VENDOR/PRODUCT SELECTION CRITERIA

Nourish Knoxville’s Winter Farmers’ Market & Market Square Farmers’ Market are intended to showcase food and food products with an emphasis on locally grown and raised agriculture products. Also represented at these Markets are locally produced crafts. Art & Craft vendors only represent a small portion of our Winter Farmers’ Market & Market Square Farmers’ Market vendors (49% or less per market day). The Market Square Holiday Market, a holiday shopping experience, while also showcasing local farm and food products, does not limit the percentage of Art & Craft vendors.

GENERAL PRODUCT GUIDELINES All products must be grown, raised, produced, processed, and/or created by the vendor within a 150-mile radius of Knoxville, TN. Nourish Knoxville has a zero-tolerance policy concerning resale at all of our markets. Any vendor found selling anything they did not grow/make will be banned from the market for the remainder of the season. Nourish Knoxville does not condone the use of threatened or endangered materials/products. Applicants wishing to offer services such as massage, health consultations, face painting, caricature drawings, etc. are not eligible. Vendors will apply via Manage My Market (MMM), an online software program used for all Nourish Knoxville Markets. Vendors will include all products they intend to sell at Market in their MMM profile. Accepted vendors may only be approved for a portion of the products they apply to sell. The vendor must keep their product list in MMM up-to-date, as only products approved through MMM are allowed to be sold. Any vendor found selling products not approved by Nourish Knoxville staff will be asked to remove the product from their booth and be subject to an infraction. For more information regarding Nourish Knoxville’s infraction policy, please see the Infraction Policy section of this vendor handbook.

Nourish Knoxville does not extend exclusive rights to any one vendor to sell any one product. However, if Nourish Knoxville believes the number of vendors offering the same of similar products is excessive, duplicate products may be denied entry.

VENDOR APPLICATION PROCESS All vendors, returning or new, must submit an application annually for each of the 3 markets (WFM, MSFM, MSHM).

1. Applications are submitted for all Nourish Knoxville Markets via Manage My Market.

a. Vendors will first create a detailed profile through MMM. Once complete, vendors will be prompted to apply to a market.

b. Upon submitting your application, you will receive an automated invoice for your one-time application fee. This application fee is non-refundable. Payment of this application fee does not guarantee your acceptance. If we do not receive payment for your application fee within 2 weeks, your application will be withdrawn.

c. You will receive an automated email from MMM shortly after submitting your application notifying you that your application was received.

d. Remember to upload all the necessary information, photos, and permits to your profile. Applications lacking information, photos, and/or permits will be considered incomplete and will not be processed.

2. Please allow 2 weeks from payment of your application fee for your application to be processed. If your application has not been processed within 2 weeks, send us an email, [email protected].

3. Your application will then be accepted, waitlisted, or declined. a. Accepted vendors will receive a welcome email. b. Waitlisted vendors will receive a waiting list announcement. For

more information about our waiting list, please see the Waiting List Process section.

c. Declined vendors will receive an email stating with the reason for being declined. If you feel as though your application was

unjustly declined, please view the Grievances section for more information on the appeals process.

WAITING LIST PROCESS

Nourish Knoxville typically maintains a waiting list for all our markets, due to lack of space or a surplus of vendors selling the same or similar products. Each vendor on the waiting list is eligible for both permanent and last minute participation. How it works:

1. For permanent openings: a. We will contact vendors individually to fill these vacancies.

Application date, past participation, product diversity, and requested schedule are all taken into consideration when filling a permanent opening.

b. Upon acceptance, the vendor will be invoiced for ALL of the dates signed up for in the original application. If your availability has changed, contact us via email ASAP. Cancellations for a market must be made a week in advance in order to request credit for the date. Ex: If you signed up for the February 10th market, cancellations must be received no later than 11:59 pm on February 3rd.

2. For last minute openings: a. We send a mass email to the entire waiting list, which generally

varies from 10 – 30 vendors (depending on the market), as soon as we know we will have openings for a particular date. This email may come 2 weeks before a market, or as late as the afternoon before a market. Openings will be filled on a first-come, first-served basis, though consideration of product diversity will also be taken into account. Please note: you will receive a notification for EVERY opening, regardless of the dates selected on your application. If you are unable to participate, simply do not respond.

b. Upon confirmation of participation for a specific date, Nourish Knoxville will create an invoice in MMM and email it to the vendor. Note: the vendors application status will temporarily be changed to “approved” so that they may be added to the interactive map. The vendor’s status will then returned to “wait listed” following participation. If you are no longer able to

attend, you must send us an email with your cancellation no later than 8:00 am market day. If you are a no-show (don’t cancel and don’t show up), you will receive an infraction, be responsible for the booth fee, and it will hurt your chances of participating with us again. We will make exceptions for emergencies but abuse of this policy will not be tolerated.

All waiting list vendors are expected to abide by all policies set forth in the Vendor Handbook (with the exception of the cancellation policy for vendors accepting a last minute opening).

VENDOR SELECTION CRITERIA Vendor selection is based on the following:

1. Vendor Type a. Priority is given to regional Agriculture applicants who bring

products that are 100% grown and harvested on land that they own and/or operate. Agriculture applicants have priority over Prepared Food and Art & Craft applicants.

b. Priority is given to farmers who use environmentally responsible and sustainable growing, breeding, raising, and harvesting methods.

2. Product Quality and Composition a. For Prepared Food and Art & Craft applicants, priority is given to

applicants who incorporate local ingredients/materials. b. Unique or unusual products not already represented in the

Market. c. Consistently high quality products. d. Clean and attractive booths and displays.

3. Conduct, Compliance, and Customer Service a. History of compliance with Market rules as well as all local, state,

and federal regulations. b. Courteous and knowledgeable at-market staff with strong

customer service skills and a history of positive interactions with Nourish Knoxville staff, volunteers, fellow vendors, and customers.

c. Timely submission of application, licenses, and other correspondence.

d. Timely payment history. e. Minimal infraction history.

f. History of compliance with Market rules.

4. Food Safety (for Agriculture & Prepared Food applicants) a. Adherence to all local, state, and federal food safety regulations. b. Applicable certifications displayed at each and every market day.

5. Seniority a. Number of years a vendor has sold at Nourish Knoxville Markets. b. Number of Nourish Knoxville Markets in which a vendor

participates. c. Number of market dates in which a vendor participates. d. Positive attendance record.

6. Application Timing (when we receive your completed application and application fee)

Nourish Knoxville is committed to creating a diverse marketplace with the highest quality locally grown and produced products available. Nourish Knoxville will not be bound to apply a particular set of selection criteria in every instance and reserves unconditional discretion to accept or refuse any applicant.

VENDOR DEFINITIONS & REQUIREMENTS

A vendor is an owner/operator of a business entity approved to sell at a Nourish Knoxville Market. Vendors may send family members, partners, or employees to Market in their place, but are responsible for making their onsite representatives aware of all the rules, policies, and procedures discussed in this handbook. All at-market staff must be listed in your Manage My Market account with an email address and phone number.

Franchised businesses – those who have entered into an agreement or received a license to sell a company’s products and/or use a company’s packaging, logo, ingredients, and/or marketing tools – are not eligible. Please see our Sponsorships section for other ways you can get involved with Nourish Knoxville. Business promotion - those wishing to become a vendor for the sole-purpose of promoting a business are not eligible. Please see our Sponsorships section for other ways you can get involved with Nourish Knoxville. Remember, local, state, and federal laws trump any and all market rules. While we strive to keep our handbook up-to-date with the latest rules & regulations, it is the vendor’s responsibility to ensure his/her product is in full compliance with all regulations. Any failure to do so may put their business at risk and could result in expulsion from Market.

