    Introduction

    This Guide is a summary of parts of the Nunavut Elections Act - lawsto elect Members of the Legislative Assembly. Candidates must useand follow this Guide, but it does not replace the laws.

    This Guide has information about who can and can not be acandidate. It shows what candidates must do, and when and howthey must do it during the pre-election, election, and post electionperiods. It includes samples of the main forms that candidates use.

    The Guide has information about general elections and by-elections.Most of the laws are the same for both. The Guide clearly showswhere the laws are different for a by-election.

    Candidate:An eligible voter who wants to be a Member of theLegislative Assembly (MLA), and who files a declaration of

    candidacy that Elections Nunavut accepts.

    Chief Electoral Officer (CEO): The CEO is in charge of ElectionsNunavut. The Commissioner of Nunavut appoints thisperson to oversee the Nunavut Elections Act. ElectionsNunavut is all the people responsible to organize and carryout territorial elections.

    Close of candidacy: 2pm local time, 31 days before Election Day.

    Constituency: A geographic area and the people who livethere. Nunavut has 19 constituencies. The people in eachconstituency elect a Member of the Legislative Assembly.

    Contribution: Any money, goods, and / or services a person orbusiness gives to help elect a candidate.

    Counterfoil: The numbered tab on a ballot. The Deputy ReturningOfficer rips it off just before the ballot goes in the ballot box.

    Declaration:A formal or legal statement a person makes tosay something is true or they intend to do something. Ifyou break this promise its the same as breaking the law.Declaration is similar to affirm, oath, or swear.

    Declaration of candidacy: The form a person fills out to say theywant to be a candidate - they want a chance to be elected asa Member of the Legislative Assembly (MLA). They must beeligible and give a $200 deposit. The financial agent must alsosign this document.

    Deputy Returning Officer (DRO): The election officer in chargeof a polling station. A DRO makes sure voters and candidatesfollow the law in the polling station. They give out the ballotsand count them.

    Elect: To choose a person by voting. During a territorial electionwe elect our Members of the Legislative Assembly (MLAs).

    Election: The election of members to the Nunavut LegislativeAssembly. In a territorial election voters mark a secret ballotto choose a candidate to be a Member of the LegislativeAssembly (MLA). This Guide does not apply to otherelections, like municipal elections or elections to Inuitorganizations.

    Election expense: Any money paid or owed during an electionperiod, as part of a candidates campaign. Includes any goods

    and services people contribute, and any costs of thefi

    nancialagent and campaign manager.

    Elections Nunavut: The office and staff of the Chief ElectoralOfficer. These people run and organize territorial elections.

    Election Officer: A person who helps to run a territorial election.Election Officers include Returning Officers, AssistantReturning Officers, Deputy Returning Officers, Poll Clerks,and Registration Clerks.

    Election period: A 35-day period that starts with the writ and endswith Election Day; the official time for the election.

    Election report: Shows how many votes each candidate got.The Returning Officer (RO) fills it out afer they review theElection Day statements of the poll. The RO can delay theelection report for up to two weeks afer Election Day, ifneeded.

    Emergency method: A way to vote by radio or satellite phone ifyoure in a remote place and meet three strict conditions: 1)you cant get to a polling station on Election Day; 2) you cantcommunicate any other way; 3) you had no other way tovote before you went to the remote place. You must contactElections Nunavut to organize to vote this way.

    Final voters list: This list includes all the voters that were onthe list when the election started, plus those who registered

    during the election period. It comes out af

    er Election Day.

    Financial agent: The person who handles all the moneyfor a candidates campaign. The financial agent takescontributions, pays all the expenses, and helps the candidatemake a financial report afer the election. The candidateappoints the financial agent; they both sign the declaration ofcandidacy.

    Financial return: The official report of the campaigns election

    contributions and expenses, required under the NunavutElections Act. The candidate and financial agent complete thereport, sign it, and make a declaration that the information istrue.

    General election: An election for all of the 19 constituencies.

    Judicial recount: A judge of the Nunavut Court of Justice countsall the ballots for a constituency again. This happens if twocandidates have the same number of votes or almost the same

    number within 2% of each other. See the Nunavut ElectionsAct for other ways a recount can happen.

    Legislative Assembly: The people we elect to form the Governmentof Nunavut and make laws for Nunavut. The LegislativeAssembly has 19 members.

    Members of the Legislative Assembly (MLAs): The people whoget elected during a territorial election; the people who formthe Government of Nunavut.

    Mobile poll: A way to vote if you physically cant get out to vote.The poll comes to you.

    Notice of Election: Shows the name and contact information foreach candidate in a constituency, and their financial agent and

    campaign manager. The Chief Electoral Offi

    cer sends out theelection notice 30 days before Election Day.

    Nunavut Elections Act: The laws that Nunavummiut use toorganize and run a territorial election.

    Oath: A formal, legal promise that something is true; a promise todo something. Election officers take an oath to be impartialin their job; elected candidates take an oath as MLAs. Oath issimilar to affirm, declaration, or swear.

    Poll Clerk: An election officer who works at a polling station withthe Deputy Returning Officer. Poll Clerks look afer thepolling record.

    Polling record: A list of everyone who voted at a polling station,any changes to the voters list, and notes about everything thathappens during voting.

    Polling station: The place we go to vote.

