CITY OF OCEANSIDE PROFESSIONAL SERVICES AGREEMENT PROJECT: AS-NEEDED ENVIRONMENTAL CONSULTING SERVICES THIS AGREEMENT, dated _______________, 2019 for identification purposes, is made and entered into by and between the CITY OF OCEANSIDE, a municipal corporation, hereinafter designated as "CITY", and Helix Environmental Planning, hereinafter designated as "CONSULTANT." NOW THEREFORE, THE PARTIES MUTUALLY AGREE AS FOLLOWS: 1. SCOPE OF WORK. The CONSULTANT desires to provide as-needed

geotechnical engineering services in support of Oceanside Water Utilities Capital Improvement Projects as is more particularly described in the CONSULTANT’S proposal dated March 28, 2019 attached hereto and incorporated herein as Exhibit A.

2. INDEPENDENT CONTRACTOR. CONSULTANT'S relationship to the CITY

shall be that of an independent contractor. CONSULTANT shall have no authority, express or implied, to act on behalf of the CITY as an agent, or to bind the CITY to any obligation whatsoever, unless specifically authorized in writing by the CITY. CONSULTANT shall be solely responsible for the performance of any of its employees, agents, or subcontractors under this Agreement, including the training of each employee regarding the rights and responsibilities of an employer and employee for any potential discrimination or harassment claim under state or federal law. CONSULTANT shall report to the CITY any and all employees, agents, and consultants performing work in connection with this project, and all shall be subject to the approval of the CITY.

3. WORKERS’ COMPENSATION. Pursuant to Labor Code section 1861, the

CONSULTANT hereby certifies that the CONSULTANT is aware of the provisions of Section 3700 of the Labor Code which require every employer to be insured against liability for Workers’ Compensation or to undertake self-insurance in accordance with the provisions of that Code, and the CONSULTANT will comply with such provisions, and provide certification of such compliance as a part of this Agreement.

4. LIABILITY INSURANCE. 4.1. CONSULTANT shall, throughout the duration of this Agreement maintain

comprehensive general liability and property damage insurance, or commercial

general liability insurance, covering all operations of CONSULTANT, its agents and employees, performed in connection with this Agreement including but not limited to premises and automobile.

4.2 CONSULTANT shall maintain liability insurance in the following minimum limits: Comprehensive General Liability Insurance (bodily injury and property damage) Combined Single Limit Per Occurrence $ 2,000,000 General Aggregate $ 4,000,000* Commercial General Liability Insurance (bodily injury and property damage) General limit per occurrence $ 2,000,000 General limit project specific aggregate $ 4,000,000 Automobile Liability Insurance $ 2,000,000 *General aggregate per year, or part thereof, with respect to losses or other acts or

omissions of CONSULTANT under this Agreement. 4.3 If coverage is provided through a Commercial General Liability Insurance policy, a

minimum of 50% of each of the aggregate limits shall remain available at all times. If over 50% of any aggregate limit has been paid or reserved, the CITY may require additional coverage to be purchased by the CONSULTANT to restore the required limits. The CONSULTANT shall also notify the CITY promptly of all losses or claims over $25,000 resulting from work performed under this contract, or any loss or claim against the CONSULTANT resulting from any of the CONSULTANT'S work.

4.4 All insurance companies affording coverage to the CONSULTANT for the purposes

of this Section shall add the City of Oceanside as "additional insured" under the designated insurance policy for all work performed under this agreement. Insurance coverage provided to the City as additional insured shall be primary insurance and other insurance maintained by the City of Oceanside, its officers, agents, and employees shall be excess only and not contributing with insurance provided pursuant to this Section.

4.5 All insurance companies affording coverage to the CONSULTANT pursuant to this agreement shall be insurance organizations admitted by the Insurance Commissioner of the State of California to transact business of insurance in the state or be rated as A-X or higher by A.M. Best.

4.6 CONSULTANT shall provide thirty (30) days written notice to the CITY should

any policy required by this Agreement be cancelled before the expiration date. For the purposes of this notice requirement, any material change in the policy prior to the expiration shall be considered a cancellation.

4.7 CONSULTANT shall provide evidence of compliance with the insurance

requirements listed above by providing, at minimum, a Certificate of Insurance and applicable endorsements, in a form satisfactory to the City Attorney, concurrently with the submittal of this Agreement.