AGRICULTURE VENDORS Agriculture products include, but are not limited to: produce, plants, herbs, decorative gourds (unadorned), cut flowers, honey, sorghum syrup, eggs, cheese, meat, milk, beeswax candles, and animal fibers - all of which must be raised/grown by the applicant. New vendors will be subject to a farm inspection. Returning vendors are subject to re-inspections, as needed. Agriculture vendors cannot change food from its original state without approval from the Tennessee Department of Agriculture (TDA) Division of

Consumer and Industry Services. This includes jams, jellies, shelled beans, sliced melon, etc. Vendors wishing to sell these “value-added” products, please see the Vendor Definition & Requirements section for Prepared Food Vendors. Specific farm product regulatory requirements are listed below. This is not intended as an exhaustive list. Most required permits and certifications can be found via the TDA website or by calling (615) 837-5137.

1. Eggs – A producer may sell eggs at market from his/her own flock of less than 3,000 birds under the following conditions:

a. Eggs have been effectively cleaned and sanitized b. Eggs are sold in new (unused), unclassified/ungraded containers

that are labeled with the name, address, and contact information of the operation

c. Eggs are stored at 41° F or below d. Eggs deemed adulterated may not be offered for sale

2. Meat - Meat and poultry products fall under the jurisdiction of the USDA. All meat products offered for sale must be refrigerated or frozen in the original packaging with the USDA seal readily visible and in compliance with all labeling requirements, unless exempt (outlined below). For more information, the contact the USDA.

a. A Retail Meat Sales Permit is required in order to sell at Nourish Knoxville Markets. The permit must be posted at every market, and a copy must be provided with your application. This permit is acceptable for retail meat sales only. Permits can be mailed or uploaded to your Manage My Market account.

b. Meat must be transported in a secure manner. Poultry must be stored in cooler/refrigerator/freezer units separate from other meat products to prevent cross contamination with meats of other species unless all such stored meat is received and maintained hard frozen. Thermometers are required in coolers/refrigerators to verify temperatures of storage. Temperatures must be maintained at 41° F or below.

c. Poultry - poultry products are under the jurisdiction of the Food Safety Inspection Service (FSIS) of the USDA. Poultry processors must register with the FSIS. There are some exemptions to the PPIA (Poultry Products Inspection Act), which allow for processing without a USDA inspector on site for a bird-by-bird inspection. Poultry must be raised and slaughtered on the producer’s own farm in sanitary conditions suitable for human food. The facility

used to slaughter or process poultry is not used to slaughter or process another person’s poultry unless the Administrator of FSIS grants an exemption [9 CFR 381.10(b)(2)]. The TDA recognizes the USDA small poultry exemption guidelines and, therefore, does not require a permit to process and market poultry under this exemption. This recognition is based on the assumption that all applicable standards set forth in the USDA guidelines for exempt poultry processing are satisfied. Nourish Knoxville requires all vendors utilizing this exemption to label their poultry with the processor’s name, address, the exemption statement: “Exempt P. L. 90-492”, net weight, and safe handling instructions.”

3. Dairy - All dairy products, including ice cream and cheeses, must come from a licensed dairy or must be composed of pasteurized dairy products from a licensed dairy. In addition, such foods must be stored at or below 41° F at point of sale.

a. Raw milk cannot be offered for sale for human consumption. i. Raw milk may be sold at market when labeled for pet

consumption. Please see our Pet Food requirements in the Prepared Food Vendors section for more details.

ii. Raw milk may be transferred through herd share programs. Herd share programs are viewed by the TDA as a marketing agreement between the owner of the cow and the contracted shareowner. If you are planning to offer a herd share pick-up at market, a copy of your herd share agreement must be submitted with your application.

iii. Advertising the sale of “raw milk” is not allowed. Vendors may advertise the sale of herd shares or pet food.

4. Honey - Only honey from an applicant’s own hives is allowed for sale at market. All honey sold or offered for sale in Tennessee shall be prominently labeled as honey, along with the name and address of the producer and the net contents. Contact State Apiarist, Mike Studer for more information on regulations for the labeling of honey, (615) 837-5342, [email protected].

5. Sorghum molasses - All sorghum molasses sold or offered for sale in the state of Tennessee shall be prominently labeled as being either 100% pure sorghum molasses or not pure sorghum molasses. The label must also have the farm name, address, and net weight. All sorghum molasses offered for sale shall come from a permitted, licensed, and inspected facility. Contact the TDA for more information.

6. Live animals - The sale of live animals is not permitted at any Nourish Knoxville Market.

7. Rooted plant material – Any vendor who grows or keeps plants for sale and distribution at the Markets must possess the appropriate Plant Certification License from TDA.

a. Vendors not primarily engaged in the business of producing and selling plants or seedlings (revenue received in the previous calendar year for the sale or production of plants does not exceed 15% of gross revenue from farm operations during that period, as shown on applicable federal tax return documents), ie: farmers’ selling extra vegetable starts, shall have their license fee waived but are still required to fill out an application. b. Please note: turf grass sod, strawberry plants, and sweet potato plant or plant parts all require unique licenses.

PREPARED FOOD VENDORS

Prepared food includes processed foods and foods for immediate consumption.

Processed foods: Food that has been processed beyond its natural state such as baked goods, shelled beans, halved melons, canned food, etc. for retail sales. Pet food/treats also fall under this category. Food for immediate consumption: Products sold for immediate consumption that is prepared on site such as that served at a restaurant or concessions stand. These concession-style food vendors will be reviewed on a case-by-case basis. Only concessions that support local growers and sustainable farming will be accepted.

Unaccepted products: Prepared food made from purchased mixes, crusts, dough, shells, or fillings. Carnival-like foods such as flavored popcorns*, cotton candy, roasted/spiced nuts*, etc. Potentially dangerous foods. Alcohol and tobacco products. Beverages such as energy drinks, bottled water, bottled soda/fruit drinks or any other purchased beverages. In addition, applicants using a co-packer are not eligible.

*Exemptions exist for vendors growing their own corn and nuts or sourcing corn and nuts within a 150-mile radius of Knoxville, TN.

1. Processed foods: All processed foods must be sold in compliance with Tennessee Department of Agriculture (TDA) and/or local Health Department regulations. Nourish Knoxville must have all current permitting on file. Include a copy of each applicable license with your application by uploading the file(s) to your Manage My Market (MMM) account, or mailing a copy to our PO Box. All prepared food vendors must also have a copy of each license on display at his/her booth on each market day.

a. All prepared food must be made from scratch by the vendor. Any item that is made primarily from a manufactured/processed product such as dry cereal, pretzels, etc. is not allowed. All of a product must be made from scratch, within reason, including piecrusts, shells, fillings, and icings.

b. Note: While TDA offers an exemption allowing the sale of non-potentially hazardous foods from an uninspected domestic kitchen, Nourish Knoxville requires that all vendors operate out of an inspected and permitted kitchen. Nourish Knoxville may make exceptions for agriculture vendors offering a non-potentially hazardous food such as dried and/or powdered herbs, mushrooms, chilies, or other foods grown by the vendor and minimally processed on a case by case basis.

c. Potentially hazardous foods are defined as “any food that consists in whole or in part of milk or milk products, eggs, meat, poultry, fish, or other ingredients in a form capable of supporting rapid and progressive growth of infectious or toxigenic microorganisms.” This also includes acidified foods such as pickled vegetables and salsas and formulated acid foods such as marinades, hot sauces, salad dressings, etc.

i. Potentially hazardous foods must be manufactured in an inspected and permitted kitchen. Include a copy of your permit and inspection document with your application.

ii. Additionally, if manufacturing acidified foods, you must register your kitchen facility and file a process for each product you intend on selling with the U.S. Food and Drug Administration (FDA) and be compliant with 21CFR part 114. Include a copy of your certification for the acidified

foods course with your application as well as the process for each product you intend to sell at the Market.

d. Juices/Beverages – No vendor is allowed to sell and/or give away beverages unless the beverages have been included as a product in the Product section of the vendor’s MMM account and approved. This includes, but is not limited to: cider, lemonade, kombucha, water infusions, hot chocolate, etc. All beverages offered for sale must be made by the vendor from scratch.

e. Pet Food – Anyone manufacturing animal feed or pet food, including pet treats and raw milk, must obtain a Commercial Feed License from TDA. Required labeling must accompany the products, including the manufacturer’s name and address, net weight, and guaranteed analysis (% protein, % fat, % fiber). Additional information may be obtained by contacting TDA Ag Inputs at (615) 837-5137.

f. All packaged foods must be labeled with, at the very least, vendor contact information (name, street address, city, state, and zip code or a website containing the aforementioned information), an accurate statement of the net amount of food in the package in English and Metric units, as well as all ingredients and sub-ingredients in the food, listed in order of predominance by weight.

