at Room No. 709, M.S Building, Bangalore.

The Chairman welcomed the members and initiated the discussion. The following
subjects were discussed and decisions were taken as there under.
Deferred Projects:
Construction Projects:
1) "Renaissance Residences", Residential Apartment at Sy.No. 68/2A, Portion of
70/1 and 71/1, Aallasandra village, Yelahanka Hobli, Bangalore North Taluk,
Bangalore by M/s Renaissance Real asset Developers India LLP (SEIAA 2 CON
2012)
It is a proposal for construction of Residential Apartments of 285 Units with 3 Basement
+ Ground floor + 14 Upper floors + Terrace and a Club House with Basement + Ground floor +
3 Upper floors on an area of 22,662.34 Sq.m (5 Acres 24 Guntas) and the total built up area is
95,809.85 Sq.m. The total water requirement is 308 KLD and the investment is of Rs. 174.15crores. The total parking provided is for 679 cars.
Project Details: (a) Land: Total plot area: 22,662.34 Sqm; Total built up area:
95,809.85 Sqm. The project consists of 285 residential units with 3 Basement + G + 14 UF and
Club House with B+G+3UF. (b) Greenery: Landscape area: 6061.27 Sqm (35.60% of plot area).
The project site has 26 trees out of which 14 trees will be cut after obtaining permission fromBBMP/Forest Department and 12 trees will be transplanted. (c) Water Requirement: Total water
requirement is 308 KLD; Source of water: BWSSB. (d) Soil: Total excavated soil:
12,500Cum; Backfilling Quantity: 4,000 Cum, landscaping quantity: 5,000 Cum within theproject site and about 3,500 cum will be used for hardscaping within the project. (e) Sewage:
Total quantity generated: 247 KLD, treated in proposed STP of design capacity 275 KLD;
Sludge generated: - 99 Kg/day used as manure. (f) Solid Waste: Total generated: 911 Kg/day;Organic waste: 545Kg/day treated in organic converter and product used as manure. Inorganic
waste: 364Kg/day will be sent for recycling. (g) Power Requirement: Total Requirement: 1138
kW from BESCOM; Power Backup: 2X500 KVA DG sets (h) Parking: 679 Numbers.

The subject was discussed in the SEAC meeting held on 10th February 2012. The
proponent present explained the project. The proponent informed that a nallah drain runsoutside the boundary of the project site and 15 m buffer is left. The Committee advised the
proponent to develop a buffer zone for greenery and also plant fruit bearing trees in the
landscape proposed. The proponent also informed that the source of water is BWS&SB andUGD facilities are existing. There are 2 borewells in the site. The proponent informed that the
project site is well connected to BIAL road (BIAL Hebbal) and Yelahanka road (Yelahanka
BIAL road). The existing projected & modified LoS of BIAL road is B-D-C and the same forYelahanka road is B-D-C.
After deliberation, the Committee decided to recommend the proposal to SEIAA for
issue of environmental clearance after obtaining the social commitment plan for Rs. 12 Lakhs,as committed by the proponent.
The proponent has submitted the information vide letter dated 01.03.2012.
The Authority perused the information submitted by the proponent and took note of the
recommendation of the SEAC during the meeting held on 05.04.2012.
The Authority perused the information submitted by the proponent and took note of therecommendation of the SEAC. The Authority observed that width of the road (ROW) in relation
to the height of the building is not forthcoming with details.
The Authority after discussion, decided to get the following information for further
consideration:
(a) Information with regard to maximum height of the building in relation to width of theroad as per O.M. dated 7 th February 2012 issued by the Ministry of Environment and
Forests.
(b) NOC from Fire and Emergency Services Department.(c) Distance from the nearest fire station duly depicting it on the map.
(d) Plan for increasing the greenbelt to at least 33%.
(e) Details of existing drain abutting to project site and offset/greenery proposed towards
drain.(f) Revised social commitment plan with activity, budget and time frame.
The Authority also decided to invite the proponent.
The proponent has submitted the information vide letter dated 02.05.2012, received on
22.05.2012. The proponent has been invited to the meeting.
The Authority perused the information furnished by the proponent. The proponentappeared before the Authority and briefly explained about the project.
The proponent submitted that the total height of the building is 45 meter and the existingroad which is 12 meters wide is going to be widened to 18 meters as approved in the RMP 2015.
The proponent further submitted that an area of 5640.23 sq. m is being relinquished for the
proposed road widening.2

The proponent submitted a copy of NOC issued by BWS & SB for supply of water andNOC issued by the Fire and Emergency Service Department.
The proponent informed the Authority that the company is committed for environmentsafety and they have proposed to adopt the best practices for energy conservation, water
conservation, and waste management. They have availed precertification for Gold rating fromLEED for the proposed project.
While replying with regard to measures proposed for abatement of noise pollution on the
project due to vicinity to the railway track, the proponent submitted that the proposed
apartments will be at a total distance of 35 meters from the railway track, a buffer of 15 metersis provided from the compound which is going to be developed with thick tree growth.
The Authority suggested that the natural hydrology of the area should be maintainedunaltered and all the necessary actions should be ensured to prevent possible pollution of
Allalasandra Lake. The Authority while noting that the modified traffic scenario in the area is
C&D opined that care should be taken to reduce impact on traffic due to the project. The
Authority suggested left in left out to be strictly followed.
The Authority after discussion, decided to clear the proposal for issue of environmental
clearance subject to submission of the following information.
a. Documentary evidences with regard to relinquishment of land for the proposed road
widening.
b. Copy of official correspondence for LEED Certification.
c. Commitment with regard to providing in house facility for convenient shopping to meet
the daily requirement of the residents.
d. Commitment with regard to reserving the clubhouse facility only for the residents.
2) Bagmane Phoenix and Taurus, Office Building (Commercial Complex) at Sy. No.
39/6, 42/1, 42/2 and 42/3 Doddenekundi village, K.R. Puram Hobli, Bangalore
East Taluk by M/s Bagmane Estates Pvt. Ltd. (SEIAA 5 CON 2012)
It is a proposal for construction of Office Building comprising Block-1 with OneBasement + Lower Ground + Ground Floor + First Floor + 12 Upper Floors and Block 2 with