4.8 CONSULTANT shall provide a substitute Certificate of Insurance no later than

thirty (30) days prior to the policy expiration date. Failure by the CONSULTANT to provide such a substitution and extend the policy expiration date shall be considered a default by CONSULTANT and may subject the CONSULTANT to a suspension or termination of work under the Agreement.

4.9 Maintenance of insurance by the CONSULTANT as specified in this Agreement

shall in no way be interpreted as relieving the CONSULTANT of any responsibility whatsoever and the CONSULTANT may carry, at its own expense, such additional insurance as it deems necessary.

5. PROFESSIONAL ERRORS AND OMISSIONS INSURANCE. Throughout the

duration of this Agreement and four (4) years thereafter, the CONSULTANT shall maintain professional errors and omissions insurance for work performed in connection with this Agreement in the minimum amount of Two Million Dollars ($2,000,000.00).

CONSULTANT shall provide evidence of compliance with these insurance

requirements by providing a Certificate of Insurance. 6. CONSULTANT'S INDEMNIFICATION OF CITY. To the greatest extent

allowed by law, CONSULTANT shall indemnify and hold harmless the CITY and its officers, agents and employees against all claims for damages to persons or property arising out of the negligent acts, errors or omissions or wrongful acts or conduct of the CONSULTANT, or its employees, agents, subcontractors, or others in connection with the execution of the work covered by this Agreement, except for those claims arising from the willful misconduct, sole negligence or active negligence of the CITY, its officers, agents, or employees. CONSULTANT'S

indemnification shall include any and all costs, expenses, attorneys' fees, expert fees and liability assessed against or incurred by the CITY, its officers, agents, or employees in defending against such claims or lawsuits, whether the same proceed to judgment or not. Further, CONSULTANT at its own expense shall, upon written request by the CITY, defend any such suit or action brought against the CITY, its officers, agents, or employees resulting or arising from the conduct, tortious acts or omissions of the CONSULTANT.

CONSULTANT'S indemnification of CITY shall not be limited by any prior or

subsequent declaration by the CONSULTANT. 7. COMPENSATION. CONSULTANT'S compensation for all work performed in

accordance with this Agreement, shall not exceed the total contract price of $500,000.

No work shall be performed by CONSULTANT in excess of the total contract price

without prior written approval of the CITY. CONSULTANT shall obtain approval by the CITY prior to performing any work that results in incidental expenses to CITY.

8. TIMING REQUIREMENTS. Time is of the essence in the performance of work

under this Agreement and the timing requirements shall be strictly adhered to unless otherwise modified in writing. All work shall be completed in every detail to the satisfaction of CITY by DATE (or) until such times funds are exhausted.

9. ENTIRE AGREEMENT. This Agreement comprises the entire integrated under-

standing between CITY and CONSULTANT concerning the work to be performed for this project and supersedes all prior negotiations, representations, or agreements.

10. INTERPRETATION OF THE AGREEMENT. The interpretation, validity and

enforcement of the Agreement shall be governed by and construed under the laws of the State of California. The Agreement does not limit any other rights or remedies available to CITY.

The CONSULTANT shall be responsible for complying with all local, state, and

federal laws whether or not said laws are expressly stated or referred to herein. Should any provision herein be found or deemed to be invalid, the Agreement shall

be construed as not containing such provision, and all other provisions, which are otherwise lawful, shall remain in full force and effect, and to this end the provisions of this Agreement are severable.

11. AGREEMENT MODIFICATION. This Agreement may not be modified orally

or in any manner other than by an agreement in writing signed by the parties hereto. 12. TERMINATION OF AGREEMENT. Either party may terminate this Agreement

by providing thirty (30) days written notice to the other party. If any portion of the work is terminated or abandoned by the CITY, then the CITY shall pay CONSULTANT for any work completed up to and including the date of termination or abandonment of this Agreement. The CITY shall be required to compensate CONSULTANT only for work performed in accordance with the Agreement up to and including the date of termination.

13. SIGNATURES. The individuals executing this Agreement represent and warrant

that they have the right, power, legal capacity and authority to enter into and to execute this Agreement on behalf of the respective legal entities of the CONSULTANT and the CITY.