2. Food for immediate consumption: Foods prepared on-site, such as concessions, are under the regulatory authority of the Tennessee Department of Health. Each county has a local health department. All food prepared on-site must be stored in an inspected and permitted facility prior to arriving at Market. All applicants interested in preparing food on-site will also need a Mobile Vending Permit from City of Knoxville (CoK). Please contact Patricia Robledo with the CoK at [email protected], (865) 215-3155 for more information. *Note: the City of Knoxville does not allow food trucks on Market Square. Therefore, food trucks are not eligible for Nourish Knoxville’s Wednesday MSFM.

ART & CRAFT VENDORS Art & Craft products are items that have been made by hand, by the applicant. A majority of the tools and equipment used to produce products must require skill, personal handling, and/or manipulation.

Unaccepted Products: Second-hand/vintage items, commercial or imported items, faux & dried flower arrangements and terrariums*, embellished objects such as purchased/found boxes, glasses, stones, shells, etc.**, Beaded jewelry assembled of only purchased components (jewelry made with applicant-made beads or findings is acceptable), soy candles***, items made from commercials kits, molds, and commercially available plans, promotional material****. This guide is not intended as an exhaustive list. * Living plants are considered an Agriculture product and must be grown by the vendor; this includes terrariums. Fresh and dried flower arrangements & wreaths fall into the same category; vendors must grow as well as dry all flowers, filler, and greenery within the arrangement/wreath. Please refer to the Definition and Requirements for Agriculture Products for more information. ** Upcycled products are permitted but must be extensively embroidered, dyed, printed, painted, reworked, etc. by the vendor. *** Candles made from beeswax raised by the vendor are acceptable and would be considered an Agriculture product. Any vendor applying with beeswax candles will be subject to a farm inspection. **** Commercially manufactured reproductions (t-shirts, mugs, art prints, etc.) of original art are permitted, but on a limited scale. 1. The jurying process for Art & Craft vendors is extremely competitive due

to the limited number of available booth spaces. Only applicants with the highest quality of craft and of the most unique/under-represented medium will be accepted. Please note: we have an extremely limited number of spaces for jewelry and bath & body vendors, as these are consistently the most represented product type at our Markets.

2. Each Art & Craft applicant must submit at least 3 photos of his/her work. If more than one type of product is to be sold, i.e. you intend to sell pottery and paintings, please include at least 2 photos of each kind of product or medium. Upload your photographs to your Manage My Market (MMM) profile in the “Products” section. Nourish Knoxville staff may require more pictures, at their discretion.

a. Under each type of product you select from the drop-down menu (Products tab), click on “add product photo(s)” to add photos of your work. Include a detailed description with each product photo. These photos and descriptions will be viewable by customers. If no photos and/or descriptions are included, your application will be considered incomplete and will not be eligible for acceptance.

b. Please note that photos must be in .jpg format and uploaded from a device with updated Adobe Flash. If you are still having trouble uploading your photos, please contact MMM directly. We will not accept photos via email.

c. Returning vendors, please be sure to update your MMM profiles. This includes products, descriptions, and photos. If your packaging has changed, if your style of craft has changed, your MMM profile needs to reflect those changes.

MUSICIANS & BUSKERS

Musicians can sell their commercially recorded music as Market vendor; but musicians intending to perform are not eligible as Market vendors. Musicians can perform as buskers throughout the Market Square Farmers’ Market and Holiday Market in one of our 4 designated busking zones. No amplification will be allowed. Buskers are not allowed inside the venue where the Winter Farmers’ Market is held but can play outdoors. Please contact us for more information regarding our busking zones, [email protected]. Nourish Knoxville reserves the right to dismiss any busker who is causing a nuisance or obstructing pedestrian and/or vehicle traffic. Buskers with excessively loud performances may also be dismissed.

AUTHORS/LITERATURE Books and book signings may be allowed, provided the author is present. Books will be limited to food, cooking, or gardening. If you are an author interested in a booth at one of our markets, please contact us directly before applying, [email protected]. In many cases, it may be more appropriate to arrange a special event, separate from our Markets, rather

NON-PROFIT ORGANIZATIONS Non-profit organizations are welcome to reserve a free, 10’ x 10’ booth space at the Market Square Farmers’ Market only. We have 2 booths available every Wednesday and Saturday, May – October. These booths are intended for outreach only. The distribution of food, for sale or for free, is not allowed. Limited promotional items, such as t-shirts, can be distributed for a suggested donation. Non-profits may also solicit memberships or sell tickets to upcoming events. Nourish Knoxville’s Markets are not a forum for political, commercial, and/or religious organizations to recruit, market and/or advertise. Any organization promoting specific political, commercial, and/or religious individuals or causes are not eligible. Each organization will be limited to 3 Saturday market dates and 3 Wednesday market dates per MSFM season. All interested organizations must submit proof of their non-profit status or be a part of a governmental entity. Priority will be given to organizations with missions dealing with food, farming, the environment, historic preservation, and art. VENDOR CONDUCT & RESPONSIBILITIES

REGULATIONS & LICENSING Vendors should abide by all local, state, and federal regulations that govern sampling, production, labeling, and safety of every product offered for sale at a Nourish Knoxville Market. This includes responsibility for certifying and calibrating any scales. All vendors selling products by weight must have certified scales in accordance with state law annually. Approval seals are placed on all scales in compliance. Non-compliant scales must be repaired by scale agencies licensed by the department. Products that make any sort of medical claim that have not been evaluated and approved by the FDA are not eligible for sale at Nourish Knoxville Markets unless a legible disclaimers statement is affixed to the product. A label for each product requiring a disclaimer statement must be submitted with the application.

INSURANCE Vendors are responsible for carrying their own insurance in the amount they deem appropriate. Nourish Knoxville carries event liability insurance for each of our Markets, but does not cover individual vendors or their products.

PROPERTY LOSS

Vendors assume all responsibility for any losses of property or money from the Market site. Booths should never be left unattended and car doors should be locked (even if parked on site).

DAILY MARKET RESPONSIBILITIES

1. Vendors need to bring plenty of change. We do not carry enough to supply vendors with change and there are no banks within walking distance of Market that have Saturday hours. Vendors will be required to provide change for customers with Market Money (GREEN wooden tokens). For more information regarding our Market Money system please see the Incentive Programs/Alternative Currencies section of the vendor handbook.

2. Each vendor is responsible for maintaining his/her area in a clean and orderly manner throughout the day and cleaning the area before departing. This means picking up all debris from floral arrangements, greenery/other plant waste, craft demonstrations, paper, cigarettes, customer’s trash, etc. Having a small broom and dustpan is highly recommended. Leaving behind a messy booth may result in an infraction.