    Pre-election expense: A campaign expense that the candidatepays for during the pre-election period.

    Pre-election period: Starts the day the Commissioner publiclyannounces the date of the next election; ends the day the CEOissues the writ.

    Proxy vote: A voter gets another voter to vote for them. You applyto the Returning Officer to get a proxy certificate. You can

    only vote by proxy if: 1) You are on the voters list; 2) Youresuddenly called away from your community; 3) You cant voteany other way.

    RENU: An electronic voters list for Nunavut; stands for Register forElections in NUnavut.

    Returning Officer (RO): The election officer in charge of aconstituency. ROs appoint Assistant Returning Officers,Deputy Returning Officers, Poll Clerks, and RegistrationClerks for each poll. ROs oversee everything about theelection in their constituency.

    Special ballot: A way to vote by mail if youre away at school, onvacation, in hospital, at a treatment centre, or in jail. Othervoters can use a special ballot if they need or want to. Voters

    must apply to Elections Nunavut to get a special ballot. Theyreceive a package, follow the directions, and mail the ballotback in a special envelope.

    Stub: The numbered part of the ballot that stays with the book ofballots. When the DRO tears each ballot from the book, thestub stays in the book.

    Swear: A formal, religious promise that something is true; apromise to do something; the most serious promise you

    can make. If you break this promise its like breaking thelaw. A person gives their word and swears on the Bible thatsomething is true. Swear is similar to affirm, declaration, oroath.

    Vote: Voters mark a secret ballot in a territorial election. Theychoose the candidate in their constituency that they want toelect as their Member of the Legislative Assembly (MLA).

    Voters list: The list of voters that Elections Nunavut prepares

    for each constituency. They send a copy to each candidatewhen the election period starts, and update it 20 days beforeElection Day.

    Writ: The official notice to say there is an election. The ChiefElectoral Officer (CEO) sends it to each Returning Officer

    (RO). Each RO posts the writ in their offi

    ce.The return of the writ is the backside of the writ. It showswho won the election. The RO fills it out and sends it to theCEO afer Election Day. If a candidate wins by acclamationthe RO fills out the return of the writ right away.

    1) The Candidate

    What is a candidate?

    A candidate is a person whose declaration of candidacy is acceptedaccording to the rules in the Nunavut Elections Act. A candidate isa person who wants to be a Member of the Nunavut LegislativeAssembly, to represent the people in their constituency.

    Who can be a candidate?You can be a candidate if:

    Youre eligible to vote on Election Day. AND

    You are not disqualified.

    You can be a candidate in any Nunavut constituency, not just the oneyou live in, if you are eligible and not disqualified.

    Youre eligible to vote if you are:A Canadian citizen.

    18 years or older on Election Day. AND

    A Nunavut resident for at least one year on Election Day.

    By-election: A resident in the constituency when ElectionsNunavut issues the writ. Only constituency residents canvote in a by-election.

    Youre not eligible to vote if:

    You have a court order that says you dont understandyour actions - you cant decide things for yourself. OR

    You broke the laws under the Criminal Code and youre ina place for people with mental illness. OR

    You broke an election law somewhere in Canada in the lastfive years, and were convicted.

    The election doesnt count if you get elected and youre not eligibleto be a candidate. You can be a candidate in only one constituency.

    A candidate cant sign anything that, if you won, would:

    Make you resign your seat in the Legislative Assembly ifsomeone asked you. OR

    Be like an undated resignation from the LegislativeAssembly. OR

    Prevent you from acting freely in the Legislative Assembly.

    Check with your employer to see if they have any rules or policiesyou must follow about being a candidate in a territorial election. Forexample, you may have to take a leave of absence from your workduring the election period.

    Many employers such as the Government of Nunavut have rules orpolicies about how employees participate in political activities andelection campaigns.

    Who cant be a candidate?

    You cant be a candidate if, on the day you file your declaration ofcandidacy you:

    Were a candidate or a financial agent in the last electionand didnt file the campaign financial return on time.

    Work for Elections Nunavut.

    Did not take a leave of absence if you work for theGovernment of Nunavut.

    Are a member of the House of Commons, Senate, orlegislature of another territory or province.

    Are a judge, except in a citizenship court.

    Are in jail and still in jail afer Election Day.

    Did not follow a compliance agreement from the last

    election.

    A member of the Legislative Assembly may leave their seat becausetheyre charged with or convicted of a crime under Nunavut orCanadian laws. This person can be a candidate again only five yearsafer the constituency elects someone else to take their place.

    What happens if a candidate dies?

    If a candidate dies afer the deadline for declarations of candidacyand before the polls close on Election Day:

    The election is cancelled in that constituency. AND

    A new election process begins for that constituency.

    Elections Nunavut destroys all the old ballots if they call a newelection.

    What does elected by acclamation mean?

    Elected by acclamation means there is only one candidate and theywin the election with no voting. This can happen two differentways:

    Only one person files a declaration of candidacy thatElections Nunavut accepted. OR

    A second candidate changed their mind and removedtheir name before the deadline - 5:00 pm local time 31 days

    before Election Day.

    People have no one to vote for. The one candidate becomes the MLAfor the constituency. The Returning Officer sends them a copy of theelection return.

    What happens if a candidate changes their mind?