IN WITNESS WHEREOF, the parties hereto for themselves, their heirs, executors, administrators, successors, and assigns do hereby agree to the full performance of the covenants herein contained and have caused this Professional Services Agreement to be executed by setting hereunto their signatures on the dates set forth below. 1. Firm Overview

HELIX Environmental Planning (HELIX) was established in 1991 to serve the Southern California environmental consulting market. Creative problem-solving, a strong commitment to our clients, and high-quality work products are the hallmarks of HELIX’s success. This is evidenced by a strong record of repeat clients, including three consecutive environmental consulting contracts with the City of Oceanside (City). HELIX clients are assured of direct senior-level staff involvement in both the management and document-preparation aspects of each project. HELIX has the resources necessary for, and is committed to, the provision of excellent service to the City throughout the duration of this important contract.

HELIX’s core services are California Environmental Quality Act (CEQA) and National Environmental Policy Act (NEPA) compliance, biological and cultural resources surveys and monitoring, and related technical and environmental compliance services, with an emphasis on water/wastewater/recycled water and other infrastructure projects. HELIX has successfully provided environmental consulting services to Southern California public utilities departments and water districts through more than 50 on-call/as-needed contracts. Through these and individual contracts, we have completed environmental documentation for hundreds of water/wastewater/recycled water projects, including numerous projects directly for the City. This experience encompasses a broad range of project types, including treatment plants, pump stations, reservoirs, indirect potable reuse, wells, pipelines, groundwater recharge, and water transfers.

HELIX’s staff consists of more than 150 employees, including planners and project managers specializing in CEQA/NEPA compliance and technical specialists in the fields of biology, habitat restoration, cultural resources, air quality, greenhouse gas (GHG) emissions/climate change, noise and acoustics, landscape architecture, visual impact assessment, and geographical information systems (GIS). Section 2 of this Statement of Qualifications provides a team organization chart and brief resumes for the key staff who will be available to the City under this agreement.

Based on our previous experience providing on-call environmental consulting and monitoring services to the City, we understand and are able to provide the full range of services that may be required under this contract, including the following:

Project Management and Coordination/Communications. HELIX’s project managers have demonstrated their ability to work closely with City staff and effectively manage projects on behalf of the Water Utilities Department. Our effective communications include regular phone calls, emails, and meetings with the City’s points of contact and, if applicable (and only with the City’s permission), the design engineers. These communications encompass the status of our ongoing projects, outstanding information needs, and the identification of, and suggested solutions to, issues

that could affect a project’s schedule, cost, or viability. Our key staff are experienced in preparing scopes, fee estimates, schedules, meeting notes, and invoices in the City’s preferred formats.

Quality Assurance/Quality Control. The success of HELIX’s quality assurance/quality control (QA/QC) program is demonstrated by the quality of the documents we have provided to the City under our current and previous as-needed environmental services contracts. Our approach includes making sure that we thoroughly understand the City’s expectations, assign the correct personnel to each task, and ensure senior-level review of each document prior to submittal to the City.

CEQA Documents. HELIX has prepared hundreds of CEQA documents for water, wastewater, and recycled water projects. In many cases, the City’s projects qualify for exemptions under CEQA, and HELIX has prepared 17 Notices of Exemption for Water Utilities Department projects under our on-call environmental consulting contracts. We also have extensive experience preparing Initial Study/Mitigated Negative Declarations (IS/MNDs) and Environmental Impact Reports (EIRs), as well as the full range of associated public notices and State Clearinghouse forms for water/wastewater/recycled water projects.

CEQA Plus and Substitute Environmental Documents. HELIX is knowledgeable with regard to CEQA Plus and Substitute Environmental Document requirements. This working knowledge results from our directly related experience providing CEQA Plus/environmental cross-cutting services for projects receiving Clean Water State Revolving Fund Program funding. Our understanding of CEQA Plus requirements is also aided by our experience preparing NEPA documents that require Native American outreach in compliance with Section 106 of the National Historic Preservation Act and analyses of federal Clean Air Act criteria pollutant emissions.

NEPA Documents. We have extensive experience preparing NEPA compliance documents for projects that need federal approvals or have federal funding. HELIX has prepared numerous NEPA Categorical Exclusions, Environmental Assessments, and Environmental Impact Statements. Our NEPA experience includes helping local water districts with U.S. Bureau of Reclamation WaterSMART Water and Energy Efficiency Grant environmental documentation requirements.

Biology Surveys, Analyses, and Technical Reports. HELIX has a strong biological resources practice, and we provide a full range of surveys, including general biology, focused species, and pre-construction surveys. HELIX has conducted biology surveys and prepared biological resources technical reports for the City both as stand-alone task orders and in support of CEQA documents.