3. Prohibited at our Markets: a. No pets or any live animal, other than services animals, may be

in a vendor’s stall at Market. b. Amplified music is not allowed. c. Vendors are not allowed to give away food other than

approved samples of their product. No commercially manufactured candy or other foods should be given away at booths.

d. In the interest of the health and cleanliness, smoking and the use of tobacco products is not allowed in or around vendor stalls.

SUBLETING & SHARING BOOTHS Vendors are not permitted sublet a booth space. Applicants may share a booth, provided each applicant will attend the Market at some point. There are two ways vendors can share booths:

1. Example 1: Jamie’s Jewelry and Polly’s Pottery are marketing their products together as J&P Creations. Jamie and Polly should fill out a single application as J&P Creations, listing and describing both vendors’ products. Jamie and Polly’s products would then have to be approved

as a whole, meaning: Nourish Knoxville may want Polly’s Pottery to participate, but feel as though Jamie’s Jewelry does not meet our quality standards. Since they applied as a whole, they would then get denied as a whole. If J&P Creations were accepted, they would pay 1 annual fee and 1 booth fee/market date.

2. Example 2: Polly’s Pottery would like to sell at the Market weekly. Polly’s friend Jamie has a jewelry business and would like to share a booth once a month with Polly. Polly and Jamie would fill out separate applications and would each need to specify in their application that they would like to share a booth. Jamie and Polly would be approved/denied separately, meaning: Polly may be approved, but Jamie may be put on the waiting list or denied and wouldn’t be eligible to sell her products with Polly on the occasional Saturday. If both vendors were to be accepted, they would each pay an annual fee, but only pay 1 booth fee/market date.

If a Nourish Knoxville approved vendor sells his or her business, their stall space does not transfer to the new business owner. The new owner must submit a new application for approval. Nourish Knoxville does not guarantee acceptance.

CSA SHARES & OTHER PRE-SELL BUSINESS DROP-OFFS All CSA shares being distributed at a Nourish Knoxville Market must be composed entirely of products grown/raised/made exclusively by the Nourish Knoxville vendor distributing these shares. Vendors wishing to distribute aggregate* CSA shares or products from any other online ordering system/pre-sell business structure and delivered at a Nourish Knoxville Market must notify Nourish Knoxville staff, in writing, of the following:

1. Drop off location (Ex: Sally’s Farm Fresh Produce at the Market Square Farmers’ Market).

2. Complete list of growers and producers participating in the aggregate CSA/online ordering system/pre-sell business. Please note: Each vendor participating must be a current Nourish Knoxville vendor or submit an application to the appropriate Market to become an approved vendor even if they don’t plan on participating in Markets as a stand-alone

vendor. These new applicants are required to meet all Nourish Knoxville guidelines set forth in the Vendor Handbook, pay the one-time application fee, and have a farm inspection conducted, if applicable.

*CSA shares composed of multiple growers’/producers’ products are considered aggregate CSA shares. Nourish Knoxville reserves the right to deny aggregate CSA share drop offs at Market.

SALES & PRICING

Pricing of goods sold is the sole responsibility of the vendor. Dishonest merchandising or collusion to set prices among vendors are grounds for dismissal from Market. Vendors are discouraged from selling product at below-cost pricing, thus undercutting potential sales for other vendors and devaluing the product. All items for sale must be clearly marked with the retail price. Prices may be posted on the product with an individual sign or posted as a list of prices on a large sign or board. Vendors are responsible for their own applicable sales tax. Vendors are not permitted to use the following techniques: hawking, calling attention to products in a loud, repetitive public manner, or selling products in an aggressive way.

SOLICITATION

The MSFM and MSHM are free, public events in the middle of a downtown area, which attracts a wide variety of people. People unaffiliated with Nourish Knoxville may offer to help to unload and/or set up a vendor’s booths in exchange for food, money, or other forms of currency. While the decision to hire anyone is ultimately up to you, Nourish Knoxville discourages this practice and will often have staff and/or volunteers who can aid vendors in unloading/loading and set up/tear down. Nourish Knoxville has a no-panhandling policy at all of our events. Again, while the decision to give money/food/etc. is ultimately up to you, Nourish Knoxville’s policy is not to give money or food to panhandlers. We feel that

this policy is in the best interest of our vendors and our customers. This also allows you to cite the policy to anyone asking for money. There are many places downtown for people in need to receive food and shelter and if you would like to donate any leftover food product, several donation centers would be glad to have it! Please feel free to contact us for a list of suggested donation centers. Additionally, anyone not associated with Nourish Knoxville who is passing out flyers, samples, etc. is not allowed. If you ever feel uncomfortable about anyone, please make Nourish Knoxville staff or our police officer aware. And, as always, have a neighboring vendor or Nourish Knoxville staff member or volunteer watch your belongings if you have to leave your booth. Please report any violations of these policies to a Nourish Knoxville staff member or volunteer by calling us at 865-805-8687.

WORKPLACE VIOLENCE The safety of Nourish Knoxville employees, customers, volunteers, vendors, and visitors is of utmost importance. Threatening behavior, both verbal and physical, and acts of violence at Nourish Knoxville Markets, office, or by electronic means will not be tolerated. Any person who engages in this behavior shall be removed from the premises immediately and banned from the Nourish Knoxville Market premises pending the outcome of an investigation. Subsequent to the investigation, Nourish Knoxville will respond appropriately. This response may include, but is not limited to, suspension and/or termination of any business relationship, and/or the pursuit of criminal prosecution of the person(s) involved. If you experience workplace violence, please communicate with the Nourish Knoxville staff as quickly as possible so the matter can be addressed swiftly.

EQUIPMENT

The vendor must provide all necessary equipment and displays. Nourish Knoxville will not provide extension cords, signs, chairs, tables, tablecloths, scales, display containers, tents, weights, etc. All materials, including tables, tents, chairs, and signage must fit within each vendor’s assigned space. There will be no “bleeding” into the aisles.

TENTS & CANOPIES

1. For your safety and for the safety of those around you, Nourish Knoxville will no longer be allowing the use of umbrellas as canopies at Markets. All tents should be securely anchored at every MSFM and MSHM market day from the moment the canopy is erected until the moment immediately before the canopy is taken down, no exceptions.

2. We recommend 25 lbs of weight per tent leg. Any vendor found without sufficient weight, as determined by Nourish Knoxville, will be required to take down their tent.

a. Tie-downs attached to vehicles will not suffice. No tie-downs shall be attached to City property; this includes benches, planters, fencing, street signs, etc.

b. Tents and other equipment cannot be staked into the ground. c. Vendors whose tents lift off the ground due to an insufficient

amount of weight will be asked to take down their canopy, charged a $100.00 fine, and will be subject to an infraction.

SIGNAGE Vendors are required to use signage to distinguish their business. At the very least, signage must list the name of the business and the city and state in which the business is located. In compliance with the Food Safety Modernization Act, all agriculture vendors must prominently and conspicuously display the name and business address of the farm where the food was grown. Vendors must clearly post prices on all products being sold.

Nourish Knoxville staff and volunteers have the right to ask for signage/displays to be rearranged if they are blocking another vendor or customer traffic flow. Additionally, any signage or other forms of advertisement for other events or businesses during our Markets is not allowed without prior approval from Nourish Knoxville staff.

PRODUCT STORAGE & PACKAGING Containers of produce and other foods should not be placed directly on the ground. All containers containing food for sale should be at least 6 inches off the ground at all times. This includes baskets and coolers holding food. Nourish Knoxville strives to be as environmentally responsible as possible and therefore does not allow the use of Styrofoam containers. Nourish Knoxville strongly recommends using recyclable or compostable materials for all packaging. Recycling bins are available at each of our Markets.

