    Under th e curr ent law commonly known a s th e Smar t Growth stat ute, if acity, village, town, coun ty, or r egiona l plan ning commission (local governm ent al u nit )creates a development plan or master plan (comprehensive plan) or amends anexisting compreh ensive plan , the plan mu st cont ain certa in plan ning elements. Therequired plann ing element s include th e following: housing; tra nsporta tion; ut ilitiesand community facilities; agricultural, natural, and cultural resources; economicdevelopmen t; lan d use; an d inter governm ent al cooperation.

    Also un der curr ent law, un less certa in conditions apply, beginning on J an ua ry1, 2010, certain ordinances enacted or amended by a local governmental unit thataffect land use m ust be consistent with that local governmen ta l units compr ehen siveplan . The ordina nces to which t his requ iremen t a pplies a re official ma pping, localsubdivision regulation, and zoning ordinances, including zoning of shorelands orwetlan ds in sh orelan ds. Also un der curr ent law, beginnin g on J an ua ry 1, 2010, if alocal governmental unit enacts or amends any of these specified ordinances, thecompreh ensive plan mu st conta in a t least all of the required plann ing elements.

    Under this bill, a local governmental unit is authorized to repeal itscompr ehensive plan . Corr espondingly, th e ordina nces th at u nder curr ent law mustbe consistent with a local governm ent al un its compr ehen sive plan m ust , under th ebill, be consisten t with th e local governmen ta l un its compreh ensive plan only if th e

    local governm ent al un it ha s a compr ehen sive plan in effect.Under cur ren t law, the Depar tm ent of Administr at ion pr ovides gran ts t o localgovernm ent al un its to assist in finan cing the cost of plan ning activities. This billelimina tes th is gran t progra m.

    The p eople of the s tate of Wisconsin, repr esented in sena te an d assem bly, do

    enact a s fol lows:

    SECTION 1. 16.965 of th e sta tu tes is repealed.

    SECTION 2. 20.505 (1) (cm) of th e sta tu tes is r epea led.

    SECTION 3. 20.505 (1) (cn) of th e sta tu tes is r epea led.

    SECTION 4. 20.505 (1) (ie) of th e sta tu tes is a men ded t o read:

    20.505 (1 ) (ie) Land. The All moneys received by the depa rt men t under s. 59.72

    (5) (a), oth er t ha n t he first $2,000,000 received in ea ch fiscal year un der s . 59.72 (5)

    (a), for th e lan d inform at ion program un der s. 16.967 an d for reviews of proposed

    mu nicipal incorporations a nd a nn exations by the depa rt ment an d for t he pu rpose of

    providing a ids un der s. 16.965.

    SECTION 5. 20.505 (1) (if) of the st at ut es is repealed.

    SECTION 6. 36.11 (37) of th e sta tu tes is am ended t o rea d:

    36.11 (37) E XTENSION LOCALPLANNINGPROGRAM. The board shall offer a local

    plan ning pr ogram th rough t he exten sion t o educat e local policyma kers a bout local

    planning an d the gran t program un der s. 16.965.

    SECTION 7. 59.69 (3) (a) of the st at ut es is am ended t o read:

    59.69 (3 ) (a) The count y zonin g agency ma y direct the prepar at ion of a coun ty

    development plan or parts of the plan for the physical development of the

    unincorporated territory within the county and areas within incorporated

    jurisdictions whose governing bodies by resolution agree to having their areas

    included in th e count ys development plan . The plan ma y be adopt ed in whole or in

    part an d ma y be amended by th e board an d endorsed by the governing bodies of

    incorpora ted jurisdictions included in the plan . The coun ty development pla n, in

    whole or in pa rt , in its origina l form or a s am ended, is herea fter r eferr ed to as th e

    developmen t plan . Beginn ing on J an ua ry 1, 2010, or, if th e coun ty is exempt u nder

    s. 66.1001 (3m), the date under s. 66.1001 (3m) (b), if the county engages in any

    program or a ction described in s. 66.1001 (3), the development plan sha ll cont ain at

    least a ll of th e elemen ts specified in s. 66.1001 (2).

