I. INTRODUCTION

By adopting the Strategy for Prevention and Protection against Discrimination (hereinafter: the Strategy), the Republic of Serbia opted for a systemic development of institutional and legal framework and mechanisms to combat discrimination. The Strategy represents a medium-term strategic document, which contains objectives to be implemented in the next five years.

The Action Plan for the Implementation of the Strategy for Prevention and Protection against Discrimination for the period 2014–2018 (hereinafter: the Action Plan) specifies the framework for the implementation of strategic goals, enabling the implementation of the objectives and measures established by the Strategy, as well as a systemic oversight of the implementation of the Strategy. The Action Plan envisages specific measures and activities necessary for the implementation of strategic goals; deadlines; entities accountable for its implementation; and necessary resources. It also defines indicators of fulfilment of the activities, on the basis of which the degree of their implementation shall be monitored, as well as indicators for evaluation of success of the established objectives. In the process of monitoring of the Strategy implementation, the Office for Human and Minority Rights shall use solely indicators of the fulfilment of activities. Documents and other materials contained in the framework of these indicators shall be submitted to the Office for Human and Minority Rights as the evidence of implementation of the activities.

Should the name of the state authority/entity change, the abbreviation of the state authority/entity used in this Action Plan shall pertain to the authority/entity which assumes the scope of their work/mandate.

2.2. GENERAL REMARKS

1. The deadlines shall run from the date of publication of the Action Plan, unless otherwise specified.

2. Unlike the Strategy, the Action Plan envisages activities and measures for the implementation of the Strategy in different areas and not in relation to vulnerable social groups. In this way, state authorities are provided with an easier overview of those measures and activities for which performance they are accountable and where they appear as implementing entities and participants in the implementation of the specific measure/activity.

3. The areas of the Strategy are integrative-general areas, and specific areas. Integrative areas are: Public Administration and Prohibition of Discrimination; and Security, Home Affairs and Judiciary. Specific areas are: Education and Professional Education and Training; Labour and Employment; Marriage, Family Relations and Inheritance; Health Care, Health Protection, Social Welfare and Housing; Youth, Sports, Culture and Media; and Regional Development and Local Self-Government.

4. Each measure is set forth in the particular area and numbered. If there is a connection between one measure and other measures or activities from other measures, the connection is clearly marked in specific columns. Within the areas of the Strategy (integrative-general or specific) measures are classified in accordance with the degree of their generality in the following way:

4.1. General measures (activities, indicators, implementing parties, deadlines and necessary resources are stated separately);

4.2. General measures containing specific measures envisaged for certain vulnerable social groups (these measures are marked with an additional number stated before the measure formulated in the column 3). For each specific measure within such general measure, particular activities, indicator, participants, implementation deadlines and necessary resources are set forth. In some cases, the general measure containing such specific measures also contains separate activities, indicators and implementation deadline and indicates that the general measure can be further extended by incorporating other special measures if the need arises in the course of the implementation of the Action Plan.

4.3. General measures in the framework of which specific measures are envisaged for several vulnerable groups.

4.4. Specific measures, pertaining only to a particular vulnerable group. In this case the measure is marked with an ordinal number in the column 1. The column 2 – General measures – remains empty while the column 3 contains the number and the formulation of the specific measure. As an exception, there are specific measures pertaining to certain vulnerable groups that are not contained within the general measure - they contain activities, indicators, implementing parties, deadline and individual resources. 4.5. When a measure pertains to gathering, processing, storage or exchange of information related to personal data, it provides that its implementation must be regulated by the

law, i.e. it must be implemented in accordance with the law regulating protection of personal data. In this case, a bylaw can only regulate technical issues related to processing of the data since a bylaw cannot represent a valid legal basis for processing of personal data.

5. The column 6 is horizontally divided into implementers of the measure and participants.

Implementer is a public administration authority/government service or other entity accountable for the implementation of the measure.

Participants are all other entities (public administration authorities, other public authorities/bodies, government’s services, civil society organizations, international organizations etc.) identified (recognized) in this Action Plan as actors which can contribute to the implementation of a measure or activity. Civil society organizations, trade unions and international organizations can take part as participants in implementation of the activities in the framework of measures set forth in this Action Plan with an advisory role or in other ways, at the initiative of the implementers.