Biology Monitoring. HELIX’s biologists routinely provide monitoring services to ensure that project construction activities are conducted in compliance with applicable mitigation measures and permit conditions. When requested, we develop a comprehensive list of a project’s environmental commitments, mitigation measures, and permit conditions so that both the construction management team and the biology monitors have a shared understanding of these requirements. Our biologists follow appropriate communications protocols with the construction team and prepare and submit monitoring reports in a timely manner. Some of our biologists are also Qualified Storm Water Pollution Prevention Plan (SWPPP) Practitioners (QSP), allowing HELIX to provide both biology and SWPPP monitoring at the same time.

Cultural Resources Studies and Assembly Bill (AB) 52 Native American Tribal Consultation Documentation. Our archaeologists have extensive experience with cultural resource surveys, technical reports, Native American outreach and coordination, and consultation with the State Historic Preservation Officer. We also have directly related experience supporting the City’s AB 52 consultations.

Cultural Resources Monitoring. HELIX’s archaeologists have extensive experience providing cultural resources monitoring services. We have excellent working relationships with local Native American monitors and typically include Native American monitors as subconsultants to HELIX (subject to the City’s prior approval), thereby streamlining the monitoring process for the City. Our archaeologists are adept at helping clients meet their monitoring commitments while minimizing disruptions to project construction activities.

Environmental (Air Quality/Greenhouse Gas, Noise, and Aesthetics) Technical Studies. We have modeled air pollutant and GHG emissions for a wide variety of utility and infrastructure projects and have directly related experience assessing air quality impacts within the San Diego Air Basin pursuant to San Diego County Air Pollution Control District guidelines. HELIX acoustical specialists routinely prepare noise impact studies in support of CEQA and NEPA compliance documents and also have expertise in assessing potential noise impacts to federally or state-listed wildlife (typically bird) species. HELIX also prepares visual impact assessment studies, many of which are supported by computer-generated photo-realistic visual simulations.

Mitigation Monitoring and Reporting Programs. HELIX routinely prepares Mitigation Monitoring and Reporting Programs (MMRPs) as part of our environmental services projects. In addition to documenting CEQA mitigation requirements, HELIX also often prepares mitigation monitoring plans that consolidate NEPA and/or CEQA mitigation requirements, permit requirements, and other conditions of project approval into a single plan that makes it convenient for our clients to track all of their environmental commitments.

Habitat Restoration, Monitoring, Maintenance, and Report Preparation. The HELIX team has extensive experience with, and is well-qualified to provide, habitat restoration/landscape planning services. Several of our in-house biologists have expertise in preparing and overseeing the implementation of habitat restoration plans. HELIX’s in-house landscape architect, together with our wholly owned subsidiary HELIX Environmental Construction Group, provides additional expertise in habitat restoration, including the working knowledge necessary for the design of effective and practical irrigation systems and the ability to prepare construction plans, specifications, and estimates (PS&E) suitable for public agency construction bid packages.

Clean Water Act and California Fish and Game Code Permits. HELIX has directly related experience providing regulatory permitting support for public utility infrastructure projects. We often work with our clients and their design engineers to avoid the need for permits entirely or, if that is not feasible, to help projects qualify under Nationwide Clean Water Act Section 404 permits. HELIX has an excellent understanding of U.S. Army Corps of Engineers (USACE) and California Department of Fish and Wildlife (CDFW) guidelines and procedures, as well as working relationships with many of the USACE and CDFW regulatory staff in Southern California.

Endangered Species Act Consultations and Incidental Take Permits. HELIX supports clients in Endangered Species Act Section 7 and Section 10(a) consultations with the U.S. Fish and Wildlife Service (USFWS), including the preparation of supporting studies (e.g., Biological Assessments), helping clients develop negotiation strategies, and participating in agency meetings.

Presentations. HELIX’s key staff are experienced with the full range of presentation types, from training client personnel, to staffing/leading public workshops, to giving presentations to decision-makers at public hearings. HELIX-led trainings have included a CEQA 101 training for a water district’s engineers and managers and a Vegetation Clearing/Migratory Bird Treaty Act compliance training for another water district’s operations personnel.

