A RESOLUTION ESTABLISHING FEES FOR THE USE OF THE CITY’S PARKS

AND RECREATION FACILITIES AND PROGRAMS; AUTHORING

AUTHORIZING RULES, REGULATIONS AND PROCEDURES FOR THE

OPERATION OF THE SAME; RESCINDING RESOLUTION NO. 4459.

WHEREAS, the City of Overland Park (the “City”) owns and operates multiple park and recreation

facilities and provides multiple organized recreation programs; and

WHEREAS, said facilities and programs include, but are not limited to, the City’s parks and park

shelters, Arboretum & Botanical Gardens, Deanna Rose Children’s Farmstead, public swimming pools,

public golf courses, Matt Ross Community Center, Tomahawk Ridge Community Center, City-sponsored

organized recreation programs (e.g., softball, volleyball, and basketball programs), Overland Park Fall

Festival, Overland Park Farmers’ Market and the Scheels Overland Park Soccer Complex; and

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY

OF OVERLAND PARK:

SECTION 1. RULES AND REGULATIONS

A. Parks and Park Facilities – The City Manager (through the Director1 of Parks Services) is authorized to

establish rules, regulations and procedures for use of the following facilities:

1. Parks and Park Shelters (subject to O.P.M.C. Chapter 10.08)

The Director of Recreation Services and staff shall administer said rules, regulations, and

procedures as directed by the City Manager through the Director of Parks Services.

2. Arboretum & Botanical Gardens (subject to O.P.M.C. Chapter 10.12)

The Arboretum & Botanical Gardens Supervisor and staff shall administer said rules,

regulations and procedures as directed by the City Manager through the Director of Parks

Services.

B. Recreation Facilities and Programs – The City Manager (through the Director of Recreation Services)

is authorized to establish rules, regulations and procedures for use of the following facilities and

programs:

1. Deanna Rose Children's Farmstead

The Farmstead Superintendent shall administer said rules, regulations and procedures as

directed by the City Manager through the Director of Recreation Services.

2. Swimming Pools (subject to O.P.M.C. Chapter 10.04)

The Aquatics Supervisor shall administer said rules, regulations and procedures as directed by

the City Manager through the Director of Recreation Services.

3. Golf Courses (subject to O.P.M.C. Chapter 10.06)

The golf course operator and the golf professionals shall administer said rules, regulations, and

procedures as directed by the City Manager through the Director of Recreation Services and as

dictated by its contractual operating agreement with the City.

4. Community Centers (subject to O.P.M.C. Chapter 10.10)

The Community Centers Manager and staff shall administer said rules, regulations, and

procedures as directed by the City Manager through the Director of Recreation Services.

5. City-Sponsored Organized Recreation Programs

The DeputyAssistant Director of Recreation Services shall administer said rules, regulations,

and procedures as directed by the City Manager through the Director of Recreation Services.

6. Overland Park Fall Festival

The Recreation Supervisor shall administer said rules, regulations, and procedures as directed

by the City Manager through the Director of Recreation Services.

7. Overland Park Farmers’ Market

The Recreation Supervisor shall administer said rules, regulations and procedures as directed

by the City Manager through the Director of Recreation Services; and the Director of

Recreation Services is responsible for interpretation and consistent enforcement of all market

rules and regulations.

8. Scheels Overland Park Soccer Complex

The Soccer Complex Manager shall administer said rules, regulations and procedures as

directed by the City Manager through the Director of Recreation Services.

SECTION 2. PROVISIONS APPLICABLE TO ALL FEE REQUIREMENTS – The following

provisions are applicable to all fees and policies for City facilities and programs as established in Sections

3 through 13 of this Resolution:

A. City Use – Notwithstanding the fees set forth by this Resolution, the City Manager (or designee) may

waive any admission, permit or other fee for the use of any City park or recreation facility by the City

or a City-sponsored program.

B. Caregivers – Notwithstanding the admission fees set forth by this Resolution, it is the City’s policy that

designated caregivers required to facilitate the use of any City park or recreation facility by a person

with a disability shall be admitted at no charge in compliance with the Americans with Disabilities Act

(ADA).