Lower Basement + Upper Basement + Lower Ground + Ground Floor + First Floor + 12 Upper
Floors on an area of 24,865.27 Sq. m and the total built up area is 1,29,642.04 Sq. m. The total
water requirement is 500 KLD and the investment is of Rs. 191.55 crores. The total parkingprovided is for 1594 cars.
Project Details: (a) Land: Total plot area: 27,305.77 Sqm; Total built up area: 1,32,540.49
Sqm. The project consists of 2 blocks with 2B+LG+G+12 UF. (b) Greenery: Landscape area:9,067.13 Sqm (6298.21 Sqm on land & 2,768.92 Sqm on podium) (33% of plot area). (c) Water
Requirement: Total water requirement is 500 KLD; Source of water: BWS&SB. (d) Soil: Total
excavated soil: 197450 Cum; (e) Sewage: Total quantity generated: 400 KLD, treated inproposed STP of design capacity 400 KLD; Sludge generated: 20 Kg/day used as manure. (f)
Solid Waste: Total generated: 1580 Kg/day; Organic waste: 632 Kg/day treated in bio converter
and product used as manure. Inorganic waste: 948 Kg/day will be sent for recycling. (g) PowerRequirement: Total Requirement: 8971.414 KVA from BESCOM; Power Backup: 6X 1500
KVA DG sets (h) Parking: 1594 Numbers.
Project Surrounding Details: Bannerghatta National Park 25 km. Other Details: RainWater Harvesting is proposed. NOC from BWS&SB not submitted. Land conversion letter from
DC submitted.
The subject was discussed in the SEAC meeting held on 10 th February 2012. Theproponent present explained the project. The proponent informed that the Mahadevapura Lake is
700 m and Doddanekundi Lake is 800 m away from the project site. The proponent informed
that there is an external drain of BBMP outside the property. The project site is connected byORR which connects KR Puram on one site and Marathahalli on the other side. The project is
also connected to Ferns City road which is connected to ORR. The existing, projected and
modified LoS for ORR is C-D-D (road towards KR Puram) and D->F->F (road towardsMarathahalli). The same for road towards Ferns City is A-A-C.
After deliberation, the Committee decided to recommend the proposal to SEIAA for issue
of environmental clearance after obtaining the following information from the proponent with acondition to leave appropriate buffer for the external drain as per the MoEF norms.
1. Revised land-use pattern showing percentage of greenery on natural ground.
2. Drainage pattern details with contour plan.3. Dated peak hour traffic density photographs.
4. Social commitment plan for Rs. 19 Lakhs, as committed by the proponent.
The proponent has submitted the information vide letter dated 25.02.2012.
The Authority during the meeting held on 05.04.2012, perused the information submitted
by the proponent and took note of the recommendation of the SEAC. The Authority noted that
NOC from the BWS&SB and in respect of fire safety is not submitted. The traffic scenarioreveals that it is CDD and DFF. Mahadevapura and Doddanekkundi lakes are located at a
distance of 700 meters and 800 meters respectively. The information with regard to complianceof the O.M. dated 7th February 2012 also is not forthcoming.
The Authority therefore decided to get the following information for further
consideration of the proposal:
(a) Copy of NOC from the Fire and Emergency Services Department

(b) Copy of NOC from the BWS&SB.
(c) Proposal to ensure that the nearest lakes are not polluted due to project activity.
(d) Information with regard to maximum height of the building in relation to width of theroad as per O.M. dated 7th February 2012 issued by the Ministry of Environment and
Forests.
The Authority also decided to invite the proponent to the meeting.
The proponent has submitted the information vide letter dated 30.05.2012. The proponent has
been invited to the meeting.
The Authority perused the information furnished by the proponent. The proponent
appeared before the Authority and briefly explained about the project.
The proponent submitted a copy of the NOC issued by the BWS&SB. He submitted that
application has been submitted to Fire and Emergency Service department for the NOC and it is
being pursued.
While responding to the impact on Lakes, the proponent submitted that MahadevapuraLake is at a distance of 700 meters from the project site in the upstream and therefore no impact
is anticipated. The Doddanekkundi Lake is at the down stream at a distance of 800 meters and is
separated by outer ring road. The proponent further submitted that lot of development havealready taken place in between these two Lakes and the project site. Therefore not much of
impact is anticipated on the Lakes due to this project activities.
While replying to the ROW of the road, the proponent submitted that the project site is at
a distance of 53 meters from the outer ring road on the cross road, and emphasized that ringroad meets the RoW criteria.
The proponent further submitted that they have planned to avail Gold Certification from
LEED.
The Authority after discussion, decided to clear the proposal for issue of environmental
clearance subject to submission of the following information.
a. Details of the High Flood Level (HFL) of the near by Lakes and the level basement to
ensure that the basement is above the HFL of the Lakes.
b. Water balance for the non-rainy season.
c. Details of Green Belt Development with tree cover.

