    As you know, this firm represents the New York City and Vicinity District Council ofCarpenters.I have enclosed copies of the new collectively bargained agreement between theDistrict Council and the Building Contractors Association, Inc. {the "BCA"). The twodocuments are the collective bargaining agreement and the related market recoveryaddendum. Both documents were executed by the parties yesterday, May 15, 2013.Under Your Honor's April 11, 2013 Order (Doc. 1303) on best practices, the District

    Council's Delegate Body will review and vote on whether to ratify the agreement at its nextregularly scheduled meeting on May 22, 2013.The agreement provides for the same full mobility and anti-corruption complianceprovisions as in the agreement between the District Council and the Association of WallCeiling & Carpentry Industries of New York, Inc. (the "WC&C") that was the subject ofYour Honor's May 8, 2013 Decision & Order (Doc. 1315). If the Delegates ratify theagreement with the BCA, I will write to the Court the next morning to request that Your revisions under the May 8, 2013 Decision &Order.

    ADDENDUMON MARKET RECOVERY FOR GENERAL CONTRACTORSto theCOLLECTIVE BARGAINING AGREEMENT-between-Building Contractors Association, Inc.-and-DISTRICT COUNCll.. OF NEW YORK CITY AND VICINITY OF TilE UNITEDBROTHERHOOD OF CARPENTERS AND JOINERS OF AMERICA("UNION" or "DISTRICT COUNCIL")

    This Addendum is made, entered, and effective as of he implementation of he collective bargainingagreement between the DISTRICT COUNCIL and the Building Contractors Association, Inc. with a tennof July 1, 2011 to June 30, 2015 (the ''CBA").

    WHEREAS, the DISTRICT COUNCll.. and the Building Contractors Association, Inc. recognizethe growth ofR.esidential & Hotel construction in New York City which has been built by non-signatorycon1ractors with non-Union labor; and

    WHEREAS, the DISTRICT COUNCll.. and the Building Contractors Association, Inc. recognizethe growth ofCommercial Renovation ofClass C Office Buildings in New York City which has beenbuilt by non-signatory contractors with non-Union labor; andWHER.EAS, the DISTRICT COUNCll.. and the Building Contractors Association, Inc. furtherrecognize that this trend will continue and will ultimately erode areas ofwork opportunities heretoforeconsidered secure for Building Contractors Association, Inc. members and UNION workers;NOW, THEREFORE, in order to combat the effectsofsuch non-Union construction in the area

    of residential & hotel construction and renovation of commercial space in Class C Office Buildings, in aneffort to recover this market for the benefit ofUNION carpenters and General Contracting members ofthe Building Contractors Association, Inc., the parties have negotiated and agreed to the followingmodifications to the collective bargaining agreement, to be known as the "Market Recovery Addendum.",

    I. Qeocraphie Area: This Market Recovery Addendum shall apply in the boroughs of he Bronx,Brooklyn. Queens and Staten Island and Manhattan. Also included will be the area ofNassau Countycovered under the jurisdiction ofLoca145.2. This Market Recovery Addendum shall apply only when a Building ContractorsAssociation, Inc General Contractor or Construction Manager is contracted directly by theowner/client to a prime construction contract for the project. The General Contraetor orConstruetlon Manaaer shall be responsible for the subc:onb:acting of all work covered under thejurisdiction ofThe District Council ofNew York City & Vicinity ofThe United Brotherhood ofCarpenters and Joiners ofAmerica.     through the New York City Building and Construction Trades Council (i&., PLA's).5. Covered Work:a. Interior Alteration and Fit Out Projects (All Boroughs)i. Class C Office Buildings as identified through CoStar Group, Inc. on or aboutMarch 2013. (excel Database Attached).ii. Twenty percent (20%) reduction in wage and fringe benefit package on all projectsregardless of square footage.b. Construction ofnew buildings (residential and hotel only) in the Bronx, Brooklyn, Queens,and Staten Island:i. Twenty percent (200.A.) reduction in wage and fringe benefit package on all projectsregardless of square footage.ii. Mixed use buildings can be submitted to hardship and advisory committee.c. Construction of new buildings (residential and hotel only) in Manhattan only:i. Utilize the Carpenters B-12A Wage & Fringe package on buildings on 100,000square feet and under excluding PLA jobs.ii. When a holiday fa l l s on a Saturday, then the make-upday r a te sha l l be t ime and one-hal f . Because of the various l i ab i l i t i e s andresponsib i l i t ies placed upon a l l par t i e s to th i s Agreement,including a l l Contractors and Union representa t ives and the i rrespect ively designated Trustees, each Contractor hereby agreestha t the Fringe Benefi t Fund Trustees shal l have the necessarypowers to f u l f i l l t he i r f iduciary obl igat ions in order to ful lyprotect each Employer signed to th i s Agreement and the i remployee-beneficiar ies under the respect ive fund plans.

    amended, and by a l l By-Laws adopted to regulate each of saidFunds. The Trustees of the Funds sha l l secure the approval ofthe Treasury Department under the appl icable provis ions of theIn te rna l Revenue Code and sha l l amend the same, if necessary , tosecure such approval , so as to qua l i fy the Employer-contr ibut ions as deductions fo r Federal Income Tax purposes.

