1. Only 3 bills are destined for the governor’s desk. However, two of the three bills are identical; so, we have only two bills. (HB 0004 / SB 0208 and HB 1629)
2. The path a bill takes on the route to becoming law can vary depending upon several factors. Therefore, the number of votes taken on a given bill often vary.
3. Most bills died in Committee without a vote (this is not unusual). 4. ONLY the bills which received a Third Reader vote or had a cross-file bill which did receive
a 3rd Reader vote are listed in this report. 5. Bills with “SA” following the bill number represent votes on bills amended in the Senate. 6. It is strongly recommended that you take the time read the synopsis of each bill’s journey

Legislative Action and Vote History for Bills Passed in the General Assembly: HB 0004 Public Safety – Rifles and Shotguns – Sales, Rentals and Transfers (SB 0208) First amended in the House Judiciary Committee (JUD) and given a favorable report (15-6), HB 0004 was later amended on the House floor to provide what was mistakenly believed to provide relief for clubs that owned firearms for training and competition. The amended bill passed 2nd Reader on 01/31/2020 and 3rd Reader (87-47) on 02/04/2020. HB 0004, as amended and passed by the House, was no longer identical to its Senate cross-file, SB 0208. HB 0004 was referred to the Senate Judicial Proceedings Committee (JPR) On 02/05/2020, for action by JPR and the Senate. The Senate JPR Committee amended HB 0004 to match the JPR’s amended language of SB 0208 including a change in the bill title to reflect the revised scope of the amended bill. HB 0004 was voted favorably on 03/04/2020 (6-5) in the JPR Committee. After further amendments on the Senate floor, HB 0004 was passed in the Senate (31-14) on 03/09/2020 and returned passed with amendments to the House. The JUD Committee accepted the amended language and the House concurred with the Senate amendments to HB 0004 on 03/16/2020 and HB 0004 was passed enrolled (87-43). NOTE: The original version of HB 0004 as passed in the House, was never voted on by the JRP Committee or the full Senate. SB 0208 Public Safety – Rifles and Shotguns – Sales, Rentals and Transfers (HB 0004) The Senate JPR Committee amended SB 0208 from its original form to match the JPR’s amended language of HB 0004 including a change in the bill title to reflect the revised scope of the amended bill. HB 0004 was voted favorably on 03/04/2020 (8-3) in the JPR Committee. SB 0208 was passed by the Senate in amended form on 03-09-2020 (31-14) and referred to the House Judiciary Committee (JUD) on 03/10/2020. A hearing was scheduled for 03/18/2020 only to be cancelled on 03/14/2020. The bill was suddenly voted favorably by the JUD Committee on 03/18/2020, sent to the full House where it passed (87-42) the same calendar day 03/18/2020 and immediately returned passed to the Senate. Synopsis: HB 0004 / SB 0208 Public Safety – Rifles and Shotguns – Secondary Transactions As passed, the major impact is on secondary sales of rifle and shotguns where the transaction must go through a dealer and the buyer must successfully pass a NICS background check. The loan restrictions were stricken from the bill. The bills as passed remain unenforceable. Both bills are on the Governor’s desk awaiting action.

HB 1629 Office of the Attorney General – Firearm Crime, Injuries, Fatalities, and Crime Firearms – Study (SB 1047) Passed by the House Judiciary Committee on 03/10/2020 (14-6 with 1 excused) and send to the full House on 03/11/2020, where it passed 2nd Reader on 03/11/2020 and a favorable 3rd Reading vote (106-28) on 03/13/2020. HB 1629 was sent to the Senate Judicial Proceedings Committee (JPR) on the same day. HB 1629 was amended in the JPR Committee where it received a favorable vote (8-3) on 03/17/2020. Further amended on the Senate floor, HB 1629 passed 3rd Reader (30-15) in the Senate on 03/18/2020 and was quickly returned to the House. The House immediately concurred with the Senate amendments and HB 1629 passed enrolled on 3rd Reader (100-28) on 03/18/2020. SB 1047 Office of the Attorney General – Firearm Crime, Injuries, Fatalities, and Crime Firearms – Study (HB 1629) SB 1047 was voted favorably (8-3) by the Senate Judicial Proceedings Committee (JPR) on 03/17/2020 and immediately sent to the full Senate. It passed the 2nd Reading on 03/18/2020. SB 1047 died on the Senate floor, with no 3rd Reader vote to record when the Senate adjourned sine die.

Legislative Action and Vote History for Bills with Third Reader Floor Votes: HB 0035 Public Safety - Firearm Telematics - Study HB 0035 passed with amendments in the House (92-39), and then sent to the Senate Judicial Proceedings Committee (JPR). No action was taken by the JRP Committee and HB 0035 died in the JPR Committee.
HB 0591 Public Safety – Lost or Stolen Regulated Firearm – Reporting (SB 1050) HB 0591 passed in the House Judiciary Committee (13-7 with 1 excused) on 03/11/2020. It passed 2nd Reader on 03/12/2020 and 3rd Reader (89-44) on 03/13/2020 and was referred to the Senate Judicial Proceedings Committee on 03/14/2020. The Senate JPR Committee amended HB 0591 to match the amended version of SB 0208. HB 0591 was no longer identical to the version previously passed in the House. HB 0591 was passed by the Senate JPR (11-0) on 03/17/2020, sent to the Senate floor where it passed 2nd Reader on 03/17/2020, and 3rd Reader (45-0) on 03/18/2020. HB 0591 as amended by the Senate JPR was returned to the House where no action took place and the bill died when the House adjourned sine die. SB 1050 Public Safety – Lost or Stolen Regulated Firearm – Reporting (HB 0591) Passed in amended form by the Senate Judicial Proceedings Committee (JPR) (11-0) on 03/17/2020 and voted favorable on 2nd Reader the same day. Pass 3rd Reader (45-0) on 03/18/2020 and referred to the House. No action on SB 1050 as passed by the Senate was taken by the House Government Operations Committee (HGO) and the bill died. It is curious to note that this bill began in the Senate Judicial Proceedings Committee (JPR) but when passed, went not to the House Judiciary Committee (JUD) as is normally the case: but rather, to the House HGO Committee. The reason for this anomaly is unknown.

HB 0636 Public Safety - Access to Firearms - Storage Requirements (SB 0646) HB 0636 was heard in the House Judiciary Committee (JUD) on 02/19/2020. No further action was taken, and the bill died in JUD. SB 0646 Public Safety - Access to Firearms - Storage Requirements (HB 0636) SB 0646 was passed in amended form by the Senate Judicial Proceedings Committee (JPR) (7-4) on 03/10/2020, passed 2nd Reader on 03/17/2020 and passed 3rd Reader (29-16) on 03/17/2020. The bill was sent to the House Judiciary Committee (JUD) on 03/17/2020 but died in (JUD).
HB 1078 Public Safety - Education - Firearm Funding (No Funding for Firearms Act) HB 1078 was passed (14-5 with 4 excused) by the House Appropriations Committee on 03/13/2020, passed 2nd Reader the same day and passed 3rd Reader (91-40) on 03/14/2020. It was then referred to the Senate Judicial Proceedings Committee (JPR) which took no action and it died when the Senate adjourned sine die.
SB 0506 Firearms - Handgun Permit - Preliminary Approval SB 0506 was passed (11-0) by the Senate Judicial Proceedings Committee (JPR) on 02/21/2020. It passed 2nd Reading in the Senate on 02/25/2020 and 3rd Reading (46-0) on 02/27/2020. It was referred to the House Judiciary Committee on 02/28/2020 where no action was taken, and the bill died in JUD when the House adjourned sine die.
