graduate level, Cal Poly grants the• Master of Arts (MA),• Master of Science (MS),• Master of Agricultural Education (MAgEd),• Master of Business Administration (MBA),• Master of City and Regional Planning (MCRP),• Master of Public Policy (MPP)• Master of Professional Studies (MPS)

    MajorsA major is a program of study that provides students with the knowledge,skills and experience necessary to pursue a specific career or advancedstudy and leads to an undergraduate degree in that subject. Each major isoffered in an academic department or program.

    Undergraduate applicants to Cal Poly select a major at the time theyapply for admission.

    General requirements for bachelor's degrees are outlined in GeneralRequirements - Bachelor's Degree (p. 30) and for master's degrees in

    Graduate Education (p. 408). The specific requirements for a particularmajor degree program are listed under the academic department orprogram that offers the major.

    The curriculum display for each bachelor's degree program showscourses arranged by Major, Support, General Education and Electives.These curriculum displays are useful guides, but students should consultwith their academic advisors.

    Information regarding academic advising is available on the AcademicAdvising (p. 418) page.

    CoursesDescriptions of Cal Poly courses are located in Courses A-Z (p. 500),arranged alphabetically by subject area with its correspondingcourse prefix (an abbreviation that represents the subject or offeringdepartment). The courses in a bachelor's degree curriculum are identifiedas Major Courses, Support Courses, General Education, and Electives.

    Major Courses are designed to provide competence in the professionalfield in which a degree is earned. They are usually offered by theacademic department in which the degree program is offered, but theymay include courses from other departments.

    Approved Electives are courses that students can choose from within theparameters set by their departments.

    Support Courses provide background needed for major courses and areoffered by departments other than the department in which the majoris offered. For example, most majors in engineering and in the sciencesrequire support courses in mathematics. Some degree programs do notinclude support courses.

    General Education (GE) courses provide a common foundation ofknowledge for all undergraduate programs. GE requirements aredescribed in detail on the General Education (p. 30) page.

    Free Electives are courses that students can choose simply to pursuetheir own interests.

    Prerequisites are one or more courses that must be completed, or otherknowledge, skills, or standards that must be demonstrated, before astudent is permitted to take certain courses. Prerequisites (if any) for acourse are listed in the course's description in the catalog.

    Some prerequisites have their own prerequisites, forming a string ofcourses that must all be taken. The catalog course description showsthe last course in the prerequisite string of courses. For example, ME 212Engineering Dynamics has prerequisites of MATH 241; and ME 211 orARCE 211.  MATH 241 Calculus IV requires MATH 143, which requiresMATH 142, which requires MATH 141. ME 211 Engineering Staticsrequires MATH 241; and PHYS 131 or PHYS 141. To enroll in ME 212Engineering Dynamics, students must have successfully completedMATH 241, MATH 143, MATH 142, MATH 141 and ME 211 or ARCE 211and PHYS 131 or PHYS 141.

    Statements in the catalog course descriptions may also contain thewords “concurrent” which means that two or more courses must be takenin the same term or “corequisite” which means that the course or coursesmay be taken prior to the course being described (prerequisite) or in thesame term (concurrent).

    If a student does not meet a requisite as outlined in a course'sdescription, but can demonstrate to an instructor that they have the

    necessary knowledge or skills through alternative means, then theinstructor may grant the student permission to enroll in the course.

    Crosslisted courses are shared by two or more academic units andhave identical titles, descriptions, units, modes of instruction andprerequisites. They are interchangeable for degree requirements. Theycannot be repeated for degree credit under separate prefixes. Example:HNRS 141 / MATH 141 Calculus I.

    Selected Advanced Topics (470s) are generic courses that offer specialtopics on an "as needed basis.” The specific topic appears in theSchedule of Classes and on the students' transcripts.

    Topic courses are shown in the catalog with generic titles and arerepeatable with different topics. Specific topic titles appear in theSchedule of Classes and on students’ transcripts. Example: ENGL 439Significant British Writers, repeatable to 12 units with different topics(e.g., Jane Austen, Victorian Poets, Hardy).

    Other statements in the course descriptions include, “major credit limit”(total number of units allowed toward the major) and “total credit limit”(total number of units students can take a course for credit).

    Course Numbering SystemCourses are generally numbered according to the plan shown below.

    • 010–099 Pre-baccalaureate courses that are not for degree credit.• 100–299 Courses primarily for freshman and sophomore students.• 300–399 Courses primarily for advanced undergraduate students

    with prerequisite coursework.• 400–499 Courses for advanced undergraduates. Certain 400-level

    courses can be used in graduate programs. See General Policies(p. 412) for Graduate Education.

    • 500–599 Graduate courses.

