Pharmaceutical market in Poland

Poland is ranked as second most attractive pharmaceutical market in Central and Eastern Europe, just behind the Czech Republic.Pharmaceutical sector in Poland as one of with the longest tradition has experienced radical changes throughout the last 25 years. There has been a transition from state-owned companies into private ones and new regulations have been introduced. The administrative system of public health care management has changed and the market shares have been consolidated. Moreover, the importance of foreign pharmaceutical companies as investors on the Polish market has increased. The value of the Polish market is estimated at EUR 6 billion (PLN 25.1 billion). In the years 2006-2013 the value of the Polish pharmaceutical market increased by nearly 40% and it is projected to grow to EUR 7 billion (PLN 29.2 billion) by 2018. In 2013 the value of the Polish pharmaceutical sector production amounted to EUR 2.72 billion (PLN 11.4 billion), which puts the Polish pharmaceutical and biotechnological industry at the 9th place in the European Union. The pharmaceutical sector makes up approximately 1% of the Polish GDP. The majority of drugs used in Poland are generic drugs – substitutions of the original medicinal products. In 2012, the share of generic drug sales in Poland amounted to 84.5% in terms of volume and 63.5% in terms of value. In 2012, approximately 55% of the drugs sold (in terms of quantity) came from domestic production. In terms of value, it was 30%. The pharmaceutical sector is characterized by high efficiency – in 2013 the ratio of gross profits to revenues reached 12.7%. At the end of 2013 in the pharmaceutical industry in Poland there were 100 enterprises, including 65 with foreign capital. At the end of 2013, there were 20.4 thousand persons employed in the Polish pharmaceutical industry (1% of the total number of people employed in manufacturing). In 2013, the exports of the Polish pharmaceutical sector amounted to EUR 2.4 billion (PLN 10 billion), which means an increase of 15.7% as compared to 2012, and the imports amounted to 4.3 billion EUR (PLN 18 billion), which means an increase of 16.2% as compared to 2012. At the end of 2013, the value of the accumulated foreign direct investment in the pharmaceutical industry in Poland amounted 2.21 billion EUR (PLN 9.25

billion). This stood for 4.6% of the cumulative value of FDI in the industrial manufacturing.

Cosmetics market in Poland

The Polish cosmetics industry is growing rapidly, as one of the fastest in Europe. In 2014, its value

exceeded EUR 3.4 billion. An increase in sales was related to growing consumer awareness regarding

the benefits of higher quality products and an improving economic situation, which enabled

customers to spend more on beauty and personal care products. Cosmetics industry in Poland is

dominated by international players. Well-known brands, strong marketing activities, frequent

advertising as well as wide distribution enables multinational players to appeal to customers,

increase brand awareness as well as build loyalty. Due to weaker financial power, domestic

companies often struggle with building loyalty and are often unable to appeal to consumers even if

the brand is even better than other well-known brands. Product innovation was one of the most

important growth drivers within beauty and personal care in 2014. Manufacturers focused on

introducing more sophisticated products with specific value, such as moisturising features.

Moreover, players were also trying to offer more specialised products, designed to either solve a

particular problem, for example, cavities in the case of toothpaste or to offer more specialised

products targeting a particular customer group; for example products manufactured specially for

sensitive skin instead of regular ones suitable for all skin types. Customers are becoming increasingly

educated and interested in more advanced products; thus manufacturers also focused on the

development of less broadly used products such as eye treatments.

The structure of the Polish cosmetics market does not differ from that of other European countries.

The largest share of the market is composed of hair-care products and skin-care cosmetics, which

altogether constitute over 35% of the market. Other important categories are: perfume (13,5%),

cosmetics for men (10,5%) and colour cosmetics (9,7%). 11-12% of the cosmetics market in Poland

belongs to the selective premium cosmetics. The value of luxury cosmetics market in Poland is

estimated to PLN 350 million (EUR 90 million).

NEUCA GROUP NEUCA is one of the market leaders in pharmaceutical wholesaleto pharmacies.The company market shares reached 30.5% at the end of 2011.Reaches 10 000 pharmacies each day.Headquartered in Toruń.Neuca Group employs about 4 thousand people.First quarter of 2013: 32 million zloty profit.

PGF – HURT PGF- Hurt has more than 20% of the Polish pharmaceutical market.Part of Pelion Healthcare Group.Provides up to 9 000 pharmacies.Headquartered in Łódź.The biggest pharmacy chain “Dbam o zdrowie” (I take care of health) belongsto them. (more than 2000 pharmacies)60 sales representatives, mainly telemarketing.They offer marketing support. FARMACOL S.A. The big pharmaceutical chain “Apteki z sercem” (Pharmacies with heart)belongs to them.Since 1999 the company’s shares are registered at the Warsaw StockExchange.During 1999 – 2002 the corporation purchased majority of Cefarm shares:Kielce, Wrocław, Szczecin, Warszawa and some shares of the smaller entitiesof pharmaceutical wholesalers, forming the Capital Group.Headquartered in Katowice.First quarter of 2013: 30, 5 million zloty profit.