C. Commercial Use – Unless specifically provided for in this Resolution or the applicable rules,

regulations and procedures, there shall be no commercial use of any park or recreation facilities.

D. Rental Hours – Unless specified in this Resolution, all rentals are during the normal hours of operation

of the applicable City park or recreation facility.

E. Residency Rates – Proof of residency may be required for any Resident Rate.

F. Damage to Facilities – Regardless of whether a permit or fee is required or actually obtained, persons

damaging any park or recreation facility shall be held responsible for said damage and the cost of repair

or replacement. Furthermore, the City Manager (or designee) may temporarily suspend or prohibit

further use of the park or facility by the persons causing said damage.

SECTION 3. VIDEO AND PHOTOGRAPHY FEES – The following fees and policies are established

for video and photography at the Arboretum & Botanical Gardens, The Deanna Rose Children’s Farmstead

and City Parks:

A. Permit and Fee Requirement – A permit is required for all commercial or, professional, portrait or posed

video/photography activities at the Arboretum, the Children’s Farmstead and City parks. All

video/photography activities of this nature without a required permit are prohibited. Permit fees are:

Portrait or Posed Video/Photography

Defined as posed portraiture of individuals by

professional photographers, as well as semi-pro,

pro-am or amateur photographers, whether the

photographer is being paid or not. Examples

include, wedding, engagement, family,

maternity, prom, graduation, quinceanera, and

any other posed portraiture of individuals. This

category is limited to a video/photographer with

minimal equipment and no more than one

assistant. The City Manager (through the

Director) may further define Portrait or Posed

Video/Photography in the adopted rules or as

needed on a case-by-case basis.

Commercial Video/Photography

Includes, but is not limited to portfolio

photography, television shows or commercials,

movies, music videos, training/instructional

videos, stock images, display advertising,

brochures, product literature, brand and product

photography, including fashion shoots,

promotional use on a product, brand, company,

websites, and social media.

Fees will be assessed on a case by case basis,

with minimum location fee of $300.

(The fee determination should take into account

the time and area required to be dedicated for

said commercial use, and any additional

staffing needs.)

1. Commercial, professional, portrait or posed video/photography activities are defined as any

video/photography activity that involves any of the following:

i. Taking of any video/photography for a fee or other consideration or with the intent to

create any video/photography to be sold or distributed for consideration.

ii. Setting up, carrying or using any equipment such as a tripod, medium or large format

camera, long lenses, light meter, strobes, interchangeable lenses, reflectors or other

equipment not normally carried or used by casual visitors to the facility.

iii. Product or service advertisements.

iv. The use of models, sets, changes of clothes or props.

v. The occupancy of an area or space longer than normal or usual visitors, or requires

other visitors to move or be diverted from their intended path of travel.

vi. Entering into prohibited areas.

vii. Disrupting or interfering with the public use or enjoyment of any area of the facility.

1. Creating any risk of harm to the natural resources.

B. Exemptions – Permit and Fee Requirement shall not apply to video/photography activities that are:

1. Conducted by normal or usual visitors of the facility for casual or tourist purposes and which

do not meet any of the categories set forth above in the definition of commercial, professional,

portrait or posed video/photography activities.

2. Conducted or sponsored by the City or the Arts and Recreation Foundation of Overland Park

(ARFOP).

C. Time, Place, Manner and Conduct – The City Manager (through the Director of Parks Services and the

Director of Recreation) is authorized to establish rules, regulations and procedures to govern the time,

place, manner and conduct of all video/photography of any kind within the Arboretum, the Children’s

Farmstead and City parks.

SECTION 4. PARK SHELTERS – The following fees and policies are established for the use of the

City’s Park Shelters:

A. Rentals Fees:

Small Shelters (up to 50 people) $15/hr

Large Shelters (up to 100 people) $25/hr

Clock Tower Plaza (up to 80 people) $25/hr

Thompson Park Carriage House $50/hr

B. Administrative Fees and Rental Rules:

1. Park Shelters may be reserved up to (1) year in advance.

2. A $5 non-refundable administrative change fee will be charged for each permit change request.

3. Shelters, and the Clock Tower Plaza have a minimum rental time of four (4) hours and two (2)

rentals per day.