    Credit HourAs of July 1, 2011 federal law (Title 34, Code of Federal Regulations,sections 600.2 and 600.4) requires all accredited institutions to complywith the federal definition of the credit hour. For all CSU degree programsand courses bearing academic credit, the “credit hour” is defined as “theamount of work represented in intended learning outcomes and verifiedby evidence of student achievement that is an institutionally establishedequivalency that reasonably approximates not less than:

    1. One hour of classroom or direct faculty instruction and a minimum oftwo hours of out-of-class student work each week for approximatelyfifteen weeks for one semester or trimester hour of credit, or ten totwelve weeks for one quarter hour of credit, or the equivalent amountof work over a different amount of time; or

    2.  At least an equivalent amount of work as required in paragraph (1)of this definition for other academic activities as established by theinstitution, including laboratory work, internships, practice, studiowork, and other academic work leading to the award of credit hours.”

    A credit hour is assumed to be a 50-minute period. In courses in which“seat time” does not apply, a credit hour may be measured by anequivalent amount of work, as demonstrated by student achievement.

    Modes of InstructionThe mode of instruction is included in each course description; forsupervision/independent study courses, no mode is indicated. Somecourses have more than one mode of instruction.

    Mode and number of hours classes meet each weekActivity:    2 hours per unit of credit.Laboratory:    3 hours per unit of credit.Lecture:    1 hour per unit of credit.Seminar:    1 hour per unit of credit.Supervision/Independent Study:    Courses involve independent workdone by students under the guidance of the faculty and do not meetregularly in a classroom. 3 hours of independent study per week per unitof credit.

    ConcentrationsA concentration is a group of courses designed to provide specializedknowledge within a bachelor's degree program. Completion of aconcentration is noted on the student's transcript, but not shown on thediploma.

    SpecializationsA specialization is a similarly specialized group of courses in a master'sdegree program. Completion of a specialization is noted on the student'stranscript and shown on the diploma.

    MinorsA minor is an integrated, coherent group of courses designed to givea student knowledge in an academic area outside of the major fieldof study. The minor is completed along with the requirements for thebachelor's degree. For more information and a list including availableminors at Cal Poly, see Programs A-Z (http://catalog.calpoly.edu/programsaz). Completion of a minor is noted on the student's transcript,but not shown on the diploma.

    Graduate CertificatesA graduate certificate is designed to provide a specialized area of studythat meets the requirements for professional competence and to expandaccess to specialized knowledge. The subject matter is advanced andnarrow in focus.

    The programs are typically designed for working professionals who areseeking to advance their career opportunities by obtaining specializedknowledge in their field or in a new field. Completion of the graduatecertificate program will be commemorated by a document bearing theUniversity seal and signed by the program's college dean(s) and is notedon the student's transcript.

    Quarters and Quarter UnitsCal Poly's academic calendar consists of four quarters – Fall, Winter,Spring and Summer (see Academic Calendar (p. 18)).

    Cal Poly's academic year consists of Fall, Winter and Spring quarters.

    The university year includes, and begins with, Summer quarter.

    Each course offered by the University carries a value in quarter units,often referred to simply as units or credits.

    To convert semester units to quarter units, multiply by 1.5. For example, 6semester units X 1.5 = 9 quarter units.

    Changes in Rules and PoliciesAlthough every effort has been made to assure the accuracy of theinformation in this catalog, students and others who use this catalogshould note that laws, rules, and policies change from time to timeand that these changes may alter the information contained in thispublication. Changes may come in the form of statutes enacted by theLegislature, rules and policies adopted by the Board of Trustees of theCalifornia State University, by the Chancellor or designee of the CaliforniaState University, or by the President or designee of the campus. It is notpossible in a publication of this size to include all of the rules, policiesand other information that pertain to students, the institution, and theCalifornia State University. More current or complete information maybe obtained from the appropriate department, school, or administrativeoffice.

    UNIVERSITY LEARNINGOBJECTIVESA Cal Poly education is the result of experiences taking place in the majorand in general education, as well as in the curriculum and co-curriculum.The University Learning Objectives (ULOs) allow these experiences to bealigned to a common set of academic expectations.

    The ULOs state that all students who complete an undergraduate orgraduate program at Cal Poly should be able to:

    1. Think critically and creatively.2. Communicate effectively.3. Demonstrate expertise in a scholarly discipline and understand that

    discipline in relation to the larger world of the arts, sciences, andtechnology.

    4. Work productively as individuals and in groups.5. Use their knowledge and skills to make a positive contribution to

    society.6. Make reasoned decisions based on an understanding of ethics,

    a respect for diversity, and an awareness of issues related tosustainability.