APTEKA Z SERCEM About 1800 pharmacies in each region of Poland.They are the part of Farmacol Group.

ŚWIAT ZDROWIA About 1700 pharmacies in each region

of Poland.

Smaller chains which are located in cities, mostly in Warsaw.

DR. MAX – almost 70 pharmacies EURO APTEKA (Euro Pharmacy) – more than 60 pharmacies ZIKO – more than 30 pharmacies and also I-pharmacy APTEKA COSMEDICA (Cosmedica Pharmacy) – more than 20 pharmacies ; wide range of

cosmetics.

3. I- pharmacies

DOZ.PL The doz.pl is web platform which is a part of the biggest pharmaceuticalchain in Poland Dbam o zdrowie (I take care of health).Platform offers a wide range of products (also prescription drugs)which are cheaper than in traditional pharmacy. Ordered products have tobe collected in one of the pharmacies. They do not send orders by courier.They also publish medical advices and information.They have their own promotion department.Headquartered in Warsaw.According Adplanner research:

DOMZDROWIA.PL The biggest range of products. Not only medical products also cosmetics,medical devices, even perfume.Oriented only for web business. Orders sent by courier.They offer promotion (also PR) and legal support.According Alexy: each month more than 650 000 unique users.They are also owners of others sales platforms and also websites with medicalinformation: domzdrowia.pl, fabrykazdrowia.pl, pretty.pl, dbamyoceny.pl,101promocji.pl, sexizdrowie.pl.Headquartered near Kraków.

4. Drugstore chains

ROSSMANN The biggest drugstore chain in Poland. More than 700 stores in each partof the country. Rossmann Polska is the part of Rossmann GmbH and A.S.Watson group, which has more than 10 000 drugstores in 33 countriesof Europe and Asia.German company.Market shares more than 20% (chemical and cosmetic industry).Headquartered in Łódź.54% of participants in the PMR survey declared that they are makingtheirs cosmetics shopping in Rossmann.

HEBE DRUGSTORE Hebe is a new (established in 2011) drugstore chain on Polish market.It is owned by Jeronimo Martins Poland- the company which is proprietorof the biggest discount chain in Poland Biedronka.Nowadays it consists of 44 stores; many of them are located in Warsaw.Hebe drugstores have such sectors as: Beauty Expert, hebe Hair,

SUPER-PHARM POLAND

Polish branch of worldwide company (in Europe and Asia knownas Super-Pharm and in America as Shoppers Drug Market).In Poland since 2001.Nowadays 40 stores, which combines pharmacy and drugstore (each storeis divided into that two parts). Stores located in big cities, mostly in shoppingcenters.Headquartered in Warsaw.

DROGERIE NATURA Polish drugstore chain which was founded in 1997.Chain consists of more than 270 stores located both in big and smaller cities.Not in shopping centers.Their private distributor is Polbita Sp. z o.o. which is located in Błoń,near Warsaw.

DROGERIE POLSKIE Chain founded in 2010.Associates more than 200 pharmacies, which keep their own names.Stores located only in some regions of Poland, many of them in small cities.

DOUGLAS Douglas is a German chain of parfumeries. In Poland, the first Douglas perfumery was opened in 2001 in Wroclaw. Later other stores Douglas were opened in Warsaw, Lodz, Gdansk, Szczecin, Krakow, Poznan, Katowice, Kielce, Bydgoszcz, Torun, Olsztyn, Opole, Rzeszów, Suwalki and Radom. There are 105 Douglas perfumeries in Poland.

SEPHORA Sephora is a French brand and chain of cosmetics stores founded in 1970. Featuring more than 200 brands, along with its own private label, Sephora offers beauty products including makeup, skincare, body, fragrance, nail color, and haircare. Sephora reached Poland in 1999. The first perfumery was founded in Bydgoszcz. There are

93 stores Sephora in Poland today.SEKRET URODY Sekret Urody (Beauty secret) is a

chain of 170 Polish drugstores that was founded in 2010.

DROGERIE JASMIN The chain of drugstores Jasmin

counts more than 300 stores in Poland, from small drugstores of 30m2 size to large stores.

DROGERIE VICA The founder of the drugstore chain

Vica was Dariusz Tomczak, who is also the CEO of the company. The first store under the name Vica was founded in 2004, and now the whole chain counts 32 stores located in the western and southern Poland.