ELECTRICITY

Access to electricity is not available at every booth at each of our Markets. If you need electricity, indicate this in your application. Extension cords will be required (we recommend at least a 50’ extension cord) and may not be stretched across walkways. Nourish Knoxville will not be able to accommodate all requests for electricity. Please note: As of December 2016, The MSHM hours have changed. Because of the new, earlier hours (11 am – 5 pm), electricity will NOT be available in every booth, as it has been in years past. Please be sure to request electricity in your MSHM application if needed.

BOOTH FEES & INVOICING Upon vendor acceptance into a Market, Nourish Knoxville will create invoice(s) for all dates for which a vendor has been accepted. Each vendor’s MMM account will have an invoice for each month of the Market the vendor is participating, with itemized charges for booth fees. Booth Fees are due one week in advance of your next scheduled market. Ex: If you are scheduled to be at a market on May 14th, your booth fee would be due by May 7th. Vendors may opt to pay all up front, by month, or weekly, as long as all booth fees are paid one week in advance of participating. Nourish Knoxville will review accounts each month. If a balance remains on your invoice at the end of that month, a $5.00 late fee will be added to next months invoice. For example, if the May invoice retains a balance on June 1, the May invoice is considered delinquent and a $5 fee will be added to the vendor’s June invoice. If continued non-payment persists, Nourish Knoxville reserves the right to remove a vendor from future markets. Payments can be made online via PayPal either by using the button on the invoice found in MMM or in the “Accounts” tab of MMM. Payments may also be made by check payable to Nourish Knoxville and mailed to PO Box 2422, Knoxville, TN 37901, or delivered in person to the information booth on a market day.

A one-time, non-refundable $30 fee is due upon submission of your application. Your application will not be considered until the application fee has been received. WINTER FARMERS’ MARKET

LOCATION & DIRECTIONS

1. Nourish Knoxville’s WFM will be held at Central United Methodist Church - 201 East 3rd Avenue, Knoxville, TN.

2. Directions: • From West Knoxville: Take I-40 eastbound to exit 388

(Downtown). Stay to the right of the split. You will end up at a stoplight on Western Avenue. Turn left. Go to the next stoplight (Broadway); turn left again. Go through 4 stoplights (4th light is Central), then turn right on LaMar Street. The church will be on your left.

• From Fountain City: Head south on Broadway. Pass Gill Avenue (Domino’s Pizza on the corner). Turn left onto LaMar Street. Upon turning left on LaMar Street, you will see the church on your left.

BOOTH ASSIGNMENTS

1. Upon acceptance to the WFM, you will be assigned an 8’ wide x 5’

deep booth space (10’ x 10’ if you are a food truck). Due to the limited amount of space, vendors wanting more than 1 booth will need to submit a request with their application. Not all requests will be able to be honored.

2. Vendors are not allowed to use more than their allotted booth space.

This includes placing signage and product displays in aisles.

3. Booth assignments can be found at any time in your MMM account or via our website. Please check these assignments the evening before each market date, as they are subject to change.

SET UP

1. Arrival: Load in may begin as early as 8 am. No vendor will be permitted in the building until 8 am – the doors will be locked. If you know your booth will take less than the full 2 hours to set up, we encourage you not to show up right at 8 am. With only one loading entrance, things can get congested. All vendors must be set up and ready to sell at market opening, 10 am.

2. Load In: a. After turning onto LaMar St. from Broadway, you will make a left

into the church parking lot. The parking lot is just before the church. If you hit 3rd Ave., you’ve gone too far. If using GPS to navigate you, please make sure you enter the parking lot from LaMar St. (not Morgan St.).

b. Upon turning into the lot, keep straight, heading towards the covered loading zone. The load-in/out doors are located just before the awning, on your right (WFM staff and volunteers will help guide you). We are not allowed to load in/out through the doors located directly under the awning. Please be patient with the WFM staff, volunteers, and fellow vendors during the unloading process. We only have one accessible load in/out point. Unloading may take longer than expected.

c. The WFM staff will provide 1 cart for unloading. If you own a cart/dolly, we encourage you to bring it with you. Upon entering the building, WFM staff will direct you to your booth (booths will be marked at two corners with painters tape). Do not start setting up your booth until you have completely unloaded and parked your vehicle. The only exception is for food vendors who may set up one table to keep their product off the floor.

d. To park, continue straight through the parking lot to Morgan St. and turn right, then make your first right at 3rd Avenue, then your first right back onto LaMar. The first gravel lot on your left (on the corner of LaMar & 3rd) is where you should park. The lot does not have painted lines. Please park in an orderly fashion. There will be no parking in the lot where you unloaded.

BREAK DOWN

1. Vendors will not begin breaking down their booths until the close of the WFM, 2 pm. If you sell out, you may leave early upon checking out with Nourish Knoxville staff. Tear down your tables and pack up your product completely before acquiring one of the carts and fetching your vehicle.

2. To load your vehicle, please enter just as you did for set up. 3. Vendors will be responsible for cleaning up their booth space. If there is

any sort of debris, please ask Nourish Knoxville staff for a broom & dustpan.

4. Upon loading your vehicle, please exit the loading area promptly. Be aware of your fellow vendors and pedestrians when exiting the WFM.

SAFETY & LOGISTICS

1. Pets are not permitted inside the venue. 2. Smoking is prohibited both indoors and near building entrances. 3. Bins for both recycling & trash will be provided. 4. Indoor, multi-stalled bathrooms will be available during market. Please

keep these tidy and notify WFM staff if there are any issues (clogged toilet, overflowing trash, lack of toilet paper/paper towels, etc.).

5. Remember: This is an indoor venue. If you have muddy boots from harvesting/loading on the farm, please bring a clean pair of shoes to change into while inside.

6. All coolers must be carried inside. Coolers are not to be dragged.

7. Nothing should be taped or otherwise affixed to church property. This includes the walls above your booth.

1. Nourish Knoxville’s Market Square Farmers’ Market is held on Market Square on Wednesday, and also Union Ave., and Market St. on Saturdays, in the heart of downtown Knoxville.

2. Directions a. Directions to Market Square: Take exit 388A. Keep left at the split

for US 441, TN 158, James White Parkway. Use the right lane to take the Summit Hill Dr. exit. Use the right 2 lanes to turn right onto Summit Hill Dr. Turn left at Gay St., then make your first right onto Wall Ave. For GPS, use the address 36 Market Square, Knoxville, TN 37902.

b. Directions to Union Avenue street closure. (Saturdays only), take exit 388A. Keep left at the split for US 441, TN 158, James White Parkway. Use the right lane to take the Summit Hill Dr. exit. Use the right 2 lanes to turn right onto Summit Hill Dr. Continue on Summit Hill Dr. Turn left on to Locust St. at the light. Then make your second left onto Union Ave. Continue straight until you see our road closure. Market Square will be on your left. For GPS, use the address 1 Market Square, Knoxville, TN 37902.

BOOTH ASSIGNMENTS

1. Upon acceptance to the MSFM, you will be assigned a 10’ x 10’ booth space. Vendors may reserve up to 2 booths for a maximum of 10’ x 20’. Booths will be marked at two corners with chalk and numbered.

a. We reserve the right to limit the amount of booth spaces vendors receive. Exemptions exist for prepared food and agriculture vendors only, when space is available.

b. Agriculture vendors may reserve a vehicle space within the MSFM. Vehicle spaces are limited and will be based on demonstrated need and seniority.

c. Booth assignments are subject to change, so check your assignments each evening before heading to the MSFM.