    7. Engage in lifelong learning.

    Cal Poly shares some of these expectations with other universities(See ULO 1, 2 and 7). Others reflect Cal Poly's unique character asa comprehensive polytechnic characterized by a preponderance ofprofessional degree programs (ULO 3-6).

    ULO 6 states that all Cal Poly graduates should be able to make reasoneddecisions based on a respect and appreciation for diversity and anawareness of issues related to sustainability. Because of the complexityof these objectives, the Academic Senate adopted the Diversity LearningObjectives (DLOs) in 2008 and the Sustainability Learning Objectives(SLOs) in 2009, both as addenda to the ULOs.

    Diversity Learning ObjectivesThe DLOs state that all Cal Poly graduates should be able to:

    1. Demonstrate understanding of relationships between diversity,inequality, and  social, economic, and political power both in theUnited States and globally

    2. Demonstrate understanding of contributions made by individualsfrom diverse and/or  underrepresented groups to our local, national,and global  communities

    3. Critically examine their own attitudes about diverse  and/orunderrepresented groups   

    4. Consider perspectives of diverse groups to inform reasonabledecisions

    5. Function as members of society and as professionals with peoplewho have ideas, beliefs, attitudes, and behaviors that are differentfrom their own

    Sustainability Learning ObjectivesCal Poly defines sustainability as the ability of the natural and socialsystems to survive and thrive together to meet current and future needs.The SLOs state that all Cal Poly graduates should be able to:

    1. Define and apply sustainability principles within their academicprograms.

    2. Explain how natural, economic, and social systems interact to fosteror prevent sustainability.

    3. Analyze and explain local, national, and global sustainability using amultidisciplinary approach.

    4. Consider sustainability principles while developing personal andprofessional values.

    Both the DLOs and SLOs should be understood as operating at a levelbelow the institutional level of the ULOs.

    Student Learning AssessmentTo determine the effectiveness of various educational opportunities, CalPoly asks students to participate in learning assessments at the course,program, and university levels. These assessments provide a measure ofstudent achievement over the course of their academic careers of course,program, and university learning objectives/outcomes. They may includethe direct assessment of student work (assignments, exams, projects,performances, and theses), perhaps using standardized rubrics, as wellas surveys and other indirect methods of assessment.

    While grades may measure individual student progress, course-,program-, and university-level assessments provide evidence of theeffectiveness of educational opportunities for groups of students.This information is intended primarily as the basis for programimprovement, although it may also be used for accountability purposes,e.g., documenting educational effectiveness to accreditation agencies.

    Students at Cal Poly should expect that their academic work may be usedfor assessment purposes.

    Statement on SustainabilityIn 1987, the United Nations’ World Commission on Environment andDevelopment defined sustainable development as, “development whichmeets the needs of current generations without compromising theability of future generations to meet their own needs.” In 2009, Cal Poly’sAcademic Senate adopted a more academically focused definition ofsustainability with the passage of Sustainability Learning Objectives(p. 7):

    “Cal Poly defines sustainability as the ability of the natural and socialsystems to survive and thrive together to meet current and future needs.Cal Poly students should be able to consider sustainability when makingreasoned decisions. Students should be able to:

    Title IX of the Education Amendments of 1972 protects all peopleregardless of their gender, gender identity, gender expression orsexual orientation from gender discrimination, which includes sexualharassment and violence:

    Sex Discrimination means an adverse action taken against a student bythe CSU, a CSU employee, or another student because of gender or sex(including sexual harassment, sexual misconduct, domestic violence,dating violence and stalking) that is perpetrated against an individualon a basis prohibited by Title IX of the Education Amendments of 1972,20 U.S.C. §1681 et seq., and its implementing regulations, 34 C.F.R. Part106 (Title IX); California Education Code §66250 et seq., and/or CaliforniaGovernment Code §11135.

    Sexual Harassment, a form of sex discrimination, is unwelcome verbal,nonverbal or physical conduct of a sexual nature that includes, but is notlimited to, sexual advances, requests for sexual favors, and any otherconduct of a sexual nature where:

    1. Submission to, or rejection of, the conduct is explicitlyor implicitly used as the basis for any decision affecting acomplainant's academic status or progress, or access to benefitsand services, honors, programs, or activities available at or throughthe university; or

    2. The conduct is sufficiently severe, persistent or pervasivethat its effect, whether or not intended, could be considered bya reasonable person in the shoes of the complainant, and is infact considered by the complainant, as limiting his or her ability toparticipate in or benefit from the services, activities or opportunitiesoffered by the university; or

    3. The conduct is sufficiently severe, persistent or pervasivethat its effect, whether or not intended, could be considered by areasonable person in the shoes of the complainant, and is in factconsidered by the complainant, as creating an intimidating, hostileor offensive environment.