DAYLI Stores DAYLI are located in both large cities and small towns across Poland and their number is constantly growing. On an average area of 200 square meters customers have access to more than 200,000 articles and 42 types of services.

JAWA DROGERIE Chain of 600 stores. The plan is to extand it to another 400. Its turnover is more than 140 million zl per year.

Registration

The manner of registration depends on the type of the product which has to be registered.

1. Medicinal articles registration

Medical articles are divided in Polish law into two categories : medical products and medical devices. It is

often debatable whether a product is a medical product or a device. A lot depends on how the product

will be defined by the company.

The definition of medical product contained in Polish Pharmaceutical Law:

“Medicinal product shall mean any substance or combination of substances presented as able to prevent or treat disease in human beings or animals, or administered with a view to making a medical diagnosis or to restoring, correcting, or modifying physiological”.

The definition of medical device contained in Polish Act on medical devices :

Medical device – any instrument, apparatus, appliance, software, material or other article, whether used alone or in combination, including the software intended by its manufacturer to be used specifically for diagnostic or therapeutic purposes and necessary for its proper application, intended by the manufacturer to be used or human beings for the purpose of:

a) Diagnosis, prevention, monitoring, treatment or alleviation of disease,b) Diagnosis, monitoring, treatment, alleviation of or compensation for an injury

or handicap,c) Investigation, replacement or modification of the anatomy or of a physiological

process,d) Control of conception and which does not achieve its principal intended action

in or on the human body by pharmacological, immunological or metabolic means, but which may be assisted in its function by such means ;

The registration process is easier if the product is a medical device. In that situation the notification about

new product should be made by Polish distributor. Only the company located in Poland has to make

notifications.

If the product is a medical product the registration procedure is according to European Medicines Agency

(EMA). It is the same for all countries of EU. The main thing is to contact with Belgian registration body

and apply for an extension of national permission.

The Mutual Recognition Procedure (MRP) consists of two steps: MRP in Belgium (90 days) and national in

Poland (30 days, but in reality even few months). The Belgian body should prepare a report and give an

agreement. Later the company has to make high-quality translation into Polish and send all documents to

The Office for Registration of Medicinal Products, Medical Devices and Biocidal Products in Poland.

2. Cosmetic products registration

On 11 July 2013 entered into force a Regulation (EC) No 1223/2009 of the European Parliament and of the

Council on cosmetics products. In connect with that fact the Polish department ended its activity and all

of the regulations were transferred from the local to EU level.

From that moment all companies have to register its cosmetics products in ECAS (European Commission

Authentication System) and CPNP (Cosmetic Products Notification Portal). When a product has been

notified in the CPNP there is no need for any further notification at national level in the European Union.

The definition of cosmetic product:

‘Cosmetic product’ means any substance or mixture intended to be placed in contact with the external parts of the human body (epidermis, hair system, nails, lips and external genital organs) or with the teeth and the mucous membranes of the oral cavity with a view exclusively or mainly to cleaning them, perfuming them, changing their appearance, protecting them, keeping them in good condition or correcting body odours.

3. Dietary supplements registration

The definition of dietary supplements in polish law:

Food supplement means foodstuffs the purpose of which is to supplement the normal diet and which are concentrated sources of vitamins, minerals or other substances with a nutritional or physiological effect, alone or in combination, marketed in a form allowing the dosage, namely forms such as capsules, pastilles, tablets, pills and other similar forms, sachets of powder, ampoules of liquids, drop dispensing bottles, and other similar forms of liquids and powders designed to be taken in measured small unit quantities, excluding products having the properties of a medicinal product within the meaning of the Pharmaceutical Law (Journal of Laws , 2010. No. 136, item. 914, as amended).

Medicinal product treats or prevents disease, and the dietary supplements are designed to complement

the deficit of the diet ingredients. Both medical products and dietary supplements aimed at health, the

main difference is that dietary supplements are used to maintain homeostasis in the body and the

medical products are used to restore the health, to cure. Moreover, food supplements can contain in its

composition only vitamins and minerals that occur naturally in foodstuffs and are consumed as a part of

it, and other substances having a nutritional or other physiological effect.

The entity which is in charge of dietary supplements’ registration is Department of Functional Food which

is one of the departments of Chief Sanitary Inspectorate. The registration procedure consists of two steps:

1. Company registration on the website http://www.suplementy.gis.gov.pl by clicking on the

“rejestracja podmiotu” tab and filling special form. That is a way to create private account on the

website.

2. After that on the website will appear another tab “wprowadzenie powiadomienia”. There the

company has to submit a request and attach a Polish version of the label (it does not have to be

the final version). If the company possesses Belgian notification it will be added advantage to

enclose it also (however it is not a requirement), but it has to be translated into Polish by sworn

translator.

Chief Sanitary Inspectorate has 60 days to consider the request.