    A candidate must write to their Returning Offi

    cer if they changetheir mind and decide they dont want to be a candidate. They mustwrite a leter, sign it, and deliver it by 5:00 pm local time, 31 days

    before Election Day to make it official - and to remove their namefrom the ballot. Two voters from the constituency must take an oathand sign the leter too. The candidate does not get their $200 deposit

    back.

    If a candidate withdraws by the deadline and there is only one othercandidate, the other candidate wins by acclamation. If there is more

    than one other candidate, the election proceeds as normal. But theballot does not include the name of the candidate that withdrew.

    A candidate can withdraw afer the deadline but their name stays onthe ballot - even if they send the Returning Officer a signed leter.

    In what order are candidates names on theballot?

    Candidates names are in alphabetical order on the ballot. If twocandidates have the same first and last name, the Chief ElectoralOfficer uses their other names to tell them apart.

    At each polling station, Elections Nunavut puts up a poster thatshows a ballot with the candidates pictures beside their names. Theposter helps voters know who theyre voting for.

    When the candidate files the declaration of candidacy, they may

    choose to provide Elections Nunavut with a digital photo to useon the poster. The photo must meet certain standards, or ElectionsNunavut wont use it. The candidate decides whether or not toprovide the photo. The poster shows a blank space beside thecandidates name if Elections Nunavut has no photo.

    2) Financial Agent and

    Campaign Manager

    Who is your financial agent?

    Each candidate MUST appoint a financial agent. Choose a financialagent before you fill out the declaration of candidacy.

    The financial agent is responsible for all campaign finances -contributions and expenses. The candidate appoints a financialagent to manage the campaigns financial and reporting needs underthe Nunavut Elections Act. Choose someone who is good at thosethings.

    The financial agent must be a Nunavut resident. The financial agentcan not be:

    A candidate.

    An election officer, someone that works for ElectionsNunavut.

    A Government of Nunavut employee.

    A business, unless its an accounting business in Nunavut.

    Anyone else can be your financial agent, including a relative. Besure the person checks with their employer to see if they need tofollow any rules or policies before they take on the job as yourfinancial agent.

    What happens if the financial agent leaves theirjob?

    If the financial agent leaves their job for any reason the candidateMUST get another financial agent right away. Fill out the formAppoint a New Financial Agent and send it right away to the RO.

    To leave their job as financial agent, the candidate must revoke orcancel their appointment. Put in writing the reasons the financialagent lef their job, and include the date their duties ended.

    Make sure the formerfinancial agent gives everything related totheir job over to the new financial agent. This includes bank accountinformation, tax receipts, contributions, receipts for expenses, paidand unpaid bills - everything related to campaign finances; and anyother campaign information they have.

    Make sure the newfinancial agent:

    Has a copy of the Guide for Financial Agents.

    Changes the signing authority on the campaign account.

    Has a copy of the form you sent to the RO, to show theynow have the authority and responsibility.

    Who is your campaign manager?

    The law does not say that you must have a campaign manager,but its a good idea. You need someone to manage your campaign.

    Choose a campaign manager early - if possible before you fill out thedeclaration of candidacy.

    The campaign manager organizes and coordinates things such as:

    Butons, brochures, and signs.

    Ads for TV, radio, and the newspaper.

    Candidate website.

    Door-to-door canvassing and other campaign activities.

    Candidate travel to communities in the constituency, ifneeded.

    Volunteers to help with the campaign.

    Candidate representatives to oversee each polling stationon Election Day.

    Passing out Elections Nunavut brochures about differentways people can vote.

    Choose a campaign manager who is good at these things. Be surethe person checks with their employer to see if they need to followany rules or policies before they take on the job as your campaignmanager.

    If you dont have a campaign manager, the financial agent may haveto take on these duties. And they may not have the time or be the

    best person for this work.

    What happens if the campaign manager leavestheir job?

    If the campaign manager leaves their job for any reason, you mustgive the Returning Officer writen notice right away that they lef.

    To leave their job as campaign manager, the candidate mustrevoke or cancel their appointment. Put in writing the reasons thecampaign manager lef their job, and include the date their dutiesended.

    If you decide to NOT appoint a new campaign manager, fill out thefirst part of the form Appoint a New Campaign Manager to tell theRO that the campaign manager lef their job. Use the second part ofthe form if you decide to appoint a new campaign manager.

    If you started your campaign without a campaign manager and laterdecide you want to appoint one, you can use this form for that too.

    If the campaign manager leaves their job, make sure they giveeverything related to the campaign over to the new campaignmanager; or to you or the financial agent if you didnt appoint a newcampaign manager.

    3) Declaration of

    Candidacy

    What is a declaration of candidacy?

    The declaration of candidacy is the form you MUST fill out to sayyou want to become a candidate, and to appoint your financialagent.

    You need the following information to fill out the declaration ofcandidacy form:

    The candidates full name and contact information.

    The financial agents full name and contact information.

    Voters to sign and witness your signature and the financialagents signature. You and the financial agent cant witnessany signature.

    The campaign managers name and contact information, ifyou have one.

    You become a candidate if Elections Nunavut accepts the declarationof candidacy; you are not a candidate if Elections Nunavut rejects it.

    What information about the candidate do youneed for the declaration of candidacy?

