The Chair just wishes to affirm Senator Partee's observa-

tion. This is the adoption of the Joint Resolution mandating

the Transportation Study Commission to prepare leqislation to

implement a Northeastern Illinois Mass Trapsit District. You

will recall that there was disagreement between the two Housep

about some of the wording. We have worked it out. I believe

there is understanding on it. Representative Conollyo..sena-

tor. Conolly has moved the adoption of the Conference Committee .

report. Senator Partee's observakion that the members give

attention to this matter is appropriake, and Senator Conolly

is recognized.

SENATOR CONOLLY:

Mr. President: Members of the Senate/as you remember

during the Conference Committee report concerning HB 89 where

agreemenk was vorked out to have a State subsidization of the

CTA, the commuter railroads and the downskate bus companies.

It was also agreed in this Conference Committee khat a reso-

lution be passed by b0th Houses, directing the Transportation

Study Commission to report back to the House, to the Senate,

to bokh Houses on May 15th with a bill providing for mass

transit in the Northeast region of the State of Illinois.

There was a little bit of disagreement on the wording of that

resolution and the conference committee was established once

again and khey worked ouk the agreement that basically said

such legislation shall also establish a regional transporta-

may establish a noxious weed fund and may by referendum

pass a one cent levy, establish a one cenk levy, and

impose this for the purpose of control of noxious weeds.

I hardly feel thak it is necessary to call to the attention

of the members of the Body that many of the counties are

in rather serious financial difficulties beçause of the

elimination of a vast segment of kheir income. Therefore,

this bill seeks to provide the option for those counties

who can and want to work out an agreement with the townships

ko allow the townships ko do the actual work of'the mowing

of the noxious weeds. If at any time a county does impose

by referendum, a levy for the support of their own noxious

weed program, this they have the right to do, and any county

that is in khe position to fund the activ,ity <ight now is in

no way prevented from doing that. But khe option oughk ts

be there for the counties to enter into an agreement with

the townships to allow the townships to do khis job which

historically they have done anyway. I realize Ilm not getting

across too well, Mr. President, if there are any questions,

I will attenpt to answer them. It is not mandatory, it is

permissive, it isoo.again an exercise in home rule where

the counties oughk to be in a position ko contract with

another governmental unit.

population. What the bill provides is that in any county

which may classify, khe act of classification shall be done

by the governing board, the legislative board of the county,

Which in all cases will be the County Board. It was also

amendea on the rloor to provide thqt nothlng in the act

would impair the validity of taxes imposed prior to the ef-

feckive date of the act: which shall be January 1, 1974. I

think thak the reason for the bill is fairly obvious; the

act of classification involves major policy decisions and

should be a legislative act. In most cases...in most cases

Stakute Books with what amounts to an improper approach

at go-called tax relief. NoW if youlre going to give tax

relief, puk in a bill that mandates somebody to do some-

thing. Herb's a bill that says here you...you municipali-

ties may charge less money for these licenses. Well, they

could do that now, they don't need a bill to do that. And

all...All it means is another bill on the Statutes that says

When you go home? I voted for tax relief because I said to

those persons who set the license fees in the place where

I live that they .could charge less money. And it doesn't

mean anything at all to the old people, and it's jusk really

a joke. It...ik really plays people for being ignoramuses,

to suggest to them that khis is a form of tax relief. It

just simply isnlt. Now, I don't like to be imagized asbeing aqainst kax relief and aqainst not wanting to hurt...

to help older people. I1m getting older myself. I may...

may want to benefit from some of these bills, you know,

but the fact of the matker is, it just isn't what ik pur-

ports to be and I think I have the obligation representing

stitution khis is a proper action and while khere may be

some municipalities, home rule municipalities who can at

this kime enact such legislation or take such action on

their own, there's a serious question as to whether other

municipalities which are not home rule units can. There-

fore, this action will validate and authorize the use of

this one little effort to make life a little bit more

attractive and less of a burden to those over sixty-five.

I see nothing wrong with the bill. If it is duplicatory:

so be ik. This is not the only instance, Mr. President.

I think this is a laudable measure; in fact it came to me/

from the the attorney who represents many of the munici-

palities in Lake County. No municipality has to use ik,

but they want that prerogative. May I have the absentees

trusteeship holding naked title of the land without, under

this bill, any liability for acts of his predecessors. NoW

I say to you that if he, in fact is in collusion with his#

.predecessor and has somehow committed an illegal act, he

is certainly not excused under this bill. I khink what...

what it does and the intention of it as expressed by khe

Bar Association is simply to say to a 'person if you come

in and act as trustee, you are not liable for anything that

your predecessor may have done. And I think anybody assum-

ing the role of truskee would ccrtainly want that assurance.

.This restriction is not in the public interest. The pro-

vision originally had reason because khe old Constitution

required it; and secondly there was public policy. A per-

son having a financial interest in the' product he is buying

with kax funds is poor public policy. Now with a new Con-

stitution a change can now be made because the constitu-

tional restriction was removed fron the new Constitution.

The School Code can and should be amended to serve the pub-

lic inkerest. Now: this bill simply says and it has one

amendment, no, it has no...it has no amendment. Interest

in books, apparatus or furniture, no teacher shall be ...

any book, apparatus or furniture used in any school in

ment. Unless the teacher's compensation from such sales,

Proceeds or profits is paid to the governing body of the

all this bill does, it's.o.it's a good bill, I'd appreci-

ate its passage.

Body in matters relating to alcoholic liquors. I can recall

when a...a...a...a property which was the property of the

State of Illinois, a lodge up near Wapkegan, was not permitted

ko sell alcoholic beverages because it was State property.

There just simply wasn't any way for them to compete Withfacilities of thak kind withouk selling alcoholic beverages,

and at that time we were provincial enough to insist thatl

the alcoholic beverages could only be sold if food was sold

ak the same time. Now I don't know what that meant; it

mighk mean khak you could get a fifth of booze and a can of

sardines. I don't really know. But... you had to buy food

at the same time as liquor. Now, wp are becoming more en-

liqhtened it seems to me in terms of this kind of legisla-l l

tion, and I am merely going.to support it.

example as to having this type of thing going on there

and I think the faculty members can do their drinking in

have: Senator, we even have the Ku Klux Klan today khatls