    Sexual harassment could include being forced to engage in unwantedsexual contact as a condition of membership in a student organization;being subjected to video exploitation or a campaign of sexuallyexplicit graffiti; or frequently being exposed to unwanted images ofa sexual nature in a classroom that are unrelated to the coursework.Sexual harassment also includes acts of verbal, non-verbal or physicalaggression, intimidation or hostility based on gender or sex-stereotyping,even if those acts do not involve conduct of a sexual nature. ExecutiveOrder 1097 covers unwelcome conduct of a sexual nature. Whileromantic, sexual, intimate, personal or social relationships betweenmembers of the University community may begin as consensual, theymay evolve into situations that lead to sexual harassment or sexualmisconduct, including dating or domestic violence, or stalking, subject tothis policy. Claiming that the conduct was not motivated by sexual desireis not a defense to a complaint of harassment based on gender.

    Sexual Misconduct:  All sexual activity between members of theUniversity community must be based on affirmative consent. Engagingin any sexual activity without first obtaining affirmative consentto the specific activity is sexual misconduct, whether or not the

    conduct violates any civil or criminal law. Sexual activity includes,but is not limited to, kissing, touching intimate body parts, fondling,intercourse, penetration of any body part, and oral sex. It also includesany unwelcome physical acts, such as unwelcome sexual touching,sexual assault, sexual battery, rape, and dating violence. When based ongender, domestic violence or stalking also constitute sexual misconduct.Sexual misconduct may include using physical force, violence, threator intimidation, ignoring the objections of the other person, causing theother person's intoxication or incapacitation through the use of drugsor alcohol, or taking advantage of the other person's incapacitation(including voluntary intoxication) to engage in sexual activity.  Men aswell as women can be victims of these forms of sexual misconduct.Sexual activity with a minor is never consensual when the complainant isunder 18 years old, because the minor is considered incapable of givinglegal consent due to age.

    Sexual Assault is a form of sexual misconduct and is an attempt, coupledwith the ability, to commit a violent injury on the person of anotherbecause of that person’s gender or sex.

    Sexual Battery is a form of sexual misconduct and is any willful andunlawful use of force or violence upon the person of another becauseof that person’s gender or sex as well as touching an intimate part ofanother person against that person's will and for the purpose of sexualarousal, gratification or abuse.

    Rape is a form of sexual misconduct and is non-consensual sexualintercourse that may also involve the use of threat of force, violence,or immediate and unlawful bodily injury or threats of future retaliationand duress. Any sexual penetration, however slight, is sufficient toconstitute rape. Sexual acts including intercourse are considered non-consensual when a person is incapable of giving consent because s/he is incapacitated from alcohol and/or drugs, is under 18 years old, orif a mental disorder or developmental or physical disability renders theperson incapable of giving consent. The respondent's relationship to theperson (such as family member, spouse, friend, acquaintance or stranger)is irrelevant.

    Acquaintance Rape is a form of sexual misconduct committed by anindividual known to the victim. This includes a person the victim mayhave just met; i.e., at a party, introduced through a friend, or on a socialnetworking website.

    Affirmative Consent means an informed, affirmative, conscious,voluntary, and mutual agreement to engage in sexual activity.  It is theresponsibility of each person involved in the sexual activity to ensure thats/he has the affirmative consent of the other participant(s) to engage inthe sexual activity.  Lack of protest or resistance does not mean consentnor does silence mean consent.  Affirmative consent must be voluntary,and given without coercion, force, threats or intimidation.

    • The existence of a dating or social relationship between thoseinvolved, or the fact of past sexual activities between them, shouldnever by itself be assumed to be an indicator of affirmative consent.A request for someone to use a condom or birth control does not, inand of itself, constitute affirmative consent.

    • Affirmative consent can be withdrawn or revoked. Consent to oneform of sexual activity (or sexual act) does not constitute consent toother forms of sexual activity. Consent given to sexual activity on oneoccasion does not constitute consent on another occasion. Theremust always be mutual and affirmative consent to engage in sexualactivity. Consent must be ongoing throughout a sexual activity and

    can be revoked at any time, including after penetration. Once consentis withdrawn or revoked, the sexual activity must stop immediately.

    • A person who is incapacitated cannot give affirmative consent. Aperson is unable to consent when s/he is asleep, unconscious or isincapacitated due to the influence of drugs, alcohol, or medication sothat s/he could not understand the fact, nature or extent of the sexualactivity. A is if s/he lacks the mental ability to make informed, rationaldecisions.

    • Whether an intoxicated person (as a result of using alcohol or otherdrugs) is incapacitated depends on the extent to which the alcohol orother drugs impact the person’s decision-making capacity, awarenessof consequences, and ability to make fully informed judgments. Aperson's own intoxication or incapacitation from drugs or alcoholdoes not diminish that person's responsibility to obtain affirmativeconsent before engaging in sexual activity

    • A person with a medical or mental disability may also lack thecapacity to give consent.