    You need the following information about the candidate for thedeclaration of candidacy:

    Full name - no titles, degrees, or prefixes. Include anickname if you want.

    Home address - mailing address and street address.

    Phone numbers at home and at work.

    Fax number and email address, if you have one.

    Write your name on the declaration of candidacy the exact wayyou want it to be on the ballot. Write it in two different languages ifthats how you want it on the ballot. Elections Nunavut uses exactlythe name you write on your declaration of candidacy.

    For example, if you write your name in Inuktitut syllabics first andEnglish second, or English first and Inuktitut second thats how itwill be on the ballot. If you write your name in just English or justInuktitut syllabics, thats how it will be on the ballot.

    The candidate signs the declaration and takes an oath. A voterwitness also signs. The candidate cant witness any signature; thefi

    nancial agent cant witness the candidates signature.

    What information about the financial agent do youneed for the declaration of candidacy?

    You need the following information about the financial agent for thedeclaration of candidacy:

    Full name.

    Home address - mailing and street address.Phone numbers at home and at work.

    When candidates and financial agents needinformation or help, who do they turn to?

    Once you get the package, you deal only with Elections NunavutCEO office in Rankin Inlet for all campaign issues and questions.This includes all financial issues and questions. See contactinformation at the front of this Guide. And participate in ElectionsNunavut teleconference calls for financial agents.

    You can expect only certain things from the Returning Officer inyour contituency, such as:

    Notices.

    Copies of the voters list for the constituency.

    The list of voters who voted in the early polls.

    The election report.

    What happens if the RO rejects a declaration ofcandidacy?

    The Returning Officer rejects your declaration of candidacy if you:Did not pay the $200 deposit.

    Did not fill out the form properly and have no time beforethe deadline to correct it.

    Filed afer the deadline.

    Filed a declaration of candidacy in more than oneconstituency. If you did this you cant be a candidate inany constituency.

    Are not eligible because you:Are a member of the House of Commons, Senate, or

    legislature of a province or another territory.

    Are a judge of any court, except a citizenship court.

    Are a staff person or election officer with ElectionsNunavut.

    What happens if the RO accepts a declaration ofcandidacy, but gives official Notice?

    The RO may suspect you are not eligible to be a candidate on othergrounds that only the CEO can decide. If this happens they acceptthe declaration, but send you an official Notice to say why theythink youre not eligible. The Notice also goes to the CEO who mustreview the information and decide.

    If you think you are still eliglble, you must immediately tell the CEOwhy - in person, in writing, or by phone - and provide evidence tosupport your case. The CEO decides within two days of the close of

    candidacy and sends you a Notice about their decision.

    If you disagree with the CEOs decision, you can apply to the court,within seven days, to have a judge review the decision. The judgehears the case and makes a decision as soon as possible.

    The election continues without the person as a candidate, unless thecourt decides that the person is eligible and orders a new election.

    4) Money Matters

    You need money to run an election campaign - to pay for thingssuch as brochures, butons, signs, ads on TV or radio, and travel todifferent communities in your constituency.

    The financial agent manages all campaign finances. They accept allthe contributions and pay all the expenses - NOT the candidate. Allmoney related to the campaign belongs to the campaign - NOT tothe candidate or the financial agent.

    What is a campaign budget?

    A campaign budget shows the total contributions you expectto receive and how you plan to spend the money. It includescontributions of goods and services.

    A budget is very helpful. The candidate, financial agent, andcampaign manager use it to understand how much money the

    campaign needs - to pay for campaign expenses. It helps thecampaign team set priorities and to not spend more money thanthey can raise through contributions.

    To write up a budget you need to work with the financial agentand the campaign manager, to plan the campaign. As you plan thecampaign you can identify what things cost money and how muchthey cost. For example:

    Will the campaign distribute butons? How many?

    Will the campaign put up signs or posters? What size?How many?

    Will the campaign produce one or more brochures? Willthey be colour printed or black and white? How many?

    Does the candidate need to travel to other communities? Ifyes, how ofen and for how long?

    What is a campaign contribution?

    Campaign contributions can be money, goods, and / or services.Money contributions may be cash or a cheque. Goods and servicescontributions include things such as office space, airline tickets,services to design and print a brochure, or food for a gathering.

    Money contributions can be named contributions or anonymouscontributions. Any contribution over $100 MUST be a namedcontribution.

    A person, business, or group can give up to $100 as an anonymous

    contribution. If the campaign receives an anonymous contributionworth more than $100, the financial agent has to give it back if theyknow who its from. Or they must give the money to the ChiefElectoral Officer, if they dont know who its from, and it becomesgovernment money.

    The financial agent can collect anonymous contributions frompeople that atend a meeting, dance, dinner, or other campaigngathering.

    The financial agent must:Record and report the name and address of any

    contributor, and the amount, if over $100.

    Record and report a money contribution from a gatheringas a total amount.

    Deposit all money into the campaign account, includingcash contributions, before spending it.

    Record and report the name and address of people thatcontribute goods and services; and calculate and record themarket value to measure the amount of the contribution.

    People ofen do volunteer work for a candidates campaign. Thefinancial agent does not count volunteer labour as a contribution.

    But - if a self-employed person does the kind of work for thecampaign that they usually get paid for, the financial agent mustcount that as a contribution of goods and services.

    Who can contribute to a candidates campaign?

