EXECUTIVE SUMMARY
Act 16 of 2000, in part, amends Section 1372 of the Public School Code of 1949 and requires the Pennsylvania Department of Education (PDE) to annually compile information listing the number of students with disabilities for which expenditures are between $25,000 and $49,999, between $50,000 and $74,999, and over $75,000 for the prior school year.
In compliance with Act 16 of 2000, PDE did the following:
1. On September 21, 2016, a PENN*Link was sent to all public school (including charter schools and intermediate unit) administrators and business managers advising them of the statutorily required reporting requirements of Act 16.
2. The September 21, 2016, PENN*Link stated that this report will now be collected at the student level through Pennsylvania Information Management System (PIMS) using the Student Fact Template for Special Education Act 16 Funds. The template will be collected during Collection #1 (October 1 through November 13, 2016). Data will be based on the prior year's (2015-16) costs.
3. The Analysis of Exceptional Children worksheet has been attached to this report that identifies and compares similar data reported in each of the last six years.
4. The data submitted by all public schools (including charter schools) via PIMS was used to generate the attached Legislative Report.
A comparison of the data identified on the Analysis of Exceptional Children worksheet, indicates all 500 school districts submitted expenditure data for fiscal year 2015-16. One hundred percent of the charter schools reported data for 2015-16. There was an increase of 2,752 in the total number of exceptional children in fiscal year 2015-16, and the total number of eligible students increased by 5,714 in fiscal year 2015-16. The number of students reported in each of the three expenditure categories shows increases. The number of students reported in the $25,000- $50,000 range increased from 20,512 students for fiscal year 2014-15 to 21,838 students in fiscal year 2015-16. The number of students reported in the $50,000 - $75,000 range increased from 4,834 for fiscal year 2014-15 to 5,307 during fiscal year 2015-16. The number of students reported in the over $75,000 range increased from 2,065 for fiscal year 2014-15 to 2, 195 for fiscal year 2015-16.
Special education is funded, in part, through the Special Education line item in the General Appropriations Act. In 2002-03, this line item included a two percent set-aside for extraordinary special education program expenses. This set-aside was reduced to one percent in 2003-04 and has remained at one percent since 2003-04. School districts and charter schools that experience extraordinary expenses in providing services to exceptional children may apply to PDE for these funds.
This report represents a compilation of the data submitted by school districts and charter schools. The data reported by the school districts and charter schools is their assessment of the individual cost of the delivery of special education services to each child in each category. PDE has no means by which to independently evaluate or affirm the accuracy or consistency of the data submitted.