2.4. The Thompson Park Carriage House has a minimum rental time of four (4) hours and limited

to one (1) rental per day.

3.5. Requests for refunds must be submitted in writing at least (7) business days in advance of the

rental date and are subject to the administrative change fee. Any request for refund submitted

less than (7) business days of rental date will not be accepted.

4.6. Rental fees for the Clock Tower Plaza are waived for the Downtown Overland Park Partnership

(DOPP) and for members of the Business Improvement District that are in good standing.

SECTION 5. ARBORETUM & BOTANICAL GARDENS – The following fees and policies are

established for the use of the Overland Park Arboretum & Botanical Gardens:

A. Daily Admission Fees:

Ages 13 and over $3

Ages 6 to 12 $1

Ages 5 and under Free

Friends of the Arboretum Members Free

B. Free Admission Dates:

1. The City Manager (or designee) shall establish:

i. One free day per month. One free day per week

ii. Two free weekends per year

2. The City Manager (or designee) may establish additional free days as determined appropriate.

2. Concessions and Resale Items charges shall be determined by the Director of Parks Services.

3. The Director of Parks Services shall have the discretion of whether to require a damage deposit

and the amount thereof.

B. Special Program and Administrative Fees:

1. Special Program Fees – The City Manager (through the Recreation ServicesParks and

Recreation Department) is authorized to establish fees for swim programs (such as swim and

dive teams, clinics, special events or classes) for the purpose of offsetting the program costs.

2. Promotional Rates – The City Manager (through the Director of Recreation Services) is

authorized to establish promotional and/or introductory rates for memberships and programs.

3. Group Care Homes – Not-for-profit group care homes accommodating 10 persons or less (8

occupants and 2 staff) and which possess a current and valid Kansas group home license are

eligible for Annual Family Memberships.

4. Replacement cost for membership cards is $1/card.

SECTION 8. GOLF COURSES – The following fees and policies are established for the use of the City-

owned golf courses (Sykes/Lady Overland Park Golf Course and St. Andrews Golf Course):

A. Greens Fees and Golf Lesson Rates – With the recommendation of the golf course operator and the

golf professionals managing the golf courses, the City Manager (through the Director of Recreation

Services) is authorized to establish greens fees, and golf lesson rates, operational fees and to

periodically modify the same in order to address ongoing market demand and related circumstances.

The City Manager (through the Director of Recreation Services) shall keep the City Council’s

Community Development Committee informed of said fees.

SECTION 9. COMMUNITY CENTERS – The following fees and policies are established for the use of

the Matt Ross and the Tomahawk Ridge Community Centers:

B. Special Program and Administrative Fees; Memberships Guidelines:

1. Annual Memberships – Annual memberships are good for (1) year from date of purchase..

2. Special Non-Peak Rates – The City Manager (through the Director of Recreation Services) is

authorized to establish and negotiate fees to promote facility usage during non-peak times.

3. Promotional/Introductory Rates – The City Manager (through the Director of Recreation

Services) is authorized to establish promotional or introductory rates for the Community

Centers.

4. Member Referral Program – If a current Community Center member refers a guest, and that

guest becomes a member, then the member will receive (1) free month to their current

membership. The free month will only be added if: the member’s name is recorded at the time

the referred guest joins either Community Center; the member has an annual membership; and

the member’s account is current and in good standing.

5. Matt Ross Charter Members – Charter members at Matt Ross Community Center will receive

upon renewal of their annual membership, 13 months for the price of 12 months.

6.5. Matt Ross Corporate Membership – This membership allows those working at businesses

within the Business Improvement District to qualify for a Resident Membership rate. (Limited

to businesses current and in good standing with the BID.)

7.6. Veterans and Active Duty Personnel – Veterans and active duty personnel of the U.S. Air

Force, Army, Navy, Marines, National Guard and Coast Guard can receive a 25% discount

towards an Annual Membership. Military identification is required to receive the discount.