Independent public authorities (Protector of Citizens, Commissioner for Information of Public Importance and Personal Data Protection, Commissioner for Protection of Equality, Provincial Ombudsman etc.) can play a part and contribute to the implementation of the activities in the framework of measures set forth in the Action Plan on their own initiative, with an advisory role or in other ways related to the tasks from the sphere of their competence and in the measure and ways that do not jeopardize their independent status and control function.

6. Activity indicator/s may relate to one or more activities.

7. The column concerning the deadlines contains information when an activity must be completed with the expiry of the quarter (trimester) – implementation of the measure shall be complete by the end of that quarter of the year. The quarters are as follows:

7.1. First quarter – Q1: 1 January – 31 March of the calendar year7.2. Second quarter – Q2: 1 April – 30 June of the calendar year7.3. Third quarter – Q3: 1 July – 30 September of the calendar year7.4. Fourth quarter – Q4: 1 October – 31 December of the calendar year.

The term “continuously”, stated in the column containing the deadlines for the implementation of measures, refers to the activities that are repeated cyclically (e.g. “the implementation monitoring”) until the last quarter of 2017 (31 December 2017). In this case, the monitoring shall be carried out in the way to determine whether the participant accountable for each calendar year of the validity of the Strategy actually carried out the activities with respect to the indicators defined in the Action Plan.

This Action Plan is harmonized with the relevant Action Plans in the framework of the negotiations for the accession of the Republic of Serbia to the European Union.

2.3. MONITORING AND IMPLEMENTATION OF THE ACTION PLAN

The Action Plan implementation monitoring shall be organized in the framework of monitoring and evaluation of the implementation of the Strategy.

The Government shall establish a provisional working body for monitoring of the Action Plan implementation. This body shall monitor progress achieved in the implementation of measures and activities, respect of the defined deadlines and will have an early warning mechanism to identify challenges for the implementation of the measures, in accordance with the Law on the Government of the Republic of Serbia and Rules of Procedure of the Government of the Republic of Serbia.

The provisional working body for monitoring the Action Plan implementation shall be composed of the representatives of state authorities, representatives of the authorities of the autonomous province and local self-government, representatives of the civil society organizations and other parties participating in the implementation of measures. Duties of the provisional working body for monitoring the Action Plan implementation, period of its activity, deadlines within which it is to produce an activity report and other issues related to its work shall be defined in a decision on its establishment.

2.4. FUNDS FOR THE IMPLEMENTATION OF THE ACTION PLAN

The funds for the implementation of the measures and activities envisaged in this Action Plan shall be provided from the budget of the Republic of Serbia, budget of the local self-governments as well as from the donors’ funding.

A part of the funds for the implementation of the Action Plan shall be budgeted in the Action Plans for Chapters 23 and 24 in the framework of the negotiations for the accession of the Republic of Serbia to the European Union.

The necessary funds for the implementation of the Action Plan in the period 2014-2018 amount to RSD 4.034.508.660 out of which RSD 2.001.826.083 shall be provided from the budget of the Republic of Serbia, while RSD 2.032.682.5771 is planned to be provided from the donors’ funds.

The donors’ funding provided for the implementation of the measures and activities of the Action Plan amount to RSD 1.733.682.577.

Integrated-general areas of the Action Plan are Public Administration and Prohibition of Discrimination, and Security, Home Affairs and Judiciary.

Necessary funds planned for the implementation of the measures and activities of the Action Plan in the period 2014–2018 in the framework of the integrated-general area Public Administration and Prohibition of Discrimination amount to RSD 1.499.400.438. Regular funds planned for the implementation from the budget of the Republic of Serbia amount to RSD 1.294.785.000. Donors’ funds provided for this area amount to RSD 204.615.438.

Necessary funds planned for the implementation of the measures and activities of the Action Plan in the period 2014–2018 in the framework of the integrated-general area Security, Home Affairs and Judiciary amount to RSD 467.692.053. Regular funds planned for the implementation from the budget of the Republic of Serbia amount to RSD 318.655.023. Donors’ funds provided for this area amount to RSD 149.037.030.

Specific areas of the Action Plan are as follows: Education and Professional Education and Training; Labour and Employment; Marriage, Family Relations and Inheritance; Health Care, Health Protection, Social Welfare and Housing; Youth, Sports, Culture and Media; and Regional Development and Local Self-Government.

