Why Justice Dalveer Bhandari'selection to the International Court ofJustice while serving as a judge ofthe Supreme Court of India is an

unhealthy developmentJustice Dalveer Bhandari, a judge of the Supreme Courtof India, was elected a fortnight ago by the United NationsGeneral Assembly and Security Council, to serve as aMember of the International Court of Justice (ICJ). Hedefeated the Filipino nominee, Justice Florentino Feliciano,by a handsome margin and now has a six-year first termat the World Court. Justice Bhandari is undoubtedly a finejudge with considerable expertise in international law. Hislegal acumen, keen intellect and a sense of justice, espe-cially for the poor and homeless that shines through in hisdomestic judgments, are qualities that make him an idealrepresentative of India, itself a beacon of democracy andhuman rights in the developing world. That India has madea good choice is not in doubt; whether it could have madea better choice, as some have suggested, is contestablethough ultimately a moot point. The key issue that arisesin this context relates to the fact that Justice Bhandari'snomination by the Government of India and eventual elec-tion to the ICJ took place while he continued to serve as ajudge of the Supreme Court of India. This raises graveand disturbing issues regarding the independence of thejudiciary in India and points to the lowered standards ofpropriety in the highest echelons of governance.The independence of the judiciary is a significant legal prin-ciple in India, ever since it was held to be part of the basicstructure of the Constitution. Since then it has been usedon several occasions by the Supreme Court most notablyto judicially lay down norms regarding the appointment ofjudges, transfer of judges between High Courts and ad-ministratively with regard to claiming exemption for theoffice of the Chief Justice of India from the purview of theRight to Information Act and formulating an internal codeof conduct for appropriate judicial behaviour. The exten-sive (and sometimes unwarranted) usage of judicial inde-pendence as a legal principle has however blighted itsprimary status as a normative principle of good governancewhich promotes impartiality, a key facet of fair adjudica-tion. The judiciary must not only be independent of the co-ordinate wings of government as well as the parties be-fore the case, but must also be seen to be so. The slight-est doubt in the public mind of excessive proximity be-tween the judiciary and the government, which is the larg-est litigant before it, may lead to significant apprehensionsof a lack of impartiality thereby questioning the legitimacyof the entire adjudicatory setup. As the Supreme Court ofIndia itself likes repeating in its judgments, “Judges, likeCaesar's wife, must be above suspicion.”It is this test of judicial independence as a normative prin-ciple that Justice Bhandari's actions fail to satisfy. Fromavailable records, Justice Bhandari's candidacy was ac-cepted by the Ministry of External Affairs after a recom-mendation to this effect in January 2012 by the IndianChapter of the Permanent Council of Arbitration, whoseadvice in this matter, the government has traditionallyhonoured. From that time, up to the election at the UnitedNations in April, Justice Bhandari continued as a servingSupreme Court judge, hearing cases (from the SupremeCourt causelist record, he heard cases till the 9th of April)and being party to delivered judgments (the last recordedjudgment thus far being delivered on the 27th of April,authored by Justice Dipak Misra, his brother Judge on theBench).

675 students appear for Common Law Admission Test in HyderabadHYDERABAD: A total of 675 candidates appeared for the Common Law Admission Test (CLAT) held in the city on Sunday. While 650candidates appeared for the under-graduate level, the remaining appeared for the post-graduate entrance examination. Mumbai, For the first time since the November 2008 Mumbai terror attack, a cricket team from Pakistan could be invitedto play in a tournament in India. A working committee meeting of the BCCI approved a proposal in Chennai yesterday toextend an invitation to Pakistan’s domestic T20 winners, Sialkot Stallions, for the Champions League tournament inIndia in October. BCCI vice-president and Minister of State for Parliamentary Affairs Rajeev Shukla said that extendingthe invitation was subject to approval of the Centre. Since 26/11, bilateral cricket ties between India and Pakistan havebeen suspended. The only time the two countries have played each other on Indian soil was when Pakistan lost to Indiain the semifinal of the World Cup in Mohali last year. However, that was an International Cricket Council (ICC) event.