2. Vendors are not allowed to use more than their allotted booth space. This includes placing signage and product displays in aisles. Vendors also may not draw or otherwise mark on city property, for example, using sidewalk chalk on city sidewalks or Market Square.

3. Booth assignments can be found at any time in your MMM account or via our website. Vendors participating every Saturday or Wednesday will be assigned permanent booth spaces, with temporary vendors assigned to remaining available booth spaces.

4. If you have a specific area where you would like your booth to be

located, please make a request in your application. Be specific. Notes such as “where I was last year” will be ignored, as we won’t remember where exactly you were last year. Please note: we will not be able to honor all location requests.

SET UP

1. Set up may begin two hours before the opening of each MSFM day, 9 am on Wednesdays and 7 am on Saturdays. Vendors must be set up and ready to sell by MSFM opening, 11 am on Wednesdays and 9 am on Saturdays.

a. Saturdays: Union Ave. & Market St. will be closed to accommodate vendors. Wall Ave. will not be closed. The information booth will be located at the corner of Union Ave. & Market St. by Krutch Park. When in doubt of where to go, check in with a staff member or volunteer there.

i. Booths 1 – 44 will enter and exit the market from Wall Ave. While loading/unloading, please park as close to one side as possible to allow traffic to flow past you.

ii. Booths around the grassy area of Market Square (except those facing Union) will enter the MSFM site from Union Ave., turning left onto the Square in front of Tupelo Honey or left onto the Square in front of Juice Bar. Vendors will park towards one side of the aisle to unload, and then continue down Market Square towards Wall Ave. to exit.

iii. Booths set up on Union Ave. will enter the MSFM site on Union Ave., parking close to the curb to unload, then continue straight on Union Ave. to Gay St. to exit.

iv. Booths set up on Market Street will enter the MSFM site on Union Ave., then make a right down Market St., parking close to one side of the street to unload, then continuing straight on Market St. to Clinch Ave. to exit. This is the wrong way from normal traffic, but the road is closed for our event.

b. Wednesdays: All vendors will enter Market Square from Wall Ave. You can enter from either side of the stage depending on which side your booth is on. Upon arriving, unload at your booth and then park your vehicle off site.

2. Do not start setting up your booth until you have parked your vehicle

off site. Any vendors found setting up their tents, tables, tablecloths, etc. before parking will be subject to an infraction.

a. Prepared Food Exception: if you are a prepared food vendor, you are permitted to set up two tables (no tents, no tablecloths) for edible products.

b. Rain Exemption: if raining during set-up all vendors will be permitted to set up their tent and one table. Tents must be weighted before leaving to park your vehicle.

3. Please be aware of your fellow vendors, as well as pedestrians, when driving within the MSFM. If you are pulling into the MSFM to unload your vehicle, be patient and careful. Find your space, unload your vehicle, then park, as efficiently and safely as possible.

a. No vehicle should exceed pedestrian speed/5 mph while driving within the MSFM.

b. Because this cannot be stressed enough, do not leave your vehicle in the MSFM site while you set up. Ask a volunteer or fellow vendor to watch your belongings if you are setting up alone.

c. Be mindful of planters, marble inlays, outdoor furniture, and the fountains when driving. We will be fined for damages to city property. Any fees will then be passed on to the vendor.

d. Driving within the MSFM during open hours (9 am – 2 pm) is not permitted. In the event of sell out, vendors must check out with Nourish Knoxville staff for permission to leave early. Please note: some vendors with vehicles parked within the MSFM may not be able to leave early due to their booth location.

4. Parking: a. Wednesdays: Free parking is no longer available in the

Market Square Garage. We will send an email in mid-April with an update on free parking.

b. Saturdays: Please park in the State St. or Locust St. Garages on Saturdays. On UT home game Saturdays, avoid the Locust S. Garage, as they charge for parking. Do not park on Wall Ave., Clinch Ave., Market St., or in the Market Square or Walnut St. Garages in order to allow for convenient turnover parking for customers. Parking for large vehicle or trailers is available in the Old City under the James White Parkway Bridge.

c. Do not start setting up until you have parked your vehicle outside of the MSFM site.

BREAK DOWN Break down will not begin until the close of the MSFM at 2 pm. Tear down your booth completely before going to get your vehicle. This includes your tent. If it is raining during break down, vendors will be allowed to leave up their tents (still weighted) and 1 table for their product. If you sell out, you may leave early as long as you check with Nourish Knoxville staff or volunteers on duty. There will be no driving within the MSFM site during open hours, but you can park at the perimeter and load out. Any vendor found running errands, dining, shopping, etc. while their vehicle remains parked within the MSFM site is subject to an infraction.

SAFETY & LOGISTICS

1. Pets are not allowed down the center aisles of Market Square or on Market St. Pets are welcome everywhere else including Union Ave., and the exterior of Market Square, around booths 1 – 10, behind booths 11 – 44 (close to the surrounding brick and mortar shops), as well as in Krutch Park. Service animals are welcome in all areas.

2. Recycling and trash bins will be provided by the City of Knoxville.

3. Newly constructed bathrooms are now available in the lower level of the Market Square Garage. These bathrooms will open at 8:00 am & will service all of Market Square. A portable toilet and handwashing station will still be available at our Saturday MSFMs on Union Ave., just past our street closure.

MARKET SQUARE HOLIDAY MARKET

LOCATION & DIRECTIONS

1. Nourish Knoxville’s Market Square Holiday Market is held on Market Square, Union Ave., and Market St, in the heart of downtown Knoxville, TN. Holidays on Ice, the City of Knoxville sponsored ice rink, will also occupy Market Square, but is not affiliated with the MSHM or Nourish Knoxville.

2. Directions from I-40: Take exit 388A. Keep left at the split for US 441,

TN 158, James White Parkway. Use the right lane to take the Summit Hill Dr. exit. Use the right 2 lanes to turn right onto Summit Hill Dr. Turn left on to Locust St. at the light. Then make your second left onto Union Ave. Continue straight until you see our road closure.

BOOTH ASSIGNMENTS

1. Upon acceptance to the MSHM, you will be assigned a 10’ x 10’ booth space. Vendors may reserve up to two booths for a maximum of 10’ x 20’. Booth spaces will be marked at two corners with chalk and numbered.

a. We reserve the right to limit the amount of booth spaces vendors receive. Exemptions exist for prepared food and agriculture vendors only, when space is available.

b. All vendors have the opportunity to reserve a vehicle space within the MSHM. Vehicle spaces are limited and will be based on demonstrated need and seniority.

c. Booth assignments are subject to change, so check your assignments each day before heading to the MSHM.

a. Unloading: Enter market from and exit to Wall Ave. Please note: craft vendors from the south end of Market Square will be exiting towards Wall Ave. Please park near your booth (away form the brick and mortar stores) to allow traffic to flow past you, when possible.

b. If you have not been assigned a vehicle space, please do not start setting up your booth until you have parked your vehicle in the Locust St. or State St. Garages. This cannot be stressed enough. Any vendors found setting up their tents, tables, tablecloths, etc. will be subject to an infraction.

i. Rain Exemption: if raining during set-up all vendors will be permitted to set up their tent and one table.

ii. Vendors are permitted to set up tables so that food products stay at least 6” off the ground.

2. Driving within the MSHM site: Please be aware of your fellow vendors,

as well as pedestrians. If you are pulling into the MSHM site to unload your vehicle, be patient and careful. Vehicles should be driving no faster than pedestrian speed, 5 mph maximum. Find your space, unload your vehicle, then park, as efficiently as possible. Other vendors need to get in and out.

a. Because this cannot be stressed enough, do not leave your vehicle in the MSHM site while you set up. If you need to put up a few tables (not tablecloths) to keep your product off the ground, especially food, please do so. Ask a volunteer or fellow vendor to watch your belongings if you are setting up alone.

b. Be mindful of planters, outdoor furniture, and the fountains when driving and parking. We will be fined for damages to city property, and any damage fees will be the responsibility of the vendor that caused the damages. Do not drive down the middle of the Square, over any marble inlays, planters, sidewalks, or fountain equipment.

c. There will be no driving within market during operating hours, 11:00 am – 2:00 pm. In the event you sell out, you must check out with Nourish Knoxville staff for permission to leave early.

