OBJECTIVE

In 2002 Malaysia had made a commitment to abide by the Biwako Millennium Framework For Action Towards An Inclusive Barrier-Free And Rights-Based Society For Persons With Disabilities In Asia And Pacific to achieve 75% ‘barrier-free’ environment in 2012.

Kuala Lumpur City Hall, being the local authority of a capital city, was given the role to lead the mission. Thus the urgent need was to identify the most effective ways of enforcing laws, effective policies and mechanisms that can create built environment friendly to all and this enable the PWDs to be socially inclusive, and enhance KL into a ACCESSIBLE CITY.


ISSUES

PLANNING STAGE

Due to lack of awareness and incompetence among the Principal Submitting Persons (PSP) during submission of development plans, facilities for PWDs has always been incorrectly specified causes unusable amenities. Developers always provide minimum facilities for PWDs to minimize cost in construction. Due to no seamless connectivity at macro-scale level had resulted in built environment were not easily accessible.

IMPLEMENTATION STAGE

Unfamiliar with the details of PWDs facilities among contractors and construction workers has caused buildings being built not according to specifications.

ENFORCEMENT STAGE

Abused of accessible parking bays

Accessible toilets being converted to store room.

Lack of cooperation among all agencies in the provision of accessible facilities

Lack of maintenance of accessible facilities

Barriers and obstructions to the accessible facilities


Malaysia is taking important measures on issues pertaining to the wellbeing of PWDs due to the prevalent increased of the number of PWDs. The drastic increased is caused by several reasons such as road accidents, diseases and the increased of ageing populations that posted the higher risk of disability among the generation and higher tendency of getting chronic diseases such as diabetes, cardiovascular disease, cancer and mental health disorder. A study made by the Department of Statistics had revealed that by the year 2020 Malaysia will have its elderly population increased to about 3.4 million.

Access to public facilities, amenities and services and buildings (26, 27, 28)

• (1)Persons with disabilities shall have the right to access to and use of, public facilities, amenities, services and buildings open or provided to the public on equal basis with persons without disabilities, but subject to the existence or emergence of such situations that may endanger the safety of persons with disabilities.

• (2)For the purposes of subsection (1), the Government and the providers of such public facilities, amenities, services and buildings shall give appropriate consideration and take necessary measures to ensure that such public facilities, amenities, services and buildings and the improvement of the equipment related thereto conform to universal design in order to facilitate their access and use by persons with disabilities.

Persons With Disabilities Act 2008



This Act has been used in each system planning and development of properties in every state in Malaysia and the State Planning Committee and local authorities with discretionary authority may impose any conditions and requirements of facilities for the disabled in all planning and development stages.

Section 133 of Part VII is one that empowers the State Authority to make by-laws as it deems necessary to implement the provisions of this act.

All retrofitting works must be accordance to MS 1183 and MS 1184: -

• 'ramp with a slope of not more than 1:12 shall be provided as a convenience in / out of the street level access to the lobby level of the building;

• accessible toilets for the disabled shall be provided a ratio of 1: 100

• Accessible parking bays shall be provided with a ratio of 4: 100 with minimum of at least one unit.

• minimum of one accessible lift shall be provided and lift is equipped with features specified in MS 1183 and MS 1184.

• Fire lift can be used to 'evacuate disabled people from buildings in an emergency subject to the 'evacuation' conducted under the direction and management control of buildings using a procedure in MS 1183;

• and 'Refuge' must be provided on each staircase in each level.

DEVELOPMENTAL APPLICATION PROCEDURES

All new development in Kuala Lumpur are controlled under the issuance of Development Order (D.O.). Conditions applied in D.O. require that all development comply to MS 1184, MS 1331 and MS 1183. In addition to that, all the PSP (Submitting Principal Person) are required to sign an undertaking as follows: "... I certify that all the needs of persons with disabilities (PWDs) to be constructed / provided are in compliance with Malaysian Standard 1183, 1184 and Disability Act 2008. I accept full responsibility accordingly.

This clause is required for all applications in the application for approval of the Development Order (DO) and Building Approvals (must be sustainable after approval is obtained and if found aberrations occur then this would enable the Authority to take appropriate action against the PSP;

Ensure the implementation of laws relating to the disabled;

Enforcing standards, regulations and laws related to the provision of disabled-friendly environment;

Lumpur An Easy Access City : 8 May 2013

As the Local Authority responsible for the capital city’s wellbeing, Kuala Lumpur City Hall is

serious about realizing Kuala Lumpur as an Easy Access City. Kuala Lumpur City Hall

organizing a seminar on Understanding Accessibility Statements to Disabled Facilities for the

Principal Submitting Person / Submitting Person which was officiated by Yang Berbahagia

Datuk Seri Ahmad Phesal Haji Talib, Mayor of Kuala Lumpur on 8 May 2013 (Wednesday). The

one day seminar was attended by over 200 participants from various government agencies and

private sector agencies and associations, the purpose of the seminar was to create

awareness among PSP / SP, developers, contractors and those involved in the construction

industry to ensure that disabled access facilities are applied in all development projects.

“in this seminar, participants will be given exposure to disabled friendly and easy access

concept applications. They will also be involved in simulation sessions, access audits with

exposure to real life situations that are faced by disabled people” he added.