    These people can contribute money, goods, and / or services to acandidates campaign:

    Individuals that live in Nunavut.

    Companies that do business or work in Nunavut.

    Groups or associations that operate in Nunavut. A groupor association must give you a list with the name and theamount each person contributed.

    People can contribute to the campaign and the campaign can acceptcontributions only under these conditions:

    Only during the election period.

    Only if you are an official candidate.

    Only if they give the money to the financial agent or

    someone the financial agent authorizes in writing to takecontributions. The candidate can not directly accept anycontributions.

    What is the maximum contribution?

    Each person, business, or group can contribute a maximum of$2500. They may contribute just money, just goods and services, or acombination.

    If someone contributes transportation services, as a goods andservices contribution, they can contribute more than the $2500maximum.

    What are the rules about tax receipts?

    Thefi

    nancial agent gives a tax receipt to everyone that gives theirname and address when they make a contribution. Any personbusiness, or group that contributes more than $100 MUST give theirname and address.

    The financial agent makes out the tax receipt for the exact amountof the contribution, to the maximum of $2500. Only people thatcontribute money get a tax receipt; not people that contribute goodsand services.

    The financial agent is the only person who can give out tax receipts.They must use the official receipts from the Chief Electoral Officer.

    People benefit from the tax receipt - they use it for a deduction ontheir income tax return. Use information about the benefits of taxreceipts to encourage people to make a campaign contribution.

    What is the maximum amount a campaign can

    collect and spend?You can spend up to $30,000 for the campaign. Total expenses can

    be more than $30,000 only for:

    Travel and living expenses.

    Childcare expenses.

    Expenses related to a candidates disability, if the ChiefElectoral Officer approves them in advance.

    The $30,000 total includes pre-election and election expenses. Pre-election expenses are acceptable campaign expenses the candidatepaid for during the pre-election period.

    The pre-election period lasts from when the Commissioner publiclyannounces the date of the next election to when the Chief ElectoralOfficer issues the writ. The candidate must save all their receiptsfor pre-election expenses. The financial agent can reimburse thecandidate for any approved pre-election expense, ONLY IF thecandidate gives the financial agent acceptable receipts.

    How much of their own money can a candidate usefor the campaign?

    A candidate can use up to $30,000 of your own money the

    maximum expenses allowed for a campaign. This includes pre-election and election expenses.

    The candidate gets a tax receipt for the actual amount youcontribute, up to the $2500 maximum, even if you contribute morethan that.

    What are the rules to pay campaign expenses?

    The financial agent or someone they authorize in writing are theonly people who can sign for and pay campaign expenses. Thefinancial agent must keep receipts for EVERYTHING. Theymust atach an original receipt for each and every expense to thecampaign financial return.

    Candidates sometimes spend their own money to pay for approvedcampaign expenses. The financial agent can reimburse you for thoseexpenses - but only afer you give them acceptable receipts.

    What are examples of acceptable andunacceptable campaign expenses?

    The Chief Electoral Officer and the Nunavut Elections Act have somecontrol over what campaign expenses are acceptable. If you arentsure, call the CEO and read the Nunavut Elections Act before youspend the money.

    Here are some examples of acceptable campaign expenses:

    Rent, utilities, and supplies for the campaign office.

    Wages to pay someone to run the campaign office, or to

    hire a campaign manager orfi

    nancial agent.Campaign materials such as signs, posters, and butons.

    Campaign ads for TV, radio, newspaper, and the Internet.

    Travel and accommodation within your constituency.

    Childcare expenses connected with the campaign.

    Expenses related to a candidates disability.

    A meal and non-alcoholic drinks at a gathering of voters topromote the candidate.

    A meal and non-alcoholic drinks for a candidate or theirrepresentatives at the polling station on Election Day.

    Gifs or prizes at a gathering to promote the candidate, ifthe total value of gifs and prizes is $500 or less.

    Here are some examples of unacceptable or unlawful expenses:

    Travel outside your constituency, unless you must do thatto reach a community inside your constituency.

    Money, food, drink, gifs, prizes, or other valuable

    hand-outs you offer at a voters gathering to promotethe candidate, if the total value is more than $500. Forexample, you cant offer a truck or snowmobile.

    Money, food, drinks, gifs, prizes, or other hand-outs youoffer to bribe a voter to vote a certain way, or to not vote.For example, you can offer a glass of juice but not a case of

    juice, and not wine or beer.

    The $200 deposit you made to file the declaration ofcandidacy.

    What financial records does the financial agentkeep?

    During the election period the financial agent must keep careful anddetailed records of everything related to the campaigns finances,such as:

    All contributions;

    Tax receipts;

    All expenses;

    Receipts for expenses;

    The financial agent uses the financial records to prepare a complete

    and accurate campaign financial return. The Financial Agents Guidegives detailed instructions about what records to keep and how tokeep them. The financial agent must follow the Nunavut Elections

    Act and the sections of the the Income Tax Act (Nunavut) that relateto tax receipts.

    What happens if theres money left over at theend of the campaign?

    If the campaign has money lef over, you have two choices:

    1) Give it to a charitable organization. OR

    2) Give it to the Government of Nunavut.

    5) Campaign Financial

    Return

    What is the financial return?

