This is a handbook on criminal law and procedure for lawyers and legislators in Slovakia, then part of the Kingdom of Hungary. At this time Hungarian criminal law was identical in most respects to that of Austria and the German states. It even adopted some of the Enlightenment's ideas about the use of torture. However, it has a more conservative view of adultery and "crimes against nature." It even has a large number of laws concerning vampirism and witchcraft. Title pages of Opuscula, Volume I, and Observationum printed in red and black, woodcut head-pieces, tail-pieces and decorated initials. Light toning to text, somewhat darker in places. Early owner annotations in tiny hand to front free endpaper, interior otherwise clean. Ex-library. Shelf-label residue to spine, small inkstamps to title page and verso. A nice copy. $650. * Later editions. Bynkershoek was a renowned Dutch jurist who founded the positive school of international law, which held that usage and practice were more important than doctrines drawn from natural law. His works are still consulted today. First published in 1719, Opuscula, an essay collection on Roman law, addresses topics in maritime and international relations, the legal rights of unwanted and abandoned children, abortion and infanticide. The essays on children reflect Bynkershoek's debate on this topic with his distinguished contemporary Gerard Noodt [1647-1725]. The notoriety of this exchange, which became acrid and lasted several years, did much to promote their circulation. First published in 1710, Observationum, a summation of his studies on Roman civil and criminal law, was a standard reference in Dutch universities until the nineteenth century. Heineccius, the editor of the present edition, was a prominent German jurist and a professor of jurisprudence and philosophy at Halle. A companion volume was issued in 1733. Faced with the gallows, Jackson confesses: "If ther'd been forty scaffolds right before my eyes, I'd have brought down the poker just the same." Darrow's novel is a sociological polemic which foreshadows such later works as Theodore Dreiser's An American Tragedy and Upton Sinclair's The Jungle. Abe Ravitz, in his Clarence Darrow and the American Literary Tradition, observed that An Eye for an Eye was worthy of a trophy not only for sociological veracity but also for genuine literary achievement. This copy was inscribed "with the regards of his friend and admirer" to James K. Jones, a lawyer in Washington, DC, who often served in criminal cases. The University of Minnesota owns the letter in which he acknowledges receipt of Darrow's book. Jones praises it as "a vivid and truthful picture...of much that comes along in many a poor devil's life... [It] turns light on places where light was needed." Decree addresses the confusion raised by the creation of the rank of baronet by James I. The King's decree explained the nature of this title and fixed its place among the other titled ranks. Anti-Duello is a contribution to a early seventeenth-century debate initiated by a 1613 decree of James I that outlawed dueling. It begins with a history and review of mortmain, and then builds an argument for its curtailment. It was a fairly well-circulated book.
