AMERICAN CONSERVATIVE UNION FOUNDATION’S 2017 Ratings of North Dakota

Dear Fellow Conservative,

The American Conservative Union Foundation is proud to present our ratings of the 2017 meeting of the North Dakota Legislative Assembly. Like our Congressional Ratings, which date back 46 years, these ratings are meant to reflect how elected officials view the role of government in an individual’s life. We begin with our philosophy (conservatism is the political philosophy that sovereignty resides in the person) and then apply our understanding of government (its essential role is to defend life, liberty and property).

Because our ratings are designed to educate the public about how consistently their elected officials adhere to conservatism, we carefully examine the entire docket of legislation introduced in each state every year. We select the most meaningful bills and publish the results after the dust has settled. The ACU Foundation is the only organization to score over 8,000 elected officials each year, including lawmakers from all 50 states and Congress.

The 2016 election dramatically impacted the political landscape of not only Washington but state legislative chambers all across the country. Republicans now have control of both legislative chambers in 32 states, more than double the number they controlled in 2010. With these victories comes an ability to implement policies that restore individual liberty and return us to a limited form of government run by and for “We the People.”

It is our hope that these ratings will serve as a guide showing who can be relied on to fight for conservative principles and restore the role of government to what our nation’s founding fathers envisioned.

SELECTING THE VOTES

ACU researched and selected a range of bills before the North Dakota Legislative Assembly that determine a member’s adherence to conservative principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of North Dakota’s elected leaders best defend the principles of a free society: Life, Liberty and Property.

1. SB 2194 Early Childhood Education. This bill requires every school district to fund an early childhood education program based on the number of enrolled students. ACU opposes diverting an estimated $47 million from the education of regular school age children and opposed this bill. The Senate defeated the bill on January 20, 2017 by a vote of 9-35.

2. SB 2180 Federal Education Mandates. This bill calls on the state and the schools of the state to refuse any federal funding conditioned on compliance with federal education mandates, conditions or requirements. ACU supports local control of education and supported this bill. The Senate defeated the bill on January 26, 2017 by a vote of 3-43.

3. SB 2285 Naming of University and College Buildings. This bill requires the legislature to authorize any agreement between universities or colleges that receive state funding and those wishing to give donations, grants or bequests in exchange for naming rights on buildings. ACU supports legislative authority over how taxpayer funds are used and supported this bill. The Senate defeated the bill on February 10, 2017 by a vote of 16-28.

4. SB 2320 Needle Exchange Program. This bill authorizes the government to run needle exchange programs for drug addicts. Illicit drug use imposes significant economic and health burdens on families and society, including lost productivity, increased costs and impaired family structure, which is all illustrated by the ACU Foundation’s Family Prosperity Index. ACU opposes programs that use taxpayer funds to foster drug addiction and opposed this bill. The Senate passed the bill on February 10, 2017 by a vote of 41-3.

5. HB 1094 Board of Barber Examiners Payments. This bill increases per diem payments to members of the Board of Barber Examiners by 60 percent to 100 dollars per day when they are meeting. ACU opposes this wasteful spending on licensing boards based on unneeded licensing requirements that are primarily designed to restrict competition and opposed this bill. The Senate passed the bill on February 22, 2017 by a vote of 44-2.

6. HB 1139 Franchise Labor Law. This bill clarifies labor law to make it clear that owners of franchises and the employees of the franchise are not employees of the franchisor. ACU supports this effort to clarify the law after the National labor Relations Board overturned decades of precedent to make franchisors liable for labor law violations and supported this bill. The Senate passed the bill on March 10, 2017 by a vote of 45-1.

7. HB 1308 Addiction Screening for Welfare Recipients. This bill requires screening for drug addiction for those welfare recipients participating in the individual employment program. Those identified as at-risk for addiction are referred to appropriate treatment services. Illicit drug use imposes significant economic and health burdens on families and society, including lost productivity, increased costs and impaired family structure, which is all illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports reasonable restrictions on welfare recipients and supported this bill. The Senate defeated the bill on March 16, 2017 by a vote of 21-25.