d. CSR with time frame, budget and activities.
3) Construction of New Laboratory Complex (NLC) at NCBS Campus, GKVK,
Bellary Road, Bangalore by M/s National Centre for Biological Sciences (SEIAA
124 CON 2011)It is a proposal for construction of New Laboratory Complex with Basement + Ground
floor + 3 upper floors (built up area-21,270 Sq.m.) and sport cum dinning complex with
basement + ground floor + 1 upper floor (1445 Sqm Built up area) on an area of 80967 Sq.m
and the total built up area of 22,715 Sq.m The total water requirement is 150 KLD and theinvestment is Rs.80 crores. NCBS, TIFR comes under the aegis of Department of Atomic
Energy, Government of India.
Project Details: (a) Land: Total plot area: 80,967 Sqm; Total built up area: 21,270 Sqm;The project consists of new laboratory complex with basement + ground floor + 3 upper floors
and sport cum dinning complex with basement + ground floor + 1 upper floor. (b) Landscape
area: 68,988 Sqm. (c) Water Requirement: Total water requirement is 253 KLD for existing andproposed facilities. Sourced from BWSSB. (d) Soil: Total excavated soil: 39,964 Cum. 4,000Cum will be used for backfilling and landscape development. The balance 35,964 Cum will be
used for filling up low laying areas in the GKVK campus (e) Sewage: Total quantity generated:
135 KLD treated in the existing STP of design capacity of 200 KLD. (f) Solid waste: Totalgenerated: 400 Kg/day; organic waste will be treated in organic converter. Inorganic waste of
will be sent for recycling; sludge- 20 Kg/day will be used as manure. (g) Power Requirement:
Total Requirement: 41 KW from BESCOM; Power Backup 2X500 KVA DG sets.
Other details: Rain Water Harvesting proposed. CFE for expansion issued by KSPCB on
4.01.2011. Authorization for hazardous waste and biomedical waste handling is also obtainedfrom KSPCB on 22.09.2011 and 30.01.2010 respectively.
The subject was placed in the 75 th SEAC meeting held on 14/15.10.2011 and the subject
was deferred since the circulation material was not received by some of the members and alsothe project proponent remained absent without prior intimation in response to the meeting notice
sent.
The subject was discussed in the SEAC meeting held on 6 th January 2012. The proponentpresent explained the project. The proponent informed that the laboratory complex is in
advanced stage of construction and they have come for environmental clearance after KSPCB
served notice to them. Out of 21,270 Sqm built up area 19,864 Sqm is taken up already. The
Committee observed that this as a case of violation of the provision of EIA Notification, 2006.The proponent informed that the radiation exposure in R&D will be taken care of by BARC. The
proponent informed that human biological research such as stemcell and brain cell and noclinical activities are done in the R&D facility. He informed that no additional water fromBWS&SB is required as the existing stored water is sufficient for meeting expansion
requirement.
The SEAC considered this proposal as a construction project only and observed that theproject proponent has to obtain the necessary approvals from the competent authorities for R&D
activities.

After deliberation, the Committee decided to recommend the proposal to SEIAA for issue
of environmental clearance after obtaining the following information from the proponent with a
condition that the project proponents shall obtain necessary clearances from the competentauthorities.
1. NOC from BWS&SB.
2. Plan for disposal of excess excavated earth along with MoU.3. Calculation for energy savings.
The proponent has submitted the information vide letter dated 06.02.2012.
The Authority perused the information submitted by the proponent and took note of the
recommendation of the SEAC during the meeting held on 08.03.2012.
The Authority observed that it is a case of violation of the provisions of EIA Notification,2006. An area of 19,864 Sqm is already reported to have been built.
The Authority therefore decided to get the following information, for further
consideration of the proposal:
(a) Explanation as to why action should not be initiated for starting the construction activitywithout Environmental Clearance required as per EIA Notification, 2006
(b) Submission of resolution of the Board of Directors as required under the OfficialMemorandum No.J-11013/41/2006-IA.II(I) dated 16th November 2010 issued by
Ministry of Environment and Forests, Government of India.
(c) Plan for disposal of excess excavated earth with details and present land use of the siteproposed to be used for disposal of the excess excavated earth.
(d) NOC / sanction letter from the BWS&SB for supply of 3 lakh litres of required water.
(e) Clarification as to whether the proposed site falls in the GKVK Biodiversity HeritageSite.
(f) Quantification and characteristics of wastes that would be generated in the proposed
activity.(g) Proposal for safe disposal of waste including plan to contain radioactive contamination.
The proponent has submitted the information on 10.04.2012.
The Authority perused the information submitted by the proponent during the meeting
held on 09.05.2012.
The Authority noted that the project has already been taken up and is in completion stageand the reason provided for taking the work without prior Environmental Clearance is
unacceptable. The Authority after discussion, decided to consider the proposal after the receipt
of information with regard to whether the construction activity started with plan sanctioned for
an area of less than 20,000 Sqm if any.The Authority also decided to invite the proponent to the meeting.
The proponent has submitted the information. The proponent has been invited to the
meeting.
The Authority perused the information furnished by the proponent.

The proponent remained absent. The Authority observed that the resolution of the board
of directors does not spell out the reason for undertaking the construction activity without prior
Environment Clearance (EC).
The Authority opined that the concern expressed by the Authority vide letter dated16/5/2012 has not been satisfactorily addressed. The Authority after discussion decided to
provide one more opportunity to the proponent for furnishing the required information forfurther consideration. The Authority also decided to invite the proponent to the next meeting.
4) "Sobha Classic & Classic Premium" (Earlier Classic & Signature), Residential
Apartment at Sy.No.3/1B, 3/2, 7 & 162, Haralur Village, Varthur Hobli,
Bangalore South Taluk by M/s Sobha Developers Ltd. (SEIAA 36 CON 2012)
It is a proposal for Modification of Residential Apartments from 234 units to 363 units
with 2 blocks A & B. Block A consists Basement, Ground floor and 13 upper floors and Block B
consists Basement, Ground floor and 17 upper floors on an area of 28,110.4 Sq.m and with thetotal built up area of 75997.74 Sq.m. The total water requirement is 384.03 KLD and the
investment is of Rs.114.56 crores. Total parking provided is for 420 cars.
The project proponent had obtained Environmental Clearance from SEIAA vide file No.
SEIAA 39 CON 2010 dated: 19.11.2010 for Modification and expansion of residential apartment
from 234 units to 281 units in the name of Sobha Classic & Signature on a plot area of 28,110.42Sqm and built up area of 76,078.47 Sqm. The proposed building consists of 281 units in 2 blocks
A & B. Block A consists Basement, Ground floor and 13 upper floors and Block B consists
Basement, Ground floor and 16 upper floors.
Now the PP has again applied for Environmental Clearance with following further
modification:
Present Project Details: (a) Land: Total plot area: 28,110.42 Sqm; Total built up area:
75,997.74 Sqm. The proposed residential building consists of 363 units in 2 blocks (Sobha
Classic & Classic Premium). Sobha Classic consists of Basement, Ground floor and 13 upperfloors (with 243 units) and Classic Premium consists of Basement, Ground floor and 17 upper
floors (with 120 units). (b) Greenery: Landscape area: 6493.35 Sqm (23.09% of plot area). (c)
Water Requirement: Total water requirement is 384.03 KLD; Source of water: BWSSB. (d)Soil: Total excavated soil: 47547 Cum; Backfilling Quantity: 29004.72 Cum, and landscaping
quantity: 1948 Cum within the project site (entire soil shall be reused within the site). (e)
Sewage: Total quantity generated: 345.62 KLD, treated in proposed STP of design capacity 350
KLD; Sludge generated: 75 Kg/day used as manure. (f) Solid Waste: Total generated: 1016.55Kg/day; Organic waste: 609.93Kg/day treated in organic waste converter and product used as
manure. Inorganic waste: 406.62 Kg/day will be sent for recycling. (g) Power Requirement:
Total Requirement: 3191 KVA from BESCOM; Power Backup: 2X500 KVA & 2X 750 KVADG sets (h) Parking: 420 Numbers.
Project Surrounding Details: Haralur Lake 0.1Kms, Other Details: Rain Water
Harvesting is proposed.

