Historical Note. This amendment of section 3—120—4, Hawaii Administrative Rules and Exhibit A, replacesinterim rules effective 10/31/2014 (file no. 3121)which expired on 05/10/2016.

§3—120-4 Procurements exempt from chapter 1030,HRS. (a) Notwithstanding the intent of chapter 1030,HRS, to require governmental bodies to procure theirgoods and services through competitive bidding, it isacknowledged that there may be situations whereprocurement by competitive means is either notpracticable or not advantageous to the State.

(b) Exhibit A titled “Procurements Exempt FromChapter 103D, HRS” dated 10/30/2014, is located at theend of this chapter. This exhibit provides a list ofgoods and services which the procurement policy boardhas determined to be exempt from chapter 1030, HRS,because although such goods and services may beavailable from multiple sources, their procurement bycompetitive means would be either not practicable ornot advantageous to the State.

fc) Chief procurement officers may requestperiodic reports from the heads of purchasing agenciesof procurements made pursuant to subsection (b) . Theheads of purchasing agencies may be required toinclude in their reports, descriptions of the processor procedures the agency used to select the vendorensuring maximum fair and open competition wheneverpracticable.

(U) Chief procurement officers may request thatadditional exemptions be added to Exhibit A entitled“Procurements Exempt From Chapter 1030, HRS” dated10/30/2014, located at the end of this chapter.

(e) The procurement policy board shall reviewExhibit A titled “Procurements Exempt From Chapter1030, HRS” dated 10/30/2014, located at the end ofthis chapter, annually or more frequently as neededfor amendments.

(f) Purchasing agencies making procurementswhich are exempt from chapter 1030, HRS, arenevertheless encouraged to adopt and use provisions ofthe chapter and its implementing rules as appropriate;provided that the use of one or more provisions shall

not terminate the exemption and subject the

procurement of the purchasing agency to any other

provision of the chapter.(g) Purchasing agencies shall cite on the

purchase order or on the contract, the authority

waiver as “Exempt From Chapter 103D, HRS, pursuant to

section 3—120-4(5) (cite exemption number from

Exhibit A titled “Procurements Exempt From Chapter

103D, HRS” dated 10/30/2014, located at the end of

Amendments to chapter 3—120, HawaiiAdministrative Rules, on the Summary Page dated June15, 2016, were adopted on June 15, 2016, following apublic hearing held on May 6, 2016, after public noticewas given in the Honolulu Star Advertiser, HawaiiTribune-Herald, West Hawaii Today, The Maui News, andThe Garden Island on April 5, 2016.

These amendments shall take effect ten days afterfiling with the Office of the Lieutenant Governor.

“EXHIBIT A”

PROCUREMENTS EXEMPT FROM CHAPTER 103D, HRS10/30/2014

The following exemptions, pursuant to section 3-120—4,HAR, have been determined to be exempt from chapter103D, HRS, by the procurement policy board,notwithstanding remaining ethical considerations inpublic procurement, as guided by section 1030-101,HRS, and section 3-131—1.02, HAR:

1. Research, reference, and educationalmaterials including books, maps,periodicals, and pamphlets, which arepublished or available in print, video,audio, magnetic, or electronic form,including web-based databases, and costsassociated with publication of articles inscholarly journals;

2. Services of printers, rating agencies,support facility providers, fiscal andpaying agents, and registrars for theissuance and sale of the State’s orcounties’ bonds;

3. Services of lecturers, speakers, trainers,facilitators and scriptwriters, when theprovider possess specialized trainingmethods, techniques or expertise in thesubject matter;

4. Services of legal counsel, guardian adlitem, psychiatrists, psychologists,receivers and masters when required by courtorder;

7. Food and fodder for animals;

8. Facility costs for conferences, meetings,

such as in ethnic or foreign language

publications, trade publications, orprofessional publications;

10. Arbitrator and mediator services;

11. Interpreter services;

12. Procurement of repair services whendismantling is required to assess the extent

of repairs;

13. Burial services consisting of mortuary,

crematory, cemetery, and other essentialservices for deceased indigent persons or

unclaimed corpses;

14. Radio and television airtime when selection

of station is based on the targeted audience

(i.e. ethnic or age group, gender, etc);

15. Subscription costs and registration orworkshop fees for conferences or training;

and

16. Court reporter services.