8. HB 1434 Insurance Mandate. This bill requires insurance providers to include coverage for “applied behavioral analysis” to treat those who suffer from autism. ACU opposes these mandates that drive up the cost of health care for everyone and opposed this bill. The Senate defeated the bill on March 21, 2017 by a vote of 16-31.

9. HB 1029 Restrictions on Federal Funds. This bill requires state agencies to evaluate the acceptance of federal funds for state programs to determine they don‘t subject the state to undue federal interference and that they are not in conflict with the intent of the legislature. ACU supports strengthening oversight of federal programs and supported this bill. The Senate passed the bill on March 21, 2017 by a vote of 45-2.

10. HB 1169 Concealed Carry. This bill eliminates the requirement for a concealed carry permit, limiting the requirement to a valid driver’s license or non-driver ID issued by the Department of Transportation. ACU supports the founder’s belief in the Second Amendment and supported this bill. The Senate passed the bill on March 21, 2017 by a vote of 34-13.

11. HB 1428 Parental Rights. This bill allows parents of home school students to opt out of state assessment tests if they have a philosophical or religious objection or if the parent has a college degree or is licensed to teach. ACU supports the strengthening of parental rights and supported this bill. The Senate passed the bill on March 24, 2017 by a vote of 30-17.

12. HB 1246 Government Employee Grievance Procedures. This bill makes it easier for government employees who claim employment discrimination to sue in court before they have used grievance procedures. ACU believes employees should exhaust grievance procedures before taxpayers are required to pay for an expensive lawsuit and opposed this bill. The Senate defeated the bill on March 24, 2017 by a vote of 8-39.

13. HB 1433 Direct Sale of Food to Consumers. This bill allows food producers to sell their goods directly to consumers without state inspection requirements as long as a sign is present at the point of sale noting the product has not been inspected by the state or local health departments. Exceptions are made for meat, meat products and raw dairy products and there are labeling requirements for foods that require refrigeration. Expanding entrepreneurship promotes economic growth, which leads to greater family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports the right of consumers to buy food directly from producers if they choose and supported this bill. The Senate passed the bill on March 28, 2017 by a vote of 36-10.

14. HB 1170 Asset Forfeiture Reform. This bill requires a criminal conviction before property can be seized from an individual and that funds received from the sale of seized assets be put in the General Fund rather than given to law enforcement. The ACU Foundation’s Center for Criminal Justice Reform and the Center for 21st Century Property Rights engage heavily on this issue. ACU believes property should not be seized without a criminal conviction and supported this bill. The Senate defeated the bill on March 30, 2017 by a vote of 0-46.

15. HB 1329 Freedom of Speech on Campus. This bill requires the State Board of Higher Education to develop policies protecting free speech on campus that include the confirmation of free speech as a fundamental right, reassures students that dissenting or disagreeing with generally accepted truth and knowledge is acceptable and essential to free debate and requires state institutions to allow peaceful assembly and expression of ideas. ACU believes the constitutionally protected right of free speech should not be confined to a restricted area and supported this bill. The Senate defeated the bill on March 31, 2017 by a vote of 7-37.

16. HB 1369 Voter ID. This bill requires election officials to set aside ballots cast by those voters who cannot produce a valid ID and exclude them from the count until a valid ID is produced before the official canvass is conducted. Currently, a voter can have the vote counted by signing an affidavit swearing they are an eligible voter in that precinct. ACU supports strengthening ballot integrity to prevent voter fraud and supported this bill. The Senate passed the bill on April 18, 2017 by a vote of 35-10.

17. HB 1201 Carbon Monoxide Alarm Mandate. This bill requires all residential rental property to include a carbon monoxide alarm. ACU opposes these government mandates that drive up the cost of rental property and opposed this bill. The Senate passed the bill on April 19, 2017 by a vote of 24-19.

18. SB 2010 Government Funding of the Arts. This bill appropriated $1.5 million to the North Dakota Council on the Arts which gives grants to programs in the arts approved by the government. ACU believes taxpayer funding of the arts is not a proper role of government and opposed this bill. The Senate passed the bill on April 19, 2017 by a vote of 36-6.