    Sect ion 4. I t i s agreed tha t no contr ibut ions to any ofthe Funds as spec i f ied in t h i s Art ic le sha l l be required on thepremium port ion of wages. For the purposes of these Sect ionsonly, a l l hours worked sha l l be regarded as s t ra igh t - t ime hours .

    I t i s fur ther agreed, however, t h a t con t r ibu t ions spec i f iedin t h i s Art ic le sha l l be paid on the hours represented by wagesreceived fo r not working on the af ternoon of the days spec i f iedin Art ic le XI, Sect ion 10.

    Fringe benef i t con t r ibu t ions , including Vacation Fundpayments, wi l l be the same for th e General Foreman, Foreman andJourneyman. Fringe bene f i t con t r ibu t ions fo r Apprentices sha l lbe in accordance with app l icab le schedules in Art ic le XII.

    Section 5. Whenever the Employer i s in defaul t in paymentsto the Funds re fe r red to in Art ic le XVI of the Agreement, andreasonable not ice of such defau l t i s given to the Employer, ifthe payments are not made, th e Union may remove i t s members fromthe work of such Employer. I f such men who a re removed remaina t the jobs i t e during regu la r working hours , they sha l l be paidfo r l o s t t ime not to exceed three (3) days ' pay.

    Section 6. (a) In the event t h a t formal proceedings arei n s t i tu t ed before a cour t of competent j u r i s d i c t i o n by thet rus tees of a Benef i t Fund or Funds to co l l e c t del inquentcontr ibut ions to such Fund(s) , and if such cour t renders ajudgment in favor of such Fund (s ) , th e Employer s h a l l pay tosuch Fund(s) , in accordance with the judgment of the court , andin l ieu of any other l iqu ida ted damages, cos t s , a t to rney ' s feesand/or i n t e res t , th e fol lowing:

    Section 3. I f the Employer fa i l s to comply with theforegoing, they sha l l receive no support from the Union;provided, however, t ha t no Carpenter sha l l be removed from jobsin the t e r r i to ry covered by t h i s Agreement pending resolu t ionsof the matter in accordance with Art ic le XIII .

    Sect ion 10. The Employers, employees, or the Agents of theEmployer sha l l not accept or give d i rec t ly or ind i rec t ly , anyrebate on wages, or give or accept gra tu i t i e s or give anythingof value o r extend any favor to any person for th e purposes ofaffec t ing any ra te of wages.

    For viola t ion of the foregoing, a penal ty must be imposed.In case of viola t ion by the Employer, the penal ty sha l l beimposed by the Associat ion to which he belongs. In the case ofviola t ion by a Union Member, the penal ty s h a l l be imposed by theDis t r i c t Council .

    Sect ion 11. Should the par t i e s hereto be unable to agreeon the in te rp re ta t ion of any Sect ion of t h i s Agreement, thequest ions sha l l be se t t l ed as provided fo r in Art ic1es XIII andXVl:.

    Section 13. Every Employer sha l l not i fy the Dis t r ic tCouncil, by ce r t i f i ed mail or fax, of the awarding of anycont rac t on which any of the work descr ibed in Artic le I I Ihereof shal l be performed by the Employer or a Subcontractor .Regardless of whether said work i s to be performed by theEmployer or Subcontractor, said not ice sha l l include thelocat ion of the job and the name and address of the Contractoror Subcontractor involved. Fai lure to comply with th i s Sectionsha l l be a breach of th i s Agreement and sha l l author ize theUnion to remove i t s members from any job on which sa idContractor or Subcontractor is working un t i l said not icerequirement i s complied with. A ll work covered by t h i s Agreement sha l l becontracted or subcontracted only to an Employer who i s signatoryto or agrees to become signatory to a co l lec t ive bargainingagreement with the Union. Once an award i s made by a General Contractor ,Prime Contractor , or Bui lder to a Subcontrac tor , who performsonly one type o f work, then t h i s Subcontrac tor cannot re -subcontract to another Subcontrac tor who performs the same typeof work.