3. Parking: please park in the State St. or Locust St. Garages. Do not park on Wall Ave., Clinch Ave., or in the Market Square and Walnut St. Garages. These parking areas are reserved for customers.

BREAK DOWN FOR AGRICULTURE VENDORS

Break down will be from 2:00 pm - 3:00 pm for our agriculture vendors. Some vendors (depending on location) who sell out will be permitted to leave early, upon first checking out with Nourish Knoxville staff. SET UP FOR PREPARED FOOD AND ART & CRAFT VENDORS

1. Set up may begin two hours before each MSHM at 9:00 am. Union Ave. and Market St. will be closed to accommodate vendors. Our street closures do not begin until 9:00 am. Any vendor found setting up before 9:00 am, without express permission from Nourish Knoxville staff will be subject to an infraction and/or a citation from our officer on duty. All vendors will enter the MSHM on Union Ave. from Walnut St. There will be an officer and a “Road Closed” sign for our event. Drive around the

sign, but be prepared to be stopped by the officer. All vendors must be set up by market opening at 11:00 am.

a. If you are setting up along the grassy area of Market Square, you will turn left between 1 Market Square (Tupelo Honey) and the booth spaces to the right, unload, then exit to Wall Ave. by the stage. Do not park in the Market Square Garage or along Wall Ave. Park in the Locust St. or State St. Garages, both of which are free on Saturdays.

b. If you are set up along Market St., turn right just past Urban Outfitters. This will be the wrong way according to normal street traffic, but the road will be closed for our event. Upon locating you booth, please park as close the one side of the street as possible. Unload, and then exit to Clinch to park your vehicle in the Locust St. or State St. Garages.

c. If you are setting up along Union Ave., please park your vehicle close to a curb. Do not block the entrance to the Square (by Tupelo Honey) or Market St. Unload, and then park in the Locust St., or State St. Garages.

BREAK DOWN FOR ART & CRAFT AND PREPARED FOOD VENDORS

Break down will not begin until the close of the MSHM, 5:00 pm. Vendors who sell out are permitted to leave early after checking out with Nourish Knoxville staff. There will be no driving within the MSHM site during open hours (11:00 am – 5:00 pm) but you are welcome to park at the perimeter and load-out, if you sell out early and have checked out with Nourish Knoxville staff. Break down your booth completely before retrieving your vehicle. If you have another person picking you up, please inform them to arrive once you have completely packed up your booth, not right at closing. Enter and exit the market the same way you were instructed for set-up. Any vendor found running errands, dining, shopping, etc. while their vehicle still remains parked within the MSHM site is subject to an infraction.

INCENTIVE PROGRAMS/ALTERNATIVE

CURRENCIES All vendors must accept U.S. currency and other applicable Nourish Knoxville sponsored currencies. These currencies include EBT/SNAP (if selling eligible products), Market Money (accepted by all vendors), Fresh Savings (if selling fruits and vegetables), and PoP Bucks (if selling fresh fruits and vegetables and food producing plants). Vendors are not required to accept credit cards or checks, but may accept any other form of payment desired. A currency guide is available in your Manage My Market account. You can print it and bring to market or request a printed copy from Nourish Knoxville. Vendors that sell fresh fruits and vegetables will receive a bag with a printed copy of the currency guide on each market day. Nourish Knoxville processes credit and EBT/SNAP cards from customers at our central information booth at each of our Markets. All cards will be swiped for the customer’s desired amount in exchange for wooden tokens to be spent with vendors.

• SNAP/EBT: EBT stands for Electronic Benefits Transfer, which is the current system for distributing the USDA Food Stamp Program, now referred to as the Supplemental Nutrition Assistance Program (SNAP). These tokens are printed in RED and come in $1.00 and $0.25 denominations. Only vendors with snap/ebt eligible products can accept red tokens.

• Market Money: Our markets accept credit cards at the

information booth in exchange for GREEN printed tokens in $5.00 denominations, similar to an ATM. Customers are charged a $2.00 transaction fee for this service. All vendors must accept GREEN tokens.

How it works:

1. SNAP/EBT: a. How it works for customers:

i. Cards are swiped at the information booth and exchanged for RED tokens in $1.00 and $0.25 denominations. The customer will be given a receipt with their remaining balance.

ii. The customer’s unused RED tokens can be returned to the information booth to be refunded onto their card, and MUST be returned that day.

iii. No lost or stolen tokens will be reissued or refunded. iv. All RED tokens must be transacted the day the tokens were

purchased. v. RED tokens can be used on grocery items throughout the

market. b. How it works for vendors:

i. Vendors with eligible products are required to accept RED tokens, which come in $1.00 and $0.25 denominations.

ii. RED tokens can only be used for USDA approved foods including fruits, vegetables, meats, poultry, packaged baked goods, packaged dairy products, other packaged foods, and food producing plants (ie: herbs, tomato plants, blueberry bushes). It excludes any foods sold hot or prepared for on-site consumption and any hot or cold beverages (including coffee) or pet food (including raw milk).

iii. The customer must present both the SNAP/EBT card and the tokens to the vendor at each transaction.

iv. Vendors cannot give change back. At no time can RED tokens be exchanged for cash.

v. Any remaining amount from the tokens received can be written on a receipt by the vendor. Customers will bring the receipt to the information booth for a refund of the remainder. Example:

1. Customer purchase total comes to $4.17 2. Customer hands vendor four $1.00 RED tokens and

one $0.25 RED token for a total of $4.25. 3. Vendor writes receipt for items (one bunch green

onions - $2.00, weighed spinach - $2.17, total = $4.17)

4. Vendor writes “$4.25 received”, “$0.13 remaining” and hands receipt to customer

5. Customer takes the receipt to the information booth to receive a refund to their card for $0.13.

vi. Vendors may not round up or overcharge at any time, but are welcome to round down to a whole number. For instance, using the above example of a total of $4.17, the vendor may round down to $4.00 but may not round up to $4.25.

vii. Sales tax: If sales tax is included in the display price, you can charge the full amount for the item. If the sales tax is added to the displayed price, you do not charge sales tax. Note: particular businesses may have different requirements. Please see this document for more information, and contact FNS with questions.

viii. At the end of the market day, vendors will return the SNAP/EBT tokens with to the market staff or volunteers, and market staff will write a receipt for redeemed tokens. Vendors with fresh fruit and vegetables will return their provided bank bag (See Fresh Savings information below). Vendors will be written checks for the amount owed at every $10.00 or after one month, whichever comes first. Checks will be delivered at the market, or mailed if the vendor is no longer participating. RED tokens are not transferable should not be used to buy from another vendor.

2. Market Money: a. How it works for customers:

i. Credit cards are swiped at the market information booth in exchange for GREEN Market Money tokens in $5.00 denominations. All transactions will be run as credit through Square.

ii. All Market Money (GREEN token) purchasers will be charged a $2.00 transaction fee per transaction. Example: Customer wants $20.00 in tokens, is charged $22.00 via our machine and receives four $5.00 GREEN tokens).

iii. Customers can buy anything at market with the GREEN tokens, and use them on any future market date.

b. How it works for vendors:

i. All vendors are required to accept market money (GREEN tokens).

ii. Market Money should be treated as a $5.00 bill. Vendors will give US currency change back for purchases.

iii. Vendors will be refunded in cash at the end of the market day. Fresh Savings eligible vendors will have the option of turning in their GREEN Market Money tokens with their zipper bag and receiving a check when their total reimbursement amount reaches $10.00 or the end of the month, whichever comes first.

iv. Green tokens are transferable and vendors can use the green tokens they receive during market to make purchases from other vendors.

