(a) No person may offer for transpor- tation or transport a hazardous waste (as de fi ned in § 171.8 of t hi s subchapter) in interstate or intrastate commerce except in accordance with the require- ments of this subchapter. (b) No person may accept for trans- portation, transport, or deliver a haz- ardous waste for which a manifest is required unl es s th at pe rson: (1) Has marked ea ch motor vehicl e used to transport hazardous waste in accor danc e wi t h § 3 9 0 .21 or § 1 0 5 8 .2 of this title even though placards may not be required; (2) Complies with the requirements for mani fests set f ort h i n § 1 7 2 .2 0 5 of t his subchap t er; and (3) Delivers, as designated on the manifest by the generator, the entire quantity of the waste received from the generator or a transporter to: (i) T he de signated fa cil it y or, i f not pos sibl e, to the designated alt ernate fa- cility; (ii ) T he de signated subse que nt car- rier; or (iii) A designated place outside the United States. §171.3 Hazardous waste.

(a) No person may offer for transpor-tation or transport a hazardous waste(as defi ned in §171.8 of t hi s subchapter)in interstate or intrastate commerceexcept in accordance with the require-ments of this subchapter.

(b) No person may accept for trans-portation, transport, or deliver a haz-ardous waste for which a manifest isrequired unless that person:

(1) Has mark ed each motor vehicl eused to transport hazardous waste inaccordance with §390.21 or §1058.2 ofthis title even though placards maynot be required;

(2) Complies with the requirementsfor mani fests set fort h i n §172.205 of

this subchapter; and(3) Delivers, as designated on the

manifest by the generator, the entirequantity of the waste received from thegenerator or a transporter to:

(i) T he designated facil it y or, i f notpossible, to the designated alt ernate fa-cility;

(ii ) T he designated subsequent car-rier; or

(iii) A designated place outside theUnited States.

NOTE : F ederal l aw specifi es penalt ies up to$250,000 fine for an i ndivi dual and $500,000 fora company and 5 years imprisonment for thewil lful discharge of hazardous waste at otherthan designated faci l i ti es. 49 U.S.C . 5124.

(c) I f a discharge of hazardous wasteor other hazardous material occursduring transportation, and an officialof a State or local government or aF ederal agency, acting wit hin t hescope of his official responsibilities, de-termines that immediate removal ofthe waste is necessary to prevent fur-ther consequence, that official may au-thorize the removal of the waste with-out the preparation of a manifest.

§171.4 Marine pollutants.

(a) Except as provided in paragraph(c) of this section, no person may offerfor transportation or transport a ma-rine pollutant, as defined in §171.8, inintrastate or interstate commerce ex-cept in accordance with the require-ments of this subchapter.

(b) The requirements of thi s sub-

chapter for the transportation of ma-rine pollutants are based on the provi-sions of Annex II I of the 1973 Inter-national Conventi on for P reventi on ofP olluti on from Ships, as modifi ed bythe Prot ocol of 1978 (MARP OL 73/78).

(c) Except ions. Except when trans-ported aboard vessel, the requirementsof this subchapter specific to marinepollutants do not apply to non-bulkpackagings transported by motor vehi-cles, rail cars or air craft.

perwork Reduction Act.(a) Purpose and scope.  Thi s section

collects and displays the control num-bers assigned to the HMR collections ofinformation by the Office of Manage-ment and Budget (OMB) under the Pa-perwork Reducti on Act of 1995. Thissection complies with the requirementsof 5 CF R 1320.7(f), 1320.12, 1320.13 and1320.14 (OMB regulati ons implement ingthe Paperwork Reducti on Act of 1995)