    • Sexual activity with a minor (a person under 18 years old) is notconsensual, because a minor is considered incapable of giving legalconsent due to age.

    • It shall not be a valid excuse that a person affirmatively consented tothe sexual activity if the respondent knew or reasonably should haveknown that the person was unable to consent to the sexual activityunder any of the following circumstances:

    • The person was asleep or unconscious;

    • The person was incapacitated due to the influence of drugs,alcohol or medication, so that the person could not understandthe fact, nature or extent of the sexual activity;

    • The person was unable to communicate due to a mental orphysical condition

    • It shall not be a valid excuse that the respondent believed thatthe person consented to the sexual activity under either of thefollowing circumstances:

    • The respondent's belief in affirmative consent arose from theintoxication or recklessness of the respondent;

    • The respondent did not take reasonable steps, in thecircumstances known to the respondent at the time, to ascertainwhether the person affirmatively consented.

    Consensual Relationships:  Consensual relationship means a sexualor romantic relationship between two persons who voluntarily enterinto such a relationship. While sexual and/or romantic relationshipsbetween members of the University community may begin as consensual,they may evolve into situations that lead to discrimination, harassment,retaliation, sexual misconduct, dating or domestic violence or stalking.

    • A University employee shall not enter into a consensual relationshipwith a student or employee over whom s/he exercises director otherwise significant academic, administrative, supervisory,evaluative, counseling, or extracurricular authority. In the event sucha relationship already exists, each campus shall develop a procedureto reassign such authority to avoid violations of this policy.

    • This prohibition does not limit the right of an employee to make arecommendation on the personnel matters concerning a family or

    household member where the right to make recommendations onsuch personnel matters is explicitly provided for in the applicablecollective bargaining agreement or MPP/confidential personnel plan.

    Domestic Violence is abuse committed against someone who is acurrent or former spouse, current or former cohabitant, someone withwhom the respondent has a child, someone with whom the respondenthas or had a dating or engagement relationship, or a person similarlysituated under California domestic or family violence law. Cohabitantmeans two unrelated persons living together for a substantial period oftime, resulting in some permanency of relationship. It does not includeroommates who do not have a romantic, intimate, or sexual relationship.Factors that may determine whether persons are cohabiting include, butare not limited to (1) sexual relations between the parties while sharingthe same living quarters, (2) sharing of income or expenses, (3) joint useor ownership of property, (4) whether the parties hold themselves out asspouses, (5) the continuity of the relationship, and (6) the length of therelationship. For purposes of this definition, "abuse" means intentionallyor recklessly causing or attempting to cause bodily injury or placinganother person in reasonable apprehension of imminent serious bodilyinjury to himself or herself, or another. Abuse does not include non-physical, emotional distress or injury.

    Dating Violence is abuse committed by a person who is or has been ina social or dating relationship of a romantic or intimate nature with thevictim. This may include someone the victim just met; i.e., at a party,introduced through a friend, or on a social networking website. Forpurposes of this definition, "abuse" means intentionally or recklesslycausing or attempting to cause bodily injury or placing another personin reasonable apprehension of imminent serious bodily injury to himselfor herself, or another. Abuse does not include non-physical, emotionaldistress or injury.

    Stalking means engaging in a repeated course of conduct directed at aspecific person that would cause a reasonable person to fear for his/heror others' safety or to suffer substantial emotional distress.  For purposesof this definition:

    • Course of conduct means two or more acts, including but not limitedto, acts in which the stalker directly, indirectly, or through thirdparties, by any action, method, device, or means, follows, monitors,observes, surveils, threatens, or communicates to or about a person,or interferes with a person's property;

    • Reasonable person means a reasonable person under similarcircumstances and with the same protected status(es) as thecomplainant;

    • Substantial emotional distress means significant mental suffering oranguish that may, but does not necessarily, require medical or otherprofessional treatment or counseling.

    Title IX requires the University to adopt and publish complaint proceduresthat provide for prompt and equitable resolution of gender discriminationcomplaints, including sexual harassment and misconduct, as well asprovide training, education and preventive measures related to sexdiscrimination.     Duty to Report. Except as provided below under confidentiality andsexual misconduct, dating violence, domestic violence, and stalking, anyUniversity employee who knows or has reason to know of allegationsor acts that violate University policy shall promptly inform the Title IXCoordinator. These employees are required to disclose all informationincluding the names of the parties, even where the person has requestedthat his/her name remain confidential. The Title IX Coordinator willdetermine whether confidentiality is appropriate given the circumstancesof each such incident. (See confidential reporting options outlinedbelow.)