    The financial return is the official record of campaign contributionsand expenses. The financial agent prepares the financial returnon the proper form. The financial agent and the candidate bothsign it and take an oath to declare it is complete and accurate. Thecandidate sends it to the CEO via Expresspost or air cargo. Rightaway fax the Expresspost or air cargo receipt to Elections Nunavutso they know you sent the financial return.

    The financial agent MUST complete the long form of the financialreturn if the campaign had ANY contributions or expenses. Thefinancial agent completes the short form only if the campaign hadNO contributions and NO expenses. See a sample of each form inthe last section of this Guide.

    The CEO has an auditor review eachfi

    nancial return. The CEOpublishes a summary of each financial return in a newspaper in yourconstituency. Its a public document.

    What documents are part of the financial return?

    When you send in the financial return long form you must include:

    Part A: Summary of campaign contributions and expenses,and signed declarations from the financial agent and thecandidate.

    Part B: Details of contributions and expenses. Includeinformation about unpaid expenses why you didnt paythem, if you plan to and when.

    All tax receipts: used, unused, or voided receipts, CEOcopy of issued receipts. Account for ALL tax receiptslisted on the Record of Tax Receipts that the financial agentsigned when they first got the receipts.

    What is the deadline for the campaign financialreturn?

    The candidate must send the financial return to the Chief ElectoralOfficer before the end of the post election period - 60 days aferElection Day. You get your $200 deposit back if you file the returnon time.

    If you won the election, you have to send in the financial returnbefore you can sit in the Legislative Assembly.

    What happens if the campaign financial returnisnt done on time?

    The financial agent or candidate can apply to the Chief ElectoralOfficer to extend the deadline for the financial return. You must

    have a good reason and do this in writing before the end of the postelection period - 60 days afer Election Day. The CEO decides if youget an extension or not, and if you do how long it is.

    When do candidates get the Election Notice?

    Your Returning Officer sends you the Election Notice 28 days beforeElection Day. The Election Notice gives you the name and addressof each candidate in your constituency.

    How do candidates learn where the pollingstations are?

    Your Returning Officer tells you where they have polling stations onElection Day and for the Advance Vote, and a schedule and locationfor voting in the ROs office. They also give you a schedule for themobile poll.

    On Election Day polling stations open at different times, depending

    on time zones:In Rankin Inlet and other communities on Central time,

    the Election Day polls are open from 9 am to 7 pm.

    In Iqaluit and other communities on Eastern time, theElection Day polls are open from 10 am to 8 pm.

    In Cambridge Bay and other communities on Mountaintime, the Election Day polls are open from 8 am to 6 pm.

    Help make sure the people in your constituency know the exact time

    the polling station is open in their community.

    What are the rules about the voters list?

    Elections Nunavut gives you a copy of the voters list for yourconstituency as soon as you become an official candidate. When youget the list you sign a form and promise to respect the voters list anduse it properly.

    The candidate, financial agent, campaign manager, and all otherpeople involved in an election campaign must respect the voters listsand use them properly. Everyone must use the voters lists only forthings related to the election campaign. NO ONE may use the listsfor any other reason.

    The candidate, financial agent, and campaign manager areresponsible to make sure that people follow the rules about voterslists. It is a serious offence to misuse any voters list.

    You are responsible to return or destroy all hard copies and deleteall electronic copies of any and all voters lists at the end of theelection period.

    Elections Nunavut continuously updates voter information to

    have as complete and accurate a voters list as possible for eachconstituency.

    When you read the voters list you might believe something ismissing or see something on the list you believe is not correct. Youmay contact a voter directly to see if they want to take any action.

    Or you may suggest changes to the list, in writing, to the CEO. Saywho you are, what changes you believe they should make, and why.The CEO looks into your suggested changes. To add or remove aname from the voters list, or to change information on the list, theycontact the voter and ask them to fill out and sign the proper form.

    What information do candidates get about peoplewho voted before Election Day?

    Three days before Election Day the Returning Officer sends you alist of the people in your constituency who voted at the early polls- the advance vote, mobile poll, and at the Returning Officers office.

    7) Election Day

    On Election Day each voter should vote quickly and leave thepolling station as soon as their ballot goes in the ballot box. No oneshould hang around. People must stay at least 10 metres away fromthe polling station, unless they are voting.

    What are the rules about campaign materials onElection Day?

    You can not have any campaign materials inside or outside thepolling station on Election Day. You can not put any campaignmaterial on the land or building at the polling station. You can notwear, use, or show any campaign material at the polling station.

    You can not broadcast any ads or speeches on Election Day OR theday before Elections Day. Broadcast includes newspaper, TV, radio,and Internet. If you have a website for the candidate you MUSTtake off anything that promotes the candidate; you can leave

    things such as where people go to vote.

    What are the rules for candidates and theirrepresentatives at the polling station?

    Youre allowed one representative at a time at each pollingstation, unless youre there yourself. Either a candidate or theirrepresentative can be there, not both.

    When your representative first gets to the polling station, they mustgive the Deputy Returning Officer the consent form that you or yourfinancial agent signed. Each representative has their own form.

    You or your representative may disagree when the DeputyReturning Officer accepts or rejects a ballot. Tell the DRO why youobject. They record your objection in the polling record and decideto accept or reject the ballot. You must accept their decision as final.