MONITORING STAGE

KLCH has established a special unit to focus on the requirements of

disabled & Standards Building Innovation Unit (UIPB) in the

Department of Town & Building Design (JRBB) in May 2010.

• Ensuring the implementation of laws relating to disabled. All

implementing departments in the KLCH shall always in

compliance of Universal Design approach to implement all

developments in Kuala Lumpur, Pilot projects are introduced as

benchmark and references, Access audits for existing and new

developments and Access Consultants (professionals/training)

• This unit as the secretariat to advice and planning in KLCH; to

liase, monitor and coordinates all infrastructure and utility

providers in terms of planning, implementation and maintenance

on facilities for PWD

• To conduct workshop and training TOT -Training to provide a

better skills at understanding the built-environment issues and

manual for Access Audits the facilities for

the PWDs

Kuala Lumpur City Hall in collaboration with the Malaysian Paralympic

Council (MPC) will participate in the International Paralympics

Championship in Esfahan which took place on 6 September to 13

September 2011. In order to support city Esfahan as Sister City to

Kuala Lumpur, City Hall will send a contingent of 23 people, including

athletes and officials and will be headed by the Honorable Datuk Amin

Nordin Abdul Mhd. Aziz, Deputy Director General of the Socio

Economic Development City Hall.

To brighten the spirit of all athletes involved, DBKL had a flag handover

ceremony to the contingent leader, His Excellency Datuk Amin Nordin

Mhd held at the Lobby of Tower 1 City Hall, August 25, 2011. The

handover ceremony was officiated by the Honourable Tan Sri Ahmad

Fuad Ismail, Kuala Lumpur mayor.

At the tournament, the contingent will participate in the event City Hall

Sitting Volleyball men and women categories. This tournament was a

preparation platform for the squad to be nominated in Asean Para

Games in Solo, Indonesia in December.

1. There are 78 children of

KLCH’s disabled staff

registered being sponsored

medically for whole life.

provided for children of the

disabled to get treatment

for life and pensions of their

3. KLCH to date has funded nine employees to provide

artificial limbs that cost approximately RM3,000 to RM10,000.

and also wheelchair priced between RM20,000.

1. Disabled-friendly Public Low Cost Housing

2. 1.2% of the total dwelling units or 4 units of each 350 dwelling units shall be provided to the housing needs of special groups. Rentals are also reduced.

3. For residential apartments - ground floor shall meet the design standards for the mobility of people with disabilities, especially those who using wheelchair.

4. Provide a 'ramp' whether in the public areas (parking lots, corridors, etc.) until to the main entrance of the dwelling unit.

"A total of 12 stations have and will be upgraded to OKU-friendly stations. At

present, seven stations have been successfully upgraded, which include, among

others, Subang Jaya, Bank Negara, Kepong Sentral, MidValley, Kajang and

Seremban. This project is expected to be completed by May 2010.

"Various Klang Valley stations would also be installed with Wi-Fi services to

enable people on the go to surf and work while waiting for the train to arrive. This

project is expected to be completed by October 2012

KUALA LUMPUR, June 13 - Kuala Lumpur City Hall (DBKL) is available to provide any facilities for the disabled including Horse Riding Center for Persons with Disabilities (PWDs) are the largest in the country, which opened today. Handicapped Equestrian Centre located at Taman Tasik Titiwangsa is providing a total of 16 horses, including 11 new horses, which are brought in from Belgium. Kuala Lumpur Mayor Datuk Seri Ahmad Phesal Talib said, cooperation between DBKL and Horse Riding For the Disabled Association (RDA) was able to realize the center, which is the ninth branch in the country. "With the opening of this center today to meet the demand of some special education schools for horse riding activities are becoming a very good rehabilitation therapy to people with disabilities," he said. He said the center will be equipped with more systematic and planned services include health checks disabled, the focus of education and physical activity in a safe and therapeutic horseback riding facility in accordance with the standard set of techniques and RDA. "The appropriate use of disease therapy include stroke, cerebral palsy, down syndrome, learning disabilities and slow learners," he said. Expected over a thousand people, especially disabled children will be riding training at Lake Titiwangsa provided free of charge for them.

• Handicapped Equestrian Centre, Kuala Lumpur City Hall (DBKL) in cooperation with Association Horse Riding For the Disabled, Malaysia (Riding For Disabled Association, Malaysia (RDA) will introduce Equestrian Therapy. Program aims to provide opportunities for the disadvantaged children and adult activities horseback riding as a therapeutic method. This therapy can help improve the body, mind and spirit with physical disabilities, intellectual disabilities growth, social and emotional.

Efforts to create Accessible City for the urban population whilst to ensure a sustainable development require continuous and an endless commitment from the various level in

the governments, NGO and the private sectors. KLCH desires to work closely with all various organizations and individuals to materialize the success of the vision of KL

structure plan 2020 towards a World Class City by year 2020.

These divine intentions to create Universal Design Environment can be achieved through vigorous and collaborative effort among all sectors to provide the PWDs the physical and infrastructure facilities in the urban environment in cooperating designs

into the building interior, spaces between buildings, open spaces, parks and recreational areas, market places, school, public halls, the roads/walkways and commercial spaces.