    Regardless of whether an alleged victim of gender discriminationultimately files a complaint, if the campus knows or has reason to knowabout possible sexual discrimination, harassment or misconduct, itmust review the matter to determine if an investigation is warranted.The campus must then take appropriate steps to eliminate any genderdiscrimination/harassment/misconduct, prevent its recurrence, andremedy its effects.

    Safety of the Campus Community is PrimaryThe University's primary concern is the safety of its campus communitymembers. The use of alcohol or drugs never makes the victim at faultfor gender discrimination, harassment or misconduct; therefore, victimsshould not be deterred from reporting incidents of sexual misconduct outof a concern that they might be disciplined for related violations of drug,alcohol or other University policies. Except in extreme circumstances,

    victims of sexual misconduct shall not be subject to discipline for relatedviolations of the Student Conduct Code.

    Information Regarding Campus, Criminal and CivilConsequences of Committing Acts of Sexual ViolenceIndividuals alleged to have committed sexual misconduct may facecriminal prosecution by law enforcement and may incur penalties as aresult of civil litigation. In addition, employees and students may facediscipline at the University, up to and including suspension or expulsion.Employees may face sanctions up to and including dismissal fromemployment, pursuant to established CSU policies and provisions ofapplicable collective bargaining unit agreements.

    Students who are charged by the University with gender discrimination,harassment or misconduct will be subject to discipline, pursuant to theCalifornia State University Student Conduct Procedures (see ExecutiveOrder 1098 at https://www.calstate.edu/eo/EO-1098-rev-6-23-15.htmlor any successor executive order) and will be subject to appropriatesanctions. In addition, during any investigation, the University mayimplement interim measures in order to maintain a safe and non-discriminatory educational environment. Such measures may includebut not be limited to immediate interim suspension from the University; arequired move from University-owned or affiliated housing; adjustmentsto course schedule; and/or prohibition from contact with parties involvedin the alleged incident.

    Confidentiality and Sexual Violence, Dating Violence,Domestic Violence and StalkingThe University encourages victims of sexual misconduct, dating violence,domestic violence or stalking to talk to someone about what happened –so they can get the support they need, and so the University can respondappropriately.

    Privileged and Confidential CommunicationsPhysicians, Psychotherapists, Professional Licensed Counselors,Licensed Clinical Social Workers, and Clergy – Physicians,psychotherapists, professional, licensed counselors, licensed clinicalsocial workers, and clergy who work or volunteer on or off campus, actingsolely in those roles or capacities as part of their employment, and whoprovide medical or mental health treatment or counseling (and thosewho act under their supervision, including all individuals who work orvolunteer in their centers and offices) including those who act in thatrole under their supervision) may not report any information about anincident of sexual misconduct to anyone else at the University, includingthe Title IX Coordinator, without the victim’s consent. A victim can seekassistance and support from physicians, psychotherapists, professional,licensed counselors, licensed clinical social workers and clergy withouttriggering a University investigation that could reveal the victim’s identityor the fact of the victim’s disclosure. However, see limited exceptionsbelow regarding when health care practitioners must report to local lawenforcement agencies. Health care practitioners should explain theselimited exceptions to victims, if applicable.

    Sexual Assault and Domestic Violence Counselors and Advocates –Sexual assault and domestic violence counselors and advocates whowork or volunteer on or off campus in sexual assault centers, victimadvocacy offices, women’s centers and health centers and who areacting solely in that role (including those who act in that role under theirsupervision, along with non-professional counselors or advocates whowork or volunteer in sexual assault centers, victim advocacy offices,women's centers, gender equity centers, or health centers), may talkto a victim without revealing any information about the victim and the

    incident of sexual misconduct to anyone else at the University, includingthe Title IX Coordinator, without the victim’s consent. A victim canseek assistance and support from these counselors and advocateswithout triggering a University investigation that could reveal his/heridentity or that a victim disclosed an incident to them. However, seelimited exceptions below regarding when sexual assault and domesticviolence counselors and advocates must report to local law enforcementagencies. Counselors and advocates should explain these limitedexceptions to victims, if applicable.

    The University will be unable to conduct an investigation into a particularincident or pursue disciplinary action against a perpetrator if a victimchooses to (1) speak only to a physician, professional licensed counselor,licensed clinical social worker, clergy member, sexual assault counselor,domestic violence counselor or advocate; and (2) maintain completeconfidentiality. Even so, these individuals will assist victims in receivingother necessary protection and support, such as victim advocacy,disability, medical/health or mental health services, or legal services, andwill advise victims regarding their right to file a Title IX complaint withthe University and a separate complaint with local or University Police.If a victim insists on confidentiality, such professionals, counselors andadvocates will likely not be able to assist the victim with: Universityacademic support or accommodations; changes to University-basedliving or working schedules; or adjustments to course schedules. Avictim who at first requests confidentiality may later decide to file acomplaint with the University or report the incident to the police, and thushave the incident fully investigated. These counselors and advocatescan provide victims with that assistance if requested by the victim.These counselors and advocates will also explain that Title IX includesprotections against retaliation, and that the University will not only takesteps to prevent retaliation when it knows or reasonably should knowof possible retaliation, but will also take strong responsive action if itretaliation occurs.