He is serving/has served in this role for HELIX’s current and previous two on-call environmental consulting services contracts with the City’s Water Utilities Department. 2.B Key Personnel Qualifications and Experience

Michael Schwerin Contract Manager/Principal-in-Charge Mr. Schwerin serves as HELIX’s Chief Executive Officer (CEO) and also as a Principal Planner/Senior Project Manager, and he will serve as HELIX’s contract manager for this on-call environmental services contract. As the CEO of HELIX, he is committing the full resources of the firm to ensuring that HELIX provides excellent service to the City under this agreement. His 25+ years of experience in environmental consulting in Southern California include directly related experience serving as contract manager on more than a dozen as-needed environmental services contracts for water and wastewater

districts/departments, as well as managing the environmental review process for a diverse array of water facilities projects. Mr. Schwerin is serving as the contract manager for HELIX’s current on-call environmental services contract with the Water Utilities Department and also served as contract manager for HELIX’s two previous on-call services agreements with the City. His experience also encompasses management of CEQA/NEPA documents and preparation of permit application packages pursuant to the federal Clean Water Act and California Fish & Game Code. Ms. Mila de la Roca has managed and/or authored numerous CEQA compliance documents for water and wastewater facilities, as well as serving as the contract manager or assistant contract manager for on-call environmental services agreements. She coordinates directly with client project managers and engineers, prepares scope and

fee proposals, and manages task orders/projects. 3.B Representative On-call Contract Descriptions

The following pages provide additional detail on three of the on-call environmental services contracts listed in the preceding table. These descriptions provide more detailed discussion of the services that HELIX provides and illustrate our experience with a wide range of water, wastewater, and recycled water facilities.

City of Oceanside Water Utilities Department On-call Environmental Services

HELIX is providing the City of Oceanside with on-call environmental consulting services, including preparation of CEQA documents; peer review of CEQA documents prepared

by other consultants; preparation of environmental compliance cost estimates for municipal budget purposes; and biological and cultural resources monitoring. HELIX was initially selected to provide these services on an as-needed contract issued in 2013. Upon the expiration of that contract, HELIX was selected by the City for a new agreement extending through 2017 and then selected again for our current contract, which is ongoing. Representative project types addressed under these three agreements are described below.

Lift and Pump Stations. HELIX prepared CEQA Notices of Exemption for replacement of Harbor Lift Station No. 4 and the Oceanside Municipal Golf Course Lift Station. HELIX also conducted a reconnaissance visit to the planned Oceanside Boulevard Pump Station site and provided assistance developing the CEQA scope of work for the project’s engineering and environmental services Request for Proposals.

Pipelines. HELIX has worked on a number of pipeline projects for the City. Typically, our initial effort on a pipeline project entails working with the Water Utilities Department to determine if the proposed pipeline can be statutorily or categorically exempt from detailed CEQA analysis. Often, this is the case, and HELIX has prepared Notices of Exemption for the City’s Downtown Phase 1 Sewer and Water Pipelines Improvement Project, Lake Boulevard Water Pipeline, Lake Boulevard Sewer Pipeline, St. Malo Forcemain Replacement, Buena Vista Trunkline/Haymar

Pipeline Rehabilitation, and Haymar Drive Sewer Relocation.

When the City has determined that a pipeline project does require more detailed analysis under CEQA, HELIX prepares an IS/MND, as we did for the Lotus Street Sewer Replacement Project (pictured below). In addition to preparing the CEQA compliance document for that project, HELIX also conducted protocol coastal California gnatcatcher surveys and is providing the cultural resources monitoring.

Reservoirs. A substantial portion of the City’s work on reservoir projects entails the rehabilitation of existing structures. For these projects, HELIX conducts a preliminary assessment to determine if the Categorical Exemptions for minor modification of existing facilities and/or the repair or replacement of existing facilities are applicable—usually one or both of these exemptions is applicable to these projects. Examples of this include the HELIX-prepared Notices of Exemption for the repair/ rehabilitation of the City’s Fire Mountain, Guajome, and Morro Hills reservoirs.

We have also helped the City evaluate potential new reservoir sites, and HELIX prepared an EIR Addendum addressing the potential construction of a new recycled water reservoir within the City’s El Corazon Specific Plan Area.

Major Plant Automation Upgrades Project. HELIX prepared a CEQA Notice of Exemption for upgrades to the existing automation and SCADA system at three treatment plants and 34

locations within the City’s existing water and wastewater collection and distribution system.

Mission Basin Desalting Facility Operations Building. HELIX prepared an IS/MND that addressed the construction of a new 5,250-square-foot operations building at the Mission Basin Desalting Facility and the demolition of the existing operations building. (A visual simulation of the proposed building is pictured above.) In addition to addressing on-site improvements, HELIX also evaluated the potential impacts associated with an off-site staging area and the temporary use of an alternate construction route to minimize the amount of construction traffic traversing the residential neighborhood adjacent to the plant.