The House passed the bill on January 12, 2017 by a vote of 79-12.

3. HB 1260 Unemployment Insurance Eligibility. This bill allows employees to collect unemployment insurance during a strike if the employee is not directly involved in the strike. ACU believes unemployment insurance should be reserved for the unemployed and opposed this bill. The House defeated the bill on January 19, 2017 by a vote of 15-75.

4. HB 1261 Worker’s Compensation. This bill deems that a heart attack, stroke and other disabilities that occur to a volunteer firefighter or emergency response personnel within 24 hours of performing services or participating in training will be automatically presumed to have been caused by the person’s employment for the purpose of collecting worker’s compensation. ACU believes that worker’s compensation should be reserved for injuries that can be proven to have occurred on the job and opposed this bill. The House divided the bill into three sections and defeated this section of the bill on January 20, 2017 by a vote of 18-66.

5. HB 1163 Sunday Closing Laws. This bill would repeal the state’s “blue law” that prohibits many retail stores from being open on Sunday morning. ACU opposes these laws dating back to the 19th Century that are outdated in an era of online shopping and supported this bill. The House passed the bill on January 31, 2017 by a vote of 48-46.

6. HB 1029 Restrictions on Federal Funds. This bill requires state agencies to evaluate the acceptance of federal funds for state programs to determine they don‘t subject the state to undue federal interference and that they are not in conflict with the intent of the legislature. ACU supports strengthening oversight of federal programs and supported this bill. The House passed the bill on February 1, 2017 by a vote of 82-10.

7. HB 1369 Voter ID. This bill requires election officials to set aside ballots cast by those voters who cannot produce a valid ID and exclude them from the count until a valid ID is produced before the official canvass is conducted. Currently, a voter can have the vote counted by signing an affidavit swearing they are an eligible voter in that precinct. ACU supports strengthening ballot integrity to prevent voter fraud and supported this bill. The House passed the bill on February 2, 2017 by a vote of 74-16.

8. HB 1263 Minimum Wage. This bill raises the minimum wage to $9.25 per hour and allows the minimum wage to be raised each year by an amount based on the cost of living index without a vote of the legislature. An increase in the minimum wage results in higher unemployment. High rates of unemployment hinder family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU opposes these artificial wages that hurt those who need help with employment the most, such as students and inexperienced workers and opposed this bill. The House defeated the bill on February 6, 2017 by a vote of 13-77.

9. HB 1246 Government Employee Grievance Procedures. This bill makes it easier for government employees who claim employment discrimination to sue in court before they have used grievance procedures. ACU believes employees should exhaust grievance procedures before taxpayers are required to pay for an expensive lawsuit and opposed this bill. The House passed the bill on February 6, 2017 by a vote of 65-25.

10. HB 1329 Freedom of Speech on Campus. This bill requires the State Board of Higher Education to develop policies protecting free speech on campus that include the confirmation of free speech as a fundamental right, reassures students that dissenting or disagreeing with generally accepted truth and knowledge is acceptable and essential to free debate and requires state institutions to allow peaceful assembly and expression of ideas. ACU believes the constitutionally protected right of free speech should not be confined to a restricted area and supported this bill. The House passed the bill on February 6, 2017 by a vote of 65-25.

11. HB 1432 Common Core. This bill would have withdrawn the state from the Common Core curriculum by barring the state superintendent of public instruction from being part of a multi-state consortium or implementing new standards without legislative approval. ACU supports local control of education and supported this bill. The House divided the bill into sections and defeated this section of the bill on February 7, 2017 by a vote of 27-62.

12. HB 1256 Dental Therapist Regulations. This bill eases restrictions on the practice of dental therapists, who work under the supervision of a licensed dentist. Expanding entrepreneurship promotes economic growth, which leads to greater family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports increasing the opportunity for more people to obtain health care at affordable prices and supported this bill. The House defeated the bill on February 8, 2017 by a vote of 32-59.