8.7. Low-Income Scholarship Program – Based on funding availability, individuals and families

that are Overland Park residents may qualify for a 50% waiver on fees if they fall under the

HUD Income Guidelines for the year the membership starts.

9.8. State or Federal Disability Program – Overland Park adults on a State or Federal Disability

program can qualify for the Senior Membership rate. (*Includes the monthly membership rate.)

10.9. City Employees – City employees and immediate family members receive a 25% discount

towards an Annual Resident Community Center Membership and seasonal outdoor pool

memberships.

11.10. City Wellness Program – City employees who qualify for the City's Wellness Program in the

previous year will receive a 50% discount towards an Annual Resident Community Center

Membership and a seasonal outdoor pool membership. These membership discounts are valid

for the city employee and their immediate family.

i. Youth – Ages 2 - 15

ii. Adult – Ages 16 - 59

iii. Senior – Age 60 and older

iv. Family – The definition of a family for the purposes of a membership with Recreation

Services is no more than (2) adults age 24 years or older, and their dependent children

who are permanently residing together as a single family/financial household unit

within a residence that is their fixed and principal home. Dependents between the ages

of 18 and 23 years must be full-time students.

For the purposes of interpretation of the Family definition, the following shall apply:

● The household unit must operate as a single financial and economic unit above and

beyond merely sharing living arrangements and must share in the family resources

and income as a unit.

● For persons age 18 or older, or persons of any age that have a driver’s license,

passport, or other official documentation of their address, the residence must be

the residential address:

▪ Shown on any motor vehicle operator’s license or other governmental license

or other official documentation as their residence.

▪ Where they are registered to vote.

▪ Listed as their residence on their most current federal income tax return.

● For persons under the age of 18, the residence must be the address listed for that

child under any public school, private school or home school registration.

● Any children residing in the home must be the legal responsibility of at least one

of the adults who is part of the family unit. Foster children are allowed on the

family membership with proof of placement.

● Persons residing temporarily at the residence such as visitors, relatives, childcare

workers, nannies or other temporary occupants of the home shall not be considered

part of the family unit for the purposes of membership.

● Non-custodial parents, grandparents, and other relatives are not eligible for a

family pass but may purchase a separate membership based upon their residency.

● Roommates who only share the housing and utility expense are not considered

operating as a single financial and economic unit.

D. Administrative Fees and Rental Rules:

1. Regular Hours are considered normal operating hours Monday – Friday.

2. Prime Hours are considered to be Saturdays and Sundays during normal operating hours.

3. After Hours are considered to be outside of the Community Centers’ normal operating hours. (*After-Hours Rentals are subject to staff availability and a (2)-hour minimum use.)

4. A $10 non-refundable administrative change fee will be charged for each permit change

request.

5. Equipment Rental - The City Manager (through the Director of Recreation Services) is

authorized to establish fees for equipment rentals. Rental examples include but are not limited

to: TV/VCR/DVD; projectors; portable screen; podiums; AV setup; microphones; easels and

easel pads; dry erase boards; and volleyball/badminton net & standard.

SECTION 12. FARMERS’ MARKET – The following fees and policies are established for the Overland

Park Farmers’ Market:

A. Market Philosophy – The Farmers’ Market is an important community resource that provides an

opportunity for local farmers to provide fresh nutritious food to the local community, permits

consumers to buy directly from local farmers, helps promote new farm and food businesses and helps

promote the historic and economic vitality of Downtown Overland Park. The City is committed to

operating the Farmers’ Market with local producers and farmers as the centerpiece and primary

emphasis. The City recognizes, however, that the seasonal nature of local produce and other Farmers’

Market factors justify certain structured opportunities for vendors to supplement homegrown produce

and products with non-homegrown produce and products as provided for in the rules and regulations.

B. Special Program Fees – The City Manager (through the Director of Recreation Services) is authorized

to establish promotional, prorated, special, and/or introductory rates for events, leagues, clinics, and

programs and to promote use of the Soccer Complex during non-peak times.

C. Rental Rules:

1. Reservations are made with the Manager of Soccer Complex Operations by phone or email.

2. Reservations are not finalized until the rental agreement application process is completed and

full payment is received.

