Greetings All,
The mission of Harris County Pretrial Services (HCPS) is to provide accurate and timely information to
assist the judicial officers in Harris County with making informed pretrial release decisions and to
monitor defendants released on bond to promote compliance with court orders, court appearances, and
to support public safety.
To achieve our organizational mission, 2018 was the Year to REFINE for HCPS. Specifically, it was our
year to improve and perfect our overall operations. We used the strategic and systematic triangulation
of Quality, Training, and Performance (QTP), to move towards becoming a premiere pretrial services
agency. These elements are aligned with best practices in the pretrial justice industry. Primarily, we
implemented metrics to gauge our individual and collective progress including:

The purpose of the Gail Y. Brown Employee of the Month award is to give special recognition to employees for their outstanding achievements in service to Harris County Pretrial Services. The criteria for selecting the Gail Y. Brown Employee of the Month include, but are not limited to, the employee being viewed as:

Defendant Report ActivityArrests in 2018 on a new charge
where the most serious offense was a class A or B misdemeanor offense were up 3.6% from the previous year and down over 12% since 2014. Arrests for new felony offenses saw a 3.8% increase in 2018 compared to 2017 and up over 5% since 2014.
There were a total of 79,851 new arrests in 2018. This included 46,175 people whose most serious charge was a misdemeanor and 33,676 people ar-rested for a felony offense. Defendants charged with felony offenses accounted for 42.2% of arrests and misdemeanors for 57.8%.
The department compiled 44,530 defendant reports on incarcerated de-fendants, screening 55.8% of the arrest-ed population. Staff prepared 20,675 reports on defendants arrested solely for a misdemeanor offense, compiling information on 44.8% of that popula-tion. For those defendants arrested for a felony, the percentage was 70.8%, or 23,855 reports completed.
Other defendants interviewed in-cluded 49 defendants who originally posted a financial bond and were inter-viewed after release for consideration for a personal bond. There was 1 inter-view conducted with a non-incarcerated defendant who had an open warrant. In addition, 135 interviews were con-ducted for performance, appeal, and witness bonds.

since 2016. Defendants released on personal bond for a new case comprised 82% of the average caseload; those monitored while in a CSCD program were 12.2% of the caseload; 0.6% were on a performance bond, appeal, or motion to revoke or adjudication probation with pretrial services supervision; 3% in RIC; and 1.5% given an unsecured bond during the period of June through December 2018.
In 2018, 67.8% of defendants arrested on a new charge were released on bond. Most posted some form of financial bond while 28.7% were granted a personal bond, 4.7% posted an unsecured bond, and 278 defendants were given an SB-7 personal bond.
A total of 23,469 defendants were released on a personal bond for a new charge. Of the defendants supervised for a new case, 1,526 (4.7%) defendants were released to the RIC docket on a personal bond.
Other defendants released on personal bond and supervised by Pretrial Services included 208 de-fendants whose appearance was required in court on a motion to adjudicate or revoke probation, who appealed a case disposition, who were required to participate in a Community Supervision & Corrections Department (CSCD) assessment program, or who were given a bond for a specific length of time after judgment was entered on a case before the execution of the sentence (performance bond). During the same month, 233 defendants began receiving unsecured bonds (BROR) for remainder of 2018.
One condition frequently ordered was the re-quirement to submit to drug testing, affecting 18% of defendants with a new case given a personal bond. A breath-alcohol analysis device, either in the form of an ignition interlock device installed in a vehicle or an in-home device, was placed on 12.1% of the defendants with additional conditions. The courts required 54 de-fendants to observe a curfew and 64 defendants were ordered to wear an electronic monitoring device.
Defendants who receive pretrial intervention through the CSCD are still on bond until the interven-tion program requirements are fulfilled and must ap-pear in court during their participation. Defendants under the department’s supervision who subsequent-ly receive pretrial intervention usually remain on a personal bond while participating in these programs and we continue to monitor their case and remind them of upcoming court dates. During 2018, 1,303 de-fendants were monitored for this purpose, along with 3 defendants with a motion to adjudicate or to revoke probation who were granted a personal bond with no supervision by this department other than that neces-sary to assure appearance in court.
Throughout 2018, the average monthly number of defendants under supervision or monitored on the last day of month by the department was 8,748 defendants. This is a 101% increase in average case-load size compared to last year and a 240% increase

While the department uses a point-of-collection test (POCT) to screen some defendants reporting for the first drug test after release, other specimens are sent directly to a laboratory for analysis.
The department tested 3,762 defendants in 2018 and performed a total of 9,571 drug tests, a 17.8% increase over last year. There were 407 POCT specimens collected and tested onsite, with 181 spec-imens testing positive. A total of 9,126 specimens were collected and sent to a laboratory for analysis, with 2,671 specimens testing positive.
The department administered 5 tests on a deep-lung breath analysis device onsite as a result of suspicion that a defendant appearing in court was intoxicated. There was one positive reported on deep lung breath analysis tests. Also, 33 transdermal patch tests were used on defendants who could not be test-ed by other methods with 2 testing positive. In some instances, a required test cannot be completed due to the defendant’s inability to provide a specimen. There were 158 instances where there was no speci-men provided.

Drug Test Activity
The department scans the index finger of a defendant reporting for a drug test and submits it, along with the defendant’s System Person Number, to the Sheriff’s Department automated fingerprint identification system (AFIS). Pretrial Services then receives a pic-ture associated with those items and uses the picture to ensure the correct person reported for a drug test.

Defendants whose bonds are revoked for noncom-pliance are no longer part of the active supervision case-load; however, their cases are assigned to an FTA investi-gator who locates fugitive defendants with outstanding warrants. Over 68% of all FTA warrants issued in 2018 were resolved by February 15, 2019.
Another 485 defendants who were monitored by the department while appealing a case disposition, ad-dressing a motion to adjudicate or revoke probation, or who were released after pleading guilty but before the imposition of a sentence saw their supervision end in 2018 - 61% successfully. Of 1,160 defendants enrolled in a CSCD program, 74% completed their diversion pro-gram or had a motion to revoke dismissed while 26% had their case adjudicated.

There were 23,892 defendants under active supervision with a new case who exited supervision in 2018. Of those, 20,366 were charged with a mis-demeanor offense and 3,526 had a felony offense.
Of the 20,366 misdemeanor defendants whose supervision period ended, 30.9% were not further incarcerated, 15.5% because their case was dismissed. Jail time was the sentence imposed on 41% of the remaining defendants. Another 27.9% had their bond revoked for noncompliance issues. Of those revoked for noncompliance, 22.1% were for failing to appear for a scheduled court date, 3.1% were for an arrest on a new charge while on bond, and 2.7% for noncompliance with conditions of su-pervision (e.g., do not use drugs, abide by curfew restrictions). Fewer than 1% exited supervision for other reasons.
Of the 3,526 defendants charged with a felony, 53% received no additional jail time, 16.5% because their case was dismissed or no-billed. Another 3.6% of defendants charged with a felony were ordered to jail or prison. Noncompliance claimed 42% of defendants charged with a felony, 31% for failing to appear in court, 5.8% for an arrest on a new charge while on bond, and 5.5% for violating the conditions of release. The remainder, 1%, exited for reasons other than noncompliance (e.g., personal bond re-placed, bond was for a specific time period).
The most common sentence imposed included some form of community supervision, especially for misdemeanor cases with 8% entering a CSCD pro-gram. For defendants with a felony charge, CSCD supervision accounted for 31% of all felony defen-dants exiting Pretrial Services supervision.