13. HB 1429 Home School Requirements. This bill eases requirements for home school students by setting the minimum standard for monitoring parents at the thirtieth percentile nationally rather than the fiftieth percentile. Educational attainment is an important cultural value that yields substantial economic returns for families and for states, which is illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports expanding the opportunity for home schooling and supported this bill. The House defeated the bill on February 9, 2017 by a vote of 28-63.

14. HB 1308 Addiction Screening for Welfare Recipients. This bill requires screening for drug addiction for those welfare recipients participating in the individual employment program. Those identified as at-risk for addiction are referred to appropriate treatment services. Illicit drug use imposes significant economic and health burdens on families and society, including lost productivity, increased costs and impaired family structure, which is all illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports reasonable restrictions on welfare recipients and supported this bill. The House passed the bill on February 14, 2017 by a vote of 77-12.

15. HB 1434 Insurance Mandate. This bill requires insurance providers to include coverage for “applied behavioral analysis” to treat those who suffer from autism. ACU opposes these mandates that drive up the cost of health care for everyone and opposed this bill. The House passed the bill on February 15, 2017 by a vote of 61-29.

16. HB 1428 Parental Rights. This bill allows parents of home school students to opt out of state assessment tests if they have a philosophical or religious objection or if the parent has a college degree or is licensed to teach. ACU supports the strengthening of parental rights and supported this bill. The House passed the bill on February 16, 2017 by a vote of 58-31.

17. HB 1169 Concealed Carry. This bill eliminates the requirement for a concealed carry permit, limiting the requirement to a valid driver’s license or non-driver ID issued by the Department of Transportation. ACU supports the founder’s belief in the Second Amendment and supported this bill. The House passed the bill on February 21, 2017 by a vote of 83-9.

18. HB 1170 Asset Forfeiture Reform. This bill requires a criminal conviction before property can be seized from an individual and that funds received from the sale of seized assets be put in the General Fund rather than given to law enforcement. The ACU Foundation’s Center for Criminal Justice Reform and the Center for 21st Century Property Rights engage heavily on this issue. ACU believes property should not be seized without a criminal conviction and supported this bill. The House passed the bill on February 21 by a vote of 50-42.

19. HB 1115 Nursing Home and Assisted Living Facility Moratorium. This bill extends the moratorium on additional basic care beds at assisted living facilities and nursing home beds to 2019 unless a facility can prove to the government that there is a shortage of beds. ACU opposes these moratoriums that are primarily designed to restrict competition and opposed this bill. The House defeated the bill on February 23, 2017 by a vote of 23-66.

20. SB 2320 Needle Exchange Program. This bill authorizes the government to run needle exchange programs for drug addicts. Illicit drug use imposes significant economic and health burdens on families and society, including lost productivity, increased costs and impaired family structure, which is all illustrated by the ACU Foundation’s Family Prosperity Index. ACU opposes programs that use taxpayer funds to foster drug addiction and opposed this bill. The House passed the bill on March 17, 2017 by a vote of 58-35.

21. SB 2010 Government Funding of the Arts. This bill appropriates $1.5 million to the North Dakota Council on the Arts which gives grants to programs in the arts approved by the government. ACU believes taxpayer funding of the arts is not a proper role of government and opposed this bill. The House passed the bill on April 5, 2017 by a vote of 60-30.

22. HB 1433 Direct Sale of Food to Consumers. This bill allows food producers to sell their goods directly to consumers without state inspection requirements as long as a sign is present at the point of sale noting the product has not been inspected by the state or local health departments. Exceptions are made for meat, meat products and raw dairy products and there are labeling requirements for foods that require refrigeration. Expanding entrepreneurship promotes economic growth, which leads to greater family prosperity, as illustrated by the ACU Foundation’s Family Prosperity Index. ACU supports the right of consumers to buy food directly from producers if they choose and supported this bill. The House passed the bill on April 7, 2017 by a vote of 58-29.

23. HB 1201 Carbon Monoxide Alarm Mandate. This bill requires all residential rental property to include a carbon monoxide alarm. ACU opposes these government mandates that drive up the cost of rental property and opposed this bill. The House failed to override the governor’s veto of the bill on April 26, 2017 by a vote of 49-39 (a two-thirds vote was required).