Robert A. Weese Water Filtration Plant. HELIX provided a peer review of an IS/MND prepared by another consultant evaluating the planned construction of solids handling ponds at the Robert A. Weese Water Filtration Plant, a City-operated facility located in unincorporated County of San Diego. The City also retained HELIX to conduct pre-construction coastal California gnatcatcher surveys near the proposed solids handling ponds site. Under a separate task order, HELIX prepared a Notice of Exemption addressing proposed chemical facility upgrades at the plant.

North San Diego Water Reuse Coalition Regional Recycled Water Project Program EIR. The City is a member of the North San Diego Water Reuse Coalition and a CEQA Responsible Agency for the North San Diego Water Reuse Coalition Regional Recycled Water Project Program EIR. Prior to the

City’s approval of that Program EIR, HELIX prepared an EIR Addendum and a modified MMRP that better reflected the City’s interests and its role in the project. These documents were adopted by the City Council and now guide the City’s implementation of its covered recycled water projects.

Other Tasks. HELIX has responded to a wide range of other City requests, from preparing an IS/Negative Declaration for the City’s proposed plastic bag ban ordinance to conducting a biological resources assessment of a commercial development property. Not knowing what task will be next is the nature of on-call contracts, and on each occasion where the City has asked “HELIX, would you be able to…?” our answer has been “Yes.”

HELIX’s work under these agreements has given us a strong working knowledge of the Water Utilities Department’s facilities, the environmental conditions within the City, and the City’s process for preparing and approving environmental compliance documents. Our on-call work has also given HELIX directly related experience providing biology and cultural resources monitoring during construction of Water Utilities Department projects.

Padre Dam Municipal Water District As-Needed Environmental Consulting Services HELIX has provided highly responsive as-needed environmental consulting services to Padre Dam Municipal Water District since 2011. HELIX has worked closely with the district to determine the necessary scope of environmental services (e.g., reviewing to determine potential applicability of CEQA exemptions) for each project. Tasks have spanned a wide variety of the district’s needs, with representative examples described below.

Padre Dam Facilities Master Plan. The Facilities Master Plan contains a phased CIP that is guiding the implementation of potable water,

recycled water, and wastewater system improvement projects needed to meet potable and recycled water demands and wastewater flow conditions through 2020 (near term) and 2040 (long term). HELIX prepared a Program EIR for the Facilities Master Plan that analyzed a range of environmental issues, including aesthetics, air quality, biological resources, cultural resources, GHG emissions, hydrology, and noise. Where appropriate, programmatic mitigation measures were prescribed to address impacts that have the potential to have a significant adverse impact on the environment. The Program EIR has streamlined the district’s CEQA review of its CIP projects.

Eastern Service Area Secondary Connection Project. A number of the task orders that HELIX has completed were related to the selection of a new site and redesign for a pump station and reservoir. Efforts included biological and cultural resource constraints analyses, rare plant surveys, a jurisdictional delineation, an archaeological testing program, repatriation of identified cultural artifacts, Phase I hazardous

materials study, testing for asbestos and lead-based paint in structures to be demolished, a summary of environmental constraints, technical studies (biological resources, cultural resources, and noise), an IS/MND, wetland permitting, review of construction specifications, and construction monitoring.

Ray Stoyer Water Recycling Facility (WRF) Expansion Project. The Ray Stoyer WRF converts wastewater generated within the Padre Dam Municipal Water District’s service area into recycled water. This project is expanding the capacity of the Ray Stoyer WRF from 2 mgd to 6 mgd. The capacity will be increased by installing additional conventional treatment facilities, converting biological basins to nitrogen removal only, and installing a 2.2-mgd (annual average) Advanced Water Treatment Plant. The Advanced Water Treatment Plant will enable the district to send highly treated recycled water (using micro-filtration, reverse osmosis, and advanced oxidation) to a groundwater recharge and reclamation project for injection into the Santee Basin aquifer or surface discharge into Lake Jennings.