The subject was discussed in the SEAC meeting held on 17.03.2012. The proponent and
environmental consultant present explained the project. The proponent informed that the height
of the building is 55 m and the road width (RoW) is 12.1 m. The Committee observed that therevised proposal does not comply with the provisions of the O.M. issued by MoEF, GoI on
7.2.2012 stipulating guidelines on high-rise building. The Committee noted that the proponent
had already been issued environmental clearance to his earlier revised proposal and the changewith respect to the present modified proposal is only internal. Of the 2 blocks, one block is
already constructed (Block A). The other block is increased by one floor. The total built up area
is decreased from 76,078.47 Sqm to 75,997.74 Sqm. The number of units is increased by 82. Inview of the above fact the Committee considered the present modified proposal and decided to
recommend the proposal to SEIAA for issue of environmental clearance after obtaining the
following from the project proponent:
1. Road width (RoW) in front of the project site, height of the building, distance to the
nearest fire station and NOC from Disaster Management Authority.
The proponent has submitted the information vide letter dated 05.04.2012.
The Authority in the meeting held on 09.05.2012, perused the information submitted by theproponent and took note of the recommendation of the SEAC.
The Authority noted that the proposed modification involves increasing the height of the
building that has already been cleared by the Authority by adding one more floor. But the proposal
does not meet the requirement of the height criteria provided in the guidelines issued by the Ministryof Environment and Forests, Government of India vide O.M. dated 7th February 2012.
The Authority after discussion decided to get the following information for further
consideration:(a) Conformity to the guidelines issued by the Ministry of Environment and Forests,
Government of India vide O.M. dated 7th February 2012 in respect of height of the
building, road width (Row) and distance from the nearest fire station.
(b) Revised specific social commitment plan with budget, activity and time frame.
The Authority also decided to invite the proponent to the meeting.
The proponent has submitted the information vide letter dated 02.06.2012. The
proponent has been invited to the meeting.
The Authority perused the information furnished by the proponent. The proponentappeared before the Authority and briefly explained about the project.
The proponent informed the Authority that it is a proposal seeking revised Environment
Clearance for expansion of the project that has been given Environment Clearance by thisAuthority vide letter No. SEIAA 39 CON 2010 dated 19/11/2010. The project was earlier clearedfor 281 units in two blocks of 13 & 16 Upper floors with a maximum height of 61.25 meters.
Now it is proposed to construct 363 units in two blocks of 13 & 17 upper floors with a maximum
height of 56.25 meters. Even though an additional floor is added in the B block there isdecrease in overall height as the height of individual unit have been reduced from 3.4 meters to
2.95 meters. The proponent further added that the modification is warranted due to change in
the market demand.9

The proponent submitted that the OM dated 7/2/2012 should not be made applicable tothis project, as it has been cleared much earlier to the issuance of OM.
The Authority after discussion, decided to clear the proposal for issue of environmental
clearance subject to submission of the revised social commitment plan with activity and timeframe.
5) Expansion of St. John's Medical College Hospital Campus, C.B.C.I. Society for
Medical Education, St. Johns National Academy of Health Sciences at
Koramangala Ward No. 67, Bangalore East Taluk, Bangalore by C.B.C.I.
Society for Medical Education (SEIAA 21 CON 2011)
It is a proposal for expansion of St. John's Medical College Hospital with 5 buildingnamely 1) College of Nursing with Ground + 1 Floors 2) Nursing residences with Ground + 4
Floors 3) Seminar Hall with Ground + 2 Floors 4) PG, Paramedics and Ladies residences with
Ground + 4 Floors 5) Unit of hope with Ground+4 Floors on an area of 6,976.79 Sq.m andwith the total built up area of 22,536.47 Sq.m. The total existing site area of the hospital is
2,52,575.13 Sqm and total built up area of the hospital after expansion will be 1,32,829.73 Sqm.
The total water requirement is 800 KLD and the investment is of Rs.22.54 crores.
Project details: Total site area: 6,976.79 Sq.m; Total Built up area: 22,536.47 Sqm;

Nursing residences, 3) Seminar Hall, 4) PG, Paramedics and Ladies residences, 5) Unit of hope;
Water Requirement: 100 KLD from BWSSB; Sewage: proposed 500 KLD capacity STP;
Power Requirement: 100 KVA; Solid Waste: 250 Kg/day collected and given to BBMP fordisposal; Biomedical waste of 10 Kg/day approx) shall be collected and sent to M/s. MaradiEcotherm for disposal; Other details: Rain water harvesting plan not submitted; the project is in
construction stage.
The subject was appraised in the SEAC meeting held on 20.08.2011.The proponent andenvironmental consultant present explained the project. The proponent informed that the
expansion is coming up in the existing campus and out of 5 buildings proposed, 3 buildings are
already completed and the construction of remaining 2 buildings is under progress. TheCommittee observed that this as a violation of the EIA Notification, 2006. The proponent
informed that it is proposed to install one more 500 KLD capacity STP in addition to the existing
500 KLD STP. UGD for the project exists.After deliberation, the Committee decided to recommend the proposal to SEIAA for
issue of environmental clearance after obtaining the following information from the proponent
with a condition that the proponent should pre-treat the laboratory and operation theatre waste.1. Existing and proposed land use details.
2. MoU from the M/s. Maradi Ecotherm for disposal of biomedical waste.
3. Water balance chart for both rainy season and non rainy season.