3. The Manager of Soccer Complex Operations reserves the right to fill all open field time slots.

4. The league representative is responsible for specific scheduling based on the number of

reserved practice/game time slots listed on the facility use permit.

5. Field Permits (for practice, games or tournaments) will not be issued until the following are

complete:

i. Rental agreement application filled out completely.

ii. Payment:

1. Practice (single use): complete payment

2. Practice (seasonal): 10% non-refundable deposit (applied to outstanding

balance) for reserved time.

3. League Play (single use): complete payment.

4. League Play (seasonal): 10% non-refundable deposit (applied to outstanding

balance) for reserved time. Outstanding balance to be paid 30 days prior to

final game of the season.

5. Tournaments: 10% non-refundable deposit (applied to outstanding balance)

for reserved time, plus tournament fee. Outstanding balance to be paid (7)

days prior to event.

6. Adjustments to the number of fields required may be made 30 days prior to the

tournament without penalty by informing the Manager of Soccer Complex

Operations.

iii. Proof of Insurance listing “City of Overland Park, Kansas” as an additional insured.

6. All fields can only be reserved on an hourly or full-day basis. Subletting of rental space (either

partial or entire field) is prohibited.

i. Hourly rental includes access to entire field.

ii. Fields can be divided for 3v3, 4v4, 6v6 or 8v8 use (half or thirds) and applicable hourly

rates will apply.

7. Field rental (practice) reservations will be taken on seasonal basis until space filled.

i. Fall Season (Aug – Nov) taken prior to March 1

ii. Spring Season (Mar – May) taken prior to November 1

iii. The league representative must submit a practice schedule (to include team name,

level, etc) to the Manager of Soccer Complex Operations at the start of every month.

8. Sporting Blue Valley Soccer Club (SBV) retains first priority and will have access to a

minimum of (9) fields for practice Monday – Thursday; and the Overland Park Soccer Club

(OPSC) retains first priority and will have access to a minimum of (1) field for practice Monday

– Thursday.

i. SBV and OPSC can reserve time on remaining (2) fields, starting on Monday’s at

established rate & availability, if not filled.

ii. Other clubs, high school and college teams must complete rental agreement and

payment with application to confirm reservation. Fields will not be secured until all

signatures and paperwork (proof of insurance, deposit) is completed.

9. League Games – reservations will be take on season basis.

i. Fall season (Aug – Nov) taken prior to March 1

ii. Spring season (Mar – May) taken prior to November 1

iii. Completed rental agreement and non-refundable security deposit (applied to rental fee)

must accompany agreement.

10. Camps/Clinics - field rental reservations can be booked starting 18 months prior.

i. Completed rental agreement and non-refundable security deposit (applied to rental fee)

must accompany agreement.

11. Tournaments – field rental reservations can be booked starting 18 months prior.

i. Conflicting date requests will be resolved using following criteria

1. Number of anticipated out-of-town teams (based on history)

2. Length of tournament & number of fields required

3. Number of anticipated teams

4. Number of hotel rooms required

Reasonable effort will be made to avoid conflict with SBV/HSA league games.

ii. If no conflict, appropriate tournament and rental application must be completed along

with non-refundable security deposit (applied to rental fee).

1. Upon acceptance of its application for the tournament, the tournament host

will confer with Visit Overland Park. Visit Overland Park will advise, and

assist if asked, the tournament host or designated housing company in securing

the necessary hotel room blocks to adequately house tournament participants

in Overland Park and the surrounding area. No later than three weeks after

conclusion of the tournament, the tournament host or designated housing

company will provide Visit Overland Park with a complete hotel usage report

The report will include:

a. What hotels were utilized, including hotels outside of Overland Park

b. Confirmation of the original room block by day

c. Actual rooms utilized by day

2. Visit Overland Park will be responsible for reporting the hotel usage

associated with the Soccer Complex to the City of Overland Park

3. Hotel usage information as reported to the City by Visit Overland Park my

may be used to prioritize future applications for Soccer Complex use.

D. Field House Rental Fees:

1. Field House Meeting Room- $15 per hour