The Final IS/MND was completed one month ahead of the original schedule in order to meet requirements associated with the district’s application for state funding from the Water Quality, Supply, and Infrastructure Improvement Act (passed by Proposition 1 in November 2014), as well as State Water Resources Control Board (SWRCB) State Revolving Fund funding for the project. HELIX also prepared the environmental documentation for the SWRCB’s CEQA Plus requirements. Previously, HELIX

prepared a CEQA Notice of Exemption for construction of the Advanced Water Treatment Plant pilot project.

Siphon Sewer Assessment. HELIX staff conducted a site visit with district staff for two segments of a siphon sewer line that crosses the San Diego River and Forester Creek. Based on our review of site conditions, we provided recommendations to the district regarding surveys, reports, and permits that would likely be required in association with various maintenance and repair scenarios.

Test and Monitoring Wells in the Santee Aquifer. Prior to preparation of the task order, HELIX coordinated with district staff regarding environmental requirements associated with the proposed well drilling program. A Notice of Exemption with supporting documentation was prepared less than one week from receipt of notice to proceed. Biological and cultural resources monitoring was conducted during drilling activities (subject to several adjustments in drilling locations and schedules to reflect observed conditions during the drilling effort).

Surveys for Tree Removal. On several occasions, HELIX has provided biologists on short notice to conduct nesting bird surveys in advance of tree removal projects.

West Victoria Mitigation Assistance. HELIX prepared de minimis findings to allow removal of coastal sage scrub associated with the West Victoria Reservoir Roof and Pump Station Replacement Project. These findings documented that the project was consistent with the Endangered Species Act and resulted in resource agency acceptance of the proposed

mitigation program. The findings were prepared within eight days of receipt of the request.

Santee Lakes Restroom Demolition Project. HELIX coordinated completion of a survey for asbestos for the purposes of demolition of an existing restroom facility, which had been damaged by fire. The results report was provided within one week of the request for service.

Mountain View Connector Pipeline. HELIX prepared an Addendum to the district’s Program EIR to address a proposed potable water pipeline. The proposed pipeline would be larger and in a somewhat different alignment from what was analyzed in the Program EIR. The Addendum documented that these changes would not result in new or substantially more severe environmental impacts.

Of the 43 task orders completed for Padre Dam Municipal Water District to date, all have been completed within the allocated budget and over 90 percent have been completed under budget. HELIX has consistently ensured that our work met the district’s schedule requirements related to funding, contracting, and demolition/construction work.

Elsinore Valley Municipal Water District On-call Environmental Services HELIX is currently in the final year of a three-year contract to provide on-call environmental services to the Elsinore Valley Municipal Water District (EVMWD). Services have ranged from the preparation of CEQA compliance documents to providing biological monitoring for emergency pipeline repairs to supporting the district’s consultations with Native American tribal representatives in compliance with AB 52 requirements. Select project experience from this contract is provided below.

Old Newport Road 33-inch Pipeline Emergency Repairs. HELIX’s first task order following selection by EVMWD was to provide biological monitoring during emergency repairs to a pipeline that ruptured in an area of sensitive riparian habitat. HELIX monitored repairs, helped the contractor minimize impacts to sensitive habitat, and prepared and processed the after-the-fact permit applications on behalf of the district.

Regional Agricultural Pipeline Conversion Project. HELIX prepared an IS/MND and supporting biological resources and cultural resources technical studies for this project, which is redirecting Regional Water Reclamation Facility effluent flows from an earthen channel into an out-of-use former agricultural pipeline. In addition to assessing direct project impacts, HELIX addressed the potential effect of reduced surface flows on riparian habitat along the earthen channel and at its connection with Lake Elsinore. The project area is considered highly

sensitive by local Native American tribes, and HELIX took a leading role in EVMWD’s consultations pursuant to AB 52.

Vegetation Clearing/Migratory Bird Treaty Act Training. HELIX biologists developed and led a training for EVMWD’s personnel on avoiding conflicts with the Migratory Bird Treaty Act and other environmental protection laws during vegetation clearing activities.

Flagler Wells. HELIX provided a peer review of an IS/MND prepared for EVMWD by another firm. HELIX also handled document production and distribution on behalf of the district.

Diamond Regional Sewer Lift Station and Dual Force Mains Project. HELIX has prepared a Draft IS/MND and supporting biological resources and cultural resources technical reports for this proposed installation of a new lift station and pipelines near the Lake Elsinore Storm baseball park.

HELIX has provided highly responsive service to EVMWD under this contract. In addition to the projects described above, HELIX has prepared eight Notices of Exemption for EVMWD projects, often providing the completed notice forms within one day of being contacted by the district.