The Authority after discussion, decided to get the following information for further

b) Present status of construction with latest photograph with date.c) MOU entered for disposal of Biomedical Waste.

While replying to the query as to why the construction was undertaken without prior
Environmental Clearance, the proponent submitted that they were given to understand that the
Environmental Clearance is essential only when the building exceeds 20,000 Sqm Built uparea. Application has been submitted to the Authority when they were advised that environment
clearance is essential for total Built up area and not for individual buildings. Therefore, the
commencement of the work was due to misunderstanding of the provision and not a willfulviolation.
The proponent informed that the project require a total of 225.6 lakh liters water of
which 150 lakh liter is met from BWS&SB and 75.6 lakh liters is from existing 12 bore wells.
The Authority opined that abstraction of ground water should be undertaken only with theCentral Ground Water Authority and after a scientific assessment of judicious abstraction. The
proponent informed that the institute got a study conducted by the Indian Institute of Science for
undertaking scientific rain water harvesting.
The Authority opined that the proponent should increase the percentage of recycle and
reuse of water for non potable purposes. The proponent informed that no treated waste water is
let out from the premises as they have a total area of around 100 Acres with more than 3000
trees in the campus. Therefore, the excess treated water is being used for maintenance ofgreenery. The Authority opined to reuse the treated water as tree growth does not require daily
watering.
The Authority after discussion opined that the reply furnished with regard to reason for
undertaking construction without prior Environmental Clearance is at variance from that whichhas already been submitted.
After discussion, the Authority decided to get the following information for further
consideration:a) Revised reply and written justification/ clarification with regard to the reasons for
undertaking construction without prior Environmental Clearance with copies of
approved plan for all the structures.b) Resolution of the Board of Directors as required under the Official Memorandum
No.J-11013/41/2006-IA.II(I) dated 16th November 2010 issued by Ministry of
Environment and Forests, Government of India.c) Brief note with salient aspects of the study conducted by the IISc for effective rain
water harvesting and improved ground water recharge.
d) Present status of construction with latest photographs of each of the building.
e) Permission for ground water abstraction from Central Ground Water Authority.
The Authority also decided to invite the proponent to the meeting.

It is a proposal for construction of Data Centre with Ground floor (Stilt) + 6 Upper floorson an area of 16,371 Sq.m and the total built up area is 57,166.02 Sq.m The total water
requirement is 90 KLD and the investment is of Rs. 100 crores. The total parking provided is for316 cars.
Project Details: (a) Land: Total plot area: 16,371.0 Sqm; Total built up area: 57,166.02
Sqm. The project consists of Ground Floor (Stilt) + Ground + 6 Upper Floors (b) Greenery:
Landscape area: 2,652.10 Sqm (16.1 % of plot area). (c) Water Requirement: Total waterrequirement is 90 KLD; Source of water: KIADB. (d) Soil: Total excavated soil: 14,940.30
cum; Backfilling Quantity: 5,229.0 Cum and landscaping quantity: 2,241.01 Cum within the

The subject was discussed in the SEAC meeting held on 27th & 28th April 2012. The
proponent and environmental consultant present explained the project. The proponent informed
that the height of the building is 28 m and the RoW in front of the project site is 15 m. Thenearest fire station is 8 km away from the project site. The proponent informed that the project
site is allotted to him from KIADB. The earlier owner of the project site before the allotment had
already constructed the existing building without obtaining clearance as per EIA Notification,2006. The Committee observed that this is a violation of the provisions of the EIA Notification,
2006. The Committee suggested the proponent to increase the landscape area. The proponent
informed that there is no space to develop green belt and hence he may be allowed to take up
compensatory afforestation in the nearby schools/parks/civic amenities area etc.
The project proponent informed that the project is located along approach which connects
Whitefield road. The Whitefield road connects ITPL on one side and Hoodi on the other side.The existing, projected and modified LoS of Whitefield road is B-D-D (road towards ITPL road)
and B-C-C (road towards Hoodi) and the same for approach road is A-B-B.
After deliberation, the Committee decided to recommend the proposal to SEIAA for issueof environmental clearance after obtaining the following information from the proponent.
1. Letter from KIADB for water supply to the project.
2. Social commitment plan for Rs. 20 Lakhs, as committed during the meeting(letter not given)

The Authority perused the information submitted by the proponent and took note of therecommendation of the SEAC during the meeting held on 01.06.2012.
The Authority observed that SEAC has made a note that the construction activity hasstarted in this case and this is a case of violation of the provisions of EIA Notification, 2006. The
Authority also observed that the proponent have produced a copy of the plan approved by
KIADB on 15.01.2006 for a built up area of 18,554.81 Sqm.
The Authority after discussion decided to get the following information for further
consideration of the proposal:
(a) Present status of construction with area built up and latest photographs of the project site.(b) Clarification as to why the action should not be initiated for the violation in case the area
already built is more than 20,000 Sqm.
The Authority also decided to invite the proponent to the meeting.
The proponent has submitted the information vide letter dated 19.06.2012. The
proponent has been invited to the meeting.
The Authority perused the information furnished by the proponent. The proponent
appeared before the Authority and briefly explained about the project.
The proponent informed that construction was undertaken as per the plan approved byKIADB for a built up area of 18,543.81 Sqm on 05.11.2005. The proponent submitted a copy of
the approved plan for perusal of the Authority. The proponent further informed that the plan
has been revised for a built up area of 57,166.02 Sqm and the revised plan has been approvedby KIADB on 15.01.2006. However, due to administrative reasons the expansion programme
is undertaken now and since the total built up area exceeds 20,000 Sqm they have submitted
application to the Authority for Environmental Clearance. The proponent clarified that thepresent construction does not exceed 20,000 Sqm and therefore it should not be construed as a
violation.
The Authority after discussion, decided to clear the proposal for issue of Environmental
Clearance subject to submission of the following information:
(a) Submission of resolution of the Board of Directors as required under the OfficialMemorandum No.J-11013/41/2006-IA.II(I) dated 16th November 2010 issued by Ministryof Environment and Forests, Government of India delineating the reasons for
undertaking the construction work without the prior Environmental Clearance.

built up area is 39,826.56 Sq.m. The total water requirement is 110 KLD and the investment is
of Rs. 58.81 crores. The total parking provided is for 251 cars.