Use the following trick to remember which are which: RED means stop, GREEN means go.

FRESH SAVINGS (EBT/SNAP DOUBLING)

Despite the support of government programs like EBT/SNAP, many families struggle to put food on the table. To help fill the gap and get more produce into the hands of our low-income neighbors, Fresh Savings matches up to $20 EBT/SNAP dollars. Fresh Savings is distributed at all Nourish Knoxville markets through December 2018. Fresh Savings tokens can be used for fruits and vegetables only. Eligible items include any variety of fresh, dried, or frozen whole or cut fruits and vegetables without added sugars, fats, oils, or salt. This includes mushrooms, herbs, and dried beans. Fresh Savings tokens cannot be spent on meat, eggs, cheese, dried herbs/mushrooms/vegetables/fruit, nuts, baked goods, pickles, jams, jellies, or other foods that do not fit into the above guidelines, or edible plant starts, although those items are eligible for EBT/SNAP. Nonfood items are not eligible. No change may be given for purchases with Fresh Savings tokens.

Fresh Savings tokens are redeemed via check reimbursement. Eligible vendors will receive a zipper pouch that includes a currency guide and a receipt. Vendors will count their tokens (GREEN Market Money, RED EBT/SNAP, & BLACK Fresh Savings tokens, and PoP Bucks) and fill out the corresponding blanks on the receipt. Vendors will keep one half of the receipt for their records, then return the zipper pouch to the information booth with all tokens and vouchers & the other half of the receipt. A note for non-produce vendors: Although non-produce vendors are not eligible to accept Fresh Savings tokens, non-produce vendors at other markets offering produce-only incentives have seen in an increase in sales from EBT/SNAP tokens because customers were able to spend Fresh Savings tokens on produce, freeing other EBT/SNAP currency for meats, cheese, baked goods, etc.

POP BUCKS

Nourish Knoxville hosts Power of Produce (POP) Club activities for children at our Markets. These are held on every WFM date and once a month at the MSFM, as well as during field trips. Restrictions are the same as Fresh Savings, except that children can also purchase food-producing plants. No change is given. CANCELLATION POLICIES

Nourish Knoxville’s Markets are held rain or shine. If the weather is too dangerous to hold market or for vendors to safely get to/from market (snowy/icy conditions, tornado, flooding), Nourish Knoxville staff will notify vendors via email and issue necessary refunds for the date. If unexpected extreme weather occurs during a market, and Nourish Knoxville decides to cancel the market, all vendors will not be charged a stall fee for the day. Vendors canceling due to weather, such as rain, will NOT be eligible for a refund. Vendors are responsible for keeping track of their own dates. Vendors can access their approved dates at any time via MMM. If a change needs to be made, the vendor must email market staff of said change. Cancellations for a reserved market must be made one week in advance of the market date being cancelled to request a refund. Example: You are scheduled for a February 14th market but can no longer attend. The vendor must email us no later than 11:59 pm on February 7th in order to be able to request a refund. Vendor cancellations of market dates due to health, business failure, or other extraordinary circumstances will be taken into consideration regarding any fees due. Please note: you must request a refund. All cancellations must be made via email to [email protected] or by text to 865-805-8687. Verbal cancellations are not accepted as official cancellations. Vendors who cancel a large number of their originally approved market dates will have their account evaluated. Said vendor may lose their permanent booth space (if they had one) or be removed from the roster entirely and added back on a day-by-day basis. No shows: A vendor who signs up for a date, does not cancel the date, and then does not show up. Any vendor who is a no show will receive an infraction, will be removed form all future booth assignments, and will still be responsible for the booth fee. In order to return to market, the vendor must take care of all outstanding fees as well as get in touch with Nourish Knoxville staff, requesting to return. Nourish Knoxville reserves the right to change the cancellation policy.

INFRACTION POLICY

Any vendor found in violation of the vendor handbook will be subject to the following disciplinary process:

• 1st violation – Email notification. • 2nd violation - Email notification. • 3rd violation - Email notification and a $20.00 fine. Fine must be

paid before the vendor may participate again. • 4th violation - Email notification and a $20.00 fine. Fine must be

paid before the vendor may participate again. • 5th violation – Email notification and a $20.00 fine. Vendor will be

removed from all future dates and will not be permitted to return until their fines are paid and their performance is reviewed by Nourish Knoxville. Nourish Knoxville has the right to terminate the vendors attendance for the remainder of the season, if deemed necessary.

If a vendor feels as though they received an infraction unjustly, they may appeal within one week of receipt. To appeal an infraction, simply forward your receipt of your infraction with a brief description as to why you feel as though you have been unjustly issued an infraction to [email protected].

SPONSORSHIPS Vendor fees at Nourish Knoxville Markets cover some of the basic costs of operating the Markets, but not all. Nourish Knoxville seeks sponsors annually to provide additional income for educational outreach, advertising, special events, and market programming. Organizations wishing to become a sponsor are evaluated on an individual basis. All organizations wishing to become sponsors must have missions and values that are aligned with those of Nourish Knoxville. Sponsors might be ongoing or appear on single occasions. Nourish Knoxville also holds fundraising events, receives in-kind donations, enlists support of volunteers, and cultivates community partners to ensure the organization’s continued success. As a 501(c)(3) nonprofit organization, donations are tax deductible. GRIEVANCES Nourish Knoxville has created protocols and procedures that allow vendors to lodge complaints against other vendors whom they believe to be out of compliance with Market rules and policies. Nourish Knoxville has also created protocols and procedures that allow applicants and vendors to lodge a complaint against Nourish Knoxville staff to the Nourish Knoxville Board of Directors.

VENDOR V. VENDOR GRIEVANCE PROCEDURE Nourish Knoxville vendors who have concerns regarding another vendor’s compliance with the Vendor Handbook should submit a Vendor Grievance Form (VGF), available in your MMM account, and $20.00 within one week of the alleged incident/violation. Nourish Knoxville will review the grievance(s), investigate, and work to resolve the issue. The inquiring individual will remain anonymous. If the grievance is validated, the $20.00 fee will be refunded. Completed VGFs may be emailed to [email protected] or mailed to: Nourish Knoxville PO Box 2422 Knoxville, TN 37901. Payments can be made via PayPal (please include a receipt of payment with your VGF) or by check. Upon receiving and reviewing the VGF, we will determine the appropriate next steps to address the concern.

• All validated grievances will be sent to the accused vendor via email, outlining the concerns.

• The accused vendor will have the opportunity to correct the concern by their next scheduled Market.

• If the accused vendor choses not to comply, their contract with Nourish Knoxville will be terminated immediately.

• If a vendor receives 3 validated grievances within a calendar year, the vendor’s contract may be terminated.

• Any and all contract terminations will be communicated via email.

VENDOR/APPLICANT V. NOURISH KNOXVILLE STAFF/VOLUNTEER GRIEVANCE PROCEDURE

Nourish Knoxville vendors and applicants who have concerns regarding the application process or a Nourish Knoxville staff member or volunteer’s conduct should email our Executive Director, Charlotte Tolley: [email protected], with their concern. Procedure will vary based on complaint. If the complaint is with the Executive Director, the vendor may appeal to the Nourish Knoxville Board of Directors. As the President of the board changes, the vendor may request contact information for the current president from any Nourish Knoxville staff member.