    EXCEPTIONS: Under California law, any health practitioner employed ina health facility, clinic, physician’s office, or local or state public healthdepartment or clinic is required to make a report to local law enforcementif he or she provides medical services for a physical condition to a patient/victim who he or she knows or reasonably suspects is suffering from(1) a wound or physical injury inflicted by a firearm; or (2) any woundor other physical injury inflicted upon a victim where the injury is theresult of assaultive or abusive conduct (including sexual misconduct,domestic violence, and dating violence). This exception does not applyto sexual assault and domestic violence counselors and advocates.Health care practitioners should explain this limited exception to victims,if applicable.

    Additionally, under California law, all professionals described above(physicians, psychotherapists, professional counselors, licensed clinicalsocial workers, clergy, and sexual assault and domestic violencecounselors and advocates) are mandatory child abuse and neglectreporters, and are required to report incidents involving victims under 18years of age to local law enforcement. These professionals will explainthis limited exception to victims, if applicable.

    Finally, some or all of these professionals may also have reportingobligations under California law to: (1) local law enforcement in casesinvolving threats of immediate or imminent harm to self or others wheredisclosure of the information is necessary to prevent the threateneddanger; or (2) to the court if compelled by court order or subpoena in acriminal proceeding related to the sexual misconduct, dating or domestic

    violence, or stalking incident. If applicable, these professionals willexplain this limited exception to victims.

    Reporting to University or Local PoliceIf a victim reports to local or University Police about sexual misconductcrimes, the police are required to notify victims that their names willbecome a matter of public record unless confidentiality is requested. Ifa victim requests that his/her identity be kept confidential, his/her namewill not become a matter of public record and the police will not reportthe victim’s identity to anyone else at the University, including the TitleIX Coordinator. University Police will, however, report the facts of theincident itself to the Title IX Coordinator being sure not to reveal to theTitle IX Coordinator victim names/identities or compromise their owncriminal investigation. The University is required by the federal CleryAct to report certain types of crimes (including certain sex offenses)in statistical reports. However, while the University will report the typeof incident in the annual crime statistics report known as the AnnualSecurity Report, victim names/identities will not be revealed.

    Reporting to the Title IX Coordinator and OtherUniversity EmployeesMost University employees have a duty to report incidents of sexualmisconduct when they are on notice of it. When a victim tells the Title IXCoordinator or another University employee about an incident of sexualmisconduct, the victim has the right to expect the University to takeimmediate and appropriate steps to investigate what happened and toresolve the matter promptly and equitably. In all cases, the Universitystrongly encourages victims to report incidents of sexual misconductdirectly to the campus Title IX Coordinator. As detailed above, in the“Privileged and Confidential Communications” section of this policy,all University employees except physicians, licensed professionalcounselors, licensed clinical social workers, sexual assault counselorsand advocates, must report to the Title IX Coordinator all relevant detailsabout any incidents of sexual misconduct of which they become aware.The University will need to determine what happened – and will need toknow the names of the victim(s) and the perpetrator(s), any witnesses,and any other relevant facts, including the date, time and specific locationof the incident.

    To the extent possible, information reported to the Title IX Coordinatoror other University employees will be shared only with individualsresponsible for handling the University’s response to the incident. TheUniversity will protect the privacy of individuals involved in a sexualmisconduct violence incident except as otherwise required by lawor University policy. A report of sexual misconduct may result in thegathering of extremely sensitive information about individuals in thecampus community. While such information is considered confidential,University policy regarding access to public records and disclosureof personal information may require disclosure of certain informationconcerning a report of sexual misconduct. In such cases, efforts willbe made to redact the records, as appropriate, in order to protect thevictim’s identity and privacy and the privacy of other involved individuals.Except as detailed in the section on “Privileged and ConfidentialCommunications” above, no University employee, including the Title IXCoordinator, should disclose the victim’s identity to the police without thevictim’s consent or unless the victim has also reported the incident to thepolice.