    The Deputy Returning Officer completes the Statement of the Pollafer they count the ballots. Theyll give you or your representativea copy. The Statement tells you the number of votes for eachcandidate and the number of rejected ballots for that poll.

    8) Who won the

    election?

    How do candidates and their representatives knowwho won the election?

    The Returning Officer receives a Statement of the Poll from eachDeputy Returning Officer. The Returning Officer adds togetherthe votes from all the polls in the constituency and does an election

    report to certify the number of votes for each candidate.

    The Returning Officer sends you a copy of the election report.

    What happens if two candidates get the samenumber of votes?

    Two candidates might get the same number of votes, or really close.If the difference is less than 2% of the total votes, the Returning

    Officer must apply to the Nunavut Court of Justice for a recount.

    Here are 2 examples:

    2% of 1000 is 20 votes. 2% of 500 is 10 votes.

    How else can a recount happen?

    Any voter may apply for a recount to the Nunavut Court of Justice.The Nunavut Elections Act has very specific rules a voter must followto apply for a recount. They have to pay a $250 deposit when theyapply.

    If there is a recount, when does it happen?

    The Nunavut Court of Justice decides a time and a place for therecount. Where possible, the recount happens within 10 days afer

    a voter or the Returning Officer applies. If the recount cant happenwithin 10 days, it happens as soon as possible with the courtsschedule.

    What are candidates allowed to do during arecount?

    If youre involved with a recount you might want to get a lawyer.

    You or your representative and your lawyer may be at the recount.If you or your lawyer cant be there, any three voters can representyou.

    A recount may cost you money. You can be reimbursed forreasonable expenses if the recount happens because the vote is tiedor within 2% of total voters. You have to apply to the Chief ElectoralOfficer on the official form.

    What are the main types of election crime?

    There are many ways to break the law for each type of crime. Seesome examples in the table below. Read the Nunavut Elections Actand make sure you follow the law.

    If someone is charged and convicted, how arethey punished?

    If you break the law and youre charged and convicted, you will:

    Pay a fine not more than $5000. OR

    Go to jail for not more than one year. OR

    Pay a fine and go to jail.

    Also, for five years you cant:

    Be elected to the Legislative Assembly.

    Sit as a member of the Legislative Assembly.

    Have a job appointed by the Commissioner, a Minister orofficial of the Government of Nunavut, or the LegislativeAssembly.

    A judge can also tell you to do things such as:

    Publish the facts about your crime.

    Pay the people you hurt because of your crime.

    Do some community service.

    Who can complain about a possible election crime?

    Any person who believes someone broke the law in the NunavutElections Act can complain. They must go to the police, NOT toElections Nunavut or the Chief Electoral Officer.

    Its the same as making a complaint about someone who breaksany other law - people go to the police if someone breaks into theirhouse, steals their truck, or beats up their friend.

    They need to go to the police within 90 days of when they knowsomeone broke the law, and put the complaint in writing.

    Who investigates a complaint?

    The police investigate. Theyll tell you if theyre investigating you,unless they think it will hurt their investigation.

    The police have the same power and responsibility to enforce theNunavut Elections Act as other Nunavut and Canadian laws.

    The police work with the Chief Electoral Officer and the IntegrityCommissioner to solve the problem.

    The Integrity Commissioner is an officer of the Legislative Assembly

    and oversees the Integrity Act. The purpose of this Act is to helpmake sure Members of the Legislative Assembly are honest, reliable,and honourable.

    The Commissioner of Nunavut appoints the Integrity Commissioner.The Members of the Legislative Assembly recommend who theCommissioner should appoint.

    Whats a compliance agreement?

    A compliance agreement is a contract between the IntegrityCommissioner and someone who probably broke the law. Its anoption any time before a person is convicted of a crime.

    The Integrity Commissioner decides whether or not to negotiatea compliance agreement. They consider these things before theydecide to negotiate:

    The kind of crime and how bad it is.

    The punishment for doing the crime.The public interest.

    The interests of justice.

    Other factors they consider relevant.

    The Integrity Commissioner and the person both sign thecompliance agreement. The Commissioner publishes a summary ofeach signed agreement - its a public document.

    When a person signs the compliance agreement, they takeresponsibility for their crime. They agree to do one or more of thesethings:

    Pay money to one or more people.

    Apologize to the public and to the people involved.

    Use IQ (Inuit Qaujimajatuqangit / traditional Inuitknowledge) to make the wrong beter.

    Do some community service.Agree to do or not to do some specific actions.

    If you dont follow the agreement, you can be charged and go tocourt. You can NOT be a candidate for five years, and you might

    be convicted and punished. If you follow the agreement, you arentcharged and you dont have a record.

    The Commissioner makes a public report on whether or not theperson followed the agreement.

    Candidates Checklist

    Before the election period begins

    Check with your employer to see if they have rulesor policies you need to follow to become a candidate- such as taking a leave of absence from work duringthe election period.

    Find a good financial agent. Make sure they areeligible; make sure they check with their emloyer.

    Find a good campaign manager. Its a good idea tohave a campaign manager, but you dont have to.Make sure they check with their employer.

    Keep receipts for eligible campaign expensesduring the pre-election period - from when theCommissioner publicly announces the date of theelection to when the CEO issues the writ.

    Start to plan your campaign and discuss a campaignbudget with the financial agent and campaignmanager.