    SECTION 8. 62.23 (2) of th e sta tu tes is am ended t o rea d:

    62.23 (2 ) FUNCTIONS. It shall be the function and duty of the commission to

    ma ke a nd a dopt a ma ster p lan for t he ph ysical developmen t of the city, including any

    ar eas outside of its bounda ries that in th e commissions judgment bear relation to the

    development of the city provided, however, that in any county where a regional

    planning depar tmen t h as been esta blished, ar eas outside the boun daries of a city

    ma y not be included in t he m ast er plan without t he consen t of th e coun ty boar d of

    supervisors. The mast er plan, with the a ccompan ying maps, plat s, cha rts, and

    descriptive an d explana tory ma tt er, sha ll show th e comm issions r ecomm enda tions

    for su ch physical developmen t, a nd sha ll, as described in su b. (3) (b), cont ain at least

    th e elements d escribed in s. 66.1001 (2). The comm ission m ay from t ime to time

    am end, extend, or add t o the m aster plan or carry an y part or subject ma tter int o

    greater detail. The comm ission m ay adopt ru les for t he tr an saction of business an d

    shall keep a record of its resolutions, transactions, findings, and determinations,

    which record sha ll be a p ublic record.

    SECTION 9. 62.23 (3) (b) of the st at ut es is am ended t o read:

    62.23 (3 ) (b) The comm ission m ay adopt t he ma ster p lan a s a whole by a single

    resolut ion, or, as th e work of ma king th e whole ma ster plan progresses, ma y from

    time to time by resolut ion adopt a par t or par ts of a ma ster plan . Beginn ing on

    January 1, 2010, or, if the city is exempt under s. 66.1001 (3m), the date under s.

    66.1001 (3m) (b), if th e city engages in a ny pr ogra m or action described in s. 66.1001

    (3), th e ma ster plan sha ll cont ain at least a ll of the element s specified in s. 66.1001

    (2). The adoption of th e plan or an y par t, amen dmen t, or add ition, sha ll be by

    resolution carried by the affirmative votes of not less than a majority of all the

    mem bers of th e city plan comm ission. The resolution sh all refer expressly to th e

    elemen ts u nder s. 66.1001 an d other ma tt ers intended by th e comm ission to form the

    whole or any pa rt of th e plan, an d th e action t ak en sha ll be recorded on th e adopted

    plan or part of the plan by the identifying signature of the secretary of the

    commission, a nd a copy of th e plan or par t of th e plan sha ll be cert ified to the common

    council, an d a lso to th e comm and ing officer, or t he officer s designee, of an y milita ry

    base or installation, with at least 200 assigned military personnel or that contains

    at least 2,000 acres, tha t is locat ed in or near th e city. The pu rpose an d effect of th e

    adoption an d cert ifying of th e ma ster plan or pa rt of th e plan sha ll be solely to aid

    th e city plan comm ission a nd t he coun cil in th e perform an ce of th eir dut ies.

    SECTION

    10. 66.0230 (2) (d) of the statutes is repealed.

    SECTION 11. 66.1001 (3) (intr o.) of the st at ut es is am ended to rea d:

    66.1001 (3 ) ORDINANCES THATMUSTBE CONSISTENTWITH COMPREHENSIVE PLANS.

    the following ordinances, the ordinance shall be consistent with that local

    governm ent al u nits compr ehen sive plan :

    SECTION 12. 66.1001 (3m) of the st at ut es is repealed.

    SECTION 13. 66.1001 (7) of th e sta tu tes is creat ed to rea d:

    66.1001 (7 ) REPEALOF COMPREHENSIVE PLAN. A local governmental unit may

    repea l its compr ehen sive plan by a m ajority vote of th e mem berselect, as defined

    in s. 59.001 (2m), of the governing body.

    SECTION 14. 66.1001 (8) of th e sta tu tes is creat ed to rea d:

    66.1001 (8 ) LIMITATION ON CONSIDERATION OF COMPREHENSIVE PLANNING. No

    depa rt men t or a gency of the sta te or au thority creat ed by the sta te or an y city, village,

    town, or coun ty ma y consider whet her or n ot a local governm ent al unit h as in effect

    a compr ehen sive plan in deter minin g the eligibility of th e local governm ent al un it

    or an y person or en tity in th e local govern men t u nit for pa rt icipat ion in a n economic

    development program.

    SECTION 15.0Fiscal changes .

    (1) Notwithst an ding section 20.001 (3) (c) of th e sta tu tes, th ere is lapsed to the

    genera l fun d from th e appr opriation accoun t to the depart ment of administrat ion

    under section 20.505 (1) (ie) of th e sta tu tes, as a ffected by the acts of 2011, an am ount

    equa l to $2,000,000 less any a moun t obligated or p aid for compr ehen sive plan ning

    gran ts in th e fiscal year, in th e fiscal year in which th is subsection t ak es effect.

    SECTION 16.0Effective d ates. This act takes effect on the day after publication,

    except as follows:

    (1) The t rea tm ent of section 20.505 (1) (ie) of th e sta tu tes t ak es effect on J uly

    1, 2012.