The subject was discussed in the SEAC meeting held on 10 th February 2012. The
proponent present explained the project. The proponent informed that the UGD facilities areexisting and NOC is obtained from BWS&SB. The proposed site is located off Sarjapur -
Electronic City road (Kudlu main road). The existing, projected and modified LoS for Kudlu
Main road is A-A-B. However, the Committee requested the proponent to submit revised traffic
management studies based on the realistic growth rate of vehicles.
After deliberation, the Committee decided to recommend the proposal to SEIAA for
issue of environmental clearance after obtaining the following information from the proponentand with a condition that the excess treated water should be left to the UGD only.
1. Enhanced power savings.
2. Revised traffic management studies.

The above proposals seeking Environmental Clearance for silica sand mining wereconsidered by SEAC during the meeting held on 27.04.2012. Abstract of the proceedings of the
said meeting is as below:
"The subject was placed in the 74 th SEAC meeting held on 16 th and 17th September 2011.The Secretary, SEAC informed the committee that the above 5 proposals have been placed
before the committee for discussion and explained in detail the process of silica sand mining in
coastal/river areas. He informed the Committee that the silica sand mining is banned in CRZ

areas as per the CRZ Notification but may be allowed in non- CRZ areas provided the mining
lease area is clearly demarcated by one of the identified agency by the Government of India. The
Regional Director (Environment), Udupi, who was invited to attend this meeting to give hisopinion explained the silica sand mining pertaining to ML 2203,2460,2461,2437 and 2485. He
submitted to the Committee that the mining boundaries of the lease area have not been
demarcated on the field; the IBM map prepared and got sanctioned by the Mines and GeologyDepartment during 1990 is inconsistent and has not taken HTL in consideration as per the
approved CZMP map; survey numbers shown in IBM plan and CZMP maps are inconsistent; the
cadastral maps survey numbers do not tally with the IBM survey numbers; unless the boundariesare demarcated in the field, it is difficult to ascertain the exact mining area on the basis of IBM
maps. Further, he informed that there is no silica sand in the mining lease area.
The Committee was surprised to know that there is no silica sand in the mining area leasedout by Department of Mines and Geology. The Committee observed that the ground reality
situation needs to be verified thoroughly and get the mining area jointly inspected by the
officials from Mines & Geology Dept and Regional Director (Environment), Udupi. Dr.
Sriniketan, Member, SEAC, was also requested to accompany the joint inspection team. Thecommittee also felt the need for periodical monitoring of silica sand mining in coastal areas by
the concerned Regional Director (Environment).
After deliberation, the Committee decided to consider these subjects in the SEAC along
with the site inspection report as above and also decided to call the officials from Mines andGeology Department for the SEAC for discussion.
Accordingly the proponent was informed to make arrangements for the field visit of the
subcommittee vide this office letter dated 29.09.2011.
The subject was placed in the 76th SEAC meeting held on 11 th November 2011. The
Chairman, SEAC informed that during the 74th
SEAC meeting while discussing similar cases theCommittee had observed that the ground reality situation of the silica sand mining area needsto be verified thoroughly and get the mining area jointly inspected by the officials from Mines &
Geology Dept, Dr. Sriniketan, Member, SEAC and Regional Director (Environment), Udupi.
After deliberation, the Committee decided to consider the above project also (SEIAA 8
MIN 2011) in the SEAC meeting along with the site inspection report and also to call the
officials from Mines and Geology Department for the SEAC for discussion based on the reportof Regional Director (Env), Udupi dated: 02.11.2011. The Committee also decided to write to all
the concerned project proponents to get their project site boundary demarcated by one of the
authorized agency as per the MoEF, GoI Notification. It was also decided to write to the
Director, Mines & Geology Department to cooperate and send a representative for jointinspection as well as for SEAC for discussion.
Accordingly the proponent was requested to get the project site boundary demarcated byone of the authorized agency identified by the MoEF, GoI Notification. The proponent was also
requested to get the project jointly inspected by the subcommittee vide this office letter dated 24.

The subject was placed again in the 80th SEAC meeting held on 17.03.2012. The
Committee discussed in detail the above listed files (including SEIAA 1 MIN 2011 & SEIAA 2
MIN 2011) that were appraised in the previous SEAC meetings and the project proponents havebeen requested to get their mining area demarcated by an authorized agency identified by the
MoEF, Govt. of India. The Committee noted that the project proponents have not so far
submitted the demarcated maps of their area proposed for mining in spite of reminders. TheCommittee decided that these files may be recommended for closure to SEIAA since the project
proponents have failed to submit the required information.
The committee perused the proceedings of the 50 th SEIAA meeting held on 05.04.2012
which was circulated to the members and the same is reproduced below:

by the officials from Mines and Geology Department, Dr. G. Srinikethan, Member, SEAC andRegional Director (Env), Udupi in the following proposals:
In the meanwhile the Committee also has decided to close the above files during themeeting held on 17th March 2012 for the reason that the proponent have not submitted the
demarcated maps of the area proposed for mining and recommended to the Authority for closure.
Whereas, the representation of M/s Bharat Minerals and Trading Corporation and M/sMangalore Mineral Traders reveals that the site inspection has been done on 17 th February 2012,
the details submitted by the proponent have been verified by the Regional Director (Env) and
the same has been forwarded to the Special Director, Department of Ecology and Environment.
The Authority observed that, when such being the case the proposals need to be appraised
by the SEAC considering the information submitted as above and recommendation deemed fitneeds to be submitted to the Authority.
The Authority therefore decided to send the above said proposals back to SEAC for
appraising these proposals in the light of the aforesaid observation and sending recommendationas deemed fit.
The Secretary, SEAC informed the members that the joint inspection report from theRegional Director (Environment), Udupi dated 22.03.2012 was received by SEAC & SEIAA in
April 2012 after the 80th SEAC meeting held on 17.03.2012 wherein the proposals were
recommended for closure for want of required documents. He also informed the Committee thatthe joint inspection report is a letter signed by the Regional Director (Env), Udupi only. A copy
of the this letter was also circulated to the members and the same is reproduced below:

