Purpose & Background

• Design-Build Project Delivery– Emerging delivery system in public sector– Single source of responsibility

• Faster, less contentious delivery• Not necessarily cheaper

• Landfill– Historic landfill cell began in early 1950s– New, lined landfill cell began in late 1990s– Landfill gas migration discovered in 2001

• March 2001 monitoring– High concentrations of Lfg at property boundary– >1,000 feet beyond property boundary

• May 2001– Issued engineering RFP– Informed state agency & neighbors

• Too little time for traditional design-bid-build• 2-part contract

– Several form contracts– AGC, AIA, EJCDC– DBIA is fairest to all parties– 2-Part form contract includes:

• Terms & Conditions• Scope• Price & Schedule

• Firm, fixed price based on bids• Drilling subcontractor• Equipment supplier• Balance of construction contractor

– Documents Belong to Owner• Negotiate with Part I contractor• Bid the work• Cancel the project

• Part II– Final Design– Construction, Start-up & Warantee– Firm schedule based on WES commitments

• Contract (part II) signed on September 27• Completion planned for December 14

– “Best Value” Selection