    If a victim requests of the Title IX Coordinator or another Universityemployee that his/her identity remain completely confidential, the TitleIX Coordinator will explain that the University cannot always honorthat request or guarantee complete confidentiality. If a victim wishes

    to remain confidential or request that no investigation be conductedor disciplinary action taken, the University must weigh that requestagainst the University’s obligation to provide a safe, non-discriminatoryenvironment for all students, employees, and third parties, includingthe victim. Under those circumstances, the Title IX Coordinator willdetermine whether the victim’s request for complete confidentiality and/or no investigation can be honored under the facts and circumstancesof the particular case, including whether the University has a legalobligation to report the incident, conduct an investigation or take otherappropriate steps. Without information about a victim’s identity, theUniversity’s ability to meaningfully investigate the incident and pursuedisciplinary action against the perpetrator may be severely limited.     Academic FreedomCal Poly recognizes and supports the principle of academic freedom,by which each instructional faculty member, researcher, librarian andcounselor has the right to teach, to conduct research, and to publishmaterial relevant to that faculty member's discipline, even when suchmaterial is controversial.

    The University also guarantees to its faculty the same rights shared by allcitizens, which include:

    • the right to free expression,• the right to assemble, and• the right to criticize and seek revision of the institution's regulations.

    At the same time, the faculty should recognize an equally bindingobligation to perform their academic duties responsibly and to complywith the internal regulations of the University.

    Each faculty member is expected to recognize the right of free expressionof other members of the university community; intolerance and personalabuse are unacceptable.

    Cal Poly endorses the nationally recognized definition of academicfreedom from the American Association of University Professors (AAUP):The 1940 Statement of Principles on Academic Freedom and Tenure with1970 Interpretative Notes, as follows:

    1. Teachers1 are entitled to full freedom in research and in thepublication of results, subject to the adequate performance of theirother academic duties; but research, for pecuniary return, should bebased upon an understanding with the authorities of the institution.

    2. Teachers are entitled to freedom in the classroom in discussing theirsubject, but they should be careful not to introduce into their teachingcontroversial subject matter which has no relation to the subject.2

    Limitations of academic freedom because of religious or other aimsof the institution should be clearly stated in writing at the time ofappointment.

    3. College and university teachers are citizens, members of a learnedprofession, and officers of an educational institution. When theyspeak or write as citizens, they should be free from institutionalcensorship or discipline, but their special position in the communityimposes special obligations. As scholars and educational officers,they should remember that the public may judge their professionand institution by their utterances. Hence, they should at all times beaccurate, should exercise appropriate restraints, should show respectfor the opinions of others, and should make every effort to indicatethey are not speaking for the institution.

    Student Academic Rights &ResponsibilitiesThe classroom (including laboratories, field trips, independent study,etc.) is the essential part of any university where freedom to learnshould flourish. The instructor has the responsibility for the manner ofinstruction and the conduct of the classroom. The instructor should notact in any way that denies the rights of students as set forth below:

    Students are free to take reasoned exception to the data or viewsoffered in courses. It is the responsibility of the instructor to take everyprecaution to ensure that what is presented is factual. If the instructor’spresentation is in the area of opinion, belief, or debatable fact, it is theinstructor’s responsibility to make this clear to the students. Studentsmay be required to know thoroughly the particulars set forth by theinstructor, but they are free to reserve personal judgment as to that whichis presented in the classroom.

    The student has the right to substantial presentations appropriate to thecourse. Unjustified failure of the instructor to meet or prepare for classes,which results in incompetent performance, is a legitimate ground forstudent complaints against the instructor.

    The student has the right to a statement at the beginning of each quarterproviding: instructor’s name, office location, office telephone number,and office hours; texts and supplementary materials required for thecourse; purpose of the course; prerequisites; requirements for grading;frequency and types of tests; and other information to assure student’sunderstanding of the nature and requirements of the course.

    A Fairness Board has been established to hear grievances of studentswho believe their academic rights have been denied or violated. Thelegitimacy of the process and procedure of evaluation in the course shallbe the sole criterion of the Fairness Board.     Academic ResponsibilitiesStudents enrolled in a class are responsible for meeting standardsof performance and conduct established by the University and theinstructor. Students are responsible for registering and “adding” and“dropping” classes in a timely fashion, to ensure that others have anopportunity to take classes. Students are responsible for completing andsubmitting all class assignments, examinations, tests, projects, reports,etc., by scheduled due dates, or face penalties. If any problem arisesregarding course work or attendance, the student is held responsible forinitiating communication and contact with the instructor. In addition,students are held responsible for behavior and conduct adverse to thepreservation of order as established by the University and the instructor.Students are responsible for meeting their degree requirements asprovided in the university catalog.

    Cheating and PlagiarismCal Poly does not tolerate academic cheating or plagiarism in any form.

    Learning to think and work independently is part of the educationalprocess.

    Cheating or plagiarism in any form is considered a serious violationof expected student behavior and may result in disciplinary action.