With reference to the above said subject, I would like to bring to your kind notice, that the
sub committee consisting of Dr. G. Srinikethan, Member SEAC, representative of department of
Mines and Geology and the under signed along with the staff have jointly inspected the saidmining lease areas and accordingly had instructed the proponents to submit action taken report to
this office for further needful action. The proponents have submitted action taken report during
the first week of March 2012 to this office and details pertaining to each of the leases werecirculated vide mail to Dr. G. Srinikethan and Senior geologist, department of mines and
geology, Udupi. They have agreed upon the below given report and the same is sent for further
needful action at your end:-
1) Mining lease no: 2437: Thekkatte village: Kundapura Taluk, Udupi District.
The proponent has submitted the Mining lease area superimposed on CRZ map and has
indicated that out of total M.L. area sanctioned i.e. 12.34 Ha net Mining area of 7.92 Ha isavailable for subsequent mining. They also indicate in the letter presented to this office the
modus operandi about calculating the area and mineral deposit there under. Further the
proponent has given an undertaking through affidavit that an extent of area of 0.79Ha.in
Sy.no.354 which is CRZ-I zone will not be disturbed for mining operation and the same will beprotected by barbed wire fencing. The village accountant, Thekkatte village, Kundapura Taluk
has indicated the boundaries of the said mining lease area, photographs pertaining to the M.L.boundary towards CRZ area which were fixed in the presence of village accountant are
submitted for reference. They have also submitted Google map of the mining lease area. Hence
with above said facts are placed for further needful action.
2) Mining lease no:2485 : Kumbashi Village: Kundapura Taluk, Udupi District
The proponent has submitted the Mining lease area superimposed on CRZ map and has
indicated that out of total M.L. area sanctioned i.e. 10.15 Ha, net Mining area of 3.24 Ha isavailable for subsequent mining. They also indicate in the letter presented to this office the
modus operandi about calculating the area and mineral deposit there under. Further the
proponent has given an undertaking through affidavit that an extent of area of 0.25Ha.inSy.no.247 which is in CRZ-III zone will not be disturbed for mining operation and the same will
be protected by barbed wire fencing. The village accountant, Kumbhashi village, Kundapura
Taluk has indicated the boundaries of the said mining lease area, photographs pertaining to theM.L. boundary towards CRZ, area which were fixed in the presence of village accountant are
submitted for reference. They have also submitted Google map of the mining lease area. Hence

mining lease areas with photographs pertaining to the M.L. boundary towards CRZ area whichwere fixed in the presence of village accountants are submitted for reference. They have also
submitted Google map of the mining lease area. Hence the above said facts are placed for further
needful action.
4) Mining lease no: 2461: Hejamadi Village: Udupi Taluk, Udupi District
The proponent has submitted the Mining lease area superimposed on CRZ map and hasindicated that out of total M.L. area sanctioned i.e. 42.57 Ha net Mining area of 6.6Ha is
available for subsequent mining. They also indicate in the letter presented to this office the
modus operandi about calculating the area and mineral deposits there under. Further the
proponent has given an undertaking through affidavit that an extent of area of 0.17Ha, 0.78Ha,1.38Ha and 0.78Ha respectively in sy.no 49, 151, 152 and 154 which are in CRZ-III zone and
will not be disturbed for mining operations and the same will be protected by barbed wire
fencing. The village accountant, Hejamadi village, Udupi Taluk has indicated the boundaries of
the said mining lease area. Photographs pertaining to the M.L boundary towards CRZ area whichwere fixed in the presence of village accountant are submitted for reference. They have also
submitted Google map of the mining lease area. Hence the above said facts are placed of furtherneedful action.
5) Mining Lease no: 2203: Kottathattu Village: Udupi Taluk, Udupi DistrictThe proponent has submitted the Mining lease area superimposed on CRZ map and has
indicated that out of total M.L. area sanctioned i.e.32.44 Ha, net Mining area of 13.46Ha is
available for subsequent mining. They also indicate in the letter presented to this office the
modus operandi about calculating the area and deposit there under. Further the proponent hasgiven an undertaking through affidavit that an extent of area of 0.04 Ha in sy.no 13 and 14,
0.16Ha in sy.nos. 22, 23 and 24, 1.04Ha in sy.nos. 135, 137, 138 and 139, 0.06Ha in sy. nos. 146
and 147, 0.04 Ha in sy.no. 151, which are in CRZ-III zone will not be disturbed for miningoperations and the same will be protected by barbed wire fencing. The village accountant,
Kotathattu, Udupi Taluk has indicated the boundaries of the said mining lease area. Photographs
pertaining to the M.L. boundary towards CRZ area which were fixed in the presence of villageaccountant are submitted for reference. They have also submitted Google map of the mining
lease area. Hence the above said facts are placed for further needful action.
The Committee in the meeting held on 27.04.2012, discussed in detail the joint inspection
report as well as the information submitted by the project proponent to the Regional Director
(Env), Udupi. The Secretary, SEAC informed the committee that the project proponent have notsubmitted the project site boundaries identified by an authorized agency identified by the MoEF,
GoI as per the decision taken in the 80 th SEAC meeting held on 17.03.2012 but they havesubmitted the report of M/s. Metamorphosis consultants based on the superimposition of the
CRZ map and the village map of the project area (M.L. area) along with GPS reading. Thecommittee noted that the proponent have submitted an affidavit stating that the area falling
within the CRZ zone will not be disturbed by mining operation and will be protected with proper
fencing by barbed wire. The Secretary, SEAC informed the Committee that the proponents havesubmitted the photographs of the boundary pillars/survey numbers signed by the village
accountant only.20