    Get copies of the Nunavut Elections Act- read andunderstand it. Know what you have to do to followthe laws.

    Ask the RO for a declaration of candidacy form, orget one from the Elections Nunavut website.

    The election period - up to Election Day

    Complete the declaration of candidacy form. Makesure you fill it out properly and include all theinformation the form asks for.

    File the declaration of candidacy before the deadline:

    Pay the $200 deposit.

    Give Elections Nunavut your digital photo inthe proper form, if you want your photo on the

    ballot poster.

    Participate in Elections Nunavut teleconference calls- for information about candidates.

    Tell your financial agent to participate in ElectionsNunavut weekly teleconference calls, to help them dotheir job properly. For example they must:

    Set up a campaign account.

    Receive contributions for your campaign. The

    financial agent or someone they authorize inwriting are the only people who can receivecontributions.

    Deposit all financial contributions in thecampaign account.

    Pay all campaign expenses from the campaignaccount. The financial agent or someone theyauthorize are the only people who can pay

    campaign expenses.

    Get all the official papers they need, such as taxreceipt books, campaign financial return forms,etc. and fill them out properly.

    Make sure your campaign manager or financial agenthave their name on all campaign advertising, as theNunavut Elections Act

    states.Check with the local government and other

    Review the voters list when you get it from ElectionsNunavut.

    Make sure the campaign manager and all othercampaign workers respect the proper use of voters

    lists. They MUST use the voters lists ONLY FOR theelection campaign.

    Write to the CEO if you want to suggest changes tothe voters list. Identify yourself, say what changesyou suggest, and give proof.

    Note the schedule for the mobile poll, once the ROtells you.

    Review the list of people who voted in the early polls,afer you get it from the RO.

    Note where the polling stations are in yourconstituency, once the RO tells you.

    Note the local time for voting on Election Day.

    DO NOT broadcast any TV, radio, Internet, or othercampaign ads or information the day before ElectionDay or on Election Day.

    Remove from any websites all information thatpromotes the candidate.

    Find one campaign representative to watch eachpolling station on Election Day. They should be there

    Ask one campaign representative to stay at eachpolling station while the Deputy Returning Officercounts the ballots on Election Day.

    Remove all campaign materials from the candidate /campaign website.

    Make sure you dont have any campaign materialsat the polling station on the land, building, or onpeople.

    Ask your campaign representatives to bring you thecopy of the Statement of the Poll from the DRO assoon as its ready.

    After Election Day

    Take down all your campaign materials within 10days afer Election Day.

    Make sure the campaign workers destroy or turn inall voters lists - hard copies and electronic.

    Give any money lef over from your campaign toa charitable organization or to the Government ofNunavut.

    If you decide to give the money to a group, contact

    Legal Registries, Government of Nunavut. You needto make sure the group is a registered society in goodstanding. And you need to get a receipt from thegroup made out to Campaign of _____.

    Make sure the financial agent prepares the financialreturn and that you send it to the CEO before the endof the post election period - 60 days afer ElectionDay. When you send it in you must include:

    Part A: Summary of campaign contributions andexpenses, including signed declarations from thefinancial agent and the candidate.

    Part B: Details of contributions and expenses.Includes information about unpaid expenses why you didnt pay them, if you plan to andwhen.

    Original receipts for each and every expense,

    including unpaid expenses. Printed statement of the campaign account, from

    the bank or other place that holds the account.

    Approvals you got from the CEO for expensesover $30,000 for travel, childcare, and expenses

    CEO copy of issued receipts. Account for ALLtax receipts listed on the Record of Tax Receiptsthat the financial agent signed when they firstgot the receipts.

    If you win the election, you must file the financialreturn before you can sit in the Legislative Assembly.

    Apply to the CEO to extend the deadline for thefinancial return, if needed. The CEO approves theextension ONLY IF you have a very good reason.Apply in writing, before the end of the post electionperiod.

    This section of the Guide has copies of the following forms thatcandidates and financial agents most commonly use and / or need toknow about.

    Declaration of Candidacy. A person who wants to bea candidate fills out this form and sends it to ElectionsNunavut. The person becomes a candidate if ElectionsNunavut accepts their declaration of candidacy.

    Use of Voters List. The candidate signs this to promiseto respect the voters list, and to use them only for theelection campaign. All campaign workers must do this.They promise to return or destroy all voters lists at the endof the election period.

    Set up a Campaign Account. The financial agent mustcomplete this form and send it to Elections Nunavut assoon as they set up the campaign account.

    Consent Form for Candidate Reps. The candidate

    or financial agent sign these forms. Each candidaterepresentative must have their own copy of the form andgive it to the DRO when they first get to the polling station.

    Report of Contributions from a Campaign Gathering.The financial agent or someone they appoint fills out one ofthese forms for each campaign gathering. The informationis important for the financial return.

    Financial Return Long Form. The financial agent usesthis form to record campaign contributions and expenses.

    Financial Return Short Form. The financial agent usesthis form ONLY IF the campaign had NO contributionsand NO expenses.

    Record of Tax Receipts. The financial agent signs this

    form; it lists the serial numbers of the tax receipts they getand they promise to account for them.

    Appoint a New Financial Agent or Campaign Manager.The candidate uses this form to tell the RO about a newfinancial agent or campaign manager.