Necessary funds planned for the implementation of the measures and activities of the Action Plan in the period 2014–2018 in the framework of the specific area of Education and Professional Education and Training amount to RSD 283.455.669. Regular funds from the budget of the Republic of Serbia amount to RSD 29.530.060. For the implementation of the measures and activities until the end of 2016 donors’ funds have been planned and provided in the amount of RSD 253.925.609.

In the framework of the specific area of Labour and Employment the funds stated and planned for the implementation of the measures and activities of the Action Plan amount to RSD 30.959.5002. The necessary funds stated for the implementation in the mentioned period to be provided from the budget of the Republic of Serbia amount to RSD 400.000. Donors’ funds planned and provided for the implementation of the activities until the end of 2015 amount to RSD 30.559.500.Measures and activities regarding the special area Marriage, Family Relations and Inheritance shall be implemented from the regular budgetary funds as well as from the possible donors’ funds.

Necessary funds planned for the implementation of the measures and activities of the Action Plan in the period 2014–2018 in the framework of the specific area Health Care, Health Protection, Social Welfare and Housing amount to RSD 1.313.331.000. Regular funds planned for the implementation from the budget of the Republic of Serbia amount to RSD 229.456.000. Donors’ funds planned and provided for the implementation of the activities until the end of 2017 amount to RSD 1.083.875.000.

In the framework of the specific area Youth, Sports, Culture and Media funds planned for the implementation of the measures and activities of the Action Plan in the period 2014–2018 amount RSD 81.400.000. Necessary funds for the implementation in the mentioned period from the budget of the Republic of Serbia amount to RSD 81.000.000. Donors’ funds planned and provided for the implementation of the activities until the end of 2015 amount to RSD 400.000.

Necessary funds planned for the implementation of the measures and activities of the Action Plan in the period 2014–2018 in the framework of the specific area Regional Development and Local Self-Government amount to RSD 358.270.000. Regular funds planned for the implementation from the budget of the Republic of Serbia amount to RSD 48.000.000. Necessary donors’ funds amount to RSD 310.270.000. Donors’ funds planned and provided for the implementation of the measures and activities until the end of 2015 amount to RSD 11.270.000.

III. INTEGRATED – GENERAL AREAS OF THE STRATEGY

Action Plan for the Implementation of the Strategy for Prevention and Protection against Discrimination for the period 2014-2018

3.1. Public Administration and Prohibition of DiscriminationObjective: Harmonization of legislation for the purpose of harmonizing the legal framework of the Republic of Serbia (RS) with international

standards for prevention against discrimination, and consistent implementation of the adopted international documents, laws, bylaws, Strategies and Action Plans pertaining to vulnerable groups.

Indicator: 1. Harmonized legal framework of the Republic of Serbia with international standards and ratified international documents. 2. Established method of monitoring the obligations arising from the ratified international treaties in the area of prevention against

discrimination. 3. Necessary legislation adopted and legislation specified in this Action Plan in the area of general administration amended and

supplemented for the purpose of full realization of the principle of equality and equal rights, and prevention against discrimination. 4. Bylaws adopted, amended and supplemented in order to further develop legal regulations in the field of combating discrimination, and

bylaws representing the basis of discriminatory practices in the fields specified in the Strategy and in the Action Plan abolished. 5. Established or reactivated Government’s advisory bodies with the scope of work pertaining to certain vulnerable social groups. 6. Other Strategies and Action Plans which are important for combating discrimination implemented, and remaining Action Plans for

Strategies adopted. 7. Established mechanisms for monitoring and responding to multiple discrimination cases.8. Decreased number of discrimination cases. 9. Decreased number of discrimination cases based on gender equality.

Action Plan for the Implementation of the Strategy for Prevention and Protection against Discrimination for the period 2014-2018

3.2. Security, Home Affairs and JudiciaryObjective: Creating a safe environment for members of vulnerable social groups, improving the level of tolerance towards them and suppression of hate

speech and acts of violence, and bringing to justice the perpetrators of such acts.

Indicator: 1. Reduced number of acts of violence and hate speech against vulnerable groups through preventive and repressive actions, and a safe environment for members of vulnerable groups created. 2.