The Committee after deliberation decided to recommend the above listed files for SEIAAfor environmental clearance with the condition that the project proponents have to confine their
mining activities only in the non-CRZ area."
The Authority perused the proposals and took note of the recommendation of the SEAC
during the meeting held on 01.06.2012.
The Authority opined that in view of the fact that some of the area falling in CRZ havebeen suggested to be deleted from the mining plan. It is therefore necessary to have a revised
mining plan with estimate of reserve in the non CRZ area available for mining without affecting
the local environment. The Authority therefore decided to get the following information for
further consideration of the proposals:
(a) Leasewise map / mining sketch of the non CRZ area available for mining duly marking it
on the local level CRZ map.(b) Revised estimate carried out by a technical person in accordance with the law of mineral
deposit in the non CRZ area.(c) Revised mining plan for the non CRZ area available for mining.
The Authority also decided to invite the proponents.
The proponents have furnished the information vide letter dated 30.06.2012. Theproponents have been invited to the meeting.
The Authority perused the information furnished by the proponent. The proponentsappeared before the Authority and briefly explained about the project.
The proponents submitted that the sub-committee of the SEAC visited the spot and after
verifying the details of the lease area and super imposing the same on the local level CRZ mapsuggested that the area falling in CRZ should be excluded from the mining area as mining of
sand is a prohibited activity as per CRZ Notification, 1991/2011. The proponents submitted
M.L.wise lease area excluding the CRZ area. The proponents also submitted that they do notundertake mining in the areas in and around hutments, agriculture/ horticulture fields, even
though it contains sand availability.
The Authority perused the information with regard to ore reserve as per the IBMapproved plan, balance ore available, available mining lease period, the proposed production
rate and decided the sustainable quantity of sand that can be extracted in each of the mining
lease. The details are as under:

the project site is 9 m and there is no cutting and natural slop will be retained. They haveobtained NOC from BWS&SB on 21.04.2012 and a copy of the same was given to the
Committee. The project proponent informed that the project is located off Sonnenahalli
Dommasandra road which is the approach road for the project site. The existing, projected and
modified LoS of this road is A-B-A.
After deliberation, the Committee decided to recommend the proposal to SEIAA for issueof environmental clearance after obtaining the following information from the proponent.
1. Explore the possibility of enhanced energy savings.2. Rainwater collection details.

issue of environmental clearance after obtaining the following information from the proponent.

of EIA Notification, 2006 under category-B requiring EC from SEIAA. Total project cost isRs.93.54 Crores. Project comes under BBMP limits. The project site is a vacant land and no trees
are found within the project site.

side and Hope farm Circle on the other side. The existing, projected and modified LoS of thisroad is B-C-B.
After deliberation, the Committee decided to recommend the proposal to SEIAA for issueof environmental clearance after obtaining the Social commitment plan for Rs. 9 Lakhs, as

fire station is 3 km away from the project site. The committee observed that the project does notcomply with the provisions of the O.M. dated 07.02.2012 decided to give 30 days time to the
project proponent to submit revised proposal (if he is willing, otherwise the proposal can be
recommended to SEIAA for closure) in Form 1 & 1A.

The PP vide letter dated 17.05.2012 has stated that KIADB in its letter no.
KIADB/15869/2030 / 2012-13 dated 16.05.2012 has informed that the existing 13m road will bewidened to 15m, out of the land allotted in their favour , the adjacent land allotted in favour of
Sri. Munireddy, and the land which has been acquired & held by the Board. Further the
proponent has submitted revised proposal in Form 1 & 1A along with EMP and STP report on
24.05.2012. The following are the changes made in the revised proposal:a. Project Cost: Rs. 215 Crores.
b. Total water requirement: 234.75 KLD (Fresh water: 141.4 KLD and recycled water:

dated 24.05.2012). The proponent informed that the nearest water body is bellandur Lake and is 1
km from the project site.
After deliberation, the Committee decided to recommend the proposal to SEIAA for issue
of environmental clearance after obtaining the following information from the proponent:
1. Enhanced landscape plan with more number of local flower and fruit bearing trees.
2. Enhanced energy saving.
3. Dated peak hour traffic density photographs.4. Social commitment plan for Rs. 10 Lakhs, as committed by the proponent during the

. The subject was discussed in the SEAC meeting held on 28th April 2012The proponentand environmental consultant present explained the project. The proponent informed that the
height of the building is 44.25 m and the RoW in front of the project site is 26 m. The nearest
fire station is 4.5 km away from the project site. The project site is located near to ChennasandraMain road which connects Chennasandra Village on one side and Bangalore City (Hope Farm)
on the other side. The existing, projected and modified LoS of this road remains at A. The
proponent informed that he has obtained NOC from BWS&SB on 08.11.2011.
After deliberation, the Committee decided to recommend the proposal to SEIAA for issue
of environmental clearance after obtaining the following information from the proponent:
1. Excess earth disposal details along with MoU.2. Explore the possibility to enhance the energy savings.
3. Details of revised landscape plan.
4. Breakup details of water requirement for different activities in the project.
5. Rework on water balance chart.6. Contour map.
7. Social commitment plan for Rs. 4 Lakhs, as committed by the proponent during themeeting (letter not given)
The proponent has submitted the information vide letter dated 16.05.2012.

The Authority perused the reply submitted by the proponent and took note of the
recommendation of the SEAC.
The Authority after discussion decided to clear the proposal for issue of Environmental
Clearance subject to submission of the following information:
(a) Authentic document with regard to RoW of the approach road.(b) Plan to increase greenery to at least 33%.
